APPLICANT AND ADDRESS: Richard Leventhal, Palm Desert, CA 92260 LOCATION: 45710 Verba Santa Drive ZONE: R-1, 20,000 (Single Family Residential) Associate Planner, Audrey Nickerson, narrated a PowerPoint presentation on the item and responded to Commission inquiries. Richard Leventhal, Applicant, provided additional details on the project and answered questions from the Commission. Chair Vuksic opened the public comment period. Richard Leventhal, Applicant, voiced support for his project and asserted they have been responsive to the City’s requests and have taken additional measures to mitigate noise associated with use of the court. Geoff Gregory, a Palm Desert resident, voiced opposition for the project, including inquiries as to whether the City attorney had reviewed the recommendations for loopholes and compliance and how will these recommendations be enforced. Noel Foutz, a Palm Desert resident, voiced support for the applicant, adding they have improved the subject property. Recording Secretary Note: Members of the public, Danny Hopkins, and Charles Willis, advised they did not wish to speak at the meeting during ARC’s review of this item, but requested the minutes reflect they are in opposition to this matter. With no other members of the public wishing to comment, Chair Vuksic closed the public comment period. Discussion on the item ensued with Commissioners providing comments for the project. Page 5 of 43 Following discussion, MOTION BY COMMISSIONER MCAULIFFE, SECOND BY COMMISSIONER LATKOVIC, CARRIED 6-0; to approve Case No. MISC22-0020 with the following conditions: 1. Use of the pickleball court at 45710 Verba Santa Drive shall be limited to daytime hours only. Nighttime use of the court shall be strictly prohibited between 10 p.m. and 7 a.m. 2. The court shall not be rented or used for commercial purposes and shall be used only by the property owner and guests or tenants of the property owners per Palm Desert Municipal Code Chapter 25.40.070. 3. Applicant shall install a perimeter fence, as agreed by applicant, approximately three (3) feet in height surrounding court; to be positioned as required by the municipal code and fence material as allowed by the municipal code. 4. Players shall only use the solid wood paddles provided by the Applicant that are specially designed for use at 45710 Verba Santa Drive in conjunction with standard pickleball balls. Use of any alternative paddles shall first require the submittal of a new noise impact assessment prior to use. 5. The applicant shall install a sign in the backyard at a location clearly visible to pickleball players which prohibits excessive noise or loud music during game play. 6. The applicant shall provide permanent irrigation for the proposed hedges surrounding the sport court. 7. The hedges shall be maintained at a minimum height of 8-feet in perpetuity, or until the sport court is removed. 8. Lighting is not included as a part of this approval. If lighting is proposed at a future date, the applicant shall submit a new permit application to the Planning Division subject to review by the ARC. The lighting shall comply with any outdoor lighting requirements in place at the time of application. The design shall consider impacts on adjacent residents and shall incorporate mitigation measures to screen any outdoor lighting sources. 2. CASE NO: SARC23-0005 NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to approve a Sign Design Review for one (1) new exterior business identification wall sign including an exception to the Waring Plaza Sign Program for a new Planet Fitness at 72250 Highway 111. Angie Harmel, Applicant Representative, and Kenneth Yap, Architect, each narrated a PowerPoint presentation providing additional details on the project and answered questions from the Commission. The PowerPoint presentations shared by the architect and applicant included a revised rendering of the northeast elevation based on feedback provided by the property landlord. The alternative rendering dated May 9, 2023, was recently approved by the landlord and illustrated the limestone plaster material wrapping around the neutral pier pilaster and terminating approximately 18 inches on the northeast façade pilaster. With no other members of the public wishing to comment, Chair Vuksic closed the public comment period. Discussion on the item ensued with Commissioners providing comments for the project. Following discussion, MOTION BY VICE CHAIR MCINTOSH, SECOND BY COMMISSIONER SANCHEZ, CARRIED 6-0; to approve Case No. MISC23-0020 as submitted on applicant’s revised rendering dated May 9, 2023, illustrating the limestone plaster material wrapping around the neutral pier pilaster and terminating approximately 18 inches on the northeast façade pilaster. 