say that as of this writing 85% of the irrigation is installed and by Tuesday
November 21st, that 707 of the landscaping will be installed.

the week -end.

4. Case No. 114MF - SUNRISE COMPANY - Preliminary site, floor and elevations
for a 460-unit condominium project to be located on the east side of Mon-
terey and south of the Desert Squire Country Club. Applicant not present.
On a motion by Jackson; seconded by Williams, the Board approved the pre-
liminary site, floor and elevations for the project. Carried 4-0 (Jackson,
Williams, Johnson, Urrutia).
5. Case No. 77C - NAEGELE OUTDOOR ADVERTISING - Preliminary site, floor and
elevations for a commercial office and studio to be located on the west
side of Ill and north of Park View Drive. Applicant present.
Following discussion of the project, the Board requested that the plans
submitted be modified as follows:
a. The driveway entrance on the south side of the project site is to be
eliminated.
b. Outdoor storage area shall be screened by: recessing; landscaping;
and/or use of masonry wall.
c. Redesign back of structure to: accommodate additional 10' setback;
and, reduce height of studio by 4'.
d. Intensify landscaping on north and south sides of project site.
e. Temporary ground sign shall be in earth tone color range.
On a motion by Jackson, seconded by Urrutia, the Board moved to carry this
case over to review the revised drawings. Carried 4-0 (Jackson, Urrutia,
Johnson Jams).
6. Case No. 83MF - D P CANYON LTD. - Final landscaping for a 212-single
family resideyAal complex to be located at the southeast corner of Deep
anyon th Avenue. Applicant not present.
On a motion by Urrutia, seconded by Williams, the Board approved the final
landscaping plans with noted revisions as discussed with the applicant.
Carried 4-0 (Urrutia, Williams, Jackson, Johnson).
7. Discussion on use of PVC as roofing material.
On a motion by Williams, seconded by Urrutia, the Board recommended against
the use of PVC as roofing material. It was the Board's concensus that the
material was not durable enough to withstand the general climatic conditions
in the desert area. Carried 4-0 (Williams, Urrutia, Jackson, Johnson).
8. On a motion by Jackson, seconded by Williams, the meeting was adjourned at
6:45 p.m. Carried 4-0 (Jackson, Williams, Urrutia, Johnson).

and Mr. Johnson. A number of changes with regard to plant
varieties have been suggested to the applicant and the appli-
cant has agreed to make the changes. The plans are very com-
prehensive. Staff is recommending approval of the final
landscaping plans.

1. The development of this project shall conform substantially to all
requirements of TT 9144 (Revised) and DP 02-77 (Revised) and to all
development plans submitted in behalf of this case (Exhibits A), and
as revised according to the Design Review Board process. Any minor
changes require approval by the Director of Environmental Services.
Any substantial change requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
3. This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
4. All service and distribution lines for utilities shall be placed
underground.
5. No roof top air conditioning equipment shall be permitted.
6. Elevations are approved as shown.
7. The applicant shall explore the feasibility of using solar energy
to heat all swimming pools.
8. Construction plans shall be submitted for approval to the City Fire
Marshall prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
9. Final landscaping, grading, fencing, lighting, amenities, trash storage,
walkway layout, sign and irrigation plans shall be submitted through the
Design Review Process. The building permit when issued, shall include
the grading, lighting, amenities, trash storage, walkways, swimming
pool equipment, irrigation systems, and other details. No final inspec-
tion or occupancy permit shall be given by the Dept. of Environmental

