Prior to discussing the following item, the architect for Dunham and the
Board discussed the various aspects of clocktowers and their architectural
virtues.
Case No. 101 C - PALM DESERT RACQUETBALL AND HEALTH CLUB, INC. - Revised
preliminary plans for racquetball club on property located at the north-
west corner of Highway 111 and Painters Path. Applicant was present.
The applicant presented color samples of the proposed building. The Board
indicated a desire for a darker tan color, which would blend closely with
the mountain at the rear of the property.
The Board discussed the landscape plan and changes which would blend the
height into the mountain. The Board indicated a desire to use more large
stones in flowing patterns. Additionally, they requested that Prostate
Junipers, Yuccas and Gazanias be utilized. They also requested that no
turf be utilized on the site. It was felt that with large trees in desert
type landscaping, the building would be more compatible with the surrounding
hillside.
The revised architectural elevations were reviewed with the Board indicating
that the revised plans were acceptable.
On a motion by Jackson, seconded by Barton, the Board approved the revised
preliminary plans, subject to a revised final landscaping plan being sub-
mitted to the Board for approval; carried 4-0 (Johnson, Jackson, Barton,
Crump).
Case No. 171 MF a 5 MF evision) - REIMER CONSTRUCTION - Preliminary
and final plans f t apartment, on property located on the south
side of Santa Rosa, between San Pablo and San Pascual. Applicant was
present.
The landscaping plan for the site was reviewed by the Board. Within the
private patio areas, the Board requested that Modesto Ash or Mexican Ash
be utilized in place of the palm trees. Additionally, the Board stated
that Bermuda or Rye grass should be utilized in place of the Kentucky
Blue grass.
On a motion by Crump, seconded by Jackson, the Board moved to approve
revised final plans for case 95 MF and preliminary and final plans for
case 171 MF, subject to the following modifications:
1. That Modesto Ash or Mexican Ash be utilized in the private patio areas.
2. That Bermuda or Rye grass be utilized on the site.
3. That the pool & jacuzzi area be fenced in.
4. That all private patios be fenced in.

in front of walls; azaleas shall be removed and replaced with raphiolepis;
gazanias shall be submitted for creeping fig as ground cover; landscaping
between the driveway and the fencing shall include the use of pyracanthia

front building. If the applicant agrees to indicate the
revision on the final construction drawings, Staff would
recommend approval.

1. The meeting was called to order at 5:30 p.m. in the Council Chambers of
the Palm Desert City Hall, after an hour study session.

It was moved by Jackson seconded by Urrutia that the minutes of the meeting
of March 21, 1978 be approved as written; carried 3-1 (AYES: Jackson,

2. Case No. 77C - NAEGLE OUTDOOR ADVERTISING - Preliminary site, floor and ele-
vations for a commercial office and studio to be located on the west side of
Highway 111 and north of Park View Drive. Applicant present.
On a motion by Jackson, seconded by Urrutia, the Board approved the prelimi-
nary site, floor and elevations subject to the following conditions:
a. Applicant shall provide a minimum of one handicapped parking space no
less than 11' in width.
b. Applicant shall modify entrance to building by providing a ramp with
rails for the physically handicapped.
c. Applicant shall provide a 6' - wall along the north and northeast side
of the property.

3. Case No. 71MF - PRELUDE DEVELOPMENT CO. - Final landscaping for a 50-unit
condominium project to be located northerly of and adjacent to Park View Drive
and Fairhaven. Applicant present.
On a motion by Urrutia, seconded by Jackson, the Board approved the final
landscaping plan subject to the applicant deleting any shrubs or trees within
the 15' emergency access easement. Carried 4-0 (Urrutia, Jackson, Leung,
Hill).
4. Ca No. 95MF - ILLIAM LOADVINE - Final construction drawings for a 5-unit
a artment comp x to be located on the south side of Santa Rosa between San
ablo and Pasqual. Applicant not present.
On a motion by Jackson, seconded by Urrutia, the Board approved the final con-
struction drawings subject to the applicant reversing the floor plan of the
building on Santa Rosa and providing a garden wall to the north of that build-
ing. Carried 4-0 (Jackson, Urrutia, Leung, Hill).

The regularly scheduled meeting of the Palm Desert Planning
Commission was called to order by Chairman Berkey at 1:00 p.m. in
the Council Chambers of the Palm Desert City Hall.

IV. APPROVAL OF MINUTES
A. MINUTES of the regular meeting of the Planning Commission of
February 28, 1978.
On a motion by Commissioner Snyder, seconded by Commissioner
Kelly, the minutes were approved as written; carried unanimously (4-0).
Mr. Williams noted that Case DP 02-78 has been appealed by adjacent
property owners.

IX. DESIGN REVIEW BOARD ITEMS
A. Review of Cases acted on by the Design Review Board at their
meeting of March 8, 1978.
Mr. Cipriani reviewed the cases. Regarding Case No. 51C he
reviewed the sign program; Case No. 76MF he noted that the Design
Revie r ad asked that the tile mosaic on top be eliminated;
Case N 95MF he noted that the revised plans had not been submitted
as yet, ut indicated to the Commission the proposed changes with
regard to landscaping and the reversal of the floor plan; Case No.
99MF, Chairman Berkey asked where the proposed annexation stood at
this time, Mr. Williams noted that it was to appear before the City
Council at their March 23rd meeting. It was further noted that the
applicant has submitted 16 different elevations which would allow for
80 different combinations of colors and materials. Mr. Williams then
showed acolored rendering of the proposed 480 unit complex that would
adjoin this phase.

On a motion by Commissioner Snyder, seconded by Commissioner
Kryder, the Commission approved the actions of the Design Review
Board by Planning Commission Resolution No. 343; carried unanimously i
(4-0).
X. DISCUSSION ITEMS
A. Annual Cal Chapter AIP Conference in Monterey.
Mr. Williams reviewed the various topics proposed for the
conference. Chairman Berkey asked if both lay and professional people
attended these conferences. Mr. Williams stated that various people
in both lay and professional fields were members and attended the
conferences. All Commissioners present noted their interest in attend-
ing the conference.
B. Continuing Education in Environmental Design, Planning,
and Community Development sponsored by University Extension,
University of California Berkeley.
Mr. Williams noted that this was similar to the Planning Commis-
sioners Institute held earlier this year.
C. Items to be discussed with the City Council at the Joint
Planning Commission - City Council meeting of March 30th.
Mr. Williams noted that the meeting was approved for March 30th
and would be at 7:00 p.m. He then noted that Mr. Dick Smith would
be presenting a slide program as the first item on the agenda, second
item would be the Advanced Planning Program. Chairman Berkey asked
that the procedures be discussed that apply when the Planning Commission
and Staff disagree on certain matters as item three and just procedures
in general as item four.
Commissioner Kelly asked if the inadequacy of the schools would
be discussed under Advanced Planning Studies. It was verified that
this would be discussed under "Other Studies".

XII. COMMENTS
A. City Staff
Mr. Williams noted that the Director of Public Works had
taken care of the landscaping problem at the corporate yard
and more oleanders had been planted. Also, Moller's is
going to put in more trees.

C. Planning Commissioners
Commissioner Kryder questioned the Sign Ordinance and
whether it covered a bus being used as advertising for a
business. Mr. Williams noted that there was nothing in the
Ordinance to cover a bus being used as a sign. Commissioner
Kryder then stated that the Ordinance should be revised to
cover such issues. Mr. Williams noted that the owner had
indicated that the bus would eventually be done away with
and that he intended to discuss the sign issue with the City
Attorney soon.

submitted be modified as follows:
a. Reverse the floor plan of the front building.

d. A 6' - high wood fence shall be provided at the rear and side of the
complex.
e. Provide garden wall on patio area of front building.
f. Revise the landscaping plan as follows:

2. Do not use creeping fig for ground cover - substitute gazania.
3. Remove azaleas and replace with raphiolepis.

On a motion by Minturn, seconded by Urrutia, the Board approved the revised
preliminary site, floor and elevations subject to the applicant's meeting
the conditions noted above; carried 4-0 (Minturn, Urrutia, Johnson, Williams).
6. Case No. 65C - C. G. DUNHAM - Final construction drawings for a commercial
project to be located at the northeast corner of E1 Paseo and Sage Lane.
Applicant present.
On a motion by Urrutia, seconded by Minturn, the Boardapproved the final
construction drawings for the project, subject to the applicant complying
with the following revisions:
a. Remove 2 psuedo smoke stacks from buildings 1 and 3.
b. Relocate the building complex sign from the intersection to the east on
E1 Paseo.
c. Redesign the directory signs and locate at major entrances to complex
only.
d. Redesign the landscaping plan and resubmit. The following suggestions
should be incorporated into the revised plan:

the patios, resulting larger patios. The two uncovered spaces have
been relocated to provide easier maneuverability. Additional land-

jacuzzi is being shown as an amenity in the common are. With these
modifications, staff is prepared to recommend approval of the project.