6. NON-ACTION ITEMS Principal Planner Melloni reported on April 27, 2023, City Council approved an award of contract for professional services to John Kaliski Architects (JKA) to establish objective design standards. The JKA team introduced themselves and provided an overview of the project and their method to developing objective design standards for the City. They encouraged commissioners to provide comments and insight on what they felt were good designs and undesirable designs. Discussion ensued on the topic. During the discussion JKA provided a memo which included an agenda for their kick-off meeting with the City. This memo will be posted to the City’s website for public inspection. Page 7 of 43 7. EXECUTIVE SUMMARY The Project Applicant, James McIntosh, is requesting approval of a design review for a building height exception for a new single-family residence to exceed the 15’-0” height limit of the Residential Estate (RE) zoning district. The RE zone allows building heights which exceed 15’-0”, up to a maximum of 18’-0” as an exception, subject to approval by the Architectural Review Commission (ARC). Approval of the design review would allow the Applicant to construct the new single-family residence with a maximum height of 16’-8”. PROJECT SUMMARY A. Property Description: The project site is a 1.02-acre (44,652 square-foot) vacant parcel located at 77645 Robin Road. The project site is zoned RE which allows for single-family residential on lots which are a minimum size of one acre. Adjacent parcels to the north, east, and west are developed with existing single-family residences. The area where the project is located was annexed into the City of Palm Desert (“City”) in 1994 per Local Agency Formation Commission (LAFCO) No. 93-46-4 by adopted City Council Resolution No. 94-51. The ARC has previously approved height exceptions for two residential structures on Robin Road. The residence immediately east of the project site was approved with a height of 17’-6” in 2015, and another residence to the north was approved at 18 feet tall in 2003. Page 9 of 43 B. Project Description The Applicant is requesting approval of a design review for a building height exception to construct a new single-family residence. The proposed structure is a 5,725 square-foot, single-family residence with a 490 square-foot attached guest suite. The guest suite contains a sleeping area, bathroom, and wet bar consisting of a refrigerator and sink. The structure measures 16’-8” to the highest point of the roof, and to the top of the chimney, it is 20’-8” tall. The proposed structure has a Mediterranean revival architectural style characterized by a shallow gable, clay tile roof, tower elements, arches, an inset entry door, and stucco and wrought iron finishes. The exterior color palette consists of light tan plaster with a smooth finish and wood accents that complement the roof tile. The building pad elevation is 150.8 feet, which is approximately 2.3’ higher than the pad of the parcel to the east, and 2.16’ below the finished floor of the existing structure to the west. The conceptual landscape plan shows a combination of low and moderate drought-tolerant plant materials. The tree palette in the front yard includes Desert Museum Palo Verdes, Palo Blancos, and various palms throughout the rear yard. There is also a variety of shrubbery and accent plants. The project complies with the development standards of the underlying zone including setbacks, density, and lot coverage. ZONING ORDINANCE SUMMARY Building height exceptions up to 18 feet tall in the RE zone may be granted by the ARC pursuant to the Palm Desert Municipal Code (PDMC) 25.10, Table 25.10-3: Residential Zoning District Development Standards. Findings for the ARC decisions of design review applications are listed under PDMC Section 25.68.040. Page 10 of 43 Findings in support of the project are listed below: A. That the proposed development conforms to any legally adopted development standards. The proposed structure conforms with the applicable development standards for the RE zone, including setbacks, lot coverage, and density. The property is landscaped with drought-tolerant plant materials and graded properly to direct drainage away from surrounding residents. Primary residential structures in the RE zone are permitted at 15 feet tall and may be up to 18 feet with approval of an exception by the ARC. The new single-family home would measure 16’-8” to the highest point of the roof and complies with the allowable maximum height for the RE zone. Tower elements, such as the chimney, are allowed to project an additional 25 feet above the zone’s height limit. The proposed chimney will project 5’-8” above the allowable maximum height of the zone and complies with the maximum allowable height projection for the RE zone. B. That the design and location of the proposed development and its relationship to neighboring existing or proposed developments and traffic is such that it will not impair the desirability of investment or occupation in the neighborhood; and that it will not unreasonably interfere with the use and enjoyment of neighboring existing or proposed developments and that it will not create traffic hazards or