Date of Action: August 28, 1984 Vote: 2-0 (An appeal of the above action may be made in writing to the city clerk of the City of Palm Desert within fifteen (15) days of the date of the decision.) STAFF COMMENTS: Minutes are attached. MINUTES PALM DESERT ARCHITECTURAL COMMISSION AUGUST 28, 1984 2. Final construction drawings, including a final landscaping, grading, lighting, amenities, trash storage, walkway layout, irrigation plans and sign program shall be submitted to the architectural review commission. No final inspection or occupancy permit shall be given by the department of environmental services to this project until the aforementioned approved plans and construction shall have been completed. 3. CASE NO: 238 C APPLICANT (AND ADDRESS): MENNIE W. ABELARDO, 74-360 Highway 111, Palm Desert, CA 92260. NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary and final approval of exterior revisions to commercial building. LOCATION: 74-360 Highway 111 (north side between Portola and Deep Canyon) ZONE: C-1, S.P. Mr. Smith reviewed the staff report. The commission felt that a change of texture between the stucco walls and the stucco fascia would provide needed relief. In addition, the proposed oleander should be replaced with bougainvillea. Finally, the commission indicated that it was not prepared to review the signs as proposed. Additional more detailed sign plans will be required. In response to a question by the applicant, The commission indicated that a pink neon sign if done properly, could be acceptable. Motion by Commissioner Holden, seconded by Acting Chairman Martin, to grant final approval subject to conditions. Carried 2-0. Approval was subject to the following conditions: 1. Provide a varied texture between the stucco wall and stucco accent band. 2. Landscape plans be revised as noted above. 4. (Change of zone to PC (3) S.P. pending) Representatives from Westar Associates, McClellan/Cruz/Gaylord, and Mervyn's were present. -5- MINUTES PALM DESERT ARCHITECTURAL COMMISSION AUGUST 28, 1984 Mr. Paul Bosman indicated that the new plans reflected the changes requested at the last meeting. Mr. Bob Chase explained what changes had been made. Mr. Ernie Seidel, landscape architect, indicated some sizes and types of plants that are being planned. The acting chairman indicated that the two members present had not attended the previous meeting and could only go by the minutes as to items needing revising. Three concerned citizens were present from the Sandpiper residential development on the south side of Painters Path. They expressed concerns regarding the proposed access to the site from Painters Path, the intensity of landscape planting along Painters Path and the quality of shops to locate in the center. Mr. Bosman assured the residents that there would not be a 7-11 store or that type of store in the center. After further discussion, the commission moved to grant preliminary approval. Moved by Commissioner Holden, seconded by Acting Chairman Martin, to grant preliminary approval subject to conditions. Carried 2-0. Approval was subject to the following conditions: 1. Provide adequate screening on the storm channel side of the building. 2. Landscape plans be reviewed by the architectural commission's landscape architect. IV. DISCUSSION ITEMS: None. V. Acting Chairman Leung explained that during study session, the commission expressed concern regarding the severity of the Mervyn's building. The commission would like to see the shop architecture integrated into the Mervyns store. Also, the buildings adjacent to Painters Path needs to have a tile roof element to continue the design of the roof around the entire building because of the residential across the street. Peter Koetting, Westar, explained that the wall will be screened by the landscaping and felt that wrapping was not necessary all the way around. He explained that the section plan was not to scale; the building is set down approximately five feet with street level. The actual building height is 16 feet high, so with the five foot drop and the five foot landscape berm very little of the wall will be visible. Acting Chairman Leung replied that some treatment was still needed, and that a band might help. Mr. Bob Chase, architect representing Mervyns, explained that Mervyns differs with tile materials, and that he would like the commission to give him some direction. Mr. Chase presented an alternate elevation plan for Mervyns, utilizing fluted horizontal banding at the same height as the tile roofing of the shops and tile roofing at the main entrances. He indicated they had not yet addressed exterior colors, but exterior materials would be fluted block and slumpstone block. The fluted band would extend around the building, but it was indicated that fluting need not extend around