with color prints that we will be using for the new signage. I have
made notations to the changes we are making.
There seems to be some question as to.what the City of Palm Desert
will allow in the length of the sign. Our total frontage of Highway -III
and Larkspur is equal to 747 square feet. I have attached a copy of our
plot plan for your reference. Please contact me after you have taken
this plan to the city with their response.

Approval of a precise plan of design, variance and negative declaration
of environmental impact to allow the addition of three 5640 square foot
commercial buildings with a 28% parking deficiency along the south side
of an existing shopping center bounded by Palm Desert Drive South,
Larkspur Lane and El Paseo in a C-1, S.P. Zone (general commercial,
scenic preservation overlay) more particularly described as:

The attached data was prepared by the applicant and is being forwarded to you for
comments and recommended conditions of approval. The city is interested in the probable
impacts on the natural environment (e.g. water and air pollution) and on public resources
(e.g. demand for schools, hospitals, parks, power generation, sewage treatment, etc.).
Your comments and recommended conditions of approval must be received by this office
prior to 5:00 p.m. March 23, 1983, in order to be discussed by the land division committee
at their meeting.
The land division committee (comprised of director of environmental services, city
building official, city engineer, fire marshal and a representative of CVWD) will discuss
the comments and recommended conditions of approval and will forward them to the
planning commission through the staff report. Any information received by this office
after the receipt deadline will not be discussed by the land division committee nor will it
be forwarded to the planning commission
for consideration.

Reference: Case No. PP 05-83 Palm Desert Shopping Center - Dunham
Dear Mr. Diaz,
Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 3000 GPM fire flow for a three
(3) hour duration in addition to domestic or other supply. The computation
shall be based upon a minimum of 20 psi residual operating pressure in the
supply main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building
is more than 200 feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior• surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed), shall be painted red 15 feet in either direction
from each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval, one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the design
of the water system in Case #PP 05-83 is in accordance with the requirements
prescribed by the Fire Marshal."
5. Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
6. An approved 20' fire lane is required along the North side of proposed buildings
with no parking allowed.
7. Additional fire protection requirements may be necessary when specific building
plans are submitted for approvals.

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of awning at
retail business.
LOCATION: North side of El Paseo, west of Portola.

Mr. Smith highlighted the salient points from the staff report.
Concerns expressed by the commission during study session were as follows:
1. The possibility that the awning would lay on the tile roof and the tile
would show through.
2. The wind sway problems on the awning.
MR. MARK BEATTY, of Portals, represented the applicant and stated that the
awing would be installed on a rigid frame which would not permit the fabric to rest
on the tile.
Vertical members would be provided to tie the unit together and prevent wind sway.
Moved by Commissioner Cook, seconded by Commissioner Martin, to approve the

Mr. Smith highlighted the salient points from the staff report and indicated that the
essential form of the proposed building had remained although the colors had been
toned down considerably to compliment the desert environment and a revised
landscape plan was provided.
The commissioners outlined their concerns which centered primarily on the wing
walls on the roof screen element and color thereof, and the front wall sign.
MR. BOB HORNACEK, architect, stated that the intent of the building was to
provide a roadside identity and felt that the color changes from the previous
submission went a long way to improving the building.
After considerable discussion, commission and applicant agreed to address the
concerns expressed by adding the following conditions:
3. The wing walls shall be the colors as presented but shall provide relief
(i.e. expansion joints, texture change, etc.) between the two colors.
4. That the top awning, under the proposed sign, be deleted.
5. That, with the removal of the awning, the applicant study the possibility
of moving the sign down and lowering the screen wall height in this
section.
Moved by Commissioner Holden, seconded by Commissioner Cook, to approve the

BACKGROUND:
April 12, 1983, commission received a two fold application for the subject property. The
first part of the application involved remodel of the existing facility which has been
completed. The second part of the request proposed the construction of three identical
5640 square foot single story commercial buildings fronting onto E1 Paseo. This proposed
addition was given preliminary approval subject to the usual conditions.
DISCUSSION•
The plans as submitted are in substantial conformity with those given preliminary
approval. A landscape plan has not been provided but will be required.
RECOMMENDATION:
That the commission review the final plans for Case 182 C, Metro and Dunham, to
determine acceptability. If the commission decides to grant final approval, it should be
subject to the following condition:
1. That a landscape plan be reviewed and approved by the commission prior to issuance of
building permit.

Upon reviewing the submitted plans and the presentations by the staff and by the
representative, the architectural review commission approved the sign as built, subject to
the addition of plaster skin on the existing planter to match the color of the building and
the accent brick band as proposed by the developer and agent.

Mr. Smith indicated that the commission had already approved the concept

specifically with its location.
Mr. Sandy Baum was present to represent the applicant and indicated that
the owner of the center and the owner of the market had concurred that the
sign being submitted was acceptable with the exception of the base. They
proposed that it be stuccoed to match the building; that a band of paper tile
would be added and that the electrical conduit that runs up the base would
be removed.
The commissioners reviewed the pictures of the sign distributed by Mr.
Baum and felt it would be acceptable with the changes noted above.
On a motion by Commissioner Cook, seconded by Commissioner Holden, the
sign was approved as built, subject to the addition of plaster skin on the
existing planter to match the color of the building and the accent brick band
as proposed by the developer and agent.
Motion carried 3-0-1 (Chairman Gregory abstained).

CASE NO. 69 C AMENDMENT (CONTINUED):
Mr. Jack Klotz was present and indicated that he was not opposed to their
recommendation but felt it was much more dangerous for pedestrians if
they were placed in the recommended location.
Commissioner Holden reminded the commission that the Polo Shop was
not allowed to place the poles at the curb when they installed their
awnings. He also recommended that some planting be done at the base and
asked if the public works department would allow this.
Mr. Diaz replied that this could be conditioned if the commission so
requested.
The applicant, Mr. Jack Klotz stated that the poles would be 3 Yz inches
and there would be a sleeve around the column.
Commissioner Holden then made a motion to approve the awning subject
to the pole structure being located in a cutout planter area with the
maximum size of the planter area being the size approved by the public
works department.
The motion died for lack of a second.
It was then decided on a motion by Commissioner Martin, seconded by
Commissioner Cook, to approve the installation of a canopy from the
entry to the street.
Motion carried 3-2 (Commissioners Holden and Leung voted nay)
Commissioner Gregory who voted in favor, wished to make it clear that it
was with the understanding that Mr. Klotz would assume all responsibility
for any liability that might occur in the future.

Mr. Smith stated that the wall sign as submitted was acceptable to the
commission at the study session. The discussion centered on the proposed
freestanding sign to be located in a similar position to the existing
nonconforming freestanding sign which will be eliminated. The
commission had felt there was no need to have a tile roof on top of the
sign.
The commissioners agreed that the sign should be redesigned so that there
is some architectural continuity with the building.
Commissioner Holden felt that a detailed plot plan and landscape plan for
the base of the sign should be provided as had been provided during the
processing of the Palms to Pines East Center.

Mr. Sandy Baum representing the applicant indicated that although the
sign was not designed by an architect, the sign man did try and match it
to the existing building by adding the tile roof. The two columns are the
original ones used for the previous sign and he agreed that they should
have matched them to the building. He then indicated that the planter
already has plants in it.
Mr. Baum then asked if the commission would accept the sign with a
larger planter and the deletion of the tile.
The commissioners did not feel this would be acceptable. They reiterated
that it should be redesigned and the leg stands should be de-emphasized.
On a motion by Commissioner Cook, seconded by Commissioner Martin,
the wall sign was approved as submitted and the sign board itself was
accepted for its graphics with the rest of the sign being sent back to be
redesigned and resubmitted with a detailed site plan and landscape plan.
Motion carried 4-0-1 with Chairman Gregory abstained.

Mr. Smith indicated that the commission had reconsidered the signs for
Denny's at its meeting of September 13, 1983 and agreed to enlarge the
permitted height of the "D" and "Y" to 24 inches with the remainder of
the letters being 20 inches as had been the original approval for all
letters. The applicant is here today to suggest that they be allowed to go
to 28 inches on the "D" and the "Y".
Mr. Ron McKenzie stated that if the "D" and "Y" letters are 24 inches,
the logo would be out of proportion. He indicated that the "D" and "Y"
would be form faced letters which are better looking than just flat faced
letters.
Commissioner Holden asked if the owners of Denny's were aware that the
restaurant had a problem with the venting because of the parapet height.
They had to attach large pipes to all the vent pipes in order to handle the
ventilation.
Mr. McKenzie indicated that the kitchen would be upgraded and this
problem would be resolved when it is remodeled.
Commissioner Holden stated they would not be tearing out the slab, so the
problem would probably remain.
On a motion by Commissioner Martin, seconded by Commissioner Leung,
the sign was approved with the letter "D" and the letter "Y" being 28
inches in height with a minimum 4 inch border above and below said
letters.
Motion carried 4-1 (Commissioner Cook voted nay).

BACKGROUND:
The business identification sign will conform to the size provisions of the ordinance. The
sign is composed of individual channel letters as well as a metal cabinet for the "FINEST
FOODS" portion. This sign will be wall mounted and will be ivory with gold trim caps with
dark brown returns. The cabinet for "FINEST FOODS" will have a dark brown background.
The proposed center identification sign (freestanding sign) will be located in the same
location as the previous one; however, this sign will comply with code and thereby be
substantially reduced in size (area and height). The proposed freestanding sign will be a
maximum of 12 feet high and have a face area of 50 square feet. The size of a
freestanding sign for a commercial center is based on the area of the land the center
occupies (i.e. 10 square feet per acre). This site is 5 acres; therefore, a freestanding sign
of 50 square feet is warranted.
The freestanding sign will have an ivory background and dark brown letters with gold trim.
A tile roof feature sits on the top of the sign.
RECOMMENDATION:
That the commission reviews the proposed sign for Jensen's and the Jensen Center sign,
Case No. 182 C to determine acceptability.

Mr. Smith indicated that the commissioners had reviewed the sign plan at
the study session and were concerned with its color and the fact that it
was internally illuminated.
The commissioners indicated their concern with the layout and how it
related to the building. The location on the wall was acceptable as was
the size but the colors and design need to be toned down and the materials
need to be considered. They did not approve of the sign being internally
illuminated, it should be lighted from the ground or roof (indirect).
Regional Manager, Ron Gate of Merrill Lynch Realty, felt that the
commission should try to find a way to approve the sign as presented and
urged the commission to consider the fact that it was a difficult center
from which to operate a successful business; therefore, signs which may
not be within the strict usual architectural requirements of the city
should be allowed.
Mr. Lee Hart of Imperial Signs concurred.
On a motion by Commissioner Holden, seconded by Commissioner Cook,
the sign was approved with the material to be wood sandblasted and the
lighting to be indirect with dark red and white letters.

BACKGROUND:
Construction work is underway for renovation to the former Market Basket. Center. At.
this time a new sign program is proposed, for the center.
DISCUSSION:
All the signs will utilize the same shape and colors. Three different sizes are proposed.
The sizes proposed are in direct proportion to the unit size the sign serves.
All the signs are to be interior illuminated with an extruded aluminum cabinet to be
painted brown. The sign face will have, an ivory background with a rust trim and dark
brown letters with gold trim cap.
The colors proposed are acceptable to staff.
Size: The signs proposed range in size from 26 square feet to 39 square feet to 78 square
feet.
Staff has examined the proposed sign program using a variety of methods to calculate the
maximum allowable sign area for the center. In all cases the maximum has been exceeded
by a substantial margin.
The sign ordinance provides that where businesses are located more than 100 feet from
the public right-of-way on which they face, they may then be entitled up to 1S4 square
feet of sign per linear foot of frontage. Even using this higher amount of permitted
signage the proposal exceeds the maximum permitted.
The proposal would appear to have neglected to consider that when a large building is
totaled up for sign purposes the 1l4 square feet per linear foot only applies to the first 50
feet. For the next 50 feet .75 square feet/linear foot is used and for all linear footage
above 100 feet .375 square feet/linear foot is granted.
Therefore, even though the building facing Highway III has 440 feet of building frontage
it is only entitled to up to 241.5 square feet whereas 494 square feet are proposed.
Examining the proposed signs on an individual business basis 6 of the 17 signs comply with,
the code as it relates to size.
CONCLUSION•
Our analysis indicates that it would be in the applicant's interest to consider the signs on a
unit by unit basis with most units being entitled up- to 114 square feet per linear foot
except where the units are larger than 50 feet in width and except where the units are
located closer than 100 feet from the street.

