the Architectural Review Commission on issues that are not on the agenda for up to three
minutes. Because the Brown Act does not allow the Commission to act on items not listed on
the agenda, members may briefly respond or refer the matter to staff for a report and
recommendation at a future meeting.
4. CONSENT CALENDAR: All matters listed on the Consent Calendar are considered routine
and may be approved by one motion. The public may comment on any items on the Consent

RECOMMENDATION:
1. Staff recommends the ARC continue the design review of the subject fence height
and material exception to a date uncertain, to allow City staff additional time to
work with the Applicant on providing additional information and design details.

1. CALL TO ORDER
A Regular Meeting of the Architectural Review Commission (ARC) was called to order by
Chair Vuksic on Tuesday, June 13, 2023, at 12:35 p.m. in the Council Chamber Conference
Room, City Hall, located at 73510 Fred Waring Drive, Palm Desert, California.
2. ROLL CALL
Present: Commissioners Dean Wallace Colvard, Michael McAuliffe, Vice Chair Jim
McIntosh, Francisco Sanchez, and Chair John Vuksic.
Absent: Commissioner Nicholas Latkovic

Present: Richard Cannone, Director of Development Services; Nick Melloni, Principal
Planner; Carlos Flores, Senior Planner; Anna Dan, Assistant Planner; Jason
Finley, Chief Building Official; Community Services Manager, Shawn Muir; and

NATURE OF PROJECT/APPROVAL SOUGHT: Consideration to approve a Design
Review for a building height exception for a new single-family residence located at
77645 Robin Road (Assessor’s Parcel Number 637-320-030).
APPLICANT AND ADDRESS: James McIntosh, Palm Desert, CA 92241

Vice Chair McIntosh announced his recusal due to a conflict of interest as his
architectural firm has been retained for this project and left the conference room.
Assistant Planner, Anna Dan, narrated a PowerPoint presentation on the item and
responded to Commission inquiries. Ryan Arias, Applicant Representative, was
present and answered questions from the Commission.
Chair Vuksic opened and closed the public comment period. No public comments
were provided. Discussion on the item ensued with Commissioners providing
comments for the project.
Following discussion, MOTION BY COMMISSIONER MCAULIFFE, SECOND BY
COMMISSIONER COLVARD, CARRