Steve Smith reported that this proposal had cane before commission
several years ago and was denied. The applicant noted that she
would be using an existing structure, adding a valance.
Commissioner Holden reported that an actual awning was approved
several years ago that had a shape to it. Rather than installing
the approved awning, a banner type of material was installed.
Camussion did not like the look of a banner type material hanging
from the existing beam.
Commissioner Urrutia felt the applicant would need to come back
with an alternate solution. Ccmnissioner Holden noted that the
applicant could use larger and different letters on the existing
beam.
Commission directed applicant to work towards an alternate
solution suggesting 12" brass letters placed on the existing 18"
beam.

The applicant, Mr. Del Pate, had decided to make this a gated
co mnuuty, and therefore is seeking approval of the revised entry.
Commissioner Urrutia noted that the ccmmi.ssion would need to see
more detail on the gate design, what the walls would look like,
the color and materials of the walls and gate and how it ties into
the adjacent development. He added that any signage should be
included in these details. Chairman Gregory added that the
elevations were also needed prior to approval.
Mr. Pate noted that the homeowners association would be
maintaining the retention area along the development. He added
that the retention area grading would be redesigned to create a
tot lot. Chairman Gregory asked applicant to also provide the
plans for this tot lot.
Action:
It was moved by Commissioner McCrea, sew by Camtissioner
Urrutia, to grant conceptual approval of the entryway design
noting that the applicant will need to provide details on the gate
design, what the surrounding walls will look like, the color and
materials of the wall and gate, phones, signage, card gate and haw
it ties into the adjacent development. Notion carried 5-0.
Mr. Pate requested approval to plant the date palms now. Chairman
Gregory felt the landscaping should be pulled out to the end of
the retention basin to avoid the look of the landscaping stopping
so bluntly.
Mr. Smith noted for the record that commission encouraged the
applicant to bring the entry landscaping further to the south, not
just to stop in a straight line as sham. Mr. Smith informed
applicant that with conceptual approval the he has the option to
cane back for preliminary approval prior to the final drawings
being presented.

Commissioner Urrutia was concerned with the massiveness of the two
awnings. The applicant noted that the owner felt with the design
of the building, this was their only answer. Commissioner Urrutia
suggested an awning that looked like one awning but actually would
not touch. Chairman Gregory thought the hemisphere shape done did
not work at this location and felt something with more square
lines would be appropriate.
The applicant noted that the owner on the right, Diamonds For
Klure, was adamant about having the proposed awning and suggested
that his awning could be the only one approved and work with
another type signage for Peters Crafts. Chairman Gregory
suggested two different colored awnings for the 2 businesses.
Commissioner Urrutia thought a symmetrical design could also work
on this building.

A DECISION OF THE ARCHITECTURAL COMMISSION
DENYING A REVISED REQUEST TO PERMIT A CANVAS
AWNING WITH SIGNAGE AT 73-405 EL PASEO.

WHEREAS, the City Council of the City of Palm Desert did on the 22nd day
of January and continued hearing on February 12, 1987 hold public meetings to
consider an appeal by COUNTESS VON HUELLESSEM INTERNATIONAL FASHION to a
decision of the Architectural Commission denying a revised request to permit a
canvas awning with signage at the above noted location, and .
WHEREAS, the Architectural Commission of the City of Palm Desert,
California, did on the 23rd day of December 1986 hold a public meeting to
consider a revised request by Countess Von Huellessem International Fashion to
permit an awning with signage at which time the request was denied for the
following reasons:
1. The awning was not installed in accordance with the approval granted
October 8, 1985.
2. The awning with signage as it is presently installed was rejected by
the architectural commission October 8, 1985 at which time approval
for an awning was granted subject to conditions.
3. The awning as installed is basically a canvas sign and it is not the
desire of the city to establish permanent fascia mounted canvas
awning signs.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", In that the Director of Community Development has
determined that the request is a class 3 categorical exemption for the purposes
of CEQA.
WHEREAS, at said public meeting upon hearing and considering all testimony
said City Council did find the following facts and reasons to exist to justify
the denial of the appeal:
The awning was not installed in accordance with the approval granted
October 8, 1985.
2. The awning with signage as it is presently installed was rejected by
the architectural commission October 8, 1985 at which time approval
for an awning was granted subject to conditions.
3. The awning as installed is basically a canvas sign and it is not the
desire of the city to establish permanent fascia mounted canvas
awning signs.
RESOLUTION NO. 87-8
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the council in this case.
2. That the appeal is hereby denied for reasons stated above.

Mr. Smith explained that this item had been continued from the last
meeting. He understood that the approved awning was to be placed on
a frame and not attached to the beam.
Commissioner McCrea indicated that he had viewed the awning on -site
and had no concerns with it as installed.
Commissioner Holden asked why the awning was not installed as
approved by the architectural commission.
Mr. Ernie Brooks explained that the proposed awning/valance was
presented by Count von Huellessem and built and installed by him as
Instructed by the Count. The Count understood that the approval was
for a valance.
Chairman Gregory had no objection to the proposal as installed but
felt that some type of penalty should be imposed when a building
permit is not obtained prior to construction or installation.
Commissioner Martin indicated that he would not approve the proposal
If it were to be presented as a new request. He felt that this
valance would set a precedent for the entire building.
Commissioner Holden was concerned that additional canvas signs would
be requested throughout the city.
Mr. Drell noted that the commission might want to set up a condition
for maintenance of canvas signs and awnings.
Commissioner Martin recommended that the valance be removed by
January I, 1987 and that the applicant resubmit a new proposal.
It was moved by Commissioner Cook, seconded by Commissioner Martin
to require that the awning/valance be removed by January I, 1987
since the awning was not installed as approved and without a permit.
A new proposal may be submitted for approval. Carried 3-2 (Chairman
Gregory and Commissioner McCrea opposed).

Mr. Smith indicated that in study session the commission suggested
that the north facing sign be lowered by approximately two feet and
the east sign facing the alley be one line and moved back 18".
Commissioner Cook indicated that there may be a notch in the area
where the north sign would be moved to. He suggested that the notch
be filled and painted the same color as the can.
The applicant was concerned that If the east facing sign was moved
back the building next door would block the visibility of the sign
from Highway 111.
Commissioner Cook noted that the scale of the sign was too small to
be read from Highway Ill. He asked if the backs of the letters were
to be closed.
The applicant Indicated that they would be closed back with neon
lighting inside.
It was moved by Commissioner Holden, seconded by Commissioner McCrea
to approve the signs subject to the following conditions.
1. The east facing sign to be moved south 18".
2. The east facing sign to be single line copy.
3. The north facing sign to be moved down one foot with any
notches to be filled in and painted the same color as the can.

Mr. Smith presented plans and pictures of the awning with signage
that had been installed without a permit. He explained that the
awning is over an east facing window. Staff's concern is with the
consistency of wording to be allowed on awnings.
AT Signs was present and a representative indicated that they made
the awning and advised their client on how to install it.
Chairman Gregory felt that a small description of the type of
business is fine but he was opposed to listing the services and
products provided.
Mr. Diaz felt that advertising telling what services they provide
should be done elsewhere. He felt the wording "Italian Cuisine"
would provide adequate description of the business.
Chairman Gregory suggested that the bottom green panel be removed
and the wording be changed to describe the business.
It was moved by Commissioner Drury, seconded by Commissioner McCrea
to approve the awning as installed, subject to removal of the green
panel. Applicant may return to commission with a more appropriate
submittal for copy on the green panel. Applicant to be assessed an
additional fee for the Installation of awning without benefit of
permit pursuant to building department permit procedures. Carried
4-0.

Mr. Smith explained that the proposed awning has been installed
without a Permit. Although the applicant did have approval from the
architectural commission the awning seems to have not been installed
as approved.
Commissioner Martin could not recall how they intended the proposed
awning to be attached to the building at the time of approval.
Commission had questioned whether this was an awning or a cloth sign.
Commissioner Drury had no problem with the awning. She felt the
approval and plans did not indicate exactly how the awning was to be
attached to the building therefore it was not attached incorrectly.
It was suggested that the commissioners review the awning as
installed on -site.
It was moved by Commissioner Drury, seconded by Commissioner McCrea
to continue this case. Carried 4-0

It was noted that at the last meeting the commission's concerns were
that the color was too harsh and that a detailed elevation drawing
would be needed.
Count Von Huellessem explained to the commission that they wanted
something that would be visible.
Commissioner Holden felt that the awning served no purpose except
for signage. Chairman Gregory indicated that the awning would cover
the beam of the building and questioned if that would be covering an
asset of the architecture.
Commissioner Martin noted that he would like the lettering on the
awning to match the style of the existing sign. Commissioner Holden
indicated that if the awning was lowered to expose the beam then it
might be acceptable.

BACKGROUND'
This reauest was before commission at it's September 24. 1985 meeting. At
that time it was decided that additional elevation and section drawings were
necessarv.
DISCUSSION:
Staff has discussed the matter with the applicant. The reauest is for a drop
valance over the existing beam and to extend down a maximum of 9 inches in a
scallopoed fashion. This is considerably less than what was understood to be
the reauest previously.
RECOMMENDATION:
Commission should review the proposed drop valance for Case 271 C and determine
its acceutability.

While attending the Architectural Commission meeting today, we
became aware of your case 271 C, that of Countess Von Huellessem
request for approval of awning with signage.
I noticed that their presentation packet to the City A.C. contained
our companies Brochure "FIRST IMPRESSIONS..." bearing our company
identification. We wish to make it clear that we are not involved
in this project. They do not have our permission to use our
brochures in any presentation of theirs. We are most displeased
with this action, on their part, as it implies our involvement.
Countess Von Huellessem asked us to discuss awnings with some time
ago, but no followup action was taken on their part.
Please make a copy of this letter a part of the file of Case 271 C
so as to protect our company image and liability exposure.

Waive further reading and adopt Resolution No. denying the appeal.
B. DISCUSSION:
In September of 1985 the appellant filed a request for architectural
commission approval of an awning with signage at the business location of
El Paseo.
September 24, 1985 commission reviewed the plans as submitted and
continued the matter in order that additional drawings could be prepared.
October 8, 1985 the matter was back before commission and the applicant
was present to explain the request more fully. At that time the request
was approved subject to four conditions (see attached minutes).
It was staff's understanding that the revised drawings complying with the
conditions and the discussion which took place would be submitted to
staff for review prior to the applicant proceeding to building department
for permit.

when the awning was observed by
appropriate action taken.
1985 until approximately October 1986
a code compliance officer and the
December 9, 1986 the matter was back before the architectural commission.
At this time commission continued the matter until the December 23, 1986
meeting in order that they could visit the site and view the awning.
December 23, 1986 commission determined that it could not approve the
awning as installed and resolved that it should be removed by January 1,
1987.
The applicant filed a timely appeal to the decision of the architectural
commission.

DENYING A REVISED REQUEST TO PERMIT A CANVAS
AWNING WITH SIGNAGE AT 73-405 EL PASEO.

WHEREAS, The City CounclI of the City of Palm Desert did on the 22nd day
of January 1987 ho 1 d a pub 1 i c meeting to consider an appeal by COUNTESS VON
HUELLESSEM INTERNATIONAL FASHION to a decision of the Architectural Commission
denying a revised request to permit a canvas awning with signage at the above
noted location, and
WHEREAS, the Architectural Commission of the City of Palm Desert,
California, did on the 23rd day of December 1986 hold a public meeting to
consider a revised request by Countess Von Huellessem International Fashion to
permit an awning with signage at which time the request was denied for the
following reasons:
1. The awning was not installed in accordance with the approval granted
October 8, 1985.
2. The awning with signage as it is presently installed was rejected by
the architectural commission October 8, 1985 at which time approval
for an awning was granted subject to conditions.
3. The awning as installed is basically a canvas sign and it is not the
desire of the city to establish permanent fascia mounted canvas
awning signs.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", in that the Director of Community Development has
determined that the request is a class 3 categorical exemption for the purposes
of CEQA.
WHEREAS, at said public meeting upon hearing and considering all testimony
said City Council did find the following facts and reasons to exist to justify
the denial of the appeal:
1. The awning was not installed in accordance with the approval granted
October 8, 1985.
2. The awning with signage as it is presently Installed was rejected by
the architectural commission October 6, 1965 at which time approval
for an awning was granted subject to conditions.
3. The awning as installed is basically a canvas sign and it is not the
desire of the city to establish permanent fascia mounted canvas
awning signs.
CITY COUNCIL RESOLUTION NO.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
I. That the above recitations are true and correct and constitute the
findings of the council in this case.
