CONDITIONS OF APPROVAL PP 84-45 Department of Environmental Services: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes in force, or which hereafter may be in force. 3. Construction of a portion of said project shall commence within twelve months from the date of final approval unless an extension of time is granted by the planning commission; otherwise said approval shall become null, void and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission Riverside County Department of Health City Fire Marshal Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 5. Detailed exterior parking lot lighting plan in compliance with applicable standards to be submitted to the city prior to issuance of building permits, for approval; lights to be down -shining box type to minimize glare. 6. The four foot high slump block wall facing Cook Street shall be set back five feet further from the street to provide additional landscaping. 7. A minimum four foot high slump block wall shall be provided along north property line between existing chainlink fence and wall along Cook Street. 8. Prior to issuance of a building permit, the applicant shall provide mitigation measures in the form of fees of $750 per acre for the undeveloped area for a Fringe -Toed Lizard (UMA INORNATA) habitat preserve. Any fees collected are to be placed in a fund to be used for acquisition of land for a lizard preserve in the Coachella Valley. 9. That the applicant shall pay fees into the fire protection fund as established by city ordinance for fire site apparatus and equipment acquisition. 10. All existing electrical distribution lines, telephone, cable antenna television, and similar service wires or cables, which are on or adjacent to the property being developed shall be installed underground, if practicable, as a part of development from the nearest existing pole not on the property being developed. Department of Public Works: 11. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to building permit issuance. 12. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the Director of Public Works. 13. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. -2- I PLANNING COMMISSION RESOLUTION NO. 14. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 15. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as -built" plans submitted to the department of public works prior to the project final. 16. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as -built" plans prior to the acceptance of the improvements by the city. 17. Landscaping maintenance on Cook/Eclectic shall be provided by the property owner. 18. Existing utilities on Cook Street shall be undergrounded per each respective utility district's recommendation. 19. Traffic safety striping on Cook Street shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved by the director of publi works before placing pavement markings. 20. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 21. Dedication of 11 feet of right-of-way on Cook Street shall be done prior to issuance of any permits and approval of plans. 22. Installation of curb and gutter, matching paving and sidewalk on Cook Street. 23. Waiver of access to Cook Street except at approved locations shall be granted by separate instrument. 24. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to issuance of the building permit. 25. Installation of one-half landscaped median in Cook Street or cash payment for one- half the cost of landscaped median at the option of the director of public works. 26. Size, number and location of driveways to public works specifications with only two driveway approaches to be allowed to serve this property. City Fire Marshal: 27. Install a water system capable of delivering 3500 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 28. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 29. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. -3- C PLANNING COMMISSION RESOLUTION NO. 30. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 84-45 is in accordance with the requirements prescribed by the Fire Marshal." 31. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 32. Any building over 12,000 square feet will require a monitored fire sprinkler system. 33. Fire lanes will be required. 34. ZONE: SI, SP DISCUSSION: The proposal is to construct a two story building for the administrative, marketing and production services of Coachella Valley TV. These facilities are presently located on El Paseo near Highway 111. This building would supplement the service and construciton facilities that presently exist on the westerly part of the site. ARCHITECTURE: The architectural style of the two story building would be contemporary and utilize exterior plaster, some tile, and glass. The building would be a maximum 27 feet tall and have a flat roof. The exterior would be white with the tile used as a accent as a horizontal band around the building. The tile band would be yellow, red, and blue which are CVTV'sr logo colors. The proposed sign which appears to be individual letters would also be in those same colors. It appears that the second floor which has a large amount of glass, will not have adequate solar protection. LANDSCAPING- A preliminary landscaping plan has been submitted, species types and locations. However, no sizes are indicated. SIGNS: A sign is indicated on the east elevation of the building. However, no details have been submitted. Therefore, it will need to be approved separately at a later date. RECOMMENDATION: Jhe commission should review the plans and determine acceptability. The land- scaping plan needs further work and solar protection should be reviewed. Any approval should be subject to the following conditions: 1. FILING PROCEDURE: Prior to submittal the applicant shall discuss his pro- posal with the Planning staff to determine whether or not the proposal is in conformance with the General Plan and to determine zoning ordinance, subdivision ordinance, or other requirements. II. GENERAL INFORMATION: A. Meetings: 1) City Council meetings are held on the second and fourth Thursday of each month, at 7:00 PM in the Council Chambers in the City Nall, 45-275 Prickly Pear Lane. 2) Planning Commission meetings are held on Tuesday, nine (9) days prior to the first Council meeting of the month, also at 7:00 PM in the Council'Chambers and Wednesday, eight (8) days prior to the second Council meeting of the month, at 1:00 PM in the Council Chambers. 3) The Design Review Board convenes on Tues- day, a week before the Planning Commission, at 2:00 PM in the Council Chambers. B. Public Nearing: Public hearings are held when the City considers re- quests for a change of zone, variance, conditional use permit, general plan amendment, etc. Legal notices for these hearings are published in the Palm Desert Post at least ten (10) days prior to the hearing. Public hearing items before the Palm Desert Redevelopment Agency are published in the Desert Sun. C. Appeals: Where the Zoning Ordinance provides for appeal to the City Council or Planning Commission, the appeal shall be made within fifteen (15) days of the date of the decision by filing an application of appeal with the Director of Environmental Services. D. Fees: All required fees are listed in the Fee Schedule, as approved by the City Council, and specifically noted for this application. E. Building Permits: Building permits are issued by the Department of Building and Safety and are required before any new construction, re- construction, plumbing, mechanical work is commenced. F. Business License: Prior to engaging in an enterprise for profit, zoning and building code clearance for the proposed use is required and a city business license obtained. Application should be made to the Code En- forcement Supervisor. G. Private Deed Restrictions: Many parcels of land in the City of Palm Desert are subject to private covenants, conditions, and deed restrictions which may conflict with the requirements of the City Zoning Ordinance. MANDATORY FINDINGS: No project may be approved unless: - The proposed development conforms to any legally adopted development standards. - The design and location of the proposed development and its relationship to neighboring, existing or proposed developments and traffic is such that it will not impair the desirability of investment or occupation in the neighbor- hood; and that it will not unreasonably interfere with the use and enjoyment of neighboring, existing or proposed developments, and that it will not create traffic hazards or congestion. - The design and location of the proposed development is in keeping with the character of the surrounding neighborhood and is not detrimental to the har- monious, orderly, and attractive development contemplated by the Zoning Or- dinance and the adopted General Plan of the City. - The design and location of the proposed development would provide a desirable environment for its occupants, as well as for its neighbors and that it is aesthetically of good composition, materials, textures and colors. - The proposed use conforms to all the requirements of the zone in which it is located and all other applicable requirements. - The overall development of the land shall be designed to ensure the protection of the public health, safety, and general welfare. III. ADOPTED DEVELOPMENT STANDARDS: Each project will be reviewed on the basis of its conformance to the following adopted development standards. In those areas determined by the D.R.B. to be "unacceptable", it is the responsibility of the applicant to redesign that por- tion of the project. A. TERRAIN CONTROL STANDARDS UNACCEPTABL 1. Terrain and soils shall be structurally stable and suitable for development. A. TERRAIN CONTROL STANDARDS (continued) 2.
