Moved by Commissioner Holden, seconded by Commissioner Cook to continue this case until the next meeting. Carried 5-0 5. MOBIL OIL STATION Applicant was requesting approval of signage to be on one side of a canopy. Commissioner Cook suggested that the applicant put signs on both sides of the canopy for better visibility. He asked that staff make sure that this was allowed by code. Moved by Commissioner Cook, seconded by Commissioner Martin to approve two signs if allowed by code. Carried 4-0-I (Chairman Gregory abstaining). 6. FRED HARING PROFESSIONAL BUILDING - SIGN Mr. Martin submitted samples of the letters color and sizes. The letters will be painted a maroon color and the letters will be 12" and 8" high. Moved by Commissioner Cook, seconded by Commissioner Holden to approve the sign as submitted. Carried 4-0-I (Commissioner Martin abstaining). 7. VALLEY CHRISTIAN ASSEMBLY Plans for preliminary approval of an additional were submitted. Commission had no concerns with the proposal. Moved by Commissioner Holden, seconded by Commissioner Cook to grant preliminary approval. Carried 5-0 B. SACRED HEART CHURCH Applicant was requesting approval of a landscape plan. Lighting for_Sacred Heart Church) Mr. Diaz explained that Sacred Heart Church was requesting the lights to be 7.0 feet in height, instead of the previously approved 15 faet. Commissioner Richards stated that he would prefer to keep it as it was approved and not change the standards. Chairman Crites recommended that a formal request be suemitted for public hearing to notify adjacent residents that might be affected. B. Discussion of Parcel Map Waivers and Lot Line Adjustments. Mr. Diaz stated that he would like to update the approval system for parcel map waivers and lot line adjustments. He informed commission that additional parcels would not be created. He indicated that staff would bring an amendment to the ordinance to allow this to be approved by staff. Commission indicated approval for staff to initiate an amendment. C. Request for approval of PMM 86-15. Mr. Diaz requested that Parcel Map Waiver 86-15 be considered for approval. After consideration commission concurred. Action: Moved by Commissioner Downs, seconded by Commissioner Richards, approving PMW 86-15 by minute motion. Carried 3-0, IX. ORAL COMMUNICATIONS NONE. X. COMMENTS Commissioner Richards expressed concern for the proposed procedural changes, stating that the commission had a certain job, and questioned having them before the planning commission for public hearing. Mr. Diaz replied that as part of due process, it must be heard before the planning commission. ZONE: R-1 9,000 DISCUSSION: A conditional use permit was approved by the planning, commission on July 2, 1985, to permit this construction. The expansion consists of an addition to the sanctuary and expansion of parking facilities. The addition is essentially a new, larger sanctuary which would supplement the existing sanctuary. ARCHITECTURE: The addition, which is to be added to the west side of the structure, w i I I architecturally match the existing. The walls will be smooth and split face block and plaster with a rock roof. The main entrance to the church will now face south and front on the parking lot. There wi 1 I be some demolition to facilitate the construction. A garage for storage is proposed in the parking lot area. LANDSCAPING: New landscaping will be provided around the new construction and within the parking lot area. Landscaping and mounding will screen the parking lot area from the street. PARKING LOT LIGHTING: The plans indicate 20 foot high parking lot lights. The conditional use Permit restricts the lights adjacent to the residential area to 15 feet. Therefore, those plans will need to be revised and approved by staff. SIGNAGE• A new sign is indicated on the plans. However, no details have been provided. RECOMMENDATION: The plans are generally acceptabe, except as noted. Staff recommends that approval be subject to the following conditions: I. All conditions of Planning Commission Resolution No. 1059 shall be met and incorporated into the plans. 2. Parking lot l i ght i ng plans are not approved and must be redesigned and submitted to staff to comply with conditions of approval and city codes. 3. Construction plans shall be submitted for approval to the city fire marshal prior to issuance of building permits. CASE NO. CUP 85-2 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of July, 1985, hold a duly noticed public hearing for a request by the ROMAN CATHOLIC BISHOP OF SAN BERNARDINO (SACRED HEART CHURCH) for approval of a conditional use permit and negative declaration of environmental impact to allow expansion (building and parking) of an existing church in the R-1 9000 (single family, minimum 9000 square foot lot) zone on 5.9 acres located at the northwest corner of Fred Waring Drive and Deep Canyon Road, more particularly described as: A.P.N. 624-270-002 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have an adverse impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1. The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site Is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use complies with the goals, objectives, and policies of the city's adopted general plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That approval of Conditional Use Permit 85-2 is hereby granted for reasons subject to the attached conditions. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a bulling permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural review and building permit procedures. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 6. In lieu of undergrounding existing utility distribution lines on or adjacent to property as a part of construction, the applicant shall record an agreement prior to issuance of building permit guaranteeing that the property will voluntarily be a part of any undergrounding district which is subsequently established by the city including the property in question. 7. Area shown on submitted site plan as overflow parking shall be provided with turf block or equivalent for parking and recreation use. S. Parking areas shall be screened from public street view through the use of 3 to 3.5 foot high wall, berming, and landscaping or any combination thereof. 9. All parking lot lighting shall be down shining recessed box type and shall meet city requirements with lights adjacent to residential use a maximum 15 feet high with other lights a maximum 20 feet high. Shields to be used on lights adjacent to residential as required by city. All lighting plans to be approved by department of environmental services. 10. Chain link fence along Fred Waring shall be removed and replaced with decorative fence to the satisfaction of the city. Department of Public Works: 1.
