The Commission agreed to reword Condition No. 12 as follows: "The
date palm character along Portola Avenue and the southerly property
line shall be preserved."
Case No. 42MF - Steve Fleshman presented the plans reference Case No.
42MF to the Commission. He pointed out that the applicant was requesting
the deletion of Condition No. 7 which pertains to the installation of
curb and gutter, curb cuts, and tie-in paving along Irontree. The ap-
plicant was requesting deletion as he felt these improvements were not
necessary at this time and felt they should be installed when that por-
tion of the project was developed.
Don Shayler, engineer for the project, stated he was requesting (on behalf
of the applicant) the deletion of Condition No. 5, reference roof top air
conditioning units being prohibited. He further stated that the roof top
air conditioners would be fully screened.
A short discussion ensued and the Commission agreed with staff reference
the deletion of Condition No. 7. The Commission further agreed with the
deletion of Condition No. 5, as long as the developer screened the roof
top air conditioning units in an architecturally integrated means.
Case No. IOSA - Mr. Fleshman stated that this case had been before the
Design Review Board several times.
The Commission, after a short discussion, agreed with staff to add the
following conditions to the list of conditions of approval:
"6. The Sign is to be moved down one space from the top."
Case No. 45MF - There was a brief presentation of this case by Mr. Fleshman.
The Commission decided that sidewalks should be installed on all three sides
of the subject property, along the full frontage of said property.
Commissioner Van de Mark stressed the strong need for an established side-
walk policy and requested that this item be added to the agenda for the
joint Council/Commission meeting. The Commissioners concurred with her
suggestion.
Commissioner Kelly made a motion to approve Planning Commission Resolution
No. 169, with the above -noted changes and corrections. Chairman Wilson
seconded the motion; motion carried unanimously.

1. The development of this project shall conform substantially
to the requirements of Case No. TUP 04-76 and to all develop-
ment plans submitted in behalf of this case (Exhibits A-P),
and as revised according to Design Review Board and Planning
Commission action. Any minor change requires approval by
the Director of Environmental Services. Any substantial change
requires approval by the Design Review Board Process.
2. All requirements of any law, ordinance, or regulation of the
State, City, and any other applicable government entity shall
be complied with as part of the development process.
3. This approval is applicable, subject to the development of
this project, commencing within one year from approval date and
being promptly completed.
4. All service lines for utilities shall be placed underground.
5. Roof top air conditioning equipment shall be permitted only
if screened by means architecturally integrated with the
building.
6. Final construction plans, including landscaping, irrigation
trash storage, exterior lighting, and signage plans, shall
be submitted to the Design Review Board Process for approval.
7. Elevations are approved as shown.
8. Sewer hookup for the sales building shall be made if mains
exist within 200 feet of the property.
9. Proposed flag poles shall be deleted.
10. Required sign plans shall also include all proposed directional
signs.
AGREEMENT
I accept and agree, prior to the use of this permit or approval,
to comply with all the conditions set forth, and understand that
the Department of Building and Safety will not issue a permit or
allow occupancy on the use permitted until this signed confirmation
has been received by the Department of Environmental Services.

at this time, upon receiving and considering all
testimony and arguments, if any, of all persons who desired to
be heard, said Commission did find'sufficient facts and reasons
to exist to approve the Design Review Board actions of August 10,
1976.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert as follows:
1. That the above recitations are true and correct and con-
stitute the findings of the Commission in this case;
2. That it does hereby approve the Design Review Board
actions of August 10, 1976;
3. That Case No. 45MF, Condition No. 13 is modified to read:
"A six-foot wide concrete sidewalk built to City standards shall
be constructed along the full frontage of the subject property
on Highway 74 frontage road, Ocotillo Drive, and Verba Santa
Drive."
4. That Case No. 42MF, Condition No. 5 is amended to "Roof
top air-conditioning equipment shall be permitted when architec-
turally screened and integrated with the building; that Case
No. 42MF, Condition No. 7 is deleted.
5. That Case No. 39MF, Condition No. 7 is amended to
"Perimeter screening in the form of fencing and landscaping
shall be provided as required by CUP-03-75. Landscape hedges
shall be provided adjacent to chain -link fences;" and the Case
No. 39MF, Condition No. 12 is amended to "The date palm character
shall be particularly emphasized around the perimeter of the
project. Trees other than date palms or grapefruit trees shall
be used within the cul-de-sac drives, except for the two (2) cul-
de-sacs immediately east of Portola Avenue. The revised land-
scape plan (showing new tree species and plant sizes) shall be
submitted to the Department of Environmental Services for approval
prior to issuance of building permits.
PASSED, APPROVED, and ADOPTED at a regular meeting of the
Planning Commission of the City of Palm Desert, held on the
17th day of August, 1976, by the following vote, to wit:
