WHEREAS, the Planning Commission of the City of Palm Desert, California, did review the Design Review Board actions of December 27, 1977, approving: Case No. 68C - Request for approval of final construction drawings for a storefront remodeling for RANK URRUTIA AND ASSOCIATES; Case N 107MF - Request for approval of preliminary site, floor and elevation plans for a duplex for WILLIAM J. COX; Case No. 69C - Request for approval of preliminary site, floor and elevations for a commercial complex for C. G. DUNHAM; WHEREAS, At this time, upon considering and receiving all testi- mony and arguments, if any, of all interested persons desiring to be heard, said Commission did find sufficient facts and reasons to exist to approve the Design Review Board actions of December 27, 1977. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the actions of the Design Review Board at their meeting of December 27, 1977. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission held on this 3rd day of January, 1978, by the following vote, to wit: AYES: KELLY, KRYDER, SNYDER, BERKEY NOES: READING ABSENT: NONE ABSTAIN: NONE ATTEST: PAUL A. Review of remaining cases acted on by the Design Review Board at their meeting of December 27, 1977. Mr. Williams noted that the other Design Review Board cases had been handled along with their related cases during the Public Hearing portion of the agenda. There was some discussion with regard to the exterior design of the commercial complex, Case No. 69C. Mr. Cipriani noted the Design Review Board concerns as stated in Conditions No. 7, 8, 9, & 10. Commissioner Snyder asked if the case could be delayed for a traffic study. Commissioner Kryder noted that not much could be done as the streets are already in existence. Commissioner Reading asked if the case could be refused and sent back to the Design Review Board. Mr. Williams noted that the Design Review Board had reviewed alterna- tive traffic patterns and they felt that this was the only solution. On a motion by Commissioner Kryder, seconded by Commissioner Kelly, the actions of the Design Review Board at Aire-1'r-Deqember 27, 1978 meeting including the following cases: 68 , 107MF, 69C were approved by Planning Commission Resolution No. ied (4-1) AYES: Berkey, Kelly, Kryder, Snyder, NOES: Reading. X. DISCUSSION ITEMS A. Review of Draft Planning Commission Schedule, January through June, 1978. Mr. Williams noted that this was for their information and changes would be made and additions made as needed. He then noted the upcoming Planning Commissioner Institute to be held in Oakland in February. XI. ORAL COMMUNICATIONS - None XII. COMMENTS A. City Staff - None B. City Attorney - Not present C. Planning Commissioners - None XIII. ADJOURMENT On a motion by Commissioner Snyder, seconded by Commissioner Kelly, the meeting was adjourned at 11:10 p.m.; carried unanimously (5-0). PAUL A. No final inspection or occupancy permit shall be given by the Depart- ment of Environmental Services to this project until the afore- mentioned approved plans and construction shall have been com- pleted. 2. A five (5) foot fence shall be provided along Monterey Avenue for noise abatement purposes. 3. Window treatment should be replaced with shadow box treatment. 4. Revise landscape plan as noted on plan. The development of this project shall conform substantially to all development plans submitted in behalf of this case, and as revised according to the Design Review Board process. Any minor change requires approval by the Director of Envi- ronmental Services. Any substantial change requires ap- proval by the Design Review Board. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. Landscaping (with irrigation system) shall be installed prior to final inspection and receiving certificate of occupancy. Curb, gutter, curb cuts, and tie-in paving shall be provided along the full frontage of the lot by means of installation prior to final inspection or other provisions as approved by the City Engineer.
