condominium subdivision on an approximate 8.94-acre parcel
located in the PR-7,S.P. District and situated northerly of
and adjacent to the intersection of Park View Drive and Fair-
haven Drive.
Mr. Williams again recommended a continuance due to the Commission's pre-
vious action on the Development Plan for this project since the Zoning
Ordinance requires that a development plan be acted on prior to action
on the tract map.
Chairman Wilson opened the Public Hearing and asked the applicant if
he was in agreement with the continuance.
Mr. Gittelson stated the continuance was acceptable and he was sure
that the matters could be resolved between the staff and himself.

VII. OLD BUSINESS
A. CASE NO. 52MF DEEP CA14YON LTD., APPLICANT
Request for approval of design review of a 200-unit condominium
development located in the PR-5,N District and situated at the
southwest corner of the intersection of Deep Canyon Road and
44th Avenue.
Mr. Williams stated that this case was related to the development plan and
tract map (DP 02-77 and TT 9144) for which the Planning Commission had ap-
proved the request for withdrawal made by the applicant. Therefore, staff
was recommending that the Commission also accept the request for withdrawal
on this case to allow for a re -design of the project. .
Chairman Wilson asked if there were any questions. There were none.
Commissioner Kelly moved, and Commissioner Mills seconded, that the Planning
Commission accept, without prejudice, the applicant's request for withdrawal on
Case No. 52MF; motion unanimously carried.
VIII. NEW BUSINESS
A. CONSIDERATION OF REQUEST BY THE COACHELLA VALLEY COUNTY WATER DISTRICT
FOR DETERMINATION OF COMPLIANCE TO THE CITY'S GENERAL PLAN FOR PROPOSED
CONSTRUCTION PROJECT CONSISTING OF A 900-FOOT EXTENSION OF DOMESTIC
WATER DISTRIBUTION MAIN IN IRONWOOD STREET, VERBA SANTA DRIVE, AND
BETWEEN VERBA SANTA AND OCOTILLO DRIVES.
Mr. Williams explained to the Commission that staff did find these projects
to be in conformance with the Palm Desert General Plan and, therefore, recom-
mended Planning Commission adoption of Resolution No. 220, approving same.
Being no questions of staff, Chairman Wilson asked the Commission for their
feelings. Commissioner Reading moved that the Planning Commission adopt Resolution
No. 220. Commissioner Mills seconded the motion; motion unanimously carried.

Subject matter was reviewed and discussed February 24th by the Indian Wells
Planning Commission. Their recommendations are being forwarded to our
City Council for their March 3, 1977 meeting.
The Indian Wells Planning Commission's consensus of opinion is as follows:
1) Development Plan 02 -77 appears acceptable as proposed.
2) Tract 9144, which is coincident to the Indian Wells City limit, caused
four items to be presented to the Palm Desert Planning Commission
for their consideration.
(a) Subject property is a portion of the proposed Indian Wells
flood control system. Tentative plans require a channel,
300 feet in width, to occupy space at the western limits
of the City of Indian Wells. (150' in City of Palm Desert --
1501 in City of Indian Wells)
(b) Increase dwelling size from 1600 to 2000 square feet to
be compatible with Indian Wells requirements,
(c) Density should not exceed 3. 6 units per acre.
(d) Screening, on the east side of Tract 9144 shall consist of
either landscaping or block wall.
We will forward to you the City Council comments as soon as they are available.

PALM DESERT PLANNING COMMISSION SPECIAL MEETING
Commissioner Reading moved that the Planning Commission adopt Resolution
No. 213, as recommended by staff. Commissioner Mills seconded the motion;
motion unanimously carried.
VII. OLD BUSINESS

VIII. NEW BUSINESS
A. Consideration of a Proposed City Council Resolution amending the
EIR procedures.
Mr. Williams explained the request to the Commission and stated
that sweeping changes had been made to the entire Environmental
Impact Report (EIR) procedures. Therefore, staff was recommending
approval to the City Council of the resolution pertaining to the
amendment of the EIR procedures.
Chairman Wilson asked if there were any questions of staff at this time.
Being none, he asked the Commission for their feelings on the matter.
Commissioner Mills moved that the Planning Commission adopt Resolution
No. 214, as recommended by staff. Commissioner Reading seconded the
motion; motion unanimously carried.
IX. DESIGN REVIEW BOARD ITEMS
A. Review of Cases approved at the Design Review Board meetings of
January 11, 1977 and January 19, 1977.
Mr. Williams stated that before getting involved in the Design
Review Board items, staff was recommending continuance of Case
No. 52MF as it was related to Case No. DP 02-77, which the Plan-
ning Commission had just continued to the March 1, 1977 meeting.
Further, staff was recommending a continuance of Case No. 23SA
to the meeting of February 15, 1977, as the applicant was not able
to be present at tonight's meeting.
Mr. Williams then asked Mr. Fleshman to present the remaining
Design Review Board cases.
The first case presented by Mr. Fleshman was Case No. 46C and he
explained to the Commission that this was a request for preliminary
approval of a 160-room resort hotel development for ROBERT GOODEN.
Mr. Fleshman gave a detailed description of the project. Said de-
scription included a presentation to the Commission of the elevations
and colors & materials board.
Commissioner Berkey asked about the roofing material.
Mr. Urrutia explained that the roofing material was metal with an
enamel finish, a flat finish, and traditional architecture (turned
roof).

CONDITIONS OF APPROVAL
CASE NO. 52MF
1. The development of the property shall conform substantially with that
as shown on plot plan marked Exhibits A-G, on file with the Department
of Environmental Services, Case No. 52MF, unless otherwise amended by
the following conditions.
2. Prior to the issuance of a building permit, for any condominium structure,
a subdivision shall be recorded conforming substantially with said Exhibit
A.
3. Prior to the issuance of a building permit for construction of any use con-
templated by this approval, the applicant shall first obtain permits and/or
clearance from the following public agencies:
County Dept. of Public Health Department of Fire Protection (Indio)
County Road Department Coachella Valley County Water District
Palm Desert Planning Commission Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above agencies shall be pre-
sented to the Building and Safety Department at the time of the issuance of
a building permit for the use contemplated herewith.
4. Final landscaping; grading, lighting, fencing, amenities, trash storage,
walkway layout, and irrigation plan shall be submitted through the Design
Review Board Process. The building permit when issued shall include the
grading, lighting, amenities, trash storage, walkways, swimming pool equip-
ment, and irrigation systems. No final inspection or occupancy shall be
given by the Department of Environmental Services to this project until the
aforementioned approved plans and construction shall have been completed.
5. The following Fire Protection Requirements shall apply:
The applicant shall conform to all requirements and improvements deemed
necessary by the Riverside County Department of Fire Protection and
Planning and the City of Palm Desert.
6. Construction of the development permitted hereby may be done progressively
in stages, provided adequate vehicular access is constructed for all dwel-
ling units and further provided that such stage development conforms sub-
stantially with the intent and purpose of this approval, and that the re-
creation facilities and off-street automobile parking be completed as a
part of Phase I.
7. The sewage disposal system shall be submitted to and approved by the Coachella
Valley County Water District prior to issuance of a building permit.
8. This approval shall be used within one (1) year after final proceedings before
the City Council, otherwise it shall become null and void and of no effect
whatsoever. By "use" is meant recordation of a subdivision map and beginning
of construction of a portion of the project.
9. Prior to the effective date of any City Council approval of this tract, the
applicant shall agree in writing to all conditions of approval.
AGREEMENT
I accept and agree, prior- to use of this permit or approval, to comply with all the
conditions set forth, and understand that the Department of Building & Safety will
not issue a building permit or allow occupancy on the use permitted until this
signed confirmation has been received by the Department of Environmental Services.

DESIGN REVIEW BOARD PROCESS
SINGLE-FAMILY HOMES and similar projects require 2-4 working days before they may
be submitted to the Building and Safety Division for plan check.
MULTI -FAMILY, COMMERCIAL, and other projects that must be reviewed by the D.R.B.
and Planning Commission usually require 10-20 days.
In order to facilitate processing, the applicant or a designated representative
should attend the review hearings to answer questions which may arise regarding
the project.
MANDATORY FINDINGS:
No project may be approved unless:
- The proposed development conforms to any legally adopted development standards.
- The design and location of the proposed development and its relationship to
neighboring, existing or proposed developments and traffic is such that it
will not impai'v the desirability of investment or occupation in the neighbor-
hood; and that it will not unreasonably interfere with the use and enjoyment
of neighboring, existing or proposed developments, and that it will not create
traffic hazards or congestion.
- The design and location of the proposed development is in keeping with the
character of the surrounding neighborhood and is not detrimental to the har-
monious, orderly, and attractive development contemplated by the Zoning Or-
dinance and the adopted General Plan of the City.
- The. design and location of the proposed development would provide a desirable
environment for its occupants, as well as for its neighbors and that it is
aesthetically of good composition, materials, textures and colors.
- The proposed use conforms to all the requirements of the zone in which it is
located and all other applicable requirements.
The overall development of the land shall be designed to ensure the protection
of the public health, safety, and general welfare.
DEVELOPMENT STANDARDS:
Each project will be reviewed on the basis of its conformance to the following
adopted development standards. In those areas determined by the D.R.B. to be
"unacceptable", it is the responsibility of the applicant to redesign that por-
tion of the project.
I. TERRAIN CONTROL STANDARDS UNACCEPTABLE
A. Terrain and soils shall be structurally stable and suitable
for development.

B. (Water Erosion) Property to be developed shall be protected
against drainage runoff from adjacent properties.
C. (Water Erosion) Drainage runoff produced by property and
development therein shall be contained on the property or
allowed to drain onto adjacent public streets or allowed to
drain by other City approved means.
D. (Wind Erosion) Property to be developed shall be protected
against wind carried deposits from adjacent areas.
E. (Wind Erosion) Property to be developed shall,.upon com-
pletion, produce no appreciable wind carried deposits on
adjacent properties. Suitable soil stabilization shall be
provided.
F. Curb and gutters shall be provided where required to control
and regulate drainage.
II. ACCESS & CIRCULATION STANDARDS
A. Safe & convenient vehicle access to property and development
therein shall be provided.
B. Safe and convenient pedestrian access to, property and
development therein shall be provided.
C. Circulation plans (auto, bicycle, and pedestrian) shall
conform to municipally developed circulation plans for
the vicinity and immediate area.
III. SITE PLANNING STANDARDS
A. Site Planning shall occur in a manner which minimizes obstruc-
tion of scenic views from adjacent properties.
B. Site Planning shall be compatible with existing terrain.
C. Site Planning shall occur in a manner which does not expose
unattractive areas or activities to the detriment of adjacent
properties.
D. Site Planning shall occur in a manner in which asphalt or
concrete is minimized.
E. Avoid unnecessary impediments for handicapped persons.

IV. UTILITY & EQUIPMENT STANDARDS
A. All service utility lines shall be placed underground.
B. All control panels, vaults and necessary equipment
shall be architecturally screened or landscaped or other-
wise concealed from public view.
C. All air conditioning and ventilation equipment shall be
located and screened in a manner to prevent exposure to
public rights -of -way and adjacent properties.
V. VEHICLE PARKING STANDARDS
A. Off-street parking should be located in proximity to
facilities) it serves.
B, Parking areas should be screened from view wherever possible
by means of berms, garden walls and landscaping.
C. Parking areas shall be shaded where practical.
D. Carports for apartment developments shall not front onto a
public right-of-way.
E, Garages should be encouraged not to front onto a public
right-of-way.
F. All parking areas for recreational and accessory vehicles
and trailers shall be architecturally screened or landscaped
or otherwise concealed from public view.
G. Adequate handicapped parking spaces shall be provided.
VI. ARCHITECTURAL STANDARDS
A. A singular architectural theme shall be applied to a given

E. Architectural design shall employ materials and colors which
are compatible and complementary to the desert area.

F. Architectural design shall incorporate provisions for signage
(if applicable) as an integrated part of the overall design.
G. Architecture and landscaping shall be co-ordinated and com-

H, All air conditioning, exhaust, and ventilation, accessory
mechanical and electrical equipment and control panels shall
be located and screened in a manner to prevent exposure to
public rights -of -way and adjacent properties.
VII. LANDSCAPING STANDARDS
A, Landscaping shall be an integral part of the site planning
and architectural design on all projects.
B. Provisions for the adequate maintenance and irrigation of
landscaping shall be made through the use of underground
irri•,.tion systems.
C. Landscaping, walls and fences shall not create unsafe conditions
along public rights -of -way,
VIII. LIGHTING, IDENTIFICATION & SIGNAGE STANDARDS
A. Signage shall be architecturally integrated with the structure
involved.
B. Signage shall be of colors compatible and complementary to
the structure it relates to and to other dev pment in
its surroundings.
C. No lighting of signage shall exceed an output of 10 candle-
power at 10 feet,
D, Signage for commercial uses shall be for identification pur-
poses only,
IX. FENCING, SCREENING & ENCLOSURE STANDARDS
A. Materials and colors of fences and walls shall be compatible
and complementary to the structures with which they relate.
B. Fences, walls, and enclosures shall be handled as an integrated
part of the architecture and landscaping.
C. Outside service and storage areas, where permitted, shall be
enclosed and screened.