A. C.V.C.W.D. Booster Station Discussion (Continued)
It was suggested that the process of filing an application be studied and
try to simplify the process to save staff and applicant time and trouble. It was
also suggested that the Commission draft a letter to the various service agencies
covering the various problems in the area and ask for the their assistance in
solving the problems and possibly the different heads of these agencies could be
asked to speak to the Commission in a joint study session with the City Council.
Chairman Berkey indicated that a feasibility study be done on new projects
and if they are not feasibile to the City and the services it can provide,
they should be rejected and the reasons noted so that the public and the
developers become aware of the issues. He also suggested that Mr. Weeks of
the C.V.C.W.D. be asked to attend the next meeting in September.
A motion was made by Commissioner Kelly, seconded by Commissioner Kryder to
find that the proposed projects are in conformance with the adopted Palm Desert
General Plan and approve Planning Commission Resolution No. 275; carried unanimously
(5-0).
IX. DESIGN REVIEW BOARD ITEMS
A. Review of Cases acted on by the Design Review Board at their meeting of
August 9, 1977.
Mr. Cipriani reviewed the cases:
( Case No. 77MF - PALM DESERT VENTURE, applicant - request for approval
Il of fencing plan for Shadow Mountain Resort and Racquet Club.
Commissioner Snyder pointed out that the fence is supposed to be wrought -iron
mesh, small enough that a golf ball cannot oo through i.t.
The Commission rejected the case until the correct fence plan is submitted.
Case No. 57C - CLARENCE SABA, applicant - request for approval of preliminary
site, floor and elevation plans for a commercial complex.
Commissioner Kelly requested that Conditions No. 19 and 20 be deleted.
Commissioner Kryder noted that Condition No. 15 creates an economic hardship
for the developer.
The Commission approved the case with the deletion of Condition No. 19 and 20
and the revision of Condition No.15 to read: "Applicant should investigate
various colors and materials to be utilized for paved areas".
Case No. 83MF - DEEP CANYON, LTD., applicant - request for approval of pre-
liminary site, floor and elevation plans for 212 single family residences.
Discussion followed concerning the landscaping and whether the developer or the
owner would be responsible, also some question as to the elevations.
The Commission requested that the case be continued until the developer could
be present to discuss the landscaping issue.
Case No. 48MF - AFFILIATED CONSTRUCTION, applicant - request for approval

IX. DESIGN REVIEW BOARD ITEMS
A. Review of cases acted on by the Design Review Board at
their meeting of September 20, 1977.
Mr. Williams reviewed cases 111SA, 83MF, 87MF, 59C, noting that
a late response was received from ity of Indian Wells in
reference to Case 83MF recommending a channel down eastside of
the tract. Chairman Berkey asked if the applicant would be
required to join an assessment district. Mr. Cook noted that
it was not within the Cook Street alignment. Mr. Williams
noted that he mentioned the response received from City of
Indian Wells just for the record and that the Conditions of Ap-
proval covered the assessment district question.
Mr. Freed reviewed Case No. 68MF pointing out the treatment
along San Luis Rey including the berming and elevations. Com-
missioner Reading questioned the visibility for vehicles on
the road. Commissioner Snyder noted the plans were not ac-
curate with regard to the road and its location. Some discussion
followed regarding the roads, drainage channel, landscaping
on streets as pointed out by Commissioner Reading.
Case No. 59C was discussed further and Chairman Berkey asked
if the applicant would tell the Commission of some of the
features of his project.
CHARLES MARTIN, 73-612 Highway 111, told the Commission
of the sprawl type development he was proposing and noted
that most of the area was covered with parking. He also
noted the advantages of the solar energy concept he had
proposed.
The Commission commended Mr. Martin for his solar energy con-
cept and the underground parking, both needed in our community. Com-
missioner Kryder noted the ultra modern outside archectural treatment
was not compatible to the surroundings. The Commissioners agreed
that they appreciated the idea but hoped the applicant would bring in
another concept for the outside architectural treatment. The Commission
Af approved the following cases 111SA, 83MF, 87MF, 68MF by Planning Commis -
on Resolution No. 289; motion by Commissioner Snyder, seconded by Com-
� ssioner Reading, carried unanimously (5-0). Case No. 59C was con-
inued to a the October 19th meeting; motion by.Commissioner Kelly,
J3econded by Commissioner Kryder, carried unanimously (5-0).
Mr. Williams asked that the Commissioners advise the secretary
of the dates they could attend a Design Review Board meeting as planned
at the joint meeting with the DRB. Each Commissioner took a date cover-
ing meetings through December 6, 1977.
X. DISCUSSION ITEMS
A. Discussion regarding a possible amendment to the By-laws of
the Planning Commission relative to the Secretary's powers
to present last minute items to the Commission.
Mr. Williams noted that the Planning Commission is supposed to
be notified of any items referred back from City Council at their next
meeting. He then asked if there was any discussion at this time. The
Commission agreed that there was no need for a change in the By-laws.

