Dear Mr. Williams:
This letter is to confirm my telephone conference with
Mr. James Hill this date wherein it was discussed and agreed
that the corner palm trees with appropriate lighting would
be installed and operative within thirty (30) days from the
date each mobilehome is installed at the new pads currently
under development at Silver Spur Mobile Manor. Accordingly,
this condition may not be met as of date of notice of
completion and occupancy for each new mobilehome pad, but
will be complied with within the time parameter set forth
above.
It is my hope that the job's civil engineer, general
contractor, and landscape architect will continue to com-
municate with both you and me so that practical agreements
such as is the subject of this letter may be made to insure
completion of the project at the earliest possible date.

Addition to Silver Spur Mobile Manor, Palm Desert,
Thank you for the written notice dated May 31, 1978,
that the action on the amenity improvements has been con-
tinued pending the Design Review Board's review of the
rationale supporting the amenity package previously sub-
mitted to the City of Palm Desert. Based upon my discussion
with Messrs. Paul A. Williams and Ralph J. Cipriani on
June 2, 1978, the following is respectfully submitted for
your review and consideration.
I am advised that the Design Review Board and Planning
Commission have approved the concept of dedication of the
existing rock area to perpetual open space so as to pre-
serve, presently and in the future, the natural beauty of
this desert formation, except for a lawn area with meandering
paths and an open bench and barbeque area for resident
social gatherings.
The question which I am advised is at issue is whether
the addition of a second swimming pool (not therapy pool) at
the existing social, recreation and clubhouse area is
feasible in terms of resident usage and enjoyment. The
reasons supporting the applicant's not building a second
swimming pool may be summarized as follows:
1. The approval of the amenity plans without a second
swimming pool would be consistent with the appli-
cant's concept to broaden the spectrum of amenities
available to obtain maximum resident usage according
to the residents' social and recreational preferences.
2. There does not exist sufficient available space
within the existing social, recreation, clubhouse
and swimming area to build a second swimming pool.
3. The existing swimming pool provides sufficient
water area for the residents based upon their use
of same.
4. The expansion and "Kool Decking" of the existing
swimming pool deck area with additional furniture
will provide the residents with their primary need
according to their historical social desires. The
November, 1977, residents' opinion poll and other
resident preferences expressed to me confirm that
the residents desire additional area around the
pool to gather, socialize, and sun themselves with
separate toilet facilities. These improvements
have been provided for in the plans previously
submitted.
5. The present swimming pool water surface area is
more than sufficient for adult usage at peak periods.

6. The question of children usage has not been at
issue as the children are provided with definite
hours for their exclusive use. As this is an adult
park, any deviation from this policy by management
would conflict with the residents` interpretation
of the adult lifestyle concept of the park, and
would be counter -productive to the expressed
preferences of the majority of residents to provide
only limited children's access to pool facilities.
7. The approval of the amenity plan, as submitted,
without a second swimming pool is consistent with
the resident opinion poll taken in November, 1977
(a copy of which has been presented to Mr. Paul
Williams, AIP, Director of Environmental Services,
for his information, review, and files).
8. The prior owner, at one time, maintained two
swimming areas and eliminated the second pool due
to residents' objections, liability, and mainte-
nance disadvantages.
9. The submitted plans include a decision to add an
additional therapy pool based upon the following:
a. A second therapy pool will allow two constant
"hot" temperature levels (higher and lower) so
as to be available to a broader range of
residents.
b. This facility is a desirable addition due to
the age of our residents and physical therapy
benefits which this amenity provides.
C. The second therapy pool will contain a para-
plegic device to allow access to our older
residents who are denied access to the existing
pool due to (1) an inability to negotiate the
steps, and/or (2) tolerate the higher "hot"
temperature maintained by a small minority of
residents who treat the single existing therapy
pool as their exclusive facility.
Accordingly, it is respectfully requested that the
Silver Spur Reserve application be approved without the
addition of a second swimming pool in the "natural desert
park area" or at the existing recreational and clubhouse
facility.

Re: Case #128MF Addition to Silver Spur Mobile Manor
Gentlemen:
I would like to comment regarding this case inasmuch as
I was the general partner of the limited partnership that
sold this park to Silver Spur Reserve. At the time we
purchased the park some eight years ago there were two
swimming pools in the park even though the number of
residents was about 1/3 of the number now living there,
in view of the numerous additions made to the park.
The residents at that time did not use the second swimming
pool and did not want it in the park and we finally filled
the pool in and turned it into landscaping. Since that
time and up to June 1, 1977 when we sold the park, there
was never any indication from anybody in the park that
they wanted to have another swimming pool. As a matter of
fact, in the seven years I have never seen the present
swimming pool used up to anywhere close to its reasonable
capacity.
For a number of years I was counsel of .lbile Home Com-
munities of Denver, Colorado and did the purchasing of
large parks across the United States so I believe I can
qualify as somewhat knowledgable in park operation and
park planning. It is a generally known fact in the mobile
home park operations that it is a very serious mistake to
have,in a park of this size..over one swimming pool. Two
swimming pools will generally result in encouraging people
to feel, regardless of how well it is done, that one is
better than the other or that management does more for
one group than the other. Obviously this is not a con-

dition that is sound in any park and I am sure that if
you care to, I can furnish you with many independent
operators' opinion on this condition. Of course, I am
sure that you understand this does not apply when you
have a park that has a family section and an adult
-- section, but it applies to every park that I have been
involved with over the years.
I have reviewed the plans in detail and in my opinion
the amenities, the changes, the preservation of open
space will lend a great deal to the park and the resi-
dents' enjoyment of it.
I strongly believe that two swimming pools would take
away from the park rather than benefiting it. I strongly
urge you to approve the request that the swimming pool
be dropped from the plans.

I am advised that the Design Review Board and Planning
Commission have approved the concept of dedication of the
existing rock area to perpetual open space so as to pre-
serve, presently and in the future, the natural beauty of
this desert formation, except for a lawn area with meandering
paths and an open bench and barbeque area for resident
social gatherings.
The question which I am advised is at issue is whether
the addition of a second swimming pool (not therapy pool) at
the existing social, recreation and clubhouse area is
feasible in terms of resident usage and enjoyment. The
reasons supporting the applicant's not building a second
swimming pool may be summarized as 'follows:
1. The approval of the amenity plans without a second
swimming pool would be consistent with the appli-
cant's concept to broaden the spectrum of amenities
available to obtain maximum resident usage according
to the residents' social and recreational preferences.
2. There does not exist sufficient available space
within the existing social, recreation, clubhouse
and swimming area to build a second swimming pool.
3. The existing swimming pool provides sufficient
water area for the residents based upon their use
of same.
4. The expansion and "Kool Decking" of the existing
swimming pool deck area with additional furniture
will provide the residents with their primary need
according to their historical social desires. The
November, 1977, residents' opinion poll and other
resident preferences expressed to me confirm that
the residents desire additional area around the
pool to gather, socialize, and sun themselves with
separate toilet facilities. These improvements
have been provided for in the plans previously
submitted.
5. The present swimming pool water surface area is
more than sufficient for adult usage at peak periods.

residents who treat the single existing therapy
pool as their exclusive facility.
Accordingly, it is respectfully requested that the
Silver Spur Reserve application be approved without the
addition of a second swimming pool in the "natural desert
park area" or at the existing recreational and clubhouse

I would like to comment regarding this case inasmuch as
I was the general partner of the limited partnership that
sold this park to Silver Spur Reserve. At the time we
purchased the park some eight years ago there were two
swimming pools in the park even though the number of
residents was about 1/3 of the number now living there,
in view of the numerous additions made to the park.
The residents at that time did not use the second swimming
pool and did not want it in the park and we finally filled
the pool in and turned it into landscaping. Since that
time and up to June 1, 1977 when we sold the park, there
was never any indication from anybody in the park that
they wanted to have another swimming pool. As a matter of
fact, in the seven years I have never seen the present
swimming pool used up to anywhere close to its reasonable
capacity.
For a number of years I was counsel of Mobile Home Com-
munities of Denver, Colorado and did the purchasing of
large parks across the United States so I believe I can
qualify as somewhat knowledgable in park operation and
park planning. It is a generally known fact in the mobile
home park operations that it is a very serious mistake to
have,in a park of this size -over one swimming pool. Two
swimming pools will generally result in encouraging people
to feel, regardless of how well it is done, that one is
better than the other or that management does more for
one group than the other. Obviously this is not a con-

dition that is sound in any park and I am sure that if
you care to, I can furnish you with many independent
operators' opinion on this condition. Of course, I am
sure that you understand this does not apply when you
have a park that has a family section and an adult

the amenities, the changes, the preservation of open
space will lend a great deal to the park and the resi-
dents' enjoyment of it.

be dropped from the plans.

I. The development of the property shall conform substantially with that as
shown on Plot Plan marked Exhibit A on file with the Department of Environ-
mental Services, Case No. CUP 13-77, unless otherwise amended by the follow-
ing conditions.
2. Prior to the issuance of a building permit for construction of any use con-
templated by this approval, the applicant shall first obtain permits and
clearance from the following public agencies:
Department of Public Health Palm Desert City Fire Marshal
Department of Public Works Coachella Valley County Water District
Palm Desert Design Review Board Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above agencies shall be presented
to the Building and Safety Department at the time of the issuance of a building
permit for the use contemplated herewith.
3. A preliminary landscaping, grading, lighting, amenities, trash storage, walkway
layout, signage, and irrigation plan shall be submitted through the Design
Review Board process for approval prior to issuance of building permits.
4. The sewage disposal system shall be submitted to and approved by the Coachella
Valley County Water District prior to issuance of a building permit.
5. This approval_ shall be used within one year, otherwise it shall become null and
void.
6. All utility distribution service lines within or adjacent to the subject property
shall be placed underground.
7. A six (6) foot decorative masonry wall or alternate as approved by the Design
Review Board process shall be installed along the complete frontage of the north
and west property lines. All other fencing shall be approved by the Design
Review Board process.
8. The applicant shall comply with any laws, regulations, and requirements of the City
of Palm Desert, the State of California or any other applicable government agency
as a part of construction.
9. Construction of all private streets shall be inspected by the Engineering Depart-
ment and a standard fee shall be paid.
10. Install Riverside County Standard Fire Hydrants, located at intersections so
no mobile home is more than 250 feet from a hydrant.
11. Fire hydrants shall be installed on approved looped water mains as follows:
a. A minimum of 6 inch diameter to serve all buildings and recreational vehicle
storage lots.
12. Provide the following fire flows for a two (2) hour duration in addition to domestic
or irrigation supply. All computations shall be based upon a minimum of 20 psi
residual operating pressure in the supply main from which the flow is measured
at the time of measurement.
a. 500 GPM to serve all buildings and mobile homes.
b. 500 GPM to serve recreational vehicle storage lot.

13. Prior to issuance of building permits, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
14. The water system plan shall be signed by a registered civil engineer and approved
by the water company with the following certification: "I certify that the
design of the water system in CUP 13-77 is in accordance with the requirements
prescribed by the Fire Marshal". Upon approval, the original plan will be return-
ed to the developer.
15. The subject site shall be annexed to Improvement District Nos. 54 & 80 of the
C.V.C.W.D for sanitation service and to the Coachella Valley Stormwater Unit of
the C.V.C.W.D.
16. The applicant shall engineer; and provide for drainage facilities necessary
to handle runoff waters along the northerly boundary of this subdivision
to the satisfaction of the City Engineer.

The following modifications should be made to the plans for the approved
addition to Silver Spur Mobile Manor submitted to this office and the
additional information provided at your earliest convenience:
1. Lot 6 on Flying F Drive shall be deleted and shall be utilized as
common open space.
2. A masonry wall shall be provided along the perimeter of the addition
as required by the Conditions of Approval.
3. The picnic area shown is acceptable, but a childrens' swimming pool
should also be included in order to alleviate some of the overcrowd-
ing at the existing pool.
4. A number of the lots will have to be increased in size in order to

CONDITIONS OF APPROVAL
CASE NO. CUP 13-77
1. The development of the property shall conform substantially with that as
shown on Plot Plan marked Exhibit A on file with the Department of Environ-
mental Services, Case No. CUP 13-77, unless otherwise amended by the follow-
ing conditions.
2. Prior to the issuance of a building permit for construction of any use con-
templated by this approval, the applicant shall first obtain permits and
clearance from the following public agencies:
Department of Public Health Palm Desert City Fire Marshal
Department of Public Works Coachella Valley County Water District
Palm Desert Design Review Board Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above agencies shall be presented
to the Building and Safety Department at the time of the issuance of a building
permit for the use contemplated herewith.
3. A preliminary landscaping, grading, lighting, amenities, trash storage, walkway
layout, signage, and irrigation plan shall be submitted through the Design
Review Board process for approval prior to issuance of building permits.
4. The sewage disposal system shall be submitted to and approved by the Coachella
Valley County Water District prior to issuance of a building permit.
5. This approval. shall be used within one year, otherwise it shall become null and
void.
6. All utility distribution service lines within or adjacent to the subject property
shall be placed underground.
7. A six (6) foot decorative masonry wall or alternate as approved by the Design
Review Board process shall be installed along the complete frontage of the north
and west property lines. All other fencing shall be approved by the Design
Review Board process.
8. The applicant shall comply with any laws, regulations, and requirements of the City
of Palm Desert, the State of California or any other applicable government agency
as a part of construction.
9. Construction of all private streets shall be inspected by the Engineering Depart-
ment and a standard fee shall be paid.
10. Install Riverside County Standard Fire Hydrants, located at intersections so
no mobile home is more than 250 feet from a hydrant.
11. Fire hydrants shall be installed on approved looped water mains as follows:
a. A minimum of 6 inch diameter to serve all buildings and recreational vehicle
storage lots.
12. Provide the following fire flows for a two (2) hour duration in addition to domestic
or irrigation supply. All computations shall be based upon a minimum of 20 psi
residual operating pressure in the supply main from which the flow is measured
at the time of measurement.
a. 500 GPM to serve all buildings and mobile homes.
b. 500 GPM to serve recreational vehicle storage lot.

13. Prior to issuance of building permits, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
14. The water system plan shall be signed by a registered civil engineer and approved
by the water company with the following certification: "I certify that the
design of the water system in CUP 13-77 is in accordance with the requirements
prescribed by the Fire Marshal". Upon approval, the original plan will be return-
ed to the developer.
15. The subject site shall be annexed to Improvement District Nos. 54 & 80 of the
C.V.C.W.D for sanitation service and to the Coachella Valley Stormwater Unit of
the C.V.C.W.D.
16. The applicant shall engineer; and provide for drainage facilities necessary
to handle runoff waters along the northerly boundary of this subdivision
to the satisfaction of the City Engineer.
17. In conformance with the Zoning Ordinance requirement, applicant shall provide a
minimum of 6800 square feet of community use area, the location of which is to
be approved by staff.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply with all
the conditions set forth, and understand the Department of Building and Safety will

I hereby acknowledge that I have read and agree, to comply
with all the following requirements, and understand that
the Department of Building and Safety will not issue a
building permit or allow occupancy on the use permitted
until this signed confirmation has been received by the
Department of Environmental Services.
The development of this project shall conform substantially
to all development plans submitted in behalf of this case,
and as revised according to the Design Review Board process.
Any minor change requires approval by the Director of Envi-
ronmental Services. Any substantial change requires ap-
proval by the Design Review Board.
All requirements of any law, ordinance, or regulation of
the State, City, and any other applicable government entity
shall be complied with as part of the development process.
This approval is applicable, subject to the development of
this project, commencing within one year from approval date
and being promptly completed.
Landscaping (with irrigation system) shall be installed
prior to final inspection and receiving certificate of
occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided
along the full frontage of the lot by means of installation
prior to final inspection or other provisions as approved by
the City Engineer. Construction shall conform to City Stan-

Silver Spur Mobile Manor, 50-001 Highway 74, Palm Desert, California,
and hereby represents and warrants that he has the power to sign
any and all documents on behalf of said partnership, and further
is empowered to delegate this signatory power on behalf of the
partnership to any person or persons so designated by him.
For purposes of necessity and administrative convenience,
this letter will hereby authorize Mr. Robert B. Turnbull,
Manager of the Silver Spur Mobile Manor, to sign any and all
applications, permits, or related forms required by the Architectural
Review Board on behalf of Silver Spur Reserve relating solely to
submission of required documents, plans, or related materials
for the purpose of obtaining required municipal approval for
the additional construction of mobilehome pads and/or amenity
improvements on the subject real property.
