A motion to find the proposed projects in conformance with the
adopted Palm Desert General Plan by Planning Commission Resolution
No. 282, was made by Commissioner Snyder, seconded by Commissioner
Kelly; carried unanimously (5-0).
IX. DESIGN REVIEW BOARD ITEMS
A. Review of Cases acted on by the Design Review Board on
September 6, 1977.
Mr. Cipriani reviewed Case Nos. 85MF, 71MF, 86MF, and 8MF
noting they all complied with the conditions and City standards.
There was some discussion regarding the length of County approval
effectiveness.
A motion was made by Commissioner Kryder to approve the Design
Review Board actions by Planning Commission Resolution No. 283, seconded
by Commissioner Kelly; carried unanimously (5-0).
X. DISCUSSION ITEMS
A. Consideration of a Joint Meeting of the Planning Commission
and Design Review Board on September 29, 1977 at 7:00 p.m.
The Commission approved the date and directed the staff to notify
the Design Review Board.
B. Consideration of a one-year ex ion o period of approval
of Final Construction Drawings allow ns ruction of 52-units
at Deep Caeyon Tennis Club. C se No. 41MF.
A motion was .made by Commission Readlileto approve a one-vear
extension of time on the Final Construct rawings for Case No. 41MF
by Planning Commission Resolution No. 284, seconded by Commissioner
Kelly; carried unanimously (5-0).
C. Special item added to agenda at this time, review of Case
No. C/Z 07-76.
Chairman Berkey noted a conflict of interest and left the room
at this time.
Vice -Chairman Reading noted that he thought the Commission needed
more time to review this case and last minute items were not appreciated
by the Commission.
Mr. Roland Sweet spoke to the Commission stating that the
President of the proposed clinic had asked him to inform
the Commission that they were withdrawing their request to
develop the clinic in Palm Desert. He noted that the City
Council was not aware of this at the time they reviewed the
- case and he felt this fact may have altered their decision
on the density issue.
Commissioner Kelly moved and Commissioner Snyder seconded, that
the Case be continued to the October 4th meeting; carried (4-0) Berkey
abstained.

WHEREAS, t lanning Commission of the City of Palm Desert
did recei ication from J. M. PETERS COMPANY, INC. requesting
approval of a one year extension of the period of approval of Final
Construction Drawings to allow for construction of 52 units at Deep
Canyon Tennis Club on Property more particularly described as:

WHEREAS, on September 14, 1977, the Planning Commission did
consider this request for time extension approval; and
WHEREAS, at that time, upon receiving and considering the testi-
mony and arguments, if any, of all persons who desired to be heard, said
commission did find the following facts and reasons to exist to approve
the one year time extension:
1. The proposed project does ensure the protection of the
public health, safety, and general welfare.
2. The proposed project conforms to all requirements of the
Zoning Ordinance.
3. The proposed project is compatible with existing develop-
ment in the area.
4. The proposed project is in conformance with the City's
General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert as follows:
1. That the above recitations are true and correct and con-
stitute the findings of the Commission in this case.
2. That it does hereby approve a one year extension of the
period of approval of final construction drawings for Case No. 41MF.

Re: Deep Canyon Tennis Club
Dear Mr. Roach:
Case No. 5MF was the plot plan approval for the final 180 dwelling
units of the Deep Canyon Tennis Club project. The purpose of the
plot plan review is to study detailed architectural, construction,
and landscape plans prior to submittal to the Building and Safety
Department, for building permits. Case No. 5MF was approved sub-
ject to five conditions (attached) and a provision stipulated in
the minutes of the meeting that the ten (10) buildings east of High-
way 74 and south of Tamarisk Street would be reduced to a single
story in height.
The construction approval as part of Case No. 5MF may not be im-
plemented as the approval has expired. However, a portion of the
5MF project was re -submitted for approval as Case No. 41MF. The
Planning Commission approved the request for 52 units (16 units on
the east half of Rancho Segura Lane and 36 units on Ken Rosewall
Lane) by Resolution No. 180 (attached). Said approval is still
valid and will expire on September 14, 1977. The remaining units
will have to be resubmitted for planning approval before building
permits can be issued.

2. Prior to the issuance of a Certificate of Occupancy, complete
detailed, trash storage, exterior lighting, fence, and auxiliary
equipment plans shall be considered and approved by the Director
of Environmental Services. No Certificate of Occupancy shall be
issued for any dwelling unit until such construction is completed
and approved by the City.
3. Landscaping and sprinkler systems shall be constructed during
each phase and shall be made operational prior to occupancy in
each phase.
.4. The proposed retention basins shall b.e installed in a manner
.acceptable to the County of Riverside Road Department and the
Coachella Valley County Water District. Written notice of such
approval shall be sent to the City's Director of Environmental
Services. Furthermore, the retention areas indicated in yellow
on the Revised Exhibit A map shall be studied as to the feasibility
of their installation. The decision reached on these future basins
shall be made subject to the approval of the County Road Department
and the Director of Environmental Services. Approval of P.P. 5AIF
shall specifically exclude the previously -approved surface storm -
water run-off system.

Defer action to the next meeting and direct the applicant to revise the
grading plan to reflect required retention basins and to resolve the
total matter of drainage in a manner acceptable to the City Engineer.
NOTES:
1. Preliminary approval was approved on Case No. 5MF on July 15, 1974.
A portion of the project was subsequently built. See attached materials.
2. A major concern of the initial approval dealt with on -site and off -site
drainage. Specific requirements were made relative to this matter. These
requirements are not reflected in the construction drawings.

CITY OF PALM DESERT
STAFF REPORT A ��
Report on:' Consideration of Plot Plan Case No. 5MF
Applicant: E1 Dorado homes for Deep Canyon Tennis Club
I. REQUEST: That the Planning Commission approve the Plot
Plan for the fourth, fifth, and sixth phases of the
Deep Canyon Tennis Club which is to have 170 condominium
units arraged in 45 buildings. The first three phases,
have been approved and are under construction consisting
of 16 model units, the recreaton facilities and 164 condo-
minium units arranged in 41 buildings. This matter was
continued from the Planning Commission meeting of June 17, 1974.
II. STAFF RECOMMENDATION: That it be moved that the Planning
Commission approve the Plot Plan for buildng permits subject to
the attached conditions. Justification is based upon:
1. Conformance of the proposed development to all
requirements of the Zoning Ordinance.
2. The proposed development does insure the protection
of the public health, safety, and general welfare.
3. Compatibility of the proposed development to the
existing and proposed development.
III. BACKGROUND:
A. Description - The subject property is known as Tr.
No. 4558.
B. Location - east of the State Hwy. 74 frontage road,
south of Tamarisk, and north of Haystack.
C. Size - This parcel is 29.4 acres and is part of a
larger project of 55 acres.
D. Total No. of Units - This parcel has 170 units and
the total project has 350 units.
E. Density - This parcel has 5.8 dwelling units per acre
and the overall project has 6.3 dwelling units per acre.
F. Type of Units - The units are arranged in four-plex
clusters which are one and two stories in height. The
units have 2 or 3 bedrooms and would average approx-
imately 1,100 sq. ft., somewhat larger than the same
unit as was built in the first 3 phases. The one-story
buildings will be the same as the others except that
they will have only 3 units and will be 11.5 ft. in
height. Architecturally, the exterior of both the
one-story and two-story units will be designed in the same
style as the existing development. Elevations are in
a Spanish style with predominantly stucco finish with
some wood trim. Pictures of the existing units will
be available at the meeting.
G. Coverage - Approximately 40% of the area will be
covered with structure or paving, this meets Ordinance
requirement exactly.
H. E.I.R. Finding - The major discretionary decision
concerning this project was made before CEQA was in

effect and therefore, they are exempt according to state
guidelines.

J. Adjacent Zoning - North R-3-4000 and R-1-10,000
South R-3-4000 and R-1-10,000

K. General Plan Commitment - The Cove Communities General
Plan indicates the property to be potential medium
density residential with 5 - 10 dwelling units per
acre. This development conforms to this allocation.
L. Proposed Parking - The applicant is proposing 3
parking spaces for each unit 1.5 covered in an
attached garage and 1.5 spaces uncovered in adjacent
parking areas with the exception that the ten single -
story building will have two covered spaces per unit..
M. Utilities - Water and Sewer - Coachella Valley Water
District. Power - Southern California Edison
N. Previous Actions - Tenative Tract map. No. 4558 of the
entire project was approved by the Board of Supervisors
of Riverside County, effective December 7, 1971. A
conditional use permit was approved by the Board of
Supervisors July 25, 1972. Building permits for
phase 3 were issued October 25, 1973.
IV. DISCUSSION OF PLOT PLAN ELEMENTS
The major public improvements, such as extension of
sewer and water lines, have been conditioned by the county
in their consideration of the tract map. These improvements,
including the construction of the private road system have
already been completed.
The applicant has revised the plans to replace 10 two-story
buildings with 10..one-story-structures which in the opinion
of staff, would eliminate the concern with a height difference
between these buildings and the adjacent single-family
homes along Tamerisk. This alteration of design reduces the

The revised plot plan and grading plan does provide for
water retention basins which will lessen the water run-off
problem attributed to this project. The re -designed
system of retention basins will be installed within the
project and will provide a retention capacity of approximately
1.6 acre-ft. of water - the equivalent of a 25-year storm.
The current problems associated with nuisance water should
be somewhat decreased due to the reduction of the amount of
watering which is needed for the newly -installed landscaping.
In the opinion of Staff, water run-off problems due to
major storms will only be solved by a city-wide storm water
system such as the one described in the Comprehensive Plan
for Surface Water Drainage for the Palm Desert Area, August 1966.

Report on:' Consideration of Plot Plan Case No. 5MF
Applicant: E1 Dorado Homes for Deep Canyon Tennis Club
I. REQUEST: That the Planning Commission approve the Plot
Plan for the fourth, fifth, and sixth phases of the
Deep Canyon Tennis Club which is to have 170 condominium
units arraged in 45 buildings. The first three phases,
have been approved and are under construction consisting
of 16 model units, the recreaton facilities and 164 condo-
minium units arranged in 41 buildings. This matter was
continued from the Planning Commission meeting of June 17, 1974.
11, STAFF RECOMMENDATION: That it be moved that the Planning
Commission approve the Plot Plan for buildng permits subject to
the attached conditions, Justification is based upon:
1. Conformance of the proposed development to all
requirements of the Zoning Ordinance.
2. The proposed development does insure the protection
of the public health, safety, and general welfare.
3, Compatibility of the proposed development to the
existing and proposed development.
III, BACKGROUND:
A. Description - The subject property is known as Tr,
No. 4558.
B. Location - east of the State Hwy. 74 frontage road,
south of Tamarisk, and north of Haystack,
C, Size -- This parcel is 29,4 acres and is part of a
larger project of 55 acres,
D. Total No, of Units - This parcel has 170 units and
the total project has 350 units.
E, Density - This parcel has 5.8 dwelling units per acre
and the overall project has 6.3 dwelling units per acre.
F. Type of Units - The units are arranged in four-plex
clusters which are one and two stories in height. The
units have 2 or 3 bedrooms and would average approx-
imately 1,100 sq. ft., somewhat larger than the same
unit as was built in the first 3 phases. The one-story
buildings will be the same as the others except that
they will have only 3 units and will be 11.5 ft. in
height. Architecturally, the exterior of both the
one-story and two-story units will be designed in the same,
style as the existing development. Elevations are in
a Spanish style with predominantly stucco finish with
some wood trim. Pictures of the existing units will
be available at the meeting.
G. Coverage - Approximately 40N of the area will be
covered with structure or paving, this meets Ordinance
requirement exactly.
H. E.I.R. Finding .- The major discretionary decision
concerning this project was made. before CEQA was in

attached garage and 1.5 spaces uncovered in adjacent
parking areas with the exception that the ten single -
story building will have two covered spaces per unit'..
M. Utilities - Water and Sewer - Coachella Valley Water
District. Power _ Southern California Edison
N. Previous Actions - Tenative Tract map. No. 4558 of the
entire project was approved by the Board of Supervisors
of Riverside County, effective December 7, 1971. A
conditional use permit was approved by the Board of
Supervisors July 25, 1972. Building permits for
phase 3 were issued October 25, 1973.
DISCUSSION OF PLOT PLAN ELEMENTS
The major public improvements, such as extension of
sewer and water lines, have been conditioned by the county
in their consideration of the tract map. These improvements,
including the construction of the private road system have
already been completed.
The applicant has revised the plans to replace 10.two-story
buildings with 10.'.one-story-structures which in the opinion
of staff, would eliminate the concern with a height difference
between these buildings and the adjacent single-family
homes along Tamerisk. This alteration of design reduces the
proposed total number of dwellings by ten units.

AIM - THE ARCHITECTURAL REVIE1:' BOAP.D was established
July 25, 1974, by Ci.ty Council Ordinance No. 43.
One member of the City Council, two Planning Con -
mission, the Director of Environmental Services
and the Buildi.ng Official are advised by the De-'
partment of Environmental Services staff.
PURPOSE - The purpose of the Board is to manage the orderly
and harmonious appearance of structures and pro-
perty within the City, maintain the public health,
safety and general welfare, maintain property and
improvement values throughout the City and encour-
age the physical development of the City as inten-
ded by the General Plan, and Architectural Review.
Board is hereby established and its duties and re-
sponsibilities shall be enumerated herein.
The purpose of this Ordinance is to:
Recognize the interdependence of land values and
aesthetics and provide a method by which the City
may implement this interdependence to its benefit;
Encourage the development of private and public
property in harmony with the desired character of
the City and. in conformance with -be guidelines
herein provided with due regard to the public and
private interests involved;
Foster attainment of those sections of the City's
General Plan which specifically refer to the pre-
servation and enhancement of the particular char-
acter and unique assets of this City and its liar-
monious development, through encouraging private
and public interests to assist in the implementa-
tion process;

penditures of public funds for improvement and
