Subject: City Council Meeting of July 13, 2023
Below you will find questions received from the Mayor or Councilmembers and answers provided by
City staff regarding tonight’s City Council meeting:
ITEM 1D: APPROVE REVISIONS TO THE CITY OF PALM DESERT’S PUBLIC ART
DEACCESSIONING POLICY
Q1: Under the revisions, will artists have the option to replace a deaccessed artwork within
30 days, as is listed in the prior policy?
A1: The revision to the City’s Public Art Deaccession Policy removes #12 under “Sequence of
Action” under the former policy – “If a privately owned work is deaccessioned, the artwork
owner has ninety (90) days to install a new, approved piece at the same location. If the new
work is not installed within ninety days of the removal of the original piece, then the City has
the right to revoke the location’s Certificate of Occupancy permit. If the owner anticipates the
need for longer than ninety days s/he must petition the City for an extension before the 90
days expire.” as it relates to privately owned artwork. The reason for removing this information
is that the actual process for deaccession of privately owned artwork is included in Palm
Desert Municipal Code Section 4.10.130 Removal or alteration of artwork.
A. Public art installed on or integrated into a construction project pursuant to the provisions of
this chapter shall not be removed or altered without the approval of the city council. If such
public art is knowingly removed or altered without prior approval from the public art
department, the occupancy permit for the project may be revoked by the city council upon due
notice and an opportunity to be heard. The city may in addition pursue any other available civil
or criminal remedies or penalties.
B. If any artwork provided on a development project pursuant to the provisions of this chapter
is knowingly removed by the property owner without the approval of the public art department,
the property owner shall contribute funds equal to the development project’s original public art
requirement to the city’s art in public places fund, or replace the removed artwork with one
which is of comparable value and approved of by the public art department. If this requirement
is not met, the occupancy permit for the project may be revoked. (Ord. 673 § 1, 1992)

LAND AND AUTHORIZING STAFF TO RELEASE A NOTICE OF AVAILABILITY FOR THE
SALE OF THE PROPERTIES
Q1: is it possible to retain the land as open space/park?
A1: Yes, the resolution allows the city to proceed with a notice of availability to solicit buyers for
the property; however, there is no mandated timeline for when the city chooses to release the
notice. If the City chooses to keep the property for open space the notice will not be released.
ITEM 1O: REJECT ALL PROPOSALS FOR BUMP & GRIND TRAILHEAD RESTROOM PROJECT
AND AUTHORIZE STAFF TO READVERTISE FOR PROPOSALS (PROJECT NO. 956-23)
Q1: Do we know why there is such a discrepancy between the budget and the bid? Are the
plans perhaps more ambitious than the budget allows? What is our strategy for
increasing the likelihood of additional bidders?
A1: In regard to the discrepancy, City staff held a mandatory pre-proposal meeting for the project,
in which only one vendor was in attendance. Staff believes the lack of competition may have
factored into such a discrepancy. Staff has since held a second mandatory pre-proposal
meeting but did not receive any additional responses as well. Staff anticipates the project may
exceed the budget slightly due to rising material and labor costs, but not by the margin
reflected in the previous bid.
In regard to strategizing to increase bidders, staff intends to take the following steps:
• Re-advertise the project;
• Make the pre-proposal meeting non-mandatory; and
• Perform additional outreach to vendors who perform similar work, including the vendor who
previously submitted the sole bid.
ITEM 1R: APPROVE FIRST AMENDMENT TO THE AGREEMENT FOR MARKETING SERVICES
BETWEEN THE CITY OF PALM DESERT AND IDEA PEDDLER
Q1: Where can the 2022/23 Quantitative Market Research be viewed?
A1: An overview of the research was shared with the Marketing Committee but has not been
published. The marketing team is happy to meet with anyone who would like to learn more
about the findings.
Q2: What markets will be targeted to maximize use of the $400K allotted for media buys?
A2: The City’s tourism marketing campaign primarily focuses on the drive market: Los Angeles,
Orange County, and San Diego. This approach allows the City to capitalize on the marketing
done by both Visit Greater Palm Springs and Visit California, which have large budgets and a
wide reach.

PRODUCE PALM DESERT’S 50TH ANNIVERSARY CELEBRATION
Q1: Is Allied the same security company that was used for Palm Desert Fashion Week?
A1: Allied Universal Security Services is the same company that was used for Fashion Week El
Paseo.
Q2: Has there been a consideration to have an ATM machine, since not everyone uses
Venmo/Zelle/etc.?
A2: We can work with PSL on inclusion of an ATM machine on premises for the event.
Q3: What is the projected cost for RSO support?
A3: Because the scope of the event has not yet been determined (i.e., number of and caliber of
musical acts, amount of food and artisan vendors, duration and timing of event, and actual
estimation of attendees), it is difficult to say how much RSO staff will be needed and what the
projected cost for support will be at this time. However, all those questions should be
answered by the time staff returns in September to request waiver of park municipal codes
and we can provide an update and estimate at that time.
