Final construction drawings including a final landscaping, grading and irrigation plan shall be submitted to the Design Review Board. No final inspection or occupancy permit shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construction shall have been completed. 2. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 3. Applicant shall fully improve and dedicate to the City of Palm Desert the alley on the east side of the subject property. 4. A masonry wall, 3' high, shall be provided along Las Palmas and San Gregornio Way. 5. Any and all utility service and distribution lines on or abutting the subject property, shall be placed underground prior to occupancy clearance pursuant to Section 25.56.110 of the Municipal Code. 6. Header boards shown in the landscaping plan shall be eliminated and a permanent delineation constructed. 7. Provide trees along wall at south and east property lines. 8. Provide trees around buildings and in open space areas. 9. Provide access from apartments, where appropriate, for use of open space. 10. Use Mexican Ash trees in parking lot area and bottle trees in open space areas. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth , and understand the Department of Building and Safety will not issue a build— ing permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmenta:l'Services. The meeting was called to order at 5:35 p.m. in the Council Chambers of the Palm Desert City Hall, after an hour study session. Case No. 125MF - ROGER BOYAR DEVELOPMENT - Final Construction drawings for a 186-unit condominium project to be located adjacent to the King's Point Condominium Project. Applicant not present. On a motion by Leung, seconded by Hill, the Board approved the final construction drawings subject to the applicant modifying the adobe slump stone wall as noted on Exhibit "A"; carried 4-0 (Leung, Hill, Cipriani, Johnson). 5. Case No. 69C - C.G. DUNHAM - Final construction drawings for a commercial complex to be located on the east side of San Pablo, between Highway Ill and E1 Paseo. Applicant present. On a motion by Leung, seconded by Hill, the Board approved the final construction drawings subject to the applicant increasing the size of all palm trees on the site to a minimum of 8' in height; carried 44 (Leung, Hill, Cirpriani, Johnson). 6. Mr. Williams reviewed the proposals by the Coachella Valley County Water District and noted that Staff recommends approval as they are in conformance with the adopted Palm Desert General Plan. On a motion by Commissioner Snyder, seconded by Commissioner Kelly, the Commission found that the proposed projects are in confor- mance with the adopted Palm Desert General Plan by Planning Commission Resolution No. 358; carried unanimously (4-0). X. DESIGN REVIEW BOARD ITEMS A. Review of Cases acted on by the Design Review Board at their meeting of May 16, 1978. Mr. Cipriani reviewed the cases noting that with regard to Case No. 28C that the street will be realigned per the Redevelopment Dor the City which will change the line of site problem. The Review Board was concerned the the landscaping; Case No. - Design Review Board concerns were with landscaping; Case No. the applicant was asked to rework the shop locations and traffic n, also there is a need for more parking (Mr. Williams noted that this case should be continued and deleted from the Resolution as the related cases had been continued); and, Case No. 81C - the applicant presented a model of the proposed structure and noted that it will blend with the building that was previously approved. A discussion followed regarding the exterior design, height and back wall effect of the proposal. It was noted that the applicant will have to get a Variance for the back area involving the 10 ft. of landscaping needed. Case No. 71C - a new design concept was presented for the RB Furniture Store proposed on Highway 111, which is much more in line with the concerns noted by the Design Review Board and the Planning Commission than the previously presented concept. On a motion by Commissioner Kelly, seconded by Commissioner Kryder, the actions of the Design Review Board with the deletion of Case No. 80C were approved by Planning Commission Resolution No. 359; carried unanimously (4-0). XI. DISCUSSION ITEMS - None XII. ORAL COMMUNICATIONS - None XIII. COMMENTS A. City Staff - Mr. Williams noted that the bus tour of the City had been changed to June 16, 1978 B. City Attorney - Not present C. Planning Commissioners - Commissioner Kelly asked if the Commissions Study Session meeting could be held at night. Case No. 28C - HENRY TAGLE - Preliminary site, floor and elevations for a restaurant to be located at the northwest corner of DeAnza Way and Palm Desert Drive. Applicant present. On a motion by Urrutia, seconded by Jackson, the Board approved the preliminary site, floor and elevations, subject to the following: a. Landscaping plan be revised as follows: I. A minimum 24" box size trees be used in parking lot. Tree type should be Carob. 2. Eliminate landscaping in front of trash enclosure. 3. Add street trees along project perimeter. Tree type should be Rhus lancea. b. Revise plan to maintain 25' line of site radius clear at intersection of DeAnza Way and Palm Desert Drive.