Final construction drawings including a final landscaping, grading,
and irrigation plan shall be submitted to the Design Review Board.
No final inspection or occupancy permit shall be given by the
Department of Environmental Services to this project until the
aforementioned approved plans and construction shall have been
approved.
2. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All conditions
shall be made a part of construction and no certificate of occupancy
shall be issued until completed.
3. Parking layout shall be revised in order to improve maneuverability

DESIGN REVIEW BOARD PROCESS
GENERAL INFORMATION
I. PROCESSING SCHEDULE:
SINGLE-FAMILY HOMES and similar projects require 2-4 working days before they may
be submitted to the Building and Safety Division for plan check.
MULTI -FAMILY, COMMERCIAL, and other projects that must be reviewed by the D.R.B.
and Planning Commission usually require 10-20 days.
In order to facilitate processing, the applicant or a designated representative
should attend the review hearings to answer questions which may arise regarding
the project.
II. MANDATORY FINDINGS:
No project may be approved unless:
- The proposed development conforms to any legally adopted development standards.
- The design and location of the proposed development and its relationship to
neighboring, existing or proposed developments and traffic is such that it
will not impair the desirability of investment or occupation in the neighbor-
hood; and that it will not unreasonably interfere with the use and enjoyment
of neighboring, existing or proposed developments, and that it will not create
traffic hazards or congestion.
- The design and location of the proposed development is in keeping with the
character of the surrounding neighborhood and is not detrimental to the har-
monious, orderly, and attractive development contemplated by the Zoning Or-
dinance and the adopted General Plan of the City.
- The design and location of the proposed development would provide a desirable
environment for its occupants, as well as for its neighbors and that it is
aesthetically of good composition, materials, textures and colors.
- The proposed use conforms to all the requirements of the zone in which it is
located and all other applicable requirements.
- The overall development of the land shall be designed to ensure the protection
of the public health, safety, and general welfare.
III. ADOPTED DEVELOPMENT STANDARDS:
Each project will be reviewed on the basis of its conformance to the following
adopted development standards. In those areas determined by the D.R.B. to be
"unacceptable", it is the responsibility of the applicant to redesign that por-
tion of the project.
A• TERRAIN CONTROL STANDARDS UNACCEPTABLE
1. Terrain and soils shall be structurally stable and suitable
for development.

6. Curb and gutters shall be provided where required to control
and regulate drainage.
B. ACCESS & CIRCULATION STANDARDS
1. Safe & convenient vehicle access to property and development
therein shall be provided.
2. Safe and convenient pedestrian access to property and
development therein shall be provided.
3. Circulation plans (auto, bicycle, and pedestrian) shall
conform to municipally developed circulation plans for
the vicinity and immediate area,
C.. SITE PLANNING STANDARDS
1. Site Planning shall occur in a manner which minimizes obstruc-
tion of scenic views from adjacent properties.
2. Site Planning shall be compatible with existing terrain.
3. Site Planning shall occur in a manner which does not expose
unattractive areas or activities to the detriment of adjacent
properties.
4. Site Planning shall occur in a manner in which asphalt or
concrete is minimized,
5. Avoid unnecessary impediments for handicapped persons.

D. UTILITY & EQUIPMENT STANDARDS
1. All service utility lines shall be placed underground.
2. All control panels, vaults and necessary equipment
shall be architecturally screened or landscaped or other-
wise concealed from public view.
3. All air conditioning and ventilation equipment shall be
located and screened in a manner to prevent exposure to
public rights -of -way and adjacent properties.
E. VEHICLE PARKING STANDARDS
1. Off-street parking should be located in proximity to
facilitie(s) it serves.
2. Parking areas should be screened from view wherever possible
by means of berms, garden walls and landscaping.
3. Parking areas shall be shaded where practical.
4. Carports for apartment developments shall not front onto a
public right-of-way.
5. Garages should be encouraged not to front onto a public
right-of-way.
6• All parking areas for recreational and accessory vehicles
and trailers shall be architecturally screened or landscaped
or otherwise concealed from public view.
7. Adequate handicapped parking spaces shall be provided.
F. ARCHITECTURAL STANDARDS
1. A singular architectural theme shall be applied to a given
structure or complex. (including facade architecture).
2. Architectural design shall be applied to entire structure or
complex rather than just to those sides exposed to public
view.
3. Architectural design shall be appropriate to the climatic
conditions of the desert area and shall be done in a manner
which minimizes the consumption of energy required for heating
and cooling.
4. Entrances shall include appropriate lighting and identification.
5. Architectural design shall employ materials and colors which
are compatible and complementary to the desert area.

(if applicable) as an integrated part of the overall design.
7. Architecture and landscaping shall be co-ordinated and com-

be located and screened in a manner to prevent exposure to
public rights -of -way and adjacent properties.
G. LANDSCAPING STANDARDS
1. Landscaping shall be an integral part of the site planning
and architectural design on all projects.
2. Provisions for the adequate maintenance and irrigation of
landscaping shall be made through the use of underground
irrigation systems.
3. Landscaping, walls and fences shall not create unsafe conditions
along public rights -of -way.
H. LIGHTING, IDENTIFICATION & SIGNAGE STANDARDS
1. Signage shall be architecturally integrated with the structure
involved.
2. Signage shall be of colors compatible and complementary to
the structure it relates to and to other development in
its surroundings.
3. No lighting of signage shall exceed an output of 10 candle-
power at 10 feet.
4. Signage for commercial uses shall be for identification pur-
poses only.
I. FENCING, SCREENING & ENCLOSURE STANDARDS
1. Materials and colors of fences and walls shall be compatible
and complementary to the structures with which they relate.
2. Fences, walls, and enclosures shall be handled as an integrated
part of the architecture and landscaping.

the month, also at 7:00 PM in the Council Chambers and Wednesday, eight
(8) days prior to the second Council meeting of the month, at 1:00 PM
in the Council Chambers. 3) The Design Review Board convenes on Tues-
day, a week before the Planning Commission, at 5:30 PM in the Council
Chambers.
B. Public Hearing: Public hearings are held when the City considers re-
quests for a change of zone, variance, conditional use permit, general
plan amendment, etc. Legal notices for these hearings are published
in the Palm Desert Post at least ten (10) days prior to the hearing.
Public hearing items before the Palm Desert Redevelopment Agency are
published in the Desert Sun.
Appeals: Where the Zoning Ordinance provides foF appeal to the City
Council or Planning Commission, the appeal shall be made within fifteen
(15) days of the date of the decision by filing an application of appeal
with the Director of Environmental Services.
D. Fees: All required fees are listed in the Fee Schedule, as approved by
the City Council.
Building Permits: Building permits are issued by the Department of
Building and Safety and are required before any new construction, re-
construction, plumbing, mechanical work is commenced.
Business License: Prior to engaging in an enterprise for profit, zoning
and building code clearance for the proposed use is required and a city
business license obtained. Application should be made to the Code En-
forcement Supervisor.
Private Deed Restrictions: Many parcels of land in the City of Palm
Desert are subject to private covenants, conditions, and deed restrictions
which may conflict with the requirements of the City Zoning Ordinance.
The applicant is responsible for resolving conflicts with deed restriction
requirements.

direction from each hydrant.
Prior to issuance of a building permit, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
- Marshal for review. Upon approval, one copy will be sent to the Build-
ing Department, and the original will be returned to the developer.
The water system plan shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I
certify that the design of the water system in Case Number 95MF is
- in accordance with the requirements prescribed by the Fire Marsha .

Gentlemen:
Prior to construction of any of the proposed buildings, the following con-
ditions must be met:

TYPE OF PROJECT
Agreement of compliance to be signed by those applying for review.
I hereby acknowledge that I have read and agree, to comply
with all the following requirements, and understand that
the Department of Building and Safety will not issue a
building permit or allow occupancy on the use permitted
until this signed confirmation has been received by the
Department of Environmental Services.
The development of this project shall conform substantially
to all development plans submitted in behalf of this case,
and as revised according to the Design Review Board process.
Any minor change requires approval by the Director of Envi-
ronmental Services. Any substantial change requires ap-
proval by the Design Review Board.
All requirements of any law, ordinance, or regulation of
the State, City, and any other applicable government entity
shall be complied with as part of the development process.
This approval is applicable, subject to the development of
this project, commencing within one year from approval date
and being promptly completed.
Landscaping (with irrigation system) shall be installed
prior to final inspection and receiving certificate of
occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided
along the full frontage of the lot by means of installation
prior to final inspection or other provisions as approved by
the City Engineer. Construction shall conform to City Stan-
dards and all requirements of the City Engineer.
