Standard Conditions
1. The development of this project shall conform substantially to
all plans submitted in behalf of this case (Exhibit A), and as
revised according to the Design Review Board process and/or
Planning Commission Action. Any minor changes require approval
by the Director of Environmental Services. Any substantial change
requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
3. This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
4. Prior to the issuance of a building permit for construction of any
use contemplated by this approval, the applicant shall first obtain
permits and/or clearance from the following agencies:
County Department of Public Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board #7
5. Plans and specifications shall conform to the City of Palm Desert
standard specifications, development procedures and design criteria.
Any modifications, thereof, shall require approval of the City
Engineer.
Design Review and Special Conditions
1. The site plan shall be modified in order to eliminate driveway
openings on Lµpine Lane and Sun Lodge Lane as indicated on the
Revised Exhibit 'A' on file with the Department.of Environmental
Services. Driveways shall be designed so that no vehicle shall
back out into the public rights -of -way.
2• All curbs, -utters, sidewalks and tie-in paving should be installed
on the development.
3. Right-of-way dedications shall be eight feet on Shadow Mountain
and four feet on Sun Lodge.
4. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All conditions
shall be made a part of construction and no certificate of occupancy
shall be issued until completed.
5. Any/all utility service and distribution lines on or abutting the
subject property, shall be placed underground prior to occupancy
clearance.

6. Final construction drawings including a final landscaping, grading,
lighting, amenities, trash storage, walkway layout, and irrigation
plan shall be submitted to the Design Review Board. No final in-
spection or occupancy permit shall be given by the Department of

7. Elevations shall be simplified in order to appear more compatible
with adjacent development.
AGREEMENT

I. CALL TO ORDER
The regularly scheduled meeting of the Palm Desert Planning
Commission was called to order by Chairman Berkey at 1:00 p.m. in the
Council Chambers in the Palm Desert City Hall.

A. MINUTES of the regular meeting of the Planning Commission
of January 3, 1978.
Chairman Berkey asked that the following corrections be made:
Page six, 4th paragraph, make read: "units are less dense
than adjoining".
Page seven, 2nd paragraph, change "update" to "upgrade".
On a motion by Commissioner Reading, seconded by Commissioner
Snyder, the minutes of the January 3, 1978, meeting were approved as
amended by a unanimous vote (5-0).
V. WRITTEN COMMUNICATIONS
Mr. Williams noted that all written communications received
would be covered under the appropriate cases.
VI. PUBLIC HEARINGS
Chairman Berkey explained the public h procedures to
those present.
A. Continued Case Nos. CUP 17-77 a 102MF G. DUNHAM,
Applicant
Request for approval of a Conditional Use Permit and
Preliminary Design Review to construct 30 condominium
units within the R-3(4) zone on approximately 3.5 acres
located west of Sun Lodge, north of Shadow Mountain and
east of Lupine.
Mr. Cipriani reviewed the cases and noted that the cases had
been continued from the January 3rd meeting. He noted that the DRB
had requested a redesign of the driveways and that they were concerned
with the tightness of the interior, which he noted, is justified by
the location of the project.

Commissioner Reading stated that he felt the Commission
should not approve the case if the revised drawings are not being
shown at this time. Mr. Williams noted that the conditions could
be modified to request the Design Review Board to forward the final
plans to the Planning Commission for their final approval. Chair-
man Berkey asked if the parking was sufficient. Mr. Williams noted
that it was.
Chairman Berkey declared the Public Hearing open and asked
if the applicant wished to speak at this time.
CURT DUNHAM, 73-210 E1 Paseo, Ste. 2F, apologized
for not having the revised plans before the Commis-
sion at this time, but he stated that he is under
the allowable density by 15%. He stated that he
is in agreement with the conditions.
Commissioner Kryder asked where the sidewalks would be lo-
cated. Mr. Cipriani indicated that they would be on the perimeter.
Chairman Berkey asked if there was anyone wishing to speak
in FAVOR or in OPPOSITION to the project. Being none, he declared
the Public Hearing closed and asked for the pleasure of the Commis-
sion.
On a motion by Commissioner Kelly, seconded by Commissioner
Kryder, the Commission approved the cases by Planning Commission Re-
solution No. 326, subject to the conditions; carried unanimously
(5-0).
B. Case No. DP 01-77, FRANCISCO URRUTIA for GOODEN INDUS-
TRIES, Applicant
Consideration of an Amendment to the Standard Conditions
of Approval for Case No. DP 01-77 to provide a one-year
extension of time to allow for the development of a 160-
unit resort hotel on a 9 acre parcel of land located at
the southeast corner of Highway 111 and 44th Avenue.
Mr. Williams reviewed the case and noted that there were no
changes in the conditions and that a one year extension was permis-
sable at this time.
Chairman Berkey asked for a motion. Commissioner Reading
moved, Commissioner Kelly seconded that the extension be granted by
Planning Commission Resolution No. 327; carried unanimously (5-0).

VIII. NEW BUSINESS
A. Cove Communities By -Pass
Mr. Williams noted that all the participants invited were
not present as yet and asked that this be item be held over till
later in the agenda.

IITA BELL, asked what will be done about the traffic
control on Haystack, Desert Lily, Portola and the
other effected streets in the area of the project.
Chairman Berkey stated that the project conforms with the
General Plan and all this is considered when the application is sub-
mitted.
Chairman Berkey declared the Public Hearing closed and asked
for the pleasure of the Commission.
Commissioner Snyder stated that he felt this was one of the
better planned tracts he has seen and noted his agreement with the
change in the conditions noted. Commissioner Kryder asked about the
lighting and the elevations. Mr. Sanborn stated that it would be
5 feet along the perimeter and that it might be as much as 6 to 7 feet
on internal lots. Commissioner Kelly stated that she agreed with
Commissioner Snyder, but that she was very concerned with the growth
and that she objected to the tract. Commissioner Kelly indicated that
she could not vote for approval of the project as many issues related
to rapid growth within Palm Desert i.e. flood control problems, over-
crowdedness in schools, water availability, etc. remain unresolved at
this time and that approval of the subject tract would only enhance
these problems.
�_. On a motion by Commissioner Snyder, seconded by Commissioner
Kryder, the case was approved with the following corrections made to
the Conditions of Approval and the Resolution: Sub -section 3 of the
Resolved section, should be changed to read: -"That it does hereby re-
commend approval to the City Council of the City of Palm Desert of the
above described Tentative Map No. 11636 and preliminary Design Review
for related Case No. 105MF, limiting the lots to a minimum of 12,000
square feet, subject to the fulfillment of the attached conditions";
Special Condition No. 1 to read - The total number of residential lots
shall be limited with no lot having less than 12,000 sq. ft. in area;
Special Condition No. 8 - add after acceptable "to the Director of
Public Works to the existing" etc.; Special Condition No. 12 - leave
only the first sentence; Add Special Condition No. 15 - "The connection
to Desert Lily shall be deleted"; Design Review Board Condition No. 3 -
"The proposed tennis courts shall be recessed a minimum of four feet";
the previously noted change to Condition No. 4; Add Conditions No. 6 -
"The proposed private recreation area shall be relocated to the interior
of the development prior to submittal of the map"; No. 7 - "Proposed
grading of peripheral lots of said subdivision shall be planned so
that no pad elevation shall exceed 5 feet above the rear yard lot line".

JANUARY 10, 1978
The meeting was called to order at 5:35 p.m. in the Council Chambers of
the Palm Desert City Hall, after an hour study session.

It was moved by Jackson, seconded by Minturn to approve the minutes of December
27, 1977. Motion carried 4-0 (Minturn, Urrutia, Jackson, Johnson).
Case No. 67C - Chairman Johnson suggested that this case be discussed later
on. meeting.
(LI Case No. 102MF C. G. DUNHAM - Preliminary site, floor and elevations for
condominiums be located on the north side of Shadow Mountain Drive, east of
Lu ine est of Sun Lodge. Applicant present.
Mr. Cipriani reviewed the case noting that the new submittal showing the elevations
was not as the Board had suggested. There was a discussion with regard to the
driveways on Shadow Mountain, Lupine and Sun Lodge. Mr. Urrutia noted that the
walls were misleading and that it made the area look very tight, he stated that
the walls should be a 3 foot maximum in the private areas. He also suggested
that the cosmetic treatment be simplified as this would help the tightness of the
area.
Mr. Cipriani reviewed the Design Review and Special Conditions noting that No. 1
should read: "The site plan shall be modified in order to eliminate driveway
openings on Lupine Lane and Sun Lodge Lane as indicated on the Revised Exhibit A
on file with the Department of Environmental Services. Driveways shall be designed
so that no vehicle shall back out into the public rights -of -way." - No. 2 and 3
should be deleted.
On a motion by Jackson, seconded by Urrutia, the case was approved with the
conditions as noted; carried unanimously 4-0 (Johnson, Jackson, Urrutia, Minturn).
4. Case No. 80MF - ALVIN JOHNSON - Preliminary site, floor and elevations for
duplexes to be located on the northwest corner of Shadow Mountain and Ocotillo.
Applicant present.
The case was reviewed by Mr. Cipriani and he noted that the plans had been sub-
mitted before and that the applicant had a new architect and the plans were much
better. He also noted that the applicant will request an adjustment for the rear -
yard setback.
Mr. Johnson noted that the landscaping should flow better and that A drip irriga-
tion system should be used in the final drawings.
Mr. Hill noted that Condition No. 7 should be deleted as it does not apply to
duplexes.
On a motion by Minturn, seconded by Jackson, the case was approved subject to the
conditions; carried unanimously 4-0 (Johnson, Jackson, Urrutia, Minturn).
