This landscaping plan along with a landscaping plan for the final phase
to the South was reviewed by the Board at its meeting of May 8, 1979.
At that time, the landscaping plans for the two areas were rejected
due to a lack of detail and poor design.
The applicants have submitted a revised landscaping plan for the area
Fast of San Luis Rey North of Juniper Circle. This plan is vastly
improved but does not show existing landscaping on the site.
STAFF RECOMMENDATION:
Approve final landscaping plan, subject to the following revisions:
1. Retain all existing trees on site.
2. Provide vines outside of perimeter wall along San Luis Rey
Avenue.
3. Increaee all trees on site to rinimum 24" box size with
exception of Eucalyptus trees.
4. Provide additional 24" box size trees and 5 gal. shrubs on
outside of wall along San Luis Rey Avenue.

III. CASES
Case No. 92C - Ballew/McFarland Architects for Los Sombros
Restaurant Park - Final working drawings for commercial
buildings "A", "B", and Restaurant "R-4"; Applicant was
present.
The Board and Staff discussed recommended revisions to the
conceptual and final landscaping plans submitted for the
site and Rusty Pelican Restaurant.
On a motion by Williams, seconded by Barton, the Board
approved this item subject to the following revisions:
1. No building permit for buildings "A"., "B", and
Restaurant "R-4" shall be issued until a final
landscaping plan for the entire site is approved.
2. Provide large boulders on mounded landscaped area
along Hwy. 111.
3. Upgrade all Eucalyptus Trees to a minimum 15 gal.
size.
4. Replace Washingtonia Filifera with Washingtonia
Robusta in landscaped area adjacent to commercial
buildings.
5. Along Hwy. 111, provide alternate to Pinus.Halepensis
(possibly utilizing Pinus Eldarica or Pinus Carariensis).
6. Within larger parking lot area on southeasterly portion
of site provide 5 additional tree wells in area where
sparcely indicated.
7. Along Hwy. 111 frontage, reduce numbers of. Eucalyptus
Rudis and mix in 24" box size Sterculia Diversifolia.

Case No. 68 MF - Palm Desert Venture, Ltd. - Final land-
scaping plan for phase presently under construction on the
east side of San Luis Rey Avenue, north of Juniper Circle;
Applicant was not present.
During the Study Session, the Board recommended changes
to the submitted landscaping plan. On a motion by Williams,
seconded by Barton, the Board approved this item subject
to the following revisions;
1. Retain all existing trees on site.
2. Provide Boston Ivy on outside of perimeter wall along
San Luis Rey Ave.
3. Provide one additional 24" box size California Pepper
Tree on outside of wall along San Luis Rey Ave. per
plan on file in the Department of Environmental
Services.

Please be advised that storage is provided in all units
at Shadow Mountain Resort & Racquet Club. This item was
brought up at Phase I of our Courtyard Villa development.
It was discussed at that time and agreed that storage was
in fact provided and we were not required to build storage
cabinets.

It was moved by Jackson, seconded by Crump,'that the minutes of April 24, 1979
be approved as written; carried 2-0-2 (AYES: Jackson, Johnson;

II. It was moved by Jackson, seconded by Urrutia, to approve the following case
reviewed in Study Session and found acceptable:
Case No. 170 MF (Amendment) - LEWIS HOMES - Subject to providing additional
tree to match adjacent tree, in front of area where fence is shown to be
visible from Highway 74.
III. CASES:
Case No. 43 MF - DESTINATION RESORT CORP. (SHADOW MOUNTAIN RESORT AND
RACQUET CLUB) - Final landscaping plans for phase presently under con-
struction and future phase, on the east side of San Luis Rey Avenue at
Juniper Circle. The Applicant was not present.
The Board discussed the plans reviewed during the Study Session, and found
then to be inadequate. The Board felt that a more professionally designed
landscaping plan should be submitted, incorporating the following features:
1. The plot plan should be detailed indicating buildings, walkways,
fountains, swimming pools, walls, berming, and existing landscaping,
etc.
2. Utilizing existing landscaping, create landscaping thane through
incorporation of new landscaping.
3. Utilize more Palm trees in design.
4. Give particular attention to landscaping adjacent to San Luis Rey
in order to achieve well designed planting.
On a motion by Leung, seconded by Jackson, the Board moved to continue
this case for further restudy as stated above; carried 3-0-1 (AYES: Johnson,
Jackson, Leung; ABSTAIN: Urrutia).
Case No. 72 C (Amendment) - DANIEL DWORSKY, FAIA, FOR COLUMBIA SAVINGS &
LOAN ASSOC. - Amendment to sign program for Savings & Loan building, located
on the southwest corner of Highway 111 and Highway 74. Applicant was not
present.
The Board reviewed the sign can and colors submitted by the applicant. After
extensive discussion regarding sign can and plexiglass colors, the Board
determined that further clarification was necessary.
On a motion by Urrutia, seconded by Leung, the Board moved to continue this
case for restudy with the following items to be submitted:
1• Sign cabinet samples without the back installed, utilizing the submitted
"red" color and a color which would be darker than the "red" but lighter
than the maroon sign cabinet color.

certain requirements were stipulated (see attached).
STAFF RECOMMENDATION:
Approve final construction drawings subject to the following:
1. Comply with all conditions of DP 06-77.
2. Obtain approval of final landscaping plan prior to issuance
of a Building Permit.
3. Provide overhead storage in carports (as required May 20, 1979).
Case No. 111 C - WELLS FARGO BANK.(John Outcault, Architect) - Approval
of preliminaryplans for construction of a bank building located on the
southwest corner of E1 Paseo and Lantana. Applicant's representative
present:
The Board reviewed a revised site plan for the site and was also presented
a further 'revision prepared by the applicant. Discussion followed
relative to planter desiqn and the need for landscape material to soften
the building elevations. Board recommendation for revisions to the
preliminary site pyan were recorded on the plan in the file of the
Department of Environmental Services.
Motion was made by Urrutia, seconded by Barton, to approve preliminary
plans subject to the fo�lowing revisions:
1. Submit revised site plan reflecting the notations on the plan in
the file of the Dept. Environmental Services, with the construction
drawings.
2. Provide Ordinance requirement for six foot distance from property
line to parking stall by increasing planter width in the southeast

reviewed in terms of plant material and selecti of trees. The Board
noted that several revisions to the landscaping plan would be necessary.
Motion was made by Urrutia, seconded by Barton, to approve preliminary
and final construction drawings, subject to the following revisions:
1. Provide revised final landscape plan for Staff approval incor-
porating the notations contained on the plan in the file of the
Department of Environmental Services.

Approvai of final construction drawings and revised wall detail for the final

The Board reviewed the details of the construction site plan and pro-
posed wall amendments. Previous conditions of approval for Development Plan
06-77 .. were also noted and it was found that they had generally been
complied with.
On a motion by Leung, seconded by Barton, the Board approved final
construction drawings for the 29 unit phase and revised project wall
detail, subject to the following:
1.-, That all conditrions of Development Plan 06-77 be met; and that
all conditions of the original Design Review be met, with specific
attention to condition No. 9, requiring final landscape plan
submittal.
2. That carport structures for building No. 9 be erected prior to
the request for granting an occupancy permit.
3. Provide overhead storage cabinets in carports.

CONDITIONS OF APPROVAL
CASE NO. 68 MF
1. The development of this project shall conform substantially to all require-
ments of DP-06-77 and to all development plans submitted in behalf of this
case (Exhibit A-E), and as revised according to Design Review Board action.
Any minor changes require approval by the Director of Environmental Services.
Any substantial change requires approval by the Design Review Board Process.
2. All requirements of any law, ordinance, or regulation of the State, City, and
any other applicable government entity shall be complied with as part of the
development process.
3. This approval is applicable, subject to the development of this project,
commencing within one year from approval date and being promptly completed.
4. All service and distribution lines for utilities shall be placed underground.
5. No roof top air conditioning equipment shall be permitted.
6. Curb, gutter, curb cuts, and tie-in paving shall be provided for by means of
installation. Construction shall conform to City standards.
7. Elevations are approved as shown.
8. The applicant shall comply with all fire flow requirements specified by the
Palm Desert Fire Marshall.
9. Final construction drawings, including but not limited to landscaping,
irrigation, fencing, trash storage, and exterior lighting plans, shall be
submitted for ORB process approval prior to the submittal of plans for build-
ing permits. All requirements of the final approval shall be made a part of
construction.
AGREEMENT
I accept and agree, prior to the use of this permit or approval, to comply with all
the conditions set forth, and understand that the Department of Building and Safety
will not issue a building permit or allow occupancy on the use permitted until this
signed confirmation has been received by the Department of Environmental Services.

CONDITIONS OF APPROVAL
CASE NO. DP 06-77
I. STANDARD CONDITIONS
1. The development of the property shall conform substantially with that
as shown on plot plan and related Exhibits A-E, on file with the De-
partment of Environmental Services, Case No. DP 06-77, unless other-
wise amended by the following conditions.
2. Prior to the issuance of a building permit, for any condominium structure,
a subdivision shall be recorded conforming substantitally with said
Exhibits A-E.
3. Prior to the issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following public agencies:
County Department of Public Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above agencies shall be
presented to the Department of Building and Safety at the time of the
issuance of a building permit for the use contemplated herewith.
4. A landscaping, grading, lighting, amenities, trash storage, walkway
layout, and irrigation plan shall be submitted through the Design
Review Board Process. The building permit when issued shall include
the grading, lighting, amenities, trash storage, walkways, swimming
pool equipment, and irrigation systems. No final inspection or oc-
cupancy shall be given by the Department of Environmental Services
to this project until the aforementioned approved plans and construc-
tion shall have been completed.
5. The applicant shall conform to all requirements and improvements
deemed necessary by the City Fire Marshal, per attached interoffice
memorandum.
6. Construction of the development permitted hereby may be done pro-
gressively in stages, provided adequate vehicular access is constructed
for all dwelling units and further provided that such stage development
conform substantially with the intent and purposes of this approval for
the provision of open areas, recreation facilities, park dedication,
and off-street automobile parking.
7. The sewerage disposal system and flood control considerations shall be
submitted to and approved by the Coachella Valley County Water District
prior to issuance of a building permit.
8. This approval shall be used within one (1) year of this action, otherwise
it shall become null and void and of no effect whatsoever. By "use" is
meant recordation of a subdivision map and beginning of construction of
a portion of the project.
9. Prior to utilization of this Development Plan, the applicant shall agree
in writing to any conditions of approval.
10. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in addition
to all requirements, limitations, and restrictions of all municipal
ordinances and State and Federal statutes now in force, or which here-
after may be in force.

II. SPECIAL CONDITIONS:
1. The applicant shall underground all existing overhead utility distri-
bution lines on or immediately adjacent to the property on San Luis
Rey Avenue.
2. A masonry wall or landscape berm with equivalent noise abatement
capabilities shall be required along the full frontage of San Luis
Rey except for approved openings site, design, and materials as
approved by the Design Review Board process.
3. A private patio or yard area of at least three hundred and twenty

I. STANDARD CONDITIONS
1. The development of the property shall conform substantially with that
as shown on plot plan and related Exhibits A-E, on file with the De-
partment of Environmental Services, Case No. DP 06-77, unless other-
wise amended by the following conditions.
2. Prior to the issuance of a building permit, for any condominium structure,
a subdivision shall be recorded conforming substantitally with said
Exhibits A-E.
3. Prior to the issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following public agencies:
County Department of Public Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above agencies shall be
presented to the Department of Building and Safety at the time of the
issuance of a building permit for the use contemplated herewith.
4. A landscaping, grading, lighting, amenities, trash storage, walkway
layout, and irrigation plan shall be submitted through the Design
Review Board Process. The building permit when issued shall include
the grading, lighting, amenities, trash storage, walkways, swimming
pool equipment, and irrigation systems. No final inspection or oc-
cupancy shall be given by the Department of Environmental Services
to this project until the aforementioned approved plans and construc-
tion shall have been completed.
5. The applicant shall conform to all requirements and improvements
deemed necessary by the City Fire Marshal, per attached interoffice
memorandum.
6. Construction of the development permitted hereby may be done pro-
gressively in stages, provided adequate vehicular access is constructed
for all dwelling units and further provided that such stage development
conform substantially with the intent and purposes of this approval for
the provision of open areas, recreation facilities, park dedication,
and off-street automobile parking.
7. The sewerage disposal system and flood control considerations shall be
submitted to and approved by the Coachella Valley County Water District
prior to issuance of a building permit.
8. This approval shall be used within one (1) year of this action, otherwise
it shall become null and void and of no effect whatsoever. By "use" is
meant recordation of a subdivision map and beginning of construction of
a portion of the project.
9. Prior to utilization of this Development Plan, the applicant shall agree
in writing to any conditions of approval.
10. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in addition
to all requirements, limitations, and restrictions of all municipal
ordinances and State and Federal statutes now in force, or which here-
after may be in force.

A. Review of cases acted on by the Design Review Board at
their meeting of September 20, 1977.
Mr. Williams reviewed cases 111SA, 83MF, 87MF, 59C, noting that
a late response was received from the City of Indian Wells in
reference to Case 83MF recommending a channel down eastside of
the tract. Chairman Berkey asked if the applicant would be
required to join an assessment district. Mr. Cook noted that
it was not within the Cook Street alignment. Mr. Williams
noted that he mentioned the response received from City of
Indian Wells just for the record and that the Conditions of Ap-
proval covered the assessment district question.
Mr. Freed reviewed Case No. 68MF pointing out the treatment
along San Luis Rey including the berming and elevations. Com-
missioner Reading questioned the visibility for vehicles on
the road. Commissioner Snyder noted the plans were not ac-
curate with regard to the road and its location. Some discussion
followed regarding the roads, drainage channel, landscaping
on streets as pointed out by Commissioner Reading.
Case No. 59C was discussed further and Chairman Berkey asked
if the applicant would tell the Commission of some of the
features of his project.
CHARLES MARTIN, 73-612 Highway 111, told the Commission
of the sprawl type development he was proposing and noted
that most of the area was covered with parking. He also
noted the advantages of the solar energy concept he had
proposed.
The Commission commended Mr. Martin for his solar energy con-
cept and the underground parking, both needed in our community. Com-
missioner Kryder noted the ultra modern outside archectural treatment
was not compatible to the surroundings. The Commissioners agreed
that they appreciated the idea but hoped the applicant would bring in
anpther concept for the outside architectural treatment. The Commission
a 'roved the following cases 111SA, 83MF, 87MF, 68MF by Planning Commis -
on Resolution No. 289; motion by Commissioner Snyder, seconded by Com-
sioner Reading, carried unanimously (5-0). Case No. 59C was con-
r inued to a the October 19th meeting; motion by Commissioner Kelly,
a econded by Commissioner Kryder, carried unanimously (5-0).

Mr. Williams asked that the Commissioners advise the secretary
of the dates they could attend a Design Review Board meeting as planned
at the joint meeting with the DRB. Each Commissioner took a Hate cover-
ing meetings through December 6, 1977.
X. DISCUSSION ITEMS
A. Discussion regarding a possible amendment to the By-laws of
the Planning Commission relative to the Secretary's powers
to present last minute items to the Commission.
Mr. Williams noted that the Planning Commission is supposed to
be notified of any items referred back from City Council at their next
meeting. He then asked if there was any discussion at this time. The
Commission agreed that there was no need for a change in the By-laws.

6. Case No. 59C - CHARLES MARTIN - Review of preliminary plans for a new com-
mercial office building on the south side of Highway 111, east of Panorama
Drive. The applicant, Mr. Martin, was present.
The board expressed its approval to Mr. Martin for seeing something dif-
ferent and refreshing in Palm Desert. Mr. Urrutia also said that he was
happy to see a building with underground parking being designed. Mr. Hill
pointed out that the building code would require a second stairway and pro-
hibit an opening in the west wall since it was adjacent to the property line
and did not conform to fire protection requirements. Mr. Martin indicated
that a building might not be placed on the other side of the property line.
He agreed to work out this item and the paving of the parking area with Mr.
Hill. It was moved by Hobbs and seconded by Urrutia to approve the concept
subject to 10 conditions with a revised color scheme to delete Condition
No. 5 dealing with roof mounted equipment (since the building would have
solar water panels), and to have the applicant resolve the wall opening
and paving requirements with Mr. Hill. Motion carried 4-0 (Johnson, Hobbs,
Urrutia, Minturn).
7. Case No. 68MF - PALM DESERT VENTURE, LTD. - Review of final construction
plans for 15 condo units located east of San Luis Rey and south of Shadow
Lake Drive in the Shadow Mountain Resort and Racquet Club project. Frank
Urrutia, project architect, represented the applicant.
Since the plans were in conformance to the preliminary approval, it was moved
that the case be approved by Hobbs and seconded by Minturn. Motion carried
3-0 (Hobbs, Minturn, Johnson) Urrutia abstained.
8. Discussion of Proposed Agenda for Joint Planning Commission -Design Review
Board meeting of September 29, 1977.
Urrutia and Minturn thought that there was some possibility that they might
be unable to attend a meeting on that date. Hobbs suggested that the staff
be sure to invite the new ORB member. It was also agreed that the meeting
should be held at 4:30 rather than 7 p.m.
Mr. Williams suggested that the ORB discuss a method of speeding up the review
process. It would involve having only the ORB review final construction plans.
Hobbs agreed and suggested that signs over $1000 in value be reviewed by only
the DRB. He felt that this was feasible because of the relatively simple,
appeal process for ORB cases. Mr. Williams also thought that they should dis-
cuss combining the ORB review of the preliminary plans with the Planning Com-
mission review of the Development Plan or Conditional Use Permit so that the
Planning Commission would have the DRB's comments before it acted. Hobbs
thought that the entire agenda could consist of just item D - Possible ways of
improving the efficiency and effectiveness of,the design review process.
The other ORB members agreed.
9. ADJOURNMENT
Prior to ending the meeting, Bill Hobbs expressed his enjoyment at having
served on the ORB with the other members. Chairman Johnson thanked Mr. Hobbs
for his contributions and indicated that his presence would be missed. It was
moved by Hobbs and seconded by Minturn to adjourn. Motion carried unanimously
and the meeting ended at 6:12 p.m.

A. DISCUSSION OF PROPOSED C.V.C.W.D. WATER LINE EXTENSIONS
Mr. Williams reported that this was a proposal from the Coachella Valley
County Water District to construct 1,000 lineal feet of water line in
State Highway Ill from Deep Canyon Road to Shadow Hills Road and 550
lineal feet of water line in Sage Lane between El Paseo and Tumbleweed
Lane. The staff had found the project proposed to be constructed by the
Water District to be in compliance with the adopted Palm Desert General
Plan and recommended approval by Planning Commission Resolution No. 245.
Commissioner Kelly moved, and Commissioner Reading seconded, to approve
Planning Commission Resolution No. 245; motion unanimously carried.
XI. DESIGN REVIEW BOARD ITEMS

9. Final construction drawings, including but not limited to landscaping,
irrigation, fencing, trash storage, and exterior lighting plans, shall be
submitted for DRB process approval prior to the submittal of plans for build-
ing permits. All requirements of the final approval shall be made a part of

1. The study session of the Design Review Board began at 4:45 p.m. in
the Council Chambers in the Palm Desert City Hall. The purpose of
this study session was to review the cases on the agenda.

After a one half hour study session, the meeting was called to order at
5:15 p.m. Mr. Freed informed the Board that the Minutes of their April
12, 1977 meeting would be reviewed at the next meeting.
2. CASE NO. 61MF - 0. M. HOMME
Request for approval of final construction plans for a duplex to be
located at the northeast corner of Pitahaya and Shadow Mountain Drive.
Applicant present.
The discussion of the case centered around the landscaping. The Board
requested that the applicant provide additional low shrubs adjacent to
the structure. Mr. Johnson suggested several varieties of plants that
might accomplish the intended purpose. The applicant assured the Board
that he intended to provide additional plants on the site; that those
indicated on the plan were only the minimum he intended to use.

The applicant was requested to provide trees south of the structure in
order to integrate this area with the entire site. The drainage pond
in the rear was then discussed with the applicant indicating that the
pond was intended to serve as an architectural focus. Even though there
will seldom be water in the pond, it will have an attractive appearance
as it will be lined with gravel and rocks. The Board indicated that
they were pleased with the way in which the overall plan had been up-
graded.
A motion was made by Mr. Minturn and seconded by Mr. Leung that the pre-
liminary site, floor, and elevation plans be approved subject to compli-
ance with conditions. Motion carried 4-0(Hobbs, Minturn, Johnson, Leung).
4. CASE NO. 28C, HENRY TAGLE
Request for approval of final construction plans for a restaurant to be
located at the northwest corner of De Anza Way and Palm Desert Drive.
Discussion of the case focused on the location of the project, parking, and
the basic layout. Staff indicated that the applicant has a variance for
parking and setback requirements. The Board added Condition No. 17 which
requires that the applicant relocate the trash.enclosure to a more accessible
location.

It was moved by Mr. Minturn and seconded by Mr. Johnson that the final

5. CASE NO. 45C, BANK OF AMERICA
This case was deleted from the agenda as the applicant had not submitted
the revised plans which were to be reviewed.
6. CASE NO. 69MF, EUCLID-BALL COMPANY
Request for approval of final construction drawings for ten single-
family residences to be constructed in Tract 4980. Applicant present.
Mr. Hobbs asked the applicant why he had opposed the height of the
pads originally required by the Board. The applicant responded by
saying that the cost would have been substantial and that there was
a problem at;the time as to where the displaced soil would have been
placed.
It was moved by Mr. Minturn and seconded by Mr. Johnson that the final
plans be approved subject to compliance with conditions. Motion carried
4-0 (Hobbs, Johnson, Minturn,.Leung).
7. CASE NO. 68MF, PALM DESERT VENTURE, LTD.
Request for approval of preliminary site, floor, and elevation plans for
a 46-unit condominium project to be located east of San Luis Rey and Juni-
per. Representative of applicant present.
The applicant's representative was informed by the Board that the proposed
circulation element would require revisions in order to assure adequate
fire and health protection. In addition, a reconfiguration of the dwelling
units would be required to provide larger rear yards for units on Juniper.
The applicant's representative was commended for having provided such a fine
plan considering the constraints involved with the nature of the site. Staff
pointed out to the DRB that the Development Plan for the project would be pre-
sented to the Planning Commission on May 3, 1977 so that the DRB would undoubtedly
be reviewing the project once again in the future. The DRB requested that the
staff present the following DRB findings to the Planning Commission:
1) The circulation element should be given strong consideration by the
Planning Commission.
2) The Planning Commission should consider a possible reduction in the number
of permitted units and/or a reconfiguration of the units.

relative to planter design and the need for landscape material to soften
the building elevations. Board recommendation for revisions to the

The Board ,reviewed the previously recommended revisions as they
applied to the site plan and elevations. The landscaping plan.was
w reviewed in terms of plant material and selection of trees. The Board
noted that several revisions to the landscaping plan would be necessary.
Motion was made by Urrutia, seconded by Barton, to approve preliminary
and final construction drawings, subject to the following revisions:
1.. Provide revised final landscape plan for Staff approval incor-
porating the notations contained on the plan in the file of the
Department of Environmental Services.

Approval of final construction drawings and revised wall detail.for the final
phase of Shadow Mountain development, located on the east side of San
Luis Rey (south of Juniper Circle). Applicant was present.
The Board reviewed the details of the construction site plan and pro-
posed wall amendments. Previous conditions of approval for Development Plan
06-77 .. were also noted and it was found that they had generally been
complied with.
On a motion by Leung, seconded by Barton, the Board approved final
construction drawings for the 29 unit phase and revised project wall
_ detail, subject to the following:
1.-. That all conditions of Development Plan 06-77 be met; and that
all conditions of the original Design .Review be met, with specific
attention to condition No. 9, requiring final'landscape plan
.submittal.
2. That carport structures for building No.'9 be erected prior to
the request for granting an occupancy permit.
3. Provide overhead storage cabinets in carports.