ACTIONS OF SEPTEMBER 20, 1977.
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did review the Design Review Board actions of September
20, 1977,-approving:
Case No. 111SA - Request for approval of a sign for a
restaurant for CARL COX;
Case No. 834AF -,Request for approval of final construction
drawings for 212 single family residences
for DEEP CANYON, LTD;
Case No. 87MF - Request for approval of preliminary site,
floor and elevation plans for a duplex for
ROBERT RICCIARDI;
Case No. 59C - Request for approval of preliminary site,
floor and elevation plans for an office
building for CHARLES MARTIN;
Case No. 68MF - Request for approval of final construction
drawings for 15 condominium units for PALM
DESERT VENTURE, LTD;
WHEREAS, at this time, upon considering and receiving all testimony
and arguments, if any, of all interested persons desiring to be heard,
said Commission did find sufficient facts and reasons to exist to approve
the Design Review Board actions of September 20, 1977.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case.
2. That it does hereby approve the Design Review Board actions of September
20, 1977, except for Case.No. 59C which was continued.

PALM DESERT DESIGN REVIEW BOARD MEETING
SEPTEMBER 20, 1977
1. After a one hour study session, the regular meeting of the Palm Desert Design
Review Board was called to order by Chairman Johnson at 5:30 p.m. in the
Council Chambers of the Palm Desert City Hall.

2. MINUTES
A. Minutes of the meeting of September 6, 1977.
It was moved by Minturn and seconded by Urrutia that the minutes be approved
as submitted. Motion carried 4-0 (Johnson, Minturn, Hobbs, Urrutia).
Mr. Williams advised the ORB members that the applicant for Case No. 58C,
Mr. Gibbs, was unable to complete the revision of the required plans and was
therefore requesting a continuance. It was moved by Hobbs and seconded by
Minturn to continue the case to the meeting of October 11, 1977. Motion car-
ried 4-0 (Johnson, Minturn, Hobbs, Urrutia).
3. Case No. 83MF - DEEP CANYON, LTD. - Review of final construction drawings for
212 condominium units on a 48-acre project located south of 44th Avenue and
east of Deep Canyon Road. (PR-5, N). Stan Bell, project architect, present.
In response to the issue of having a carport for each unit because of the
short driveways, Mr. Bell indicated that all units would have garages equip-
ped with automatic door openers. Mr. Bell then pointed out those units with
enlarged patios, trellises, and porches, which were required by the DRB. He
also said that 10 landscape plans would be submitted in the near future for
DRB review. Urrutia said the building plans appeared satisfactory and moved
that they be approved. Hobbs seconded and the motion was approved 4-0 (John-
son, Minturn, Hobbs, Urrutia).
4. Case No. 111SA - CARL COX - Review of sign plans for a ground monument sign for
a new restaurant, The Fort, located south of E1 Paseo and easterly of Lantana.
Several members pointed out that the sign, which was greatly improved over the
original submittal, would look even better without a cross beam on top and that
the address was unnecessary. Johnson thought that the word "entrance" would
be more appropriate than the address. It was moved by Hobbs and seconded by
Minturn to approve the sign as submitted, subject to four conditions and to
suggest that the applicant discuss the matter of the cross beam and the address
with the staff. Motion carried 4-0 (Urrutia, Minturn, Hobbs, Johnson).
5. Case No. 87MF - R. RICCIARDI - Review of preliminary plans for a duplex at the
` northeast corner of San Luis Rey and Alessandro Drive. The applicant, Mr.
Robert Ricciardi present.
The DRB discussed the question of access to the pool from both units. Mr.
Ricciardi indicated that there was no other way to locate the pool to improve
access from the corner unit. Minturn felt that this was not necessarily bad
since some people would not want the pool noise. Mr. Williams pointed out
that Standard Condition No. 5 on curb and gutter should be deleted since it
was already installed. It was moved by Hobbs and seconded by Minturn to ap-
prove the project subject to 6 conditions, with the deletion of No. 5. Motion
carried 4-0 (Minturn, Hobbs, Johnson, Urrutia).