Mr. Smith indicated that the commission at the study session had
reviewed the proposed revisions noted on the plan which involve the
installation of tile in lieu of the shake treatment on the mansard and
the addition of a cupola in the middle of the north elevation which
would be used to relocate the sign from the fascia area below.
The commission did not feel the addition of the cupola would tie in with
the rest of the buildings in the center and were concerned over the
color of the the shown on the new plan.
Commissioner Gregory noted that the new plans show the deletion of
windows on the left elevations.
Mr. Dave Carlson, of Carlson Design and Construction Company was
present and noted that the tile shown on the plans was the same as that
approved by the commission. The reason for the cupola was to improve
visibility. He felt the building was too hard to find. The windows were
deleted as a requirement of the building department.
Acting Chairman Martin felt that his problem was the frontage road
situation and not visibility.
The commission did not want to set a precedent allowing people to build
cupolas for the purpose of displaying their signs.
Mr. Diaz advised that the sign ordinance does not permit signs above
the eave line which would preclude the signs from being installed on the
cupola.
Mr. Carlson asked if they could retain the cupola and keep the sign
where it presently stands.

The commission reiterated that the cupola would not tie in with the
rest of the buildings in the center.
On a motion by Commissioner Gregory, seconded by Commissioner
Leung, the commission denied the cupola and approved the top cap on
the roof, with the color of that top cap being the same as the beam
fascia (dark brown).

Mr. Smith reviewed the staff report indicating that the applicant had
received preliminary approval of plans for the commercial building in
April of 1981. The new building which is still two stories in height has
been toned down somewhat from the one approved in 1981. The
building is connected at the second floor level and separated on the
first floor to allow for an ingress from Palm Desert Drive to the
parking area at the rear.
On a motion by Commissioner Holden, seconded by Commissioner
Gregory, the preliminary plans were approved as presented.
Motion carried 2-0-2, with Commissioner Leung and Commissioner
Martin abstaining.

1. Walls Located in Front Yards:
Mr. Diaz indicated that problems have arisen regarding six foot walls along the
front setbacks in the R-1 zone. Unless the commission would like to examine
them individually, staff will be requiring a minimum five foot setback from
the property line when there is a solid wall along the front, so that there can
be landscaping in front of it. Where they are adjacent to driveways, staff will
require a ten to fifteen foot long base and height triangle be developed to
provide visibility when exiting.
Commissioner Holden asked if the condition would still apply if there is an
existing parkway out in the middle of the property line.
Mr. Diaz replied that it would.
Acting Chairman Martin felt that setting back the wall from the driveway for
safety purposes was acceptable but in terms of coming into the front yard, he
didn't have any problem with it being on the property line. If staff told them it
would have to be five feet from the property line and they appealed, he would
have to support the property owner.

Mr. Steve Platt was present to represent this case.
Mr. Smith indicated at the study session that the Red Onion Restaurant
would be leasing a portion of the Palm Desert Town Center. The
restaurant will have a direct access to the exterior; therefore, it is
entitled to exterior signage, the board reviewed the sign plans and felt
they were acceptable. He added that the applicant wished to alter the
sharp angles on the exterior wall and replace them with smooth curves,
the top of the wall would then be capped with a precast concrete cornice.
Ceramic tile was proposed around the window areas.
Commissioner Cook wished to make it clear that there would be two
bands of neon under the cornice detail.
On a motion by Commissioner Holden, seconded by Commissioner Martin,
the plans for the exterior sign program and modification of elevations
were approved.

commission might want to recommend that the treatment continue around
so that the portion of the west end of the building which will not be
hidden from view would receive the same treatment to provide
integration, which was one of the commission's concerns at the meeting of
April 12, 1983.
The commission had expressed concern over the landscaping in the parking

DISCUSSION:
This application along with a proposed addition on the El Paseo side of the property was
approved in concept by the commission at its April 12, 1983, meeting. At this time
detailed plans of the proposed remodel of the existing shopping center have been
submitted. These plans are substantially similar to those reviewed by the commission
previously.
Attached is a copy of conditions from the April 12, 1983, staff report as well as the
motion adopted by the commission.
The plans as submitted have indicated additional detail for the southeast corner of the
existing building. Details for the rear of the proposed buildings along E1 Paseo have not
yet been received so it is difficult to appraise the extent of integration of the two
sections.
A detailed landscape plan has not been provided which would show proposed landscape
improvements in the parking lot and the perimeter screening as required for parking lots.
The plans do not address the issue of relocation/under grounding of power lines.
RECOMMENDATION:
That Case No. 182 C, for the remodel of the Market Basket Center on the west side of
Larkspur Lane be approved subject to the following conditions which must be fulfilled
prior to issuance of a building permit:
1. That the existing parking lot be redesigned to provide the required
landscaping and perimeter screening.
2. That the existing power lines be relocated to a location that will
not negatively impact the center.
3. That the existing pole sign located in the parking lot be removed.
4. That a new sign program be submitted and approved by the commission.

an addition and remodel of an existing commercial facility.
LOCATION: North side of El Paseo at the rear of Market Basket, west of Larkspur
Lane.
ZONE: C-1 S.P.
DISCUSSION:
This application is divided into two parts. First the applicant proposes to remodel
the existing commercial facility. Secondly, the applicant wishes to construct a
series of three commercial buildings adjacent to the rear of the existing building.
These new buildings will front onto El Paseo.
The site plan and parking situation will be reviewed by the planning commission in
the precise plan process.
REMODEL NO. 1-
A significant metamorphosis is proposed for the existing commercial center. The
new elevations include the installations of a covered walkway for the full width of
the sidewalk. Columns twelve feet apart with a band of brick at the top and the
bottom support the canopy. The roof of the canopy or walkway cover will be
pitched and covered with tile. The walls will be redone and covered with a white
stucco. A band of brick will extend along the stucco and provide continuity.
No additional floor area will result from this remodel.
MNCFR NS-
The parking lot was constructed many years ago and is extensively cracked.
Resurfacing of the parking lot should be considered. The parking lot design does not
comply with code requirements and will need revisions. The code requires that 15%
of the parking lot area be landscaped and that perimeter screen walls or landscape
buffers be provided.
Presently, across the front of the buildings a string of power lines exist which
negatively impact the appearance of the center. These lines should be relocated or
undergrounded as a part of this remodel.
ADDITION NO. 2:
Three identical 5640 square foot single story commercial buildings are proposed.
Each of these buildings could be divided into seven units. The buildings are
separated by plaza park areas in which a theme structure is proposed.
The elevations show a series of single story buildings with tile roofs. A substantial
walkway cover extends from the front of the buildings.
A landscape plan was not provided; however, a series of planters and palm trees are
shown for the sidewalk area.

CONCLUSION:
The remodel of the existing center will provide much needed improvement. The
construction of the three new buildings will infill one of the more substantial
vacant spots on El Paseo and add to its pedestrian appeal.
RECOMMENDATION:

southwest corner of Larkspur Lane and south Palm Desert Drive, be given
preliminary approval subject to the following conditions:

expressed concern that the parking area was not shown on the plans and

new buildings showing integration with the existing center. Commissioner
Martin felt there was too much concern over what is done with the back of the
buildings and felt that separate plans for the remodel and existing building
could be presented.
Mr. Diaz indicated that the applicant would require and was applying to the
planning commission for a parking variance which will be heard by the
applicant on April 19, 1983.
