This should be deleted since the precise plan approval requires that no development occur on the hillside to retain the natural appearance. The applicant should review the precise plan requirements since they contain requirements that must be fulfilled before a building permit can be obtained. RECOMMENDATION: The commission should review the plans in light of the above comments and determine acceptability. DISCUSSION: The applicant is requesting preliminary approval of a partial two story commercial building that was approved by the planning commission on October 16, 1984. Previously, a conditional use permit and preliminary design review case for a racquetball club was approved in 1978. That approval expired a long while back. II. SITE DESIGN: The site is irregular in shape and has frontage on Painters Path and Highway Ill. The building is placed adjacent to most of the Highway III frontage with parking occupying the flat part of the site. The steep part of the site will be basically undisturbed. Vehicular access to Painters Path would be from the southerly end of Painters Path. Circulation on -site would be one way in a counter clockwise direction. III. ARCHITECTURE: The architectural style of the building is somewhat spanish with exterior materials consisting of cement plaster walls, ceramic tile accents, and a brownish tile roof. The two story portion of the building is in the middle of the structure with one story areas at each end. IV. LANDSCAPING: A preliminary landscaping plan has been submitted which indicates species and sizes. However, for shrubs and groundcover, no spacing is indicated. V. SIGNAGE: No information on signs has yet been submitted. When available, they will have to be reviewed by the commission. VI. RECOMMENDATION: The commission should review the plans and determine acceptability. Should the commission grant approval, the following conditions should be imposed: 1. Construction plans shall be submitted for approval to the city fire marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 2. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearancejfrom the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Prior to issuance of building permit, an existing topography plan showing toe of slope shall be submitted to the department of environmental services to verify that encroachment of development does not exceed that shown on approved site plan; parking lot and building closest to toe of slope to be superimposed on topography plan. 11. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the Director of Public Works. 16. Additional storm drain construction shall be contingent upon a drainage study by --- the private engineer. 17. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 18. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the improvements by the city. 19. Landscaping maintenance on Hwy 111/Painters Path shall be provided by the owners. 20. Traffic safety striping on Hwy Ill shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to an approved by the director of public works before placing pavement markings. 21. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 22. Dedication of 5 feet of right-of-way on Hwy Ill shall be done prior to issuance of any permits and approval of plans or per Caltrans requirements. 23. Installation of curb and gutter matching paving and sidewalk on Hwy III and Painters Path. This may include a modified curb return on the northwest corner to address interim deceleration land concerns. 24. Offsite improvement plans to be approved by public works department and a Surety posted to guarantee the required offsite improvements prior to building permits being issued. 25. Installation of one-half landscaped median in Hwy Ill or cash payment for one-half the cost of landscaped median at the option of the director of public works. 26. Size, number and location of driveways to public works specifications. 27. Only one driveway approach will be allowed to serve this property. Size and location to public works specifications. City Fire Marshal: 28. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three (3) hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 29. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department, and the original will be returned to the developer. 31.
