LOCATION: 73-640 El Paseo ZONE: C-1 DISCUSSION: Applicant's conditional use permit allowed expansion of the outdoor patio to the property line, if a suitable boundary was constructed. Applicant has now submitted a plan showing 41" wrought iron between 47" brick columns with window boxes mounted on the top rail. The proposal appears to meet the commission's previous requirements. NATURE OF PROJECT/APPROVAL SOUGHT: Replacement of wrought iron fence with Potted trees and chains. LOCATION: Northeast corner of El Paseo and Larkspur. ZONE: C-1 Upon reviewing the submitted plans and presentations by staff and by the applicant, the architectural commission returned this item to the applicant for restudy. Date of Action: November 12, 1985 Vote: Carried 4-0 (An appeal of the above action may be made in writing to the City Clerk of the City of Palm Desert within fifteen (15) days of the date of the decision.) STAFF COMMENTS: Please read the attached minutes. MINUTES ARCHITECTURAL COMMISSION NOVEMBER 12, 1985 it was moved by Commissioner Martin, seconded by Commissioner Holden to approve this case subject to the following conditions. Carried 3-1 (Commissioner Leung opposed). 1. That the posts be increased to 12" X 12" 2. That 15" glu lam be used. 3. That the bases be increased to 30" 4. That additional landscaping be planted around the outside of the wall. 2. CASE NO: 283 C APPLICANT (AND ADDRESS): BON APPETIT, 73-640 El Paseo, Palm Desert, CA 92260. NATURE OF PROJECT/APPROVAL SOUGHT: Replacement of wrought iron fence with potted trees and chains. LOCATION: Northeast corner of El Paseo and Larkspur. ZONE: C-1 Mr. Smith indicated that the commission at study session stated that it would like to see the size and color of the chain and pots to be used. Commissioner Leung explained that he thought that it would be a public hazard. The chains are at a level that would be hard to see. Commissioner Martin indicated that the size of the chain links was his concern. He thought if the links were larger that they would be more visible. Commissioner Holden stated that he would prefer to see some type of horizontal bars with the pots around that. Chairman Gregory suggested that the applicant submit a table layout so that the location of the pots could be placed between every table. He also suggested that the applicant use a different type of tree in the pots than Oleander. He questioned whether this type of screening was required by ordinance. Petra Frech, applicant, indicated that it was required. F MINUTES ARCHITECTURAL COMMISSION NOVEMBER 12, 1985 It was moved by Commissioner Holden, seconded by Commissioner Martin to refer this item back to the applicant for restudy of the following. 1. That larger (fe: higher) pots be used. 2. That a table lay out be submitted. 3. That a minimum of 3" chain links to be used. 4. That the Oleander trees be substituted with a different landscape material, commission suggested Kumquat. Motion carried 4-0 Commissioner Leung left at this point of the meeting. 3. CASE NO: APPLICANT (AND ADDRESS): NEIL'S APPAREL, 73-790 E1 Paseo, Palm Desert, CA 92260. NATURE OF PROJECT/APPROVAL SOUGHT: Approval of awning with signage. LOCATION: 73-790 E1 Paseo - Northwest corner E1 Paseo and San Luis Rey. ZONE: C-1 S.P. Commissioner Leung indicated that the commission has been approving awning posts at 18" from the curb. Commissioner Martin noted that the current position would place the poles in the middle of the pedestrian walkway. It should be approved with the posts 18" from the curb subject to an encroachment permit from public works. Commissioner Holden stated that the awning should relate to the entrance door somehow and that the light fixtures inside of the awning should not be visible from the rear of the awning. Mr. Smith explained to the applicant, Mr. Rogers, that the commission was requiring that the awning be 18" from the curb and that it be narrowed to relate to the door entrance. Also that an encroachment permit will be necessary. 4 AGENDA ITEM NO. ZONE: C-I DISCUSSION: On April 16, 1985 planning commission approved a conditional use permit to allow Bon Appetit to utilize their entire outdoor patio for dining. Presently their wrought iron fence is located 10 feet from the property/right-of-way line. To use this 10 foot strip for dining the planning commission required that the existing fence be moved or replaced with a suitable structure clearly delineating the boundary between public and private space. The applicant is proposing to place eight 24" X 20" white ceramic pots inside the property line connected by a heavy iron chain. The pots would contain "Oriental Oleander" pruned to a tree and annual flowers.