CONDITIONS OF APPROVAL
CASE NO. DP 02-77 (REVISE
STANDARD CONDITIONS:
July 5, 1977
The development of the property shall conform substantially with
that as shown on plot plan marked Exhibit 'A' on file with the
Department of Environmental Services, Case No. DP 02-77(Revised),
unless otherwise amended by the following conditions.
2. Prior to issuance of a building permit, for any condominium
structure, a subdivision shall be recorded conforming substan-
tially with said Exhibit 'A'.
Prior to the issuance of a building permit for construction of
any use contemplated by this approval, the applicant shall first
obtain permits and/or clearance from the following public agencies:
County Department of Public Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above agencies shall
be presented to the Department of Building and Safety at the time
of the issuance of a building permit for the use contemplated here-
with.
4. A landscaping, grading, lighting, amenities, trash storage, walkway
layout, and irrigation plan shall be submitted through the Design
Review Board process. The building permit when issued shall include
the grading, lighting, amenities, trash storage, walkways, swimming
pool equipment, and irrigation systems. No final inspection or oc-
cupancy shall be given by the Department of Environmental Services
to this project until the aforementioned approved plans and construc-
tion shall have been completed.
5. The applicant shall conform to all requirements and improvements
deemed necessary by the City Fire Marshall as stated in the attached
letter.
6. Construction of the development permitted hereby may be done pro-
gressively in stages, provided adequate vehicular access is constructed
for all.dwelling units and further provided that such stage development
conforms substantially with the intent and purposes of this approval for
the provision of open areas, recreation facilities, and off-street auto-
mobile parking.
7. The sewerage disposal system shall be submitted to and approved by the
Coachella Valley County Water District prior to issuance of a building
permit.
8. This approval shall be used within one (1) year of this action, other-
wise it shall become null and void and of no effect whatsoever. By
"use" is meant recordation of a subdivision map and beginning of con-
struction of a portion of the project.
9. Prior to utilization of this Development Plan, the applicant shall

I. STANDARD CONDITIONS (continued)
10. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all requirements, limitations, and restrictions of all municipal ordi-
nances and State and Federal statutes now in force, or which hereafter
may be in force.
II. SPECIAL CONDITIONS:
1. The applicant shall underground all existing overhead utility distri-
bution lines on or immediately adjacent to the property.
2. (a) A meandering masonry or stucco wall, six (6) feet high, shall be
installed along the full frontage of 44th Avenue and Deep Canyon
Road except for approved openings of design and materials as ap-
proved through the Design Review Board process.
(b) A six (6) foot high masonry or stucco wall shall be installed
non -street property line of the project. Said wall shall be
the same as approved for the street frontages.
3. The indicated date palms shall be installed as shown on Exhibit A
and maintenance shall be the responsibility of the developer which
may ultimately be assumed by the homeowners association for the
project.
4. The maximum phasing shall be limited to four (4) phases.
5. The proposed landscaping and walkway treatment of the public right-of-
way on Deep Canyon Road and 44th Avenue shall be modified as necessary
to conformance of the improvement requirements of Tract 9144(Revised).
6. Any proposed landscaping of the lots across the street from the pro-
posed openings to 44th Avenue and Deep Canyon Road shall include the
utilization of existing date palms and/or citrus trees as determined
by the Director of Environmental Services.
7. A minimum of 45 guest parking spaces shall be provided in bays along
the private streets at locations which would supplement the parking
needs for the proposed cul-de-sac areas and the major recreation areas.
The precise location and design shall be reviewed as a part of the Design
Review Board process.
8. Any wall or fencing on the proposed lots shall be limited to a three to
three and one-half (3-32) foot high masonry or stucco wall with approved
openings on the rear property lines. $aid limitation shall not affect
any Ordinance requirements relating to any private.pools.
9. An emergency access of a design acceptable to the City Fire Marshall
shall be constructed from Deep Canyon Road, along the southerly boundary
of the project and through proposed lot 123 (Tract 9144-Revised) to the
proposed private streets. To accomplish this requirement, the proposed
lot number 123 and unit is hereby deleted and any width not needed for
the required emergency access shall be dispersed among the adjacent lots.
1.0. The proposed landscape treatment in the center of the proposed cul-de-
sacs shall not be permitted unless a 40 foot turning radius can be main-
tained as approved by the City Fire Marshall.

