Boyd Desert Enterprises Investment Company 42500 Portola Avenue Palm Desert, CA 92260 Subject: Progress at Portola Country Club Dear Mr. Boyd: As I have indicated in our conversation of May 15th, the City is not happy with the progress regarding completion of the final phase of Portola Country Club. Your previous correspondence of March 12th indicated full compliance of all areas of concern by the end of April, and as you know, that has not occurred. Further, in our meeting of May 15th, we did point out to you further concerns with regards to the lack of clean-up along Portola, northerly of your major entrance, and the matter of the recreational vehicle storage lot not being paved. Since progress has not been satisfactory in terms of landscaping and general clean-up in the final phase of Portola Country Club, I have instructed Staff not to act upon any additional requests for trailer installations in the new area until full compliance to required condi- tions of the original approvals on this project are complete. I have further instructed Staff that unless these conditions are met by June 15th, that even previous approvals for mobile home installations will be held up until compliance is achieved. In order to forestall this, I would suggest that a greater effort be put out to complete the necessary landscaping, clean-up, etc. in the area under discussion. truly yours, Paul A. JIM BOYD; ACTING PROJECT DIRECTOR The following represents the status of certain work in and around Portola Country Club. 1. The 2,650 foot North fence a. Completed grading of 30' right of way b. Installed snow fencing within right of way (some repair required) C. Installed new 1k" water line to feed emitter system. d. 95% complete - planting of tamarisk etc. within the right of way. e. Required Pyracanthas in stock and will be planted within the next few days. f. Fence slats contracted to be removed. 2. East fence has been re -constructed by Allen Fence and the slats are being removed. 3. Rebecca Road - All plants in stock and scheduled for planting this week per plan. 4. All paving on site including 25x80 parking area in North East common area complete 5. Two common areas planted and landscaped per plan. Remaining plastering of 1 pool scheduled for completion this week. 6. South West section of Golf Course complete, including re -construction of lake, planting of required trees per plan. 7. Work in progress includes re -shaping of three (3) remaining Golf Course areas, planting of trees per plan, re -shaping of lakes, repair and re -location of sprinklers, reseeding of fairways and greens etc., planting of trees on West exterior fence, placing of street name signs, removal of weeds on existing lots on Phase I, and a host of minor incidental items. It is our present feeling that we are making outstanding progress in the completion of this project, from which we plan to have the above captioned work completed by the end of May. The meeting was called to order at 2:15 p.m., after a 2-hour Study Session. Members present: Eric Johnson Phyllis Jackson Vern Barton Murrel Crump (for Paul Williams) Members absent: Jim Hill Bernie Leung Frank Urrutia Paul Williams Staff present: Stan Sawa Clyde Beebe (Study Session) It was moved by Jackson, seconded by Johnson, that the minutes of April 10, 1979, be approved as written; carried 4-0 (Jackson, Johnson, Barton, Crump). II. Minute motion approving cases found acceptable at the Study Session -- NONE. III. CASES / Case No. 131 MF - PALM DESERT 210 LTD - Final approval of plans for landscaping along Rebecca Road between Gary Avenue and Merle Avenue. Applicant was present. The applicant discussed the changing of the type of tree and vine used along the fence. On a motion by Crump, seconded by Barton, the Board approved the plan, subject to the following modifications: 1. Change Pyracantha Lelahbii to Pyracantha Graberi 2. Change Callistemon Lanceolatus (standards) to callistemon viminalis (standards) carried 4-0 (Jackson, Johnson, Barton, Crump). Case No. 97 C - GEORGE RITTER, AIA, FOR K.B. JACQUES ENT., INC. - Final construction plans for a 2-story office building on property located at 74-303 Highway 111. Applicant was present. The Board discussed the applicant's choice of tile, which is to be used above and below show windows. After considerable discussion, the Board requested that a tile which is more compatible to the colors used in the building be chosen. With regard to landscaping in the parking lot area, the Board requested that every other Carob tree along the east property line be removed with the remaining trees enlarged in size. They also requested that every other Ficus Nitida be removed in the T-shaped parking lot planter, with the remaining trees increased in size. The Board then discussed the disposition of street trees along Highway 111. After considerable discussion regarding where to place the street trees, the Board decided that 4 ft. by 4 ft. tree wells be placed adjacent to the curb with the tree well bricked in. Street tree to be used will be a Ficus Nitida. The applicant was requested to provide a concrete pad and apron for the trash enclosure to insure easy access. Case N 131MF - PALM DESERT 210 LTD. - Final approval of a landscape plan, perim er fenci grading, and ancillary recreation facilities for a 220 space ome subdivision located easterly of Portola and northerly of the Whitewater Channel. Applicant was present. Major concerns discussed with respect to this case were the fencing and landscaping materials to be used. On a motion by Barton, seconded by Jackson, the Board approved the final plans with the following revisions: a. Provide landscaping along the pedestrian connections to the golf course. b. Provide greater variation of landscape materials and additional materials along the golf course to buffer and protect adjacent mobile homes. Such landscape materials should include african sumac or olive trees or rhus lancea -- spreading trees with a broad head that crown out fairly low. c. 6' chain link fence shall be provided at the projects north property line with the addition of: Tamarisk every 10' and oleanders every 5' shall provide landscape buffer. 2. Pyrocantha shall be provided on the outside of the fence at 10' oc if slats are not used or on the inside of the fence if slats are used. 3. The matter of barbs on the top of the fencing shall be resolved be- tween the applicant and the Director of Environmental Services. ` d. Provide a street tree per lot in conformance with Municipal Code require- ments (Subdivision Ordinance). e. Tennis courts shall be unlighted and fenced with a 10' chain link fence. f. Additional landscaping shall be provided along the north side of the tennis courts. Oleanders would be a suitable landscape material for this location. g. Provide a minimum of five off-street parking spaces approximately 25 feet southeast of lot 220 to Ordinance Standards. h. Irrigation plan with dimensions shall be provided. i. Tree sizes shall be minimum 15 gal. on evergreen trees and 24" box on olives. j. A revised landscaping and site plan reflecting the noted revisions shall be submitted to the Environmental Services Department for approval and compliance with recommendations. I submit for you the following in terms of the schedule of the completion of landscaping, etc. Today, Thursday, I caused an inventory of trees in ground and storage to be made. Within and around golf course property we found the following: a. 101 - 50' + or - Date Palms b. 320 - Eucalyptus (15 gal. size) C. 27 - Pine Trees In storage and on site we have: a. 50 - 15 gal. Pine Trees b. 61 - 15 gal. Eucalyptus Trees C. 7 - 25 gal. + or - Olive Trees The approved plan called for 80 Evergreen or Eucalyptus, 57 Palm Trees and 102 Pine Trees. It is our plan to immediately order and plant an additional 25 - 15 gal. Pines, as well as 50 - Pines in storage. This I submit will be completed on or before April 20, 1979. Additionally we have several hundred 1 gal, oleanders that were purchased and planted between July 17, 1978 and the present. I am negotiating this day with two engineering contractors in so -far -as the recommended 30' strip outside existing fence. I hope to commence this work not later than April 17th. /31W M I have this day arranged for purchase and delivery of 280 1 gal. Tamarisk trees and 280 1 gal. Pyracanthas'. I have lined up a quantity of 5 gal. oleanders locally as well as a quantity of 1 gal. Pyracanthas' for the Rebecca Road section as made reference to. This day I have also arranged for an exceptable and approved landscaping architect (Scott McKee) to cause immediately to be prepared the subject landscape plan on Rebecca Road as per your request and the C.U.P. directive. I now direct your attention tothe blow sand problem along the 2656' North fence. At this moment, we do not have a specific plan in so -far -as blow sand intrusion into the planted area is concerned. I suggest however that we will develop or conceive something that will allow this area to grow. A contract has been let to "Landscaping by Suzi" for the sprink- ling system and planting of the areas around the two pools. This I suggest will be complete per plan the week of April 23rd. All of the above afore mentioned planting is also contracted to "Landscaping by Suzi". I now direct your attention to the East fence. As you know, the winds earlier this week, caused several hundred feet of fence to blow over. I submit the reason it blew over was because of diagonal metal slats being placed in the original construction of the fence. I now suggest to mitigate this problem, the fence has been ordered to be restored by Allen Fence Construction and I will cause to be removed all metal slats. It is my feeling that the impact of leaving the slats in or the removal of every one or two of these slats will not eliminate the possibility of the fence blowing over in the future. I believe we both have to acknowledge that the original fence was not designed as an acceptable wind buffer. Additionally I feel that the removal of these slats will precipitate certain blow sand intrusion into and on improved lots before the plants are of sufficient size to partially eliminate such. In sumation, I am sure you will have to acknowledge from the meeting, my instructions from Jack Bennett are to expedite the above captioned work as expediciously and timely as possible. I have been further ordered and instructed to do any and all remaining incidental work in so far as getting full city acceptance of this project. We have other incidental work not necessarily discussed in this correspondence of which we are presently pursuing. Therefore, I submit that the above captioned work will be completed and I especially appreciate you and your office in the spirit of cooperation necessary for this and all endeavors. Mr. Crump reviewed the cases and noted the revisions as suggested by the Design Review Board for Case Nos. 15011F & 149MF. Regarding Case o. 131MF - there was some discussion, about the wall re- quired, and the rs to be placed in front of it to help control the sand problem. Case No. 123MF was reviewed. On a motion by Commissioner Kryder, seconded by Commissioner Berkey, the Commission approved the actions of the Design Review Board by Planning Commission Resolution No. 422; carried (4-1) AYES: Berkey, Kelly, Kryder, Snyder; NOES: Fleshman X. DISCUSSION ITEMS Mr. Williams noted a referral from the City Council on Case No. C/Z 09-78 and DP 13-78, LEWIS HOMES OF CALIFORNIA, Applicant. He noted three alternatives that the Commission could take on the referral at this time. option. BETTY WILLIAMS, Rep. of Lewis Homes, spoke to the Commission and stated that some of the lots on the north side could have their own pools. She also stated that Lewis Homes does not want to appear to be in constant conflict with the Planning Commission, they want to work with the Commission and the City. Commissioner Berkey asked if she would agree with the third Mrs. Williams replied whatever is best, she will agree. Commissioner Snyder stated that the City worked very hard on the College of the Desert Specific Plan and the area should remain PR-4. He suggested that more land be given to the City and then the PR-4 would be possible. He also stated the the applicant knew the problems of the area, with regard to drainage, when the land was purchased. Minutes Palm Desert Planning Commission October 31, 1978 Page Ten X. Commissioner Fleshman asked if the Commission's comments could be forwarded to the City Council at this time so that each time this item comes before either body there is not a battle. It was suggested that option three be taken and the case scheduled for consideration on November 15, 1978. Commissioner Kryder stated that the Council should know that the Commission still wants PR-4, but that it will still be discussed on November 15, 1978. Mr. Williams reviewed the cases and noted the concerns of the Design Review Board and noted that the Design Review Board had requested that the courts be recessed 4 feet. Chairman Berkey declared the Public Hearing open and asked if the applicant would like to speak at this time. ROBERT BARNES, President of Deep Canyon Tennis Club Homeowners' Association, noted his disagreement with recessing the courts 4 feet. GREG ERICKSON, Vice President of J. M. Peters, Architect for the project, stated that he had not been notified of the Design Review Board meeting. He noted that the additional cost to recess the tennis courts would be about $10,000. Would like to be able to go back to the Design Review Board if the problem cannot be solved at this meeting. Commissioner Kryder stated that if it is costly then the Design Review Board should reconsider. Commissioner Fleshman asked the applicant if he could compromise and lower the courts 2 feet. Mr. Erickson stated that the retaining wall would also be very costly if this approach was used. Mr. Cipriani noted that the applicant had first submitted this case several months ago and due to the complete plans not being sub- mitted it had been delayed. It is the applicant's responsibility to check on the Design Review Board meeting date under these circumstances. There was some discussion as to the height of the fence and the material to be used. Also there was some concerned mentioned for the scenic highway view along Highway 74. An addition to Special Condition No. 2 was suggested to read as follows: as not to be visible from Highway 74 frontage. Commissioner Fleshman asked if there would be more landscaping than there is at present. Mr. Erickson stated that there would be. Mr. Williams reviewed the cases and noted the concerns of the Design Review Board with regard to spire and the continuation of the meandering bike path. Chairman Berkey asked if Standard Condition No. 1 should state that the case will go back before the Design Review Board. Mr. Cipriani noted that the case was continued by the Design Review Board so they will be reviewing it again. Commissioner Kelly suggested that Special Condition No. 10 be combined with Special Condition No. 6. Chairman Berkey declared the Public Hearing open and asked if the applicant would like to speak at this time. OTTO KORVER, 1110 S. Robertson, Los Angeles, stated that the main part of the tower was 59 feet high, which could be cut to 55 feet, the tower is tapered up till the last two feet which is a lightning rod. Commissioner Snyder noted that he believed that the highest point in the City had to have a red light on top of it. Mr. Korver had no objection to this. He then asked about the right-of-way as stated in Special Condition No. 4 and the mounding as noted in Special Condition No. 10. Mr. Williams noted that the figure in Special Condition No. 4 should be 110 feet not 126, and with regard to the mounding, 3 feet would be sufficient. Chairman Berkey asked if there was anyone wishing to speak in FAVOR of the project. PAUL PAYNE, 208 Michelle, Palm Springs, stated that if the tower is lowered it would be out of proportion with the building and it would be better to delete it if the maximum is 551. He asked to have the traffic safety lighting explained. Mr. Williams stated that the Director of Public Works intent is that the intersection and the driveways be lite. Chairman Berkey noted that since the Design Review Board had continued the case, the Commission should not be considering it and Special Condition No. 8 should be deleted and left up to the Design Review Board. Commissioner Fleshman noted that the spire should be left as proposed or not at all, the building will speak for itself. Commissioner Kryder stated that the 77 ft. spire is necessary for the architecture of the building and to eliminate it the building might loose impact, and noted his approval of the Variance request. Commissioner Snyder stated that he agreed that the spire was an important part of the church but that we do have an ordinance and a Design Review Board, so let the architect work it out with them. Commissioner Kelly suggested that just the CUP be approved and eliminate the Variance. Commissioner Snyder stated that the Variance should be denied and adopt the Resolution as written but leave the spire up to the Design Review Board. Mr. Williams advised the applicant that the next Design Review Board meeting was July 11, 1978, at 5:30 p.m. and that they would need a sample material board. C/Z 02-78 and related Draft EIR TOM O'SULLIVAN, stated that he opposed the project due to the traffic problems and the access to the property. Page Six (font.) Chairman Berkey stated that the present R-1 would create more access to Alamo and that this proposal allows for control. At this time Chairman Berkey declared the Public Hearing closed and asked for the pleasure of the Commission. Commissioner Fleshman stated that the easiest access for most of the residents of the project would be to use the Alamo entrance/exit; PR is preferred to R-1; all questions and concerns noted at this hearing should be better clarified; and, no more than 200 of the traffic should be directed to Alamo. Commissioner Flesh - man proposed a PR-3 zone. Commissioner Kelly stated that she like Commissioner Flesh- man's proposal; against the higher density; planned residential is only workable zoning for the parcle. Commissioner Snyder noted that the presentation and the EIR were both very complete but he is concerned with the flood control and the obligation of the City. The work that needs to be done in the City is beyond the scope of the applicant. Planned residential is good for the area. Commissioner Kryder stated that he concurred with Commissioner r Snyder and that the EIR is so complete that it defeats itself in a L sense. He noted his continued concern for projects being approved prior to the completion of flood control in the City. Chairman Berkey stated that he liked Commissioner Fleshman's approach and that he was concerned with the zone change and the in- crease in density. The PR-3 is a good solution. On a motion by Commissioner Fleshman to recommend to the City Council a Change of Zone of PR-3 and to certify the EIR as complete by Planning Commission Resolution No. 374, seconded by Commissioner Kelly; carried (4-1) (AYES: Berkey, Fleshman, Kelly, Kryder; NOES: Snyder).
