following cases were approved by minute motion:

NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of plans
for a car wash.
LOCATION: East side of El Paseo north of the entrance to the Palm
Desert Town Center.

The final plans for the car wash were approved subject to the conditions
listed in the staff report, with condition No. 1 being changed to read
"That a final landscape plan be submitted and approved by the commission
prior to issuance of a notice of completion".

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of
plans for a religious facility.
LOCATION: West side of Monterey Avenue, 350 feet north of Parkview.

The preliminary plans for the religious facility were approved subject to
the conditions in the staff report and the added condition that the sizes of
the species shown on the landscape plan be increased.
The minute motion on the cases listed above carried unanimously 4-0.

NATURE OF PROJECT/APPROVAL SOUGHT: Request to install a
freestanding monument sign at the corner of Frontage Road and Lupine
Lane.
LOCATION: 73-403 Highway I I I - SMITH FOOD KING
ZONE: C-1, S.P.
Mr. Smith reviewed the staff report indicating that this was a request to
install a 1314 square foot sign on a six foot pedestal. He added that the
code permits a free standing sign in a C-1 zone if it can be shown that the
existing or proposed sign would be ineffective for a variety of reasons
ranging from topography of the site to the location of the building.
In this instance it was staff's feeling that the signage presently on the site
was ineffective in that there are two buildings located between it and the
street. Another factor being considered was that only one free standing
sign is permitted per street footage and this would be the only free
standing sign going on the Lupine Lane frontage for the center.
Mr. Smith indicated that the applicant had submitted plans signed by the
owner's representative giving him the right to the signage. The applicant
had also mailed notices to the other affected tenants (copies of which are
included in the staff report); therefore, they had been made aware of this
meeting.
Two concerns were brought up at the study session. One was that the sign
would be located on the public right-of-way; by moving it a short distance
to the east, staff felt the sign would no longer do this. The other factor
involved the required twenty-five foot clear traingle from the
intersection of Lupine and the Frontage Road for traffic visibility. At
present the sign is set back 12 feet, it would have to be set back 25 feet
for it to comply with code.

BACKGROUND:
On August 26, 1983 the commission reviewed preliminary plans for a car wash at the Palm
Desert Town Center. Preliminary approval was granted subject to the usual conditions.
Final working drawings have now been submitted which are in substantial conformity with
those given preliminary approval.
CONCERNS:
1. A final landscape plan has not been provided as of the
writing of this report. One will be required to be submitted
and approved by the commission. The commission should decide
whether it can make a decision on the rest of the plan
without a final detailed landscape plan.
2. The final plans indicate no roof mounted equipment. This
will have to remain because there is not sufficient room
between the roof and the top of the parapet to
adequately hide any roof mounted equipment. It is curious
that the plans do not indicate any pads for ground
mounted equipment either. The commission may wish to have
the applicant clarify this apparent ommission on the plans.
RECOMMENDATION:
That the commission review the final plans for Case No. 193 C to determine
acceptability. Should the commission decide to grant final approval, it should be subject
to the following:
1. That a final landscape plan be submitted and approved by the
commission prior to issuance of a building permit.
2. That no roof mounted equipment be permitted and that it be so
noted on the plans.

DESIGN REVIEW BOARD PROCESS

I hereby acknowledge that I have read and agree, to comply with
all the following requirements, and understand that the Depart-
ment of Building and Safety will not issue a building permit or
allow occupancy on the use permitted until this signed confirma-
tion has been received by the Department of Environmental Services.
The development of this project shall conform substantially to all
development plans submitted in behalf of this case, and as revised
according to the Design Review Board process. Any minor change
requires approval by the Director of Environmental Services. Any
substantial change requires approval by the Design Review Board.
All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
Landscaping (with irrigation system) shall be installed prior to
final inspection and receiving certificate of occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided along
the full frontage of the lot by means of installation prior to
final inspection or other provisions as approved by the City
Engineer. Construction shall conform to City Standards and all
requirements of the City Engineer.
All new and existing electrical distribution lines, telephone,
cable antenna television, and similar service wires or cables,
which are adjacent to and provide service to the property being
developed shall be installed underground as a part of development
from the nearest existing pole not on the property being developed
as A4iredV Municjgal Co&e.