the channel side. Mr. Paul Bosman, representing Mervyns, spoke regarding the back of the shops tying in with Mervyns. Acting Chairman Leung was concerned regarding the bands matching. -4- MINUTES PALM DESERT ARCHITECTURAL COMMISSION AUGUST 14, 1984 Mr. Rick Manners, McClelland/Gaylord/Cruz, explained that canopy and large fascia bands were used to add design and said that the tile was a flat Italian pan. He provided a review of the architecture for the entire project and how it related. Mr. Koetting indicated they would wrap the tile roof partially around the back of the shop facing Painters Path and continue a horizontal band across the balance of the back. Commissioner Cook said that he liked the use of a returning roof, but wanted to know why the building sticks up above the fascia at the corners. Mr. Manners replied that this was a different type of design. He said that the corner of the box is flush with the fascia at various points. Mr. Manners indicated that the corner could be brought back and the tile could meet, thereby softening the corner. Mr. Koetting said that the height of the pads move up and down to show some variation. Acting Chairman Leung suggested breaking up the blankness of the front of Mervyns with raised planters. It was indicated that revised plans could be reviewed at the Architectural Commission meetin gof August 28, if plans are submitted by early next week. Moved by Acting Chairman Leung, seconded by Commissioner Cook, to approve the preliminary plans in concept. Carried 2-0. 1. Provide a type of planter for the front of the center. 2. Bring the corner back and carry the the around it. 3. Integrate the shop architecture into the Mervyn's building. 4. Tie in south elevation of tile roof and continue it around the building approximately 20-25 feet. 5. Carry band effect totally around shop building facing Painters Path. W. DISCUSSION ITEMS: None. V. PROJECT DESCRIPTION: The proposed project would consist of 126,735 square feet of floor area including a 60,000 square foot Mervyn's department store. Mervyn's, along with some shops, would be setback five feet from the Palm Valley Channel property line, while a second row of shops would be setback approximately 50 feet from the Painters Path property line. Five other pads would be located near the Highway Ill and El Paseo frontages. ARCHITECTURE: The general architectural theme for the shops and Mervyn's is a combination of spanish and contemporary, respectively. The shops will utilize clay roof tile with earth tone stucco walls. A pastel pink/peach will be tastefully used for accent of the covered walkway columns. Awnings are proposed over parts of the shop area using dark blue, green, or maroon. The maroon and blue will also be used as accent colors on the exterior. The south elevation facing Painters Path is a plain vertical stucco wall. In order to provide complete architecture, there should be some additional treatment. This would also provide some visual relief for the residential area across Painters Path. Mervyn's, which is the tallest structure on the site at 25 feet, is to be a maple nut (tan) slumpblock flat roofed building with a fluted block indention along the top. The two entry areas are recessed into the building. The back side or side facing the channel is proposed to be plain flat walls. Presently, there are large tamarisk trees along the entire property line. Those adjacent to the back of this building are proposed to remain and would screen the structure. The Mervyn's structure is basically not complimentary with the shop architecture. Staff feels the shops are more attractive and that Mervyn's should incorporate some architectural features of the shops to minimize the sharp contrast between structures on the relatively small site. No plans for the pad buildings have yet been submitted and will be reviewed when proposed in the future. Compatibility of these buildings with the main structures will be looked for. III. LANDSCAPING: A preliminary landscaping plan has been submitted which appears to be relatively complete. The landscaping concept is acceptable, although it is unclear how the parking lot areas will be screened. This should be clarified at the meeting. They are proposing a block wall with bermed landscaping adjacent to most of Painters Path for buffering of noise and for aesthetics. Decorative paving is proposed at the driveway entries on El Paseo and Highway I I I and near Mervyn's. Staff feels the decorative paving should also be provided for any driveways allowed on Painters Path. The plans seem to indicate that except for a span of 200 feet from Highway 111, the existing tamarisks will be retained. IV V. VI. WESTAR, Case 233 C Continued SIGNAGE: A comprehensive sign program for the shops has been prepared by the architect. Basically, individual