IX. DESIGN REVIEW BOARD ITEMS
A. Review of Cases acted on by the Design Review Board
at their meeting of September 12, 1978.
Mr. ani reviewed the cases noting the following concerns:
. 141MF Case No - it was suggested that a Condition No. 14 be added
requiri corative wall to screen out the parked cars as approved
by,the Design Review Board; Case No. 151MF - it was noted that the
Palm Desert Property Onwers can change the setbacks and that it is
suggested to the applicant that they obtain their okay before submit-
ting plans to the City.
On a motion by Commissioner Snyder, seconded by Commissioner
Kryder, the Commission approved the actions of the Design Review Board
by Planning Commission Resolution No. 405; carried unanimously (4-0).
X. DISCUSSION ITEMS
Mr. Williams referred to several items of discussion prior to
the one noted on the agenda, which included: the League of California
Cities Conference for the Planning Commissioners to be held in February;
the forth coming meeting on Flood Insurance; a letter to the County
regarding Case No. C/Z 2285 which the Commission approved on a minute
motion by Commissioner Snyder, seconded by Commissioner Fleshman, carried
unanimously (4-0); the Air Quality Control report put out by the County,
the Commission directed the Secretary to forward a letter to the County
noting the following comments - the Master Plan ignores the possible
benefits of the utilization of nuclear power generation as an alternative
to more polluting generators; - the document fails to provide sufficient
evaluation as to mediation of source pollution which is the major pro-
blem in the Coachella Valley in that much of the air pollution results
from Riverside and areas to the west versus being created in the Valley;
and some of the suggested implementation measures which the Commission
considered to be common sense and should have been implemented by the
County a number of years ago.
Mr. Williams then noted that the minutes of the City Council meet-
ings will be forwarded to the Commissioners; and, that LAFCO has approved
Annexation No. 5 which moves the City's Sphere of Influence out to

The meeting was adjourned to the office of the Director of--T4n
vironmental Services.
A. Discussion of North Sphere Area
An informal presentation by Commissioner Fleshman and an informal
discussion followed regarding the North Sphere Area and the concern of
possibly annexing the area to the City so that growth and development
can be better handled.
It was suggested that the Planning Commission have a joint meeting
with the City Council to discuss this matter. It was tentatively
scheduled for October 18, 1978. It was also suggested that the Com-
mission meet with the City of Rancho Mirage Planning Commission to
discuss joint concerns of growth and development in the area. On a
motion by Commissioner Snyder, seconded by Commissioner Kryder, the
Commission asked for a joint meeting with the City Council to be
held on October 18, 1978 to get a concensus of opinion from the Com-
mission and the Council and to perhaps rearrange the priorities of
the Advanced Planning program; carried unanimously (4-0).

CASE NO. 141MF
1. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All condi-
tions shall be made a part of construction and no certificate
of occupancy shall be issued until completed.
2. Final construction drawings, including a final landscaping, grading,
lighting, amenities, trash storage,_walkway layout, irrigation plans
and sign program shall be submitted to the Design Review Board. No
final inspection or occupancy permit shall be given by the Depart-
ment of Environmental Services to this project until the aforemen-
tioned approved plans and construction shall have been completed.
3. Any/all overhead utility distribution lines shall be undergrounded
pursuant to the provisions of Sec. 25.56.110 of the Municipal Code.
4. Sidewalks shall -be installed along all street frontages as approved
by the Director of Public works.
5. The exterior stucco color shall be changed to reflect more off-
white tones.
6. A more detailed landscaping plan shall be provided.
7.. Landscaping shall include materials to the edge of the sidewalk
along the full frontag-e of the project.
8. Fencing material throughout the project shall be shown.
9. The Jacuzzi shall be relocated to center on the common area of
the project. Appropriate landscaping and screening shall be
provided.
10. Reverse the parking area and provide a 3 ft. setback between car-
ports and the adjacent units.
11. The parking area should terminate on the north at the proposed
walkway with an uncovered parking space.
12. The applicant shall provide an 18" planting strip along the west
property line.
13. Substitute ficus nitida or similar plant for pinus halepensis.

area from the street.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply
with all the conditions set forth, and understand that the Department

PALM DESERT DESIGN REVIEW BOARD MEETING
SEPTEMBER 12, 1978
1. The meeting was called to order at 6:00 p.m. in the Council Chambers of the
Palm Desert City Hall after an hour study session.

It was moved by Williams, seconded by Leung, that the minutes of the meeting
of August 22, 1978, be approved as written; carried 3-0-1 (AYES: Williams,
Leung, Johnson; ABSTAIN: Urrutia).
2. Case No. 70C - GEORGE RITTER - Final construction drawings for a commercial
structure to be located on the south side of Highway 111, west of Sage Lane.
Applicant was present.
Following presentation of this case, the Board requested that the applicant
provide a clarification of the color and material to be used for the project.
The applicant complied with this request. Further discussion of this case
resolved the issue of appropriate landscape materials and sizes.
On a motion by Williams, seconded by Leung, the Board approved the final con-
struction drawings, subject to the applicant revising the landscaping plan
in accordance with the plan on file in the office of Environmental Services;
carried 4-0 (Williams, Johnson, Leung, Urrutia).
3. Case No. 92MF - AFFILIATED CONSTRUCTION - Final construction drawings for a
hotel/condominium project to be located on the south side of Highway 111, west
of the City of Palm Desert City limits. Applicant was present.
The issues resolved were: the number of stories of each building; the use of
stamp concrete; & fencing for the tennis courts.
On a motion by Leung, seconded by Urrutia, the Board approved the final con-
structj�wings; carried 4-0 (Leung, Urrutia, Williams; Johnson).
4. Case No. 141MF ROBERT SHELDON - Preliminary site, floor and elevations for
a fou unit ap tment building to be located at the northwest corner of San
Gorgon'o an as Flores. Applicant not present.
The issues resolved were: setback requirements in the parking area; provisions
for additional landscaping; and, landscape materials.
On a motion by Williams, seconded by Urrutia, the Board approved the preliminary
site, floor and elevations subject to the following:
a. Revise Special Condition No. 10 to reduce the setback between the carports
and the adjacent units from 10 ft. to 3 ft.
b. The applicant shall provide an 18" planting strip along the west property
line.
c. Substitute ficus nitida or similar plant for pinus halepensis.
Carried 4-0 (Williams, Urrutia, Leung, Johnson).

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, ANNOUCING FIND-
INGS AND APPROVING THE DESIGN REVIEW BOARD ACTIONS
OF SEPTEMBER 12, 1978.
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did review the Design Review Board actions of September
12, 1978, approving:
Case No. 151MF - Preliminary site, floor and elevation
plans for a 7-unit apartment complex
for TOM TROLLOPE;
Case No. 141MF - Preliminary site, floor and elevation
plans for a 4-unit apartment complex for
ROBERT SHELDON;
Case No. 146MF - Preliminary site, floor and elevation
plans for a 3-unit apartment complex for
MICHAEL KAY.
WHEREAS, at this time, upon considering and receiving all testi-
mony and arguments, if any, of all interested persons desiring to be
heard, said Commission did find sufficient facts and reasons to exist
to approve the Design Review Board actions of September 12, 1978.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and consti-
tute the findings of the Commission in this case.
2. That it does hereby approve the Design Review Board actions
of September 12, 1978, except that a new Condition No. 14 is added to
Case No. 141MF and Case No. 146MF is hereby continued to the Planning
Commission meeting of Ocotber 3, 1978.

I hereby acknowledge that I have read and agree, to comply
with all the following requirements, and understand that
the Department of Building and Safety will not issue a
building permit or allow occupancy on the use permitted
until this signed confirmation has been received by the
Department of Environmental Services.
The development of this project shall conform substantially
to all development plans submitted in behalf of this case,
and as revised according to the Design Review Board process.
Any minor change requires approval by the Director of Envi-
ronmental Services. Any substantial change requires ap-
proval by the Design Review Board.
All requirements of any law, ordinance, or regulation of
the State, City, and any other applicable government entity
shall be complied with as part of the development process.
This approval is applicable, subject to the development of
this project, commencing within one year from approval date
and being promptly completed.
Landscaping (with irrigation system) shall be installed
prior to final inspection and receiving certificate of
occupancy.
Curb, gutter, curb cuts, and tie-in paving shall be provided
along the full frontage of the lot by means of installation
prior to final inspection or other provisions as approved by
the City Engineer. Construction shall conform to City Stan-
dards and all requirements of the City Engineer.
