VI. PUBLIC HEARINGS A. Case Nos. CUP 16-77 and 104 MF JOHN ADAMS, Applicant Request for approval of an amendment of Special Condition No. 2 of an approved Conditional Use Permit to waive undergrounding of utilities as part of construction and, pursuant to Section 25.56.120 of the City of Palm Desert Municipal Code, permit applicant to guarantee that said property will voluntarily be part of any undergrounding assessment district which may be established by the City including the property in question, for property consist- ing of approximately 1.5 acres, within the R-3 20,000(3), S.P. (Multi -family Residential, minimum 20,000 square foot lot, one dwelling unit per 3000 square feet of lot area, Scenic Preservation Overlay) zone generally located on the east side of Ocotillo Drive, approximately 400 feet south of Tumbleweed Lane. Mr. Crump presented this case stating that the applicant had requested to amend the special condition regarding undergrounding of utilities because one pole adjacent to the subject property services an existing single family dwelling. Mr. Crump explained that an undergrounding district agreement could be entered into as an alternative to undergrounding as a part of construction. Staff recommended approval of an amendment to this condition. Chairman Snyder asked if the applicant cared to make a presentation. MR. JOHN ADAMS, 73-200 Tumbleweed Lane, gave a short presentation and explained why he was opposed to the condition requiring undergrounding. He also stated that there was no undergrounding on Ocotillo and did not feel it was fair to him to have to pay this considerable expense himself. He then introduced Mr. Wade. MR. JOHN WADE, Electrical Contractor, 42-818 Clifford Street, pointed out on the exhibit what would have to be undergrounded, the location of the poles and development near the area. He explained why this condition should be modified. Chairman Snyder asked the applicant if he was in agreement with the wording on the draft condition written in the Resolution, which included an agreement guaranteeing voluntary participation in any undergrounding district. Mr. Adams replied that he was agreeable to this draft condition. Chairman Snyder opened the Public Hearing asking if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the Public Hearing was closed. Commissioner Kryder agreed with Staff's recommendation, explaining that the burden of undergrounding the utilities was not fair to the applicant. Commissioner Berkey also agreed with Commissioner Kryder but felt the draft condition should be modifed, deleting the requirement of undergrounding the pole which had no service line connection. Mr. Crump clarified the modification which read as follows: "Any/all utility service lines on subject property, shall be placed underground prior to occupancy clearance. Additionally, the property owner/developer shall execute a record agreement, to run with the land, acceptable to the City Attorney, guaranteeing voluntary participation in any undergrounding district subsequently established by the City for that portion of the overhead utili- ties adjacent to the site which are not undergrounded as a part of construction. Page -3- Upon motion made by Commissioner Kryder, seconded by Commissioner Berkey, Special Condition No. 2 of Planning Commission Resolution No. 320, was amended as stated, for Case Nos. CUP 16-77 and 104 MF, by adoption of Planning Commission Resolution No. 583. Carried unanimously (4-0). Case No. CUP 01-80 - DAVID HEUSINKVELD (Represented by: HARRY H. SCHMITZ AND ASSOCIATES), Applicants quest for approval of a Conditional Use Permit to convert a ine unit apartment complex to "non -statutory" condominiums of proximately 1000 square feet each on approximately .7 gros acres within the R-3 13,000 (3) (Multi -family Residen- tial, inimum 13,000 square foot lot, one dwelling unit per 3000 fe of lot area) zone generally located at 73-415 Shadow Mo nta* Drive, approximately 700 feet east of Tumbleweed ane. Mr. Crump presente this case using an exhibit to point out the layout of the complex. He noted at parking facilities were on one portion of the site, which more resembled a apartment design, rather than cluster condominiums. He also pointed out that the oposed carport location varied from the R-3 yard requirements. He concludN noting that letters had been received in favor of the conversion, from present Xenters. Chairman Snyder asked if th applicant cared to make a presentation. MR. HARRY SCHMITZ, Planning Co sultant, 45-900 Paseo Coronado, felt that the parking area and design was a ropriate and would not be detrimental. He questioned three conditions: No. 10, requiring recordation of a tract map before development; he felt this conditi did not apply since the project is already developed. Mr. Crump explained t t it was necessary since the carports still had to be built. No. 12, requiring tailed construction floor plans; he felt this was also not necessary. Chairman nyder explained that this is a requirement by the ordinance and the Commiss n had to abide by it. Mr. Crump also stated that there was a question as to t floor area meeting the require- ment of 1,000 sq. ft. minimum. No. 11, requiri g service wires to be undergrounded; he felt this condition was an unfair burden to im since the service wires would be connected to other buildings. The Comm sion agreed this was a similar case to the one previously discussed and ncurred to amend this condition to read as stated in the previous case, in Plannin Commission Resolution No. 583. Chairman Snyder opened the Public Hearing ask g if anyone present wished to speak in FAVOR or OPPOSITION to this case. There ing none, the Public Hearing was closed. Upon motion made by Commissioner Berkey, seconded by Commissioner Kryder, Case No. CUP 01-80 was approved as amended, by adoption o Planning Commission Resolution No. 584. Carried unanimously (4-0). ( C. Case No. CUP 02-80 - JOE E. BULOS, Applicant Request for approval of a Conditional Use Permit to allow construction of a nursery school for a maximum of 4 children on approximately .25 gross acres within the -1 10,000 (Single Family Residential, minimum 10,000 squ e feet) zone generally located at the southeast corner o Portola Avenue and Fairway Drive. Mr. Crump presented this case showing the location of the prop ed project on the exhibit. He explained why the design of the parking fa 'lities was not adequate. Mr. Crump indicated that the Commission had two specs is points to consider in their deliberations: 1) Whether the proposed loc ion was appropriate for the intended use; and, 2) Whether the design of the to was acceptable for the contemplated use. NEW BUSINESS (continued) Mr. Crump had reviewed all the prior material and found there was no mention of general/professional business offices. Mr. Gilroy noted that 4800 sq. ft. of professional office space was stated in his presentation material. Mr. Williams explained that a matter of defining professional offices for that area was probably needed. Commissioner Berkey suggested that they act on the motion made and then resolve the rest of the matter at a later time. Mr. Crump pointed out that it might further clarify the definition of offices if general offices and professional offices could be separated by the applicant.and a specific listing of office uses submitted for Commission review. Commission concurred. Chairman Snyder reviewed the motion made, with the addition of: "The category of General and Professional Offices will be further defined and submitted for approval". The motion was unanimous. On the item for determination of the application of a condition of approval, the Commission felt that their only concern was for the construc- tion of one remaining pad. Commissioner Kryder made a minute motion to allow the project to proceed in a normal and business like manner until completion, it was seconded by Commissioner Miller. Carried unanimously (4-0). IX. DESIGN REVIEW BOARD ITEMS Consideration of cases acted on by the Design Review Board at their meeting of February 12, 1980. Case No. 104 MF Mr. Sawa presented this case stating that this was a -uni co o i lum project, which is now under construction. The Design Review Board approved the preliminary plans to add a recreation building and cabana with several modification. He reviewed the modi- fications. Case No. 102 C - Mr. Sawa presented this case stating that this originally was reviewed by the Planning Commission as a conceptual plan. The Design Review Board approved the preliminary plans for the addition to the bank site With several revisions. He reviewed the revisions. Case No.200 MF - Mr. Sawa presented this case stating that this was also approved by the Design Review Board with some revisions. He reviewed these revisions and recommended approval for the three items. Commissioner Kryder asked if wind/blowsand protection along the north and west side of the project wasn't necessary. It was discussed and agreed to add the requirement of: Wind/blowsand protection shall be added along the north and west side. Upon motion made by Commissioner Kryder, seconded by Commissioner Berkey, the Design Review Board actions were approved by adoption of Planning Commission Resolution No. 573, as amended. The Board advised the applicant that the subject property s located within the Palm Desert Homeowners Association area and, as such, sh located be reviewed by that body. It was deemed desirable to obtain their approva prior to City review because of the feeling that the height limit as all ed in the Association area was proposed to be exceeded. Therefore, the app icant was advised to provide the City with a letter asking that their reques be temporarily withdrawn until Homeowner Association approval can be ob ained. The applicant agreed to obtaining Homeowner Association approval and, there- fore, the Board agreed that a temporary withdrawal was desirable. Case No. 104 MF - JOHN ADAMS and SCOTT McKEE - review of revised final land- scaping plan for 12 unit condominium project presently under construction on the east side of Octillo Drive, south of Tumbleweed Lane; Scott McKee was present. The applicant presented a revised final landscaping plan and requested approval. The Board reviewed the revised plan and determined that the revised plan was superior to the original plan. Therefore, on a motion by Cook, seconded by Johnson, the Board moved to grant approval of the revised landsca- ping plan. Carried 5-0 (Cook, Holden, Jackson, Johnson, Martin). C No. 204 MF - J.M. Mr. Crump presente evised site plan to the Board indicating that Planning Commission had approved request with the provision that a secondary access be provided to Via Cinta. DISCUSSION: The Conditional Use Permit for subject condominium development was approved with the standard requirement for undergrounding overhead utilities. One of the two poles the project would be responsible for undergrounding provides service to a single-family dwelling. There are no service connections to the second pole. The applicant requests to be relieved from any undergrounding as a part of construction. Municipal Code (Zoning Ordinance), Section 25.56.120, provides that the Planning Commission may allow an agreement to enter into an undergrounding district inlieu of utilities being undergrounded as a part of construction. Staff's position on the matter is that the project should be required to underground the pole and lines that do not provide service connections to existing structures, versus a blanket waiver of undergrounding as a part of construction. IV. This means that the lines on the two poles abutting the rear of the site must be undergrounded with the two poles removed.