11. The design of any dwelling unit, located on a cul-de-sac and not
having a minimum of sixteen (16) feet street setback, shall be
modified to provide for one carport and one garage parking space or
electric garage doors to be provided through the Design Review Board Process.
12. The proposed tennis courts shall be recessed from adjacent walkway
or private lot grade a minimum of three (3) feet as approved through
the Design Review Board process.
13. All swimming pools shall be enclosed by walls or fences, a minimum
of four (4) feet in height.
14. The applicant shall explore the possibility of heating the swimming
pools with solar heating units.
15. A small maintenance building shall be constructed for maintenance
equipment storage.
16. A master trash agreement shall be developed for the total project
and enclosed trash storage areas shall be provided through the
development as a part of the Design Review Board process.
17. Date trees affected by the bay parking shall be relocated elsewhere
in the development.
AGREEMENT
I accept and agree, prior to use of this. permit or approval, to comply with
all the conditions set forth, and understand the Department of Building and
Safety will not issue a building permit or allow occupancy on the use per-
mitted until this signed confirmation has been received by the Department
of Environmental Services.

C. Cases from the Design Review Board meetings of August 9, 1977 and August
23, 1977.
Mr. Cipriani presented the es to the Ian 'ng Commission. He explained that
on the Hidden Palms proje Case NO. 83 t e Design Review Board wanted land-
scaping in the private ya s and asked for mo ified elevations to include more
trellises and patios.
STAN BELL, Irvine, the project architect spoke to the Commission. He in-
dicated that 8-10 landscape plans for each private yard were being prepared.
Each owner would select the plan they favored. If not installed within 90
days, the homeowners association would do the work and would assess the
owner. He was reluctant to revise the elevations, but agreed to add more
covered porches.
The staff replied that this would be acceptible and that it was not the City's
intent to cover all sides with overhangs. Mr. Williams suggested that Condition
No. 12 be revised to read:
"Porches, patios, and other related amenities shall be added where possible
to make the elevations more compatible with the desert environment."
The revised condition was inserted in Subsection 2 of the Design Review Board
Resolution.
It was moved by Commissioner Snyder and seconded by Commissioner Kelly to adopt
Planning Commission Resolution No. 281 as amended approving the Design Review Board
cases of August 9, 1977, and August 23, 1977. Motion carried unanimously (5-0).
X. DISCUSSION ITEMS
A. Agenda items for joint City Council -Planning Commission meeting of September
7, 1977.
Commissioner Snyder suggested that the topic of communications be added so that
the Council receives a better understanding of the Commission's justification for
taking a certain action on a project and so that the Commission becomes more familiar
with the Council's philosophy on development. Commissioner Reading wanted to discuss
the proposal to have developers obtain clearance from other agencies before submitting
for City approval. Chairman Berkey wanted to see some thought given to requiring an
economic impact report for each project similar to the Fresno method. Commissioner
Kryder wanted to talk to the Council about the issue of concrete driveways and the
City's relationship with C-VAG.
