STAFF COMMENTS: Please read the attached minutes. MINUTES ARCHITECTURAL COMMISSION OCTOBER 22. 1985 Commissioner Holden indicated that since they were taking what was previously open space he thought that they should provide additional landscaping outside of the wall. Commissioner Martin noted that the columns around the exterior dinina area should be increased in height and size to match the existing columns on the building. It was moved by Commissioner Martin. seconded by Commissioner Cook to approve Case No. 282 C subject to the following conditions. 1. That the columns supporting the gazebo be increased to match the existing columns on the building. 2. That landscaping be added to the public side of the exterior wall. Carried 5-0 6. Mr. Sawa outlined the case and indicated that the La Paon restaurant was not going to be remodeled as previously planned. Mr. Sawa also noted that the applicant has received preliminary property owner's association approval and that final approval will be necessary before building permit issuance. There was some question as to what was going to happen to the existing trees. Mr. Wurzburger indicated that 105 of the existing trees were to be replanted into the design. They comply with the Preliminary approval. At the time of preliminary approval. it was determined that the landscape plans were too conceptual to give preliminary approval. The applicant indicates the preliminary plans. including a program for retaining and/or relocating existing trees will be available at the meeting. however, final landscape plans would not be available immediately. The applicant is presently in the Process of obtaining final Palm Desert Propertv Owner Association approval. That approval is necessary before staff will stamp the Plans for building and safety department submission. The applicant now indicates that due to an existing lease. the La Paon Restaurant which is to be retained, will Probably not be remodeled. The tennis court fencinq will be chain link with green (or other color) cloth on the outside of the fencinq. The lighting plan for the parkinq lot and tennis courts will need to be submitted to staff. A precise plan and tentative tract map were previously approved for a different design on January 12, 1984. This plan now supercedes that approval. The Palm Desert Property Owner's Association's architectural commission has granted preliminary approval of the plans. The property encompasses the land between the Adobe Hotel at the north and La Paon restaurant to the south. All structures, except La Paon, which will be remodeled, will be demolished. ARCHITECTURE: Architecturally, the buildings will be spanish in nature with exterior materials consisting of stucco walls, wood trellis' painted metal railings for balconies, decorative the and tile roofing. The La Paon Restaurant would be remodeled to be compatible with the project. However, no plans have yet been submitted for the restaurant. The administration and guest room buildings would be three stories tall with heights 35 and 30 feet respectively. The health club would be approximately 30 feet in height. Attached to the north end of the health club at the second story level will be three tennis courts. Below the courts will be a covered parking area. Architecturally, the courts and parking structure tie in with the building. Lighting is proposed for the courts, and therefore, lighting plans will need to be approved by staff. AGENDA ITEM NO. PP 14-83 (AMENDMENT 01) Department of Community Development: The development of the property shall conform substantially with exhibits (Case No. PP 14-83 Amendment #1) on file with the department of community development/planning, as modified by the following conditions. 2. Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all municipal code requirements to the degree that the city could consider each phase as a single project. 3. Final map for TT 19697 shall be recorded and construction of a portion of said project shall commence within 12 months from the date of this final approval unless a time extension is granted by the planning commission, otherwise said approval shall become null, void and of no effect whatsoever. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to ` all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall, where appropriate, first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 6. All existing electrical distribution lines, telephone, cable antenna television, and similar service wires or cable which are on or adjacent to the property being developed shall be installed underground, if Practicable, as a part of development from the nearest existing pole not on the property being developed. 7. Any mechanical equipment placed on roof shall be screened, hidden, or camouflaged from view of adjacent public streets to satisfaction of city. 8. Parking lot lighting system shall be designed to comply with municipal code requirements with light standards to be maximum 15 feet high. 3 PLANNING COMMISSION OLUTION NO. 1078 Lights to be down -shining box type light. The restaurant which is existing and to be retained, shall be remodeled to be architecturally compatible with proposed construction. I1. 3.5 foot high decorative screen walls shall be provided adjacent to parking areas along frontage road. 12. Six foot high masonry walls shall be provided along north and south property lines, and appropriately stepped for visibility. 13. Hours of tennis court lighting shall be limited to 10 p.m. 14. Trash enclosures shall be, provided as approved by local disposal company and architectural review commission. 15. Compact stalls shall not exceed 10% of total parking spaces. 16. Dense planting of trees shall be installed to shield tennis court lighting from Ocotillo Drive. Department of Public Works: I. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of final map. 2. Drainage facilities shall be provided per Ordinance No. 218 and the Master Drainage Plan to the specifications of the director of public works. 3. Full public improvements, including sidewalks, traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Improvement plans for water and sewer systems shall be approved by the respective service districts. 5. Complete grading and improvement plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction of any improvements is commenced. The 4 PLANNING COMMISSION HtSOLUTION NO. 1078 subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the city. 6. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 7. Landscaping maintenance on Frontage Road and Ocotillo Drive shall be provided by the hotel operators. 8. Traffic safety striping on Frontage Road shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved by the director of public works before placing pavement markings. 9. Traffic analysis on the site to be conducted addressing the impact on Highway 74 to determine if a traffic signal is warranted at the intersection which aligns with Pitahaya. Fire Marshal: Install a water system capable of delivering 3500 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 14-83/Amendment #1 is in accordance with the requirements prescribed by the fire marshal." 5 PLANNING COMMISSION ..-,.JLUTI ON NO. 1078 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. 7. All buildings over 5000 square feet require an approved fire sprinkler system. 8. Hotel buildings will require an approved fire alarm system. The following conditions are those mutually agreed upon by applicant and Casa Mia Homeowners Association and included due to request of applicant and association: 1. Employee parking will be provided on site or on an off site parking lot which may in the future be acquired and which is approved for hotel parking by the City of Palm Desert. All employees will be informed not to park on Ocotillo Drive and will be issued mandatory parking stickers for their automobiles. 2. The general contractors will schedule the construction of the wall along Ocotillo Drive as the first priority. 4. The landscaping of the above mentioned wall along Ocotillo Drive will be Installed within four months after the construction of the wall. 5. The hotel will not schedule outside parties which extend past the hour of 10:00 P.M. 6. The hotel contract vendors will be informed that they are not to use Ocotillo Drive south of Tumbleweed as an access route. 7. Any illuminated pole signs which are proposed for the project will face Highway 74 and none will be placed on Ocotillo Drive. 8. Any tennis courts which are lit for night play will be located north of Tumbleweed. 9. This letter agreement will become part of the application to the City of Palm Desert for a new conditional use permit. The letter will be included in the staff report to the planning commission and the city council. All 11 PLANNING COMMISSION RESOLUTION NO. 1075 ( items, with the exception of item 5 (already deleted), will be requested to be conditions under the conditional use permit. However, failure by the city to include all conditions will not lessen the owners obligation to comply or the association's right to enforce any and all conditions.
