I. REQUEST:
Request for approval of a Conditional Use Permit and Preliminary Design
Review to construct and operate a 40 unit, church -related retirement
center and related recreation structure on approximately 7.96 acres with-
in the R-1 9,000 (Single-family residential, minimum 9,000 sq. ft. site
area) zone located on the west side of Deep Canyon, north of 44th Avenue.
II. STAFF RECOMMENDATION:
Approve the request by Planning Commission Resolution No.Zu(o
Justification:
1. The location of the project is in accord with the objectives of the
Zoning Ordinance and the purpose of the district in which the site is
located.
2. The location of the proposed use and the conditions under which it
would be operated or maintained will not be detrimental to the public
health, safety, or welfare, or be materially injurious to properties
or improvements in the vicinity.
3. The proposed use will comply with each of the applicable provisions
of the Zoning Ordinance.
4. The proposed use complies with the goals, objectives, and policies of
the City's General Plan.
III. BACKGROUND:
A. Location: West side of Deep Canyon, north of 44th Avenue
B. Size: Approximately 7.96 acres
C. Total No. of Units: 40 d.u.
D. Density: Approximately 5 d.u./acre
E. Coverage: Approximately 38.04% of the site will be covered with
structure, paving or hard surfaces; approximately 61.96%
of the site will be landscaped.
F. EIR Finding: A Negative Declaration was issued on March 13, 1978
and the appeal period has expired.

III. BACKGROUND: (Cont.)
I. Parking: Applicant is providing 40 covered spaces and 17 uncovered
spaces. Under Sec. 25.58.310 of the Municipal Code, the
applicant would be required to provide 10 spaces.
IV. DISCUSSION:
The proposed development consists of 20 duplexes (40 dwelling units), one
recreational building, a swimming pool and a jacuzzi. The proposed develop-
ment is to be enclosed by a five (5) foot masonry wall along Deep Canyon
and 20 feet along the south property line, the remainder of fencing to be
six (6) foot chain link. Examination of the site indicates wood fencing
already exists along part of the west property line. The Design Reveiw
Board may want to consider an alternative to the chain link material.
The entrance to the site is proposed on Deep Canyon Road approximately
300 feet north of the entrance of the Sacred Heart Church parking lot.
The interior streets will be privately maintained. Staff is requiring
that the width of the interior streets be increased to 32 feet; the appli-
cant is proposing 31 feet. The Conditions of Approval also require the
applicant to pay fees into the Palm Desert Planned Local Drainage Facilities
Fund.
As there are no specific provisions for required parking for the specific
use proposed, staff is calculating the required number of parking spaces
by interpreting the use as being similar to a rest home. Therefore, the
applicant would have to provide 10 parking spaces. Actually, 57 spaces
are being provided which should be more than adequate.

WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance,
the Planning Commission did on March 28, 1978, hold a duly noticed public hearing
to consider the application of the CATHOLIC BISHOP OF SAN DIEGO for a Conditional
Use Permit and Preliminary Design Review for construction and operation of a 40-
unit, church -related retirement center and related recreation structure
on approximately 7.96 acres within the R-1 9,000 (Single-family re-
sidential, minimum 9,000 sq. ft. site area) zone, generally located on
the west side of Deep Canyon, north of 44th Avenue, more particularly
described as:

WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution
No. 77-7", in that the Director of Environmental Services has deter-
mined that the project will not have a significant adverse impact on the
environment on March 13, 1978 and the appeal period has expired, and;
WHEREAS, at said Public Hearing, upon hearing and considering
{ all testimony and argument, the Planning Commission did find the fol-
lowing facts and reasons to exist to justify the granting of approval
of said Conditional Use Permit:
1. The location of the project is in accord with the objectives
of the Zoning Ordinance and the purpose of the district in which the
site is located.
2. The location of the proposed use and the conditions under
which it would be operated or maintained will not be detrimental to
the public health, safety, or welfare, or be materially injurious to
properties or improvements in the vicinity.
3. The proposed use will comply with each of the applicable

NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of

2. Approval of the Conditional Use Permit is granted to the
CATHOLIC BISHOP OF SAN DIEGO subject to the attached conditions.

Desert Planning Commission held on the 28th day of March, 1978, by the

Standard Conditions:
1. The development of this project shall conform substantially
to all plans submitted in behalf of this case (Exhibits A-F),
and as revised according to the Design Review Board process and/
or Planning Commission action. Any minor changes require approval
by the Director of Environmental Services. Any substantial change
requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the.
State, City, and any other applicable government entity shall
be complied with as part of the development process.
3. This approval is applicable, sujbect to the development of this
project, commencing within one year from approval date and being
promptly completed.
4. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All con-
ditions shall be made a part of construction and no certificate
of occupancy shall be issued until completed.
5. All utility service and distribution lines on or abutting the
subject property, shall be placed underground prior to occupancy
clearance.
6. Prior to the issuance of a building permit for construction of any
C use contemplated by this approval, the applicant shall first obtain
permits and/or clearance from the following agencies:
County Department of Public Health
Palm Desert Design Review Board Process
Palm Desert Community Services District
Regional Water Quality Control Board #7
7. Plans and specifications.shall conform to the City of Palm Desert
standard specifications, development procedures and design criteria.
Any modifications, thereof, shall require approval of the City
Engineer.
8. Applicant shall pay fees into the Palm Desert Planned Local Drain-
age Facilities Fund in an amount to be determined by the provisions
of Ordinance No. 175.
9. Applicant shall comply with all requirements of the Palm Desert
Community Services District, per the attached letter from Mainiero,
Smith and Associates, Inc., dated March 16, 1978.
Special Conditions:
1. Street widths shall be a minimum of 32 feet curb face to curb face.
2. Safety street lighting shall be installed and approved by the
Director of Public Works.
3. Drainage shall be engineered and approved by the Director of Public
Works
4. A 10' sidewalk shall be provided along Deep Canyon with tree wells.
In addition, a 2' strip between said sidewalk and masonry wall shall
be provided for landscaping purposes.
5. Air conditioning units shall be located on the ground and the
location shall be reviewed as a part of final construction drawing
review.

Design Review Conditions:
Final construction drawings including a final landscaping,
grading, lighting,trash storage, walkway layout, and irrigation
plan in addition to a sign program shall be submitted to the
Design Review Board. No final inspection or occupancy permit
shall be given by the Department of Environmental Services to
this project until the aforementioned approved plans and con-
struction shall have been completed.
2. A detailed landscaping plan shall be submitted at time of
submittal of final construction drawings. Said plan shall in-
clude a variety of trees and clusters of palms throughout the
project area. Shrub planting and/or vines shall be utilized
along perimeter walls and walls of buildings.
Tree plantings along Deep Canyon shall be consistent with other
projects in the area.
A six foot masonry wall shall be constructed along the perimeter
of the project except for the south boundary and the southwest
corner of the project where a wood fence already exists.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply
with all the conditions set forth, and understand that the Department
of Building and Safety will not issue a building permit or allow oc-
cupancy on the use permitted until this signed confirmation has been
received by the Department of Environmental Services.

Gentlemen:
Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 1500 GPM fire flow for a (2)
hour duration in addition to domestic or other supply. The computation shall be
based upon a minimum of 20 psi residual operating pressure in the supply main
from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building is
more than 250 feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed), shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval, one copy will be sent to the Building Department, and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the design
of the water system in Case Number CUP 02-78 is in accordance with the require-
ments prescribed by the Fire Marshal."
5. The emergency access shown on plan shall be fifteen (15) feet wide.

serve the proposed project; but only as an information service. Its
intent is to notify you that the Southern California Gas Company has
facilities in the area where the above named project is proposed. Gas
service to the project could be provided from an existing main without
any significant impact on the environment. The service would be in
accordance with the Company's policies and extension rules on file with
the California Public Utilities Commission at the time contractual
arrangements are made.
The availability of natural gas service, as set forth in this letter,
is based upon present conditions of gas supply and regulatory policies.
As a public utility, the Southern California Gas Company is under the
jurisdiction of the California Public Utilities Commission. We can
also be affected by actions of federal regulatory agencies. Should
these agencies take any action which affects gas supply or the condition
under which service is available, gas service will be provided in accordance
with revised conditions.
We have developed several programs which are available, upon request, to
provide assistance in selecting the most effective applications of energy

Dear Mr. Williams:
At the request of the Palm Desert Community
Services District, we have reviewed the plans for
the proposed 40-unit church -related Retirement Center
Case No. CUP 02-78, and wish to make the following
comments:
1. The District is willing and able to furnish
water to the proposed development, however
certain requirements will be imposed upon
the developer.
The developer must comply with all current
Palm Desert Community Services District
ordinances. Attention is directed to
Ordinance No. 13 which pertains to new
development.
The developer may be required to extend the
water main pipeline from a point approximately
650 feet west of Florine Avenue, along 44th
Avenue to Deep Canyon Road, then north on
Deep Canyon Road to the entrance of the pro-
posed development. The developer may be
required to pay for the cost of such extensions.
4. All water main pipelines required within the
development including fire hydrants, valves,
service pipelines and water meters shall be
paid for by the developer.

5. An engineered water plan must be submitted
to the District for approval.
6. The developer and/or the developer's engineer
should contact the District for further
details.
We are planning to attend the development committee

specifically in pool area.

in the area.

2. A detailed landscaping plan shall be submitted at time of
submittal of final construction drawings. Said plan shall in-
clude a variety of trees and clusters of palms throughout the
project area. Shrub planting and/or vines shall be utilized
along perimeter walls and walls of buildings.
3. Tree plantings along Deep Canyon shall be consistent with other
projects in the area.
4. A six foot masonry wall shall be constructed along the perimeter
of the project except for the south boundary and the southwest
corner of the project where a wood fence already exists.

I hereby acknowledge that I have read and agree, to comply
with all the following requirements, and understand that
the Department of Building and Safety will not issue a
building permit or allow occupancy on the use permitted
until this signed confirmation has been received by the
Department of Environmental Services.
The development of this project shall conform substantially
to all development plans submitted in behalf of this case,
and as revised according to the Design Review Board process.
Any minor change requires approval by the Director of Envi-
ronmental Services. Any substantial change requires ap-
proval by the Design Review Board.
All requirements of any law, ordinance, or regulation of
the State, City, and any other applicable government entity
shall be complied with as part of the development process.
This approval is applicable, subject to the development of
this project, commencing within one year from approval date
and being promptly completed.
Landscaping (with irrigation system) shall be installed
prior to final inspection and receiving certificate of
occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided
along the full frontage of the lot by means of installation
prior to final inspection or other provisions as approved by
the City Engineer. Construction shall conform to City Stan-
dards and all requirements of the City Engineer.
