Apparently, the landscape plan for the project calls for the installation, by the developer, of redwood header board. Apparently, the header board has not been installed by the developer. SUITE 604 LOS ANGELES CALIFORNIA 90010 (213) 380-9522 Pursuant to our telephone conversation on August 17, 1979 regar- ding Transcopic Development Corporation's contract to install the underground cables along 44th Avenue and Cook Street, this letter is inform you that Transcopic Development Corporation intends to immediately secure contract from a licensed subcon- tractor for the installation of underground cables. We understand that the undergrounding of utilities is one of the conditions of approval for this tract. We were told by Southern California Edison Company in our last meeting back in May, 1979 that the partial shipment of cables needed for our portion of the operation will not be here until October and the underground energizing of the tract will be completed at the earliest the latter part of January in 1980 due to backlog of work and delay of shipment. Accordingly, we did not immediately try to let the contract out on electrical underground. Instead, we have focused our attention in trying to furnish the city a financial arrange- ment letter from Southern California Edison Company. We appreciate very much the city's understanding of our need in closing Phase one escrows without further delay. We will furnish the city a copy of the electrical underground contract as soon as possible but no later than October 15, 1979. Before that date, there will be eighteen (18) closings in Phase one. We un- derstand also that there will be no more closings after the eigh- teenth unless the city has received and approved a copy of the above mentioned contract. The development of this project shall conform substantially to all plans submitted in behalf of this case and as revised accord- ing to the Design Review Board process and/or Planning Commission action. Any minor changes requires approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. All utility service and distribution lines on or abutting the sub- ject property, shall be placed underground prior to occupancy clearance. 7. Traffic control provisions shall be provided as required by the Director of Public Works. 8. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as re- quired by the Director of Public Works. 9. The Fire Protection Requirements as specified in the Fire Marshal's memo dated April 14, 1978, attached hereto, shall apply. 10. REQUEST: Request for approval of a Development Plan and Preliminary Design Review to allow construction of 80 condominium units, a clubhouse, tennis courts, and swimming pools on approximately 13.5 acres generally located at the northwest corner of Cook Street and 44th Avenue. II. STAFF RECOMMENDATION: Approve the Development Plan and Preliminary Design Review by Planning Commission Resolution No.353. Justification is based upon the following: 1. The proposed development is consistent with the City's adopted General Plan. 2. The proposed use is similar to and compatible with those existing on adjacent and nearby properties. 3. The design or improvement of the proposed development will be consis- tent with the Palm Desert Zoning Ordinance. 4. The site is physically suited for both the type of development proposed and the proposed density. 5. The design of the development and the proposed improvements are not likely to cause substantial environmental damage or have a serious ef- fect on the public health, safety, or general welfare. III. Parking: Two covered per unit - 160 Off street parking - 156 Tandem Spaces in some driveways - 56 Total Provided - 372 Required spaces �tiI7 Page Two Environmental Finding: Director of Environmental Services determined on April 17, 1978, that the project will not have a significant adverse effect on the environ- ment and no further environmental documentation will be required. IV. DISCUSSION: The proposal calls for 40 duplex structures with a two car garage attached to each unit. Also included are two recreational areas, each of which will have a swimming pool; the larger of which will contain three tennis courts. Front yard setbacks are varied, where possible, to provide a more interest- ing streetscape. Interior streets are 40' in width. The proposal calls for the development to occur in 2 phases. Generally, the project is well - designed and meets all of the requirements of the Zoning Ordinance relative to setbacks and open space requirements. The elevations are impressive. In his comments, the Director of Public Works has indicated that the westerly portion of this project appears to be in the area proposed for the "Torro Peak" drainage facility as shown upon the master plan of the City of Palm Desert. In the correspondence received from Lowell Weeks of the Coachella Valley County Water District regarding this case, no mention was made of such a conflict as pointed out by the Director of Public Works. As a result, Staff must assume that the subject drainage channel will not go on this pro- perty. Install a water system capable of delivering 2500 GPM fire flow for a (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and.the tops and nozzle caps shall be painted green. C. Curbs (if installed), shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number DP 06-78 is in accordance with the require- ments prescribed by the Fire Marshal." Unless the demand for electrical generating capacity exceeds our estimates, and provided that there are no unexpected outages to major sources of electrical supply, we expect to meet our electrical load requirements for the next several years. Our total system demand is expected to continue to increase annually; and, if our plans to proceed with future construction of new generat- ing facilities are delayed, our ability to serve all customer loads during peak demand periods could become marginal by 1981. In addition, the major fuel used in Edison's generating facilities is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory, together with our contractual commitments for delivery, and our customers' conservation efforts, will permit us to meet the forecasted demand for electricity during 1978. It is our intention to continue to do everything that can reasonably be accomplished to provide our customers with a continuous and sufficient supply of electricity. This letter is not to be interpreted as a contractual commitment to serve the proposed project; but only as an information service. Its intent is to notify you that the Southern California Gas Company has facilities in the area where the above named project is proposed. Gas service to the project could be provided from an existing main without any significant impact on the environment. The service would be in accordance with the Company's policies and extension rules on file with the California Public Utilities Commission at the time contractual arrangements are made. The availability of natural gas service, as set forth in this letter, is based upon present conditions of gas supply and regulatory policies. As a public utility, the Southern California Gas Company is under the jurisdiction of the California Public Utilities Commission. We can also be affected by actions of federal regulatory agencies. DP 06-78 nd 118MF - ANSCOPIC DEVELOPMENT COMPANY, Applicant Request for approval of a Development Plan and r Preliminary Design Review to allow construction of f 80 condominium units, a clubhouse, tennis courts, and swimming pools on approximately 13.5 acres gen- erally located at the northwest corner of Cook Street and 44th Avenue. Mr. Williams reviewed the case and noted the Design Review Boards concern over the garage doors for Plan No. 2 and the perimeter wall. He also noted that the project would have a bike system that would integrate with existing systems in and around the City. There was some discussion about the tennis courts and whether they would be lighted. Mr. Williams noted that they would be lighted and that they would be 27 ft. from the units and that the courts would be lowered. With regard to the streets, Mr. Williams noted that the interior streets would be private. Chairman Berkey declared the Public Hearing open and asked if the applicant wished to speak at this time. BILL LO, representing Transcopic, addressed the Commission and noted only one change in the Staff report and conditions and that is that the project will be done in 4 phases not 2. The amenities and streets will be completed before the units will be started. Chairman Berkey asked if there was anyone wishing to speak in FAVOR or in OPPOSITION to the proposed project. Being none, he declared the Public Hearing closed and asked for the pleasure of the Commission. On a motion by Commissioner Kryder, seconded by Commissioner Kelly, the Commission approved the case by Planning Commission Re- solution No. 353; carried unanimously (4-0). B. Case No. TT 12450, DANIEL RUSSIE, Applicant Request for approval of a Tentative Tract Map to consolidate 15 existing lots to create 4 lots to provide for 21 condominium units and common open space on property generally located east of Deep Canyon, between Sage Brush Drive and Driftwood Drive. Mr. Williams reviewed the case and the conditions noting the area involved on maps covering the site.