congestion. The proposed structure is a single-family residence located within an area developed with other single-family residences. The RE zone permits residential uses, therefore, the structure’s compatibility with the neighborhood would not impair the desirability of investment or occupation. The architectural style complements the surrounding properties which include a mixture of modern and Mediterranean revival architecture. The structure complies with the minimum setbacks and will not unreasonably interfere with the use and enjoyment of the existing homes. This home is not anticipated to generate traffic greater than the typical single-family home. C. That the design and location of the proposed development is in keeping with the character of the surrounding neighborhood and is not detrimental to the harmonious, orderly, and attractive development contemplated by this title and the General Plan of the City. The residential structure features Mediterranean revival architecture which is distinguishable throughout the neighborhood. Certain elements such as the tile gable and hip roofs, tan and cream-colored stucco, as well as arched entryways and windows are commonalities. The design and orientation of the proposed structure is in keeping with the neighborhood so as not to be detrimental to the harmony of this title and the General Plan. The proposed structure is consistent with the applicable zoning standards. Page 11 of 43 D. That the design and location of the proposed development would provide a desirable environment for its occupants, as well as for its neighbors, and that it is aesthetically of good composition, materials, textures, and colors. The proposed design utilizes durable materials that wear well over time including plaster, tile, and wood. The color palette features contrasting tan, burnt orange, and brown that complement one another. The tower elements, roof slope, and architectural projections create a cohesive variation in the massing. E. That the proposed use conforms to all the requirements of the zone in which it is located and all other applicable requirements. The proposed project conforms with the legally adopted development standards of the PDMC for the Residential Estate zoning district, including the land use, density, and built form. F. That the overall development of the land shall be designed to ensure the protection of the public health, safety, and general welfare. The development of the property is designed to ensure protection of the public’s health, safety, and general welfare. The site is adequately served by utilities, and graded in accordance with City requirements to ensure drainage does not affect neighboring properties. Further, the setback from adjacent properties is in accordance with zoning requirements. STAFF RECOMMENDATION Staff recommends the ARC approve the Design Review for a building height exception, determining the requirements of the findings have been met. Any modifications required by the ARC should be added to the motion as a condition of approval. The ARC may also vote to continue the case subject to revisions and clear direction for the requested changes. Attachment: 1. To ensure that meetings will have a quorum, it is urged that members please notify the Recording Secretary or Staff Liaison if you will be late or absent as far in advance of the meeting as practicable. Excused Absence An “excused absence” may be granted due to illness or injury, unexpected business, emergencies, important personal business, official City business, or any reasonable excuse that is approved by the body. Procedure: Members should notify the Recording Secretary or Staff Liaison in advance of the meeting. During the roll call, the Recording Secretary will announce the reason for the member’s absence and request confirmation of the excused absence from the Board. Unexcused Absence A member who does not meet any of the conditions for an excused absence or fails to notify the Recording Secretary or Staff Liaison in advance of the meeting will be marked as an unexcused absence. Limits on Unexcused Absences Unexcused absences shall result in automatic resignation under the following circumstances: • Six unexcused absences from regular meetings in any twelve-month period on appointed bodies that meeting twice monthly. • Three unexcused absences from regular meetings in any twelve-month period on appointed bodies that meeting monthly. • Two unexcused absences from regular meetings in any twelve-month period on appointed bodies that meeting bimonthly. • One unexcused absence from a regular meeting in any twelve-month period on appointed bodies that meet quarterly. Waiver of Unexcused Absences Upon reaching the number of unexcused absences, the City Clerk shall notify the regular member that they are subject to automatic resignation and shall provide a 15-day grace period for the member to request waiver of any unexcused absence from the Mayor, after which the resignation shall be deemed automatic.
