Having discussed the three major concerns of the Commi�

Kelly asked about the progress on the sewer lines, to which Mr. Weeks
indicated that a majority of the proposed lines have been installed.
Chairman Berkey asked about the flood control problem, Mr. Weeks replied
that the Bechtel Report would be reviewed for all the cities involved
Friday morning, October 21st, at 9:30 a.m. at C.V.C.W.D. Chairman
Berkey asked about the importing of Colorado River water and its quality.
Mr. Weeks indicated that it costs more to treat State water than the
Colorado River water.
Commissioner Snyder complimented Mr. Weeks on his organization
and thanked him for his presentation. The Commission also thanked
Mr. Weeks for his time and his presentation.

B. Review of Landscaping Concept for Parkview Subdivision
Case No. 48MF, and the Fencing Plan for Case No. 77MF
approved by the Design Review Board at their meeting
of August 10, 1977.
Mr. Williams reviewed Case O-no g that there was a revision
of the plans for the walls on Clud along the loth tee. It
will be slumpstone painted greenthe adjacent homes.
Mr. Williams then reviewed Case No. 48AIF noting the 10 different
landscape plans for 10 different elevations. He stated that $300 would
be added to the purchase price to cover the cost of landscaping. Some
discussion followed with regard to the landscaping being done and when.
Mr. Williams indicated that the owner would have a choice of selecting
one of the landscape plans or submitting his own to the City for approval.
FRANK GOODMAN, 77-900 Avenue of the States, applicant,
spoke to the Commission noting that the owner would
not get his $300 back until the landscaping was done
if the owner chose to do it on his own.
It was moved by Commissioner Snyder and seconded by Commissioner
Reading to approve the actions of the Design Review Board by Planning
Commission Resolution No. 293; carried unanimously (5-0).

Williams noted that there would be two entrances.

CONDITIONS OF APPROVAL
CASE NO. CUP 03-73
1. The development of this project shall conform substantially to all
development plans submitted in behalf of this case (Exhibit A), and
as revised according to Planning Commission action. Any minor changes
require approval by the Director of Environmental Services. Any sub-
stantial change requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State, City,
and other applicable government entity shall be complied with as part of
the development process.
3. This approval is applicable, subject to the development of this project
commencing within one year from approval date and being promptly completed.
4. A landscaping plan (with irrigation system) shall be provided as approved
by the Design Review Board Process for installation prior to final inspec-
tion and receiving certificate of occupancy.
5. Curb, gutter, curb cuts, and tie-in paving shall be provided for by means
of installation, along San Luis Rey. Construction shall conform to City
of Palm Desert Standards.
6. Sewer hookup shall be made if mains exist within 200 feet of property.
7. A 6 foot decorative masonry wall shall be installed along the easterly and
northerly property line.
8. Heavy landscape treatment shall be installed along said wall in a manner
acceptable to the Design Review Board Process.
9. Existing tennis court lights shall be modified in a manner acceptable to
the Design'Review Board Process.
10. The existing free standing sign shall be removed before any building
permits are issued.
11. The entry at Juniper Street shall be improved with the first phase of
development.
12. Utility lines along San Luis Rey shall be placed underground.
13. Proposed parking spaces along the easterly property line of the project
shall be improved.
14. The grading along the north and east property line shall match the grades
of the adjacent R-1 lots along Shadow Lake Drive.
15. All existing and proposed tennis court lighting shall be placed on
automatic timers.
16. The two most northerly buildings shall be re -designed to provide for
a single -story limitation.
17. Parking areas shall be lighted in a manner acceptable to the Design
Review Board Process.

17. A minimum of twenty-five (25) additional parking spaces shall be provided east

anticipated increase in restaurant patrons and employees.

proposed units on the southeastern portion of the project and Fairview Cottages.
The location, design, materials, and point of transition from masonry to wrought
iron shall be approved by the Design Review Board. Said wall/fence shall be in-
stalled' prior to issuance of building permits for the adjacent new units.
20. Any and all proposed tennis court lighting shall be submitted to the Design
Review Board for approval.
21. The applicant shall comply with all of the requirements of the City Fire
Marshall per the attached letter.

1. The development of this project shall conform substantially to all require-
ments of DP-06-77 and to all development plans submitted in behalf of this
case (Exhibit A-E), and as revised according to Design Review Board action.

submitted for ORB process approval prior to the submittal of plans for build-
ing permits. All requirements of the final approval shall be made a part of
construction.
AGREEMENT
I accept and agree, prior to the use of this permit or approval, to comply with all
the conditions set forth, and understand that the Department of Building and Safety
will not issue a building permit or allow occupancy on the use permitted until this
signed confirmation has been received by the Department of Environmental Services.

CONDITIONS OF APPROVAL
CASE NO. DP 06-77
I. STANDARD CONDITIONS
0 I. The development of the property shall conform substantially with that
as shown on plot plan and related Exhibits A-E, on file with the De-
partment of Environmental Services, Case No. DP 06-77, unless other-
wise amended by the following conditions.
2. Prior to the issuance of a building permit, for any condominium structure,
a subdivision shall be recorded conforming substantitally with said
Exhibits A-E.
3. Prior to the issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following public agencies:
County Department of Public Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board 0l7
Evidence of said permit or clearance from the above agencies shall be
presented to the Department of Building and Safety at the time of the
issuance of a building permit for the use contemplated herewith.
4. A landscaping, grading, lighting, amenities, trash storage, walkway
layout, and irrigation plan shall be submitted through the Design
Review Board Process. The building permit when issued shall include
0 the grading, lighting, amenities, trash storage, walkways, swimming
pool equipment, and irrigation systems. No final inspection or oc-
cupancy shall be given by the Department of Environmental Services
to this project until the aforementioned approved plans and construc-
tion shall have been completed.
5. The applicant shall conform to all requirements and improvements
deemed necessary by the City Fire Marshals per attached interoffice
memorandum.
6. Construction of the development permitted hereby may be done pro-
gressively in stages, provided adequate vehicular access is constructed
for all dwelling units and further provided that such stage development
conform substantially with the intent and purposes of this approval for
the provision of open areas, recreation facilities, park dedication,
and off-street automobile parking.
7. The sewerage disposal system and flood control considerations shall be
submitted to and approved by the Coachella Valley County Water District
prior to issuance of a building permit.
8. This approval shall be used within one (1) year of this action, otherwise
it shall become null and void and of no effect whatsoever. By "use" is
meant recordation of a subdivision map and beginning of construction of
a portion of the project.
9. Prior to utilization of this Development Plan, the applicant shall agree
in writing to any conditions of approval.
10. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in addition
to all requirements, limitations, and restrictions of all municipal
ordinances and State and Federal statutes now in force, or which here-
after may be in force.

II. SPECIAL CONDITIONS:
1. The applicant shall underground all existing overhead utility distri-
bution lines on or immediately adjacent to the property on San Luis
Rey Avenue.
2. A masonry wall or landscape berm with equivalent noise abatement
capabilities shall be required along the full frontage of San Luis
Rey except for approved openings site, design, and materials as
approved by the Design Review Board process.
3. A private patio or yard area of at least three hundred and twenty
(320) square feet shall be provided for each dwelling unit.
4. A master trash agreement shall be developed for the total project
and enclosed trash storage areas shall be provided through the
development as approved as a part of the Design Review Board process.
5. Any proposed lighting of the tennis courts shall be approved as a
part of the Design Review Board process. In addition, as a part of
this development, the existing tennis court lighting shall be
modified to conform to the approved system.
6. The two proposed two-story units in the southwest corner of the pro-
ject and the two-story unit adjacent to San Luis Rey shall be limit-
ed to a single story.

Re: Perimeter fencing required by Case No. DP 07-77 and 77 MF
Dear Ted:
It has come to our attention that Condition No. 16 of Planning Commission
Resolution No. 249 (Case No. DP 07-77) requiring 6 foot high chain link fencing, has not
been fulfilled. The fence is required along the south property line of your development
between the Shadow Mountain Golf Course clubhouse and course maintenance building.
You indicated in a letter dated October 21, 1977 (see attached), that the fence
would be installed in conjunction with development of the adjacent area. Development
has since occurred without the fence being installed.
Please take steps to install the required fencing and inform us of when the work
will be done. Should you need any clarification please feel free to contact this office.

Dear Mr. Snyder,
As per Ted Lennon's request, we are forwarding to you
a copy of the revised wall details that pertain to
Shadow Mountain's Fairway Units.
It is our understanding that you and Ted had discussed
the use of chain link in lieu of a complete wrought
iron fence. The revised drawing is intended to satisfy
your request. Please note that the rectangular frame
will be retained with the green vinyl chain link in-
stalled within the frame. The frame is proposed to be
painted green to match.
Any comments concerning this matter will be welcomed
by this office. We are anxious to expedite this case
and hope this will receive your immediate attention.

It was suggested that the process of filing an application be studied and
try to simplify the process to save staff and applicant time and trouble. It was
also suggested that the Commission draft a letter to the various service agencies
covering the various problems in the area and ask for the their assistance in
solving the problems and possibly the different heads of these agencies could be
asked to speak to the Commission in a joint study session with the City Council.
Chairman Berkey indicated that a feasibility study be done on new projects
and if they are not feasibile to the City and the services it can provide,
they should be rejected and the reasons noted so that the public and the
developers become aware of the issues. He also suggested that Mr. Weeks of
the C.V.C.W.D. be asked to attend the next meeting in September.
A motion was made by Commissioner Kelly, seconded by Commissioner Kryder to
find that the proposed projects are in conformance with the adopted Palm Desert
General Plan and approve Planning Commission Resolution No. 275; carried unanimously
(5-0).
IX. DESIGN REVIEW BOARD ITEMS
A. Review of Cases acted on by the Design Review Board at their meeting of
August 9, 1977.
Mr. Cipriani reviewed the cases:
Case No. 77MF - PALM DESERT VENTURE, applicant - request for approval
Il `of fencing plan for Shadow Mountain Resort and Racquet Club.
Commissioner Snyder pointed out that the fence is supposed to be wrought -iron
mesh, small enough that a golf ball cannot co through i.t.
The Commission rejected the case until the correct fence plan is submitted.
Case No. 57C - CLARENCE SABA, applicant - request for approval of preliminary
site, floor and elevation plans for a commercial complex.
Commissioner Kelly requested that Conditions No. 19 and 20 be deleted.
Commissioner Kryder noted that Condition No. 15 creates an economic hardship
for the developer.
The Commission approved the case with the deletion of Condition No. 19 and 20
and the revision of Condition No. 15 to read: "Applicant should investigate
various colors and materials to be utilized for paved areas".
Case No. 83MF - DEEP CANYON, LTD., applicant - request for approval of pre-
liminary site, floor and elevation plans for 212 single family residences.
Discussion followed concerning the landscaping and whether the developer or the
owner would be responsible, also some question as to the elevations.
The Commission requested that the case be continued until the developer could
be present to discuss the landscaping issue.
Case No. 48MF - AFFILIATED CONSTRUCTION, applicant - request for approval
of a landscaping concept for Parkview Subdivision.

NOTE FOR CASE NO. DP 07-77
In order to accept any application for Design Review on any
future building, including the maintenance building, the 45-
unit condominium complex unit adjacent to San Luis Rey, the
12 units off of Fairway, or the 10 units on the north boundary
of the project; the applicant will have to had installed fencing
on the north boundary line and the chain -link fence between the
Golf Club and the Resort.
2. In addition, in order to obtain building permits for the 12
units proposed off of Fairway, the applicant will have to
install the required wall/or mesh fence along the area off
of Fairway as required and of a design acceptable to the Design
Review Board.
3. In order to logically determine when the circular road should
be installed, the applicant should be required to install this
road as a part of either of the following situations: the 10
unit facility on the north boundary line, the 12-unit facility
off of Fairway, or the north half of the 45 units off of San
Luis Rey:
