Subject: Apartment Complex on Shadow Mountain
Dear Mr. Ricciardi:
Recently the Design Review Board considered a 7-unit apartment com-
plex that you have designed, on Shadow Mountain Drive. Said Board
did require a number of revisions to the plans which resulted in an
action by the Planning Commission when they reviewed them, of rejec-
tion, to require the revisions made before they accepted them. Sub-
sequent to these reviews, I have been in contact with a number of
property owners in the area who are concerned with regard to the
2-story element of said project. Further, said individuals have
contacted the property owners' association to indicate their concerns.
As you know, no 2-story development exists in the whole block between
San Luis Rey and Portola.
In your redesign, to reflect the requirements of the Design Review
Board, you may want to consider an alternative design to the 2-story
aspect of the project as it presently exists. I am suggesting this
reconsideration of the 2-story element on the basis that it may be
a requirement of the property owners' assocation when they review the
project.
If you have any questions regarding this matter, please feel free to

Chairman Berkey noted that this is.not a Public Hearing
but if there is anyone wishing to speak they may do so at this
time.
ALEX CAMPBELL, 73-416 Golea, noted that the density
is his concern.
JIM WALLACE, 73-575 Encilia, Association #1, Presi-
dent,stated that there are no permanent residents
in his tract.
Commissioner Kryder stated that if all legal paths have been
followed with regard to noticing; there is no need to postpone.
THE MEETING WAS RECESSED FOR A BREAK AT 10:45 p.m. R d6dhvejed at 10:50 p.m.
Mr. Cipriani reviwed the other cases noting that Case No 138MF
should be deleted as revised plans were not received; Case No. 5
is an excellent sign program; Case No. 87C - the parking spaces have
to be relocated; and, 139MF - a retaining wall will be required.
Chairman Berkey noted that he is not concerned with the summer
time lack of attendence and Ironwood has done a good job and it meets
with his approval.
On a motion by Commissioner Kryder, seconded by Commissioner
Snyder, the Commission approved the actions of the Design Review Board
with the deletion of Case No. 138MF, by Planning Commission Resolution
No. 390; carried unanimously (3-0).

7. Case No. 87C - HAROLD MCCORMICK - Preliminary site, floor and elevations
for a commercial structure to be located on the north side of Highway
111, east of San Marcos. Applicant present.
On a motion by Williams, seconded by Barton, the Board approved the
preliminary site, floor and elevations subject to the following changes:
a. Provide trash enclosure in rear.
b. Remove two parking spaces in front of the doors and provide entry
walkways, and additional landscaping._
c. Delete condition no. 15.
Carried 4-0 (Williams, Barton, Urrutia, Palomino)
8. Case No. 135MF - AMERICAN WEST DEVELOPMENT - Preliminary site, floor and
elevations for a duplex to be located on the north side of Alessandro, east
of Cabrillo Avenue.
On a motion by Williams, seconded by Barton, the Board rejected the pre-
liminary site, floor and elevations because of an inadequate site plan and
landscaping plan; carried 4-0 (Williams, Barton, Urrutia, Palomino).
The Board suggested that the applicant meet with the Director of Environmental
Services to discuss what constitutes a complete application submittal.
9. Case No. 139MF - ROBERT PURSEL - Preliminary and final site, floor and
elevations for a 5-unit apartment complex to be located on the east side of
Ocotillo, south of Tumbleweed. Applicant not present.
On a motion by Palomino, seconded by Urrutia, the Board approved the pre-
liminary and final construction drawings subject to the following:
a. Applicant shall provide a self locking gate at the entrance of the
project, between the carport and adjacent to building B.
b. Applicant shall provide for drainage under walkway at the northwest
property corner.
c. The location of all AC units shall be shown and approved by Staff prior
to plan check.
d. Ground cover shall be included or shown for the rest of the project and
approved by Staff.
e. The fence on the east property line may not remain if it is to be used
as a retaining wall.
f. Delete condition no. 3.
Carried 4-0 (Palomino, Urrutia, Williams, Barton).
10. Case No. 138MF - ROBERT RICCIARDI - Preliminary site, floor and elevations
for a 77u ' partment complex to be located on the north side of Shadow
Moun-ta—in, east of San Luis Rey. Applicant present.
On a motion by Barton, seconded by Palomino, the Board approved the preliminary
site, floor and elevations, subject to the following conditions:
a. The first three special conditions noted on Case 139MF shall apply.
b. The applicant shall provide curb and gutter.
c. One unit and one parking space shall be deleted.
d. The applicant shall provide a trash enclosure.
e. The driveway entrance shall be reduced to 24 feet.
f. The applicant shall provide gates to enclose pool area.
g. Standard conditions regarding final construction drawings shall apply.

In response to your letter to the City Council regarding property
immediately east of your residence, please be informed that the City
has received an application known as Case No. 138MF, for development
on said property. Said matter was considered by the City's Planning
Commission on August 1st and continued to allow the applicant to make
certain required revisions to said plans.
Assuming revisions are made to said plans, the soonest the case could
be brought back to the Planning Commission would be on August 16th at
1:00 p.m. in the City Council Chambers. You may be interested in see-
ing the plans as they presently exist and they are available in the
Dept. of Environmental Services in City Hall.
If you have any additional questions regarding this subject, please

5. One unit and one parking space shall be deleted.
6. The applicant shall provide a trash enclosure.
7. The applicant shall provide gates to enclose pool area.
8. Standard conditions regarding final construction drawings shall apply.
9. Final construction drawings including a final landscaping, grading,
lighting, amenities, trash storage, walkway layout, and irrigation
plan shall be submitted to the Design Review Board. No final inspection
or occupancy permit shall be given by the Department of Environmental
Services to this project until the aforementioned approved plans and
construction shall have been completed.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply
with all the conditions set forth, and understand that the Department
of Building and Safety will not issue a building permit or allow oc-
cupancy on the use permitted until this signed confirmation has been
received by the Department of Environmental Services.

Agreement of compliance to be signed by those applying for review.
I hereby acknowledge that I have read and agree, to comply
with all the following requirements, and understand that
the Department of Building and Safety will not issue a
building permit or allow occupancy on the use permitted
until this signed confirmation has been received by the
Department of Environmental Services.
The development of this project shall conform substantially
to all development plans submitted in behalf of this case,
and as revised according to the Design Review Board process.
Any minor change requires approval by the Director of Envi-
ronmental Services. Any substantial change requires ap-
proval by the Design Review Board.
All requirements of any law, ordinance, or regulation of
the State, City, and any other applicable government entity
shall be complied with as part of the development process.
This approval is applicable, subject to the development of
this project, commencing within one year from approval date
and being promptly completed.
Landscaping (with irrigation system) shall be installed
prior to final inspection and receiving certificate of
occupancy.