illuminated letter cans mounted on the vertical stucco fascia over the covered walkways would be provided or silkscreened sign would be placed on the awnings. The sign area is based on a percentage of the frontage and as proposed should meet our code requirements. No potential colors for the signs have yet been submitted. Signs for Mervyn's and one other large retailer will need to be reviewed later, since no details on those signs have been filed. CONCLUSION: Staff feels the plans are for the most part acceptable. As noted in the staff report, there are some areas which should be specifically addressed, as follows: A. Rear of shop building B. Mervyn's architecture C. Screening of parking lot from streets D. Decorative paving on all driveways E. Potential colors of signs RECOMMENDATION: The commission should review the plans with emphasis on those items noted by staff and determine acceptability. Should the commission approve the preliminary plans, it should be subject to the following conditions: Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. Final construction drawings, including a final landscaping, grading, lighting, amenities, trash storage, walkway layout, irrigation plans and sign program shall be submitted to the architectural review commission. No final inspection or occupancy permit shall be given by the department of environmental services to this project until the aforementioned approved plans and construction shall have been completed. 3. Approval is subject to final approval of C/Z 84-11, PP 84-31, and TT 20351. 4. Any site plan approval by the planning commission and/or city council that significantly affects this approval shall require additional review by this commission. Performance of this Sign Criteria shall be rigorously enforced and any nonconforming signs shall be removed by the tenant or his sign contractor at their expense, upon demand by Owner. Exceptions to these standards shall be reviewed by the Owner and Architect. However, based upon our field experience, deviations will generally result in serious inequities between tenants. Accordingly, the Owner, through the Architect, will retain full rights of approval of any sign used in the center. B. GENERAL OWNER/TENANT REQUIREMENTS 1. The tenant shall submit a sign drawing approved by the Owner and/or Architect to the appropriate City authority for approval prior to the start of any sign construction or f abr ication. Sheet 1 of McCLELLAN/CRUL/GAYLORD 3. The tenant shall pay for all signs, their installation (including final connection, transformers and al I other labor and materials) and maintenance. 4. The tenant shall obtain all necessary permits. 5. The tenant shall be responsible for fulfillment of all requirements of this sign criteria. 6. The Owner shall provide primary electrical service terminations at the center of the allowed signage area as follows: Individual Letter Cans: Interior wall or canopy. 7. It is the responsibility of the tenant's sign company to verify all conduit and transformer locations and service prior to fabrication. 8. The location of all signs shall be per the accompanying design criteria 9. One "sign space" shall be allowed for each tenant (except as other- wise approved in writing). The tenant shall verify his sign location and size with Owner prior to fabrication. 10. All shop tenants are required to have a sign band per the accompanying design criteria. 11. Address numbers shall be applied to each store by the tenant's sign company during regular course of construction, where applicable. 12. Special signs which vary from this sign criteria must first be approved by the Owner and respective City authority. 13. The maximum allocated sign area for the aggregate of all permanent signs (except exempt and convenience signs) shall be as noted herein. 14. NOTE! No sign shall be constructed until approved building permits from City Planning and Building and Safety Departments are received. C. GENERAL SIGN SPECIFICATIONS 1. No exposed raceway, crossovers, conduits, conductors, transformers, etc., shall be permitted. 11 Project: Palm Desert - MCG 82.078 Sheet 2 of 16cCLELLAN/CRULi GAYLORD 2. All lettering shall be restricted to the 'net sign area" and have a matte finish. See accompanying design criteria for specific information. 3. No projection above or below the "net sign area` will be permitted (except as otherwise approved in writing). 4. All signs and their installation must comply with all local building and electrical codes and bear a U.L. label placed in an inconspicuous location. 5. For purposes of store identification, tenant will be permitted to place upon each entrance to its demised premises not more than 144 square inches of gold leaf or decal application lettering not to exceed 2 inches in height, indicating hours of business, emergency telephone, etc. The number and letter type shall be subject to Architect's approval. (See Door Signage Design Criteria, Page —). 6. Typical Internally Illuminated, Individual Letter Sign Specifications: a. Shop signs shall be attached in designated areas only and may not exceed 60% of the leasehold width. b. The face of the individual letters and logos shall be constructed of acrylic plastic (3/16" thick minimum) and fastened to the individual channelized metal letter in an approved manner. All surrounds or trim in a single sign shall be a single color with matte finish. c. The 'copy' (letter type), logos and their respective colors shall be submitted to the Owner and Architect for written approval prior to fabrication. d. Individual shop logos may be located anywhere within the "net sign area', provided their heights does not exceed the height of the "net sign area'. e. No more than two rows of letters are permitted, provided their maximum total height does not exceed the height of the "net sign area'. Tenants shall display only their established trade name of their basic product name, e.g. "John's Jeans', or combination thereof. g. Internal illumination to be 60 milli -amp neon installed and labeled in accordance with the 'National Board of Fire Under- writers Specifications'. 7. All penetrations of the building structure required for sign installa- tion shall be sealed in a watertight condition and shall be patched to match adjacent finish. D. PROHIBITED SIGNS ;signs Constituting a Traffic Hazard: No person shall install or maintain a cause to be installed or main- tained any sign which simulates or imitates in size, color, lettering or design any traffic sign or signal, or which makes use of the words 'STOP", "LOOK', "DANGER", or any other words, phrases, symbols, or characters in such a manner to interfere with, mislead or confuse traffic. 2. Immoral or Unlawful Advertising: It shall be unlawful for any person to exhibit, post or display cause to be exhibited, posted or displayed upon any sign, anything of an obscene, indecent, or immoral nature or unlawful activity. 3. Signs or Doors. Windows or Fire Escapes: No window signs will be permitted except as noted herein. No sign shall be installed, relocated, or maintained so as to prevent free ingress to or egress from any door. No sign of any kind shall be attached to a stand pipe except those signs as required by code or ordinance. 4. Animated. Audible or Moving Signs: Signs, consisting of any moving, swinging, rotating, flashing, blink- ing, scintillating, fluctuating or otherwise animated light are prohibited. 5. Off -Premise Signs: Any signs, other than a directional sign, installed for the purpose of advertising a project, event, person or subject not related to the premises upon which said sign is located, is prohibited. Vehicle Signs: Signs on or affixed to trucks, automobiles, trailers, or other vehicles which advertise, identify, or provide direction to a use or activity not related to its lawful making of deliveries of sales or merchandise or rendering of services from such vehicles, is prohibited. 7. Light Bulb Strings and Exposed Tubing: External displays, other than temporary decorative holiday lighting, which consist of unshielded light bulbs, and open, exposed neon or gaseous light tubing, are prohibited. An exception hereto may be granted by the Architect when the display is an integral part of the design character of the activity.to which it relates. 8. Banners. Pennants. and Balloons Used for Advertising Purposes: Flags, banners, or pennants, or a combination of same, constituting an architectural feature which is an integral part of the design character of a project may be permitted subject to Architect and City approval. 9. Signs in Proximity to Utility Lines: Signs which have less horizontal or vertical clearance from authorized communication or energized electrical power lines than that prescribed by the laws of the State of California are prohibited. Performance of this Sign Criteria shall be rigorously enforced and any nonconforming signs shall be removed by the tenant or his sign contractor at their expense, upon demand by Owner. Exceptions to these standards shall be reviewed by the Owner and Architect. However, based upon our field experience, deviations will generally result in serious inequities between tenants. Accordingly, the Owner, through the Architect, will retain full rights of approval of any sign used in the center. B. GENERAL OWNER/TENANT REQUIREMENTS I. The tenant shall obtain all necessary permits. 5. The tenant shall be responsible for fulfillment of all requirements of this sign criteria. 6. The Owner shall provide primary electrical service terminations at the center of the al lowed signage area as follows: Individual Letter Cans: Interior wall or canopy. 7. It is the responsibility of the tenant's sign company to verify all conduit and transformer locations and service prior to fabrication. 8. The location of all signs shall be per the accompanying design criteria 9. One "sign space" shall be allowed for each tenant (except as other- wise approved in writing). The tenant shall verify his sign location and size with Owner prior to fabrication. 10. All shop tenants are required to have a sign band per the accompanying design criteria. 11. Address numbers shall be applied to each store by the tenant's sign company during regular course of construction, where applicable. 12. Special signs which vary from this sign criteria must first be approved by the Owner and respective City authority. 13. The maximum allocated sign area for the aggregate of all permanent signs (except exempt and convenience signs) shall be as noted herein. 14. NOTE! No sign shall be constructed until approved building permits from City Planning and Building and Safety Departments are received. C. GENERAL SIGN SPECIFICATIONS I. All lettering shall be restricted to the "net sign area' and have a matte finish. See accompanying design criteria for specific information. 3. No projection above or below the 'net sign area" will be permitted (except as otherwise approved in writing). 4. All signs and their installation must comply with all local building and electrical codes and bear a U.L. label placed in an inconspicuous location. 5. For purposes of store identification, tenant will be permitted to place upon each entrance to its demised premises not more than 144 square inches of gold leaf or decal application lettering not to exceed 2 inches in height, indicating hours of business, emergency telephone, etc. The number and letter type shall be subject to Architect's approval. (See Door Signage Design Criteria, Page _). 6. Typical Internally Illuminated, Individual Letter Sign Specifications: a. Shop signs shall be attached in designated areas only and may not exceed 60% of the leasehold width. b. The face of the individual letters and logos shal I be constructed of acrylic plastic (3/16" thick minimum) and fastened to the individual channelized metal letter in an approved manner. All surrounds or trim in a single sign shall be a single color with matte finish. c. The "copy" (letter type), logos and their respective colors shall be submitted to the Owner and Architect for written approval prior to fabrication. d. Individual shop logos may be located anywhere within the "net sign area", provided their heights does not exceed the height of the "net sign area'. e. Tenants shall display only their established trade name of their basic product name, e.g. "John's Jeans", or combination thereof. g. All penetrations of the building structure required for sign installa- tion shall be sealed in a watertight condition and shall be patched to match adjacent finish. D. PROHIBITED SIGNS I. Signs Constituting a Traffic Hazard: No person shall install or maintain a cause to be installed or main- tained any sign which simulates or imitates in size, color, lettering or design any traffic sign or signal, or which makes use of the words "STOP", "LOOK", -DANGER", or any other words, phrases, symbols, or characters in such a manner to interfere with, mislead or confuse traffic. 2. Immoral or Unlawful Advertising: It shall be unlawful for any person to exhibit, post or display cause to be exhibited, posted or displayed upon any sign, anything of an obscene, indecent, or immoral nature or unlawful activity. 3. Signs or Doors. Windows or Fire Escapes: No window signs will be permitted except as noted herein. No sign shall be installed, relocated, or maintained so as to prevent free ingress to or egress from any door. No sign of any kind shall be attached to a stand pipe except those signs as required by code or ordinance. 4. Animated. Audible or Moving Signs: Signs, consisting of any moving, swinging, rotating, flashing, blink- ing, scintillating, fluctuating or otherwise animated light are prohibited. 5. Off -Premise Signs: Any signs, other than a directional sign, instal led for the purpose of advertising a project, event, person or subject not related to the premises upon which said sign is located, is prohibited. Vehicle Signs: Signs on or affixed to trucks, automobiles, trailers, or other vehicles which advertise, identify, or provide direction to a use or activity not related to its lawful making of deliveries of sales or merchandise or rendering of services from such vehicles, is prohibited. 7. Light Bulb Strings and Exposed Tubing: External displays, other than temporary decorative holiday lighting, which consist of unshielded light bulbs, and open, exposed neon or gaseous light tubing, are prohibited.
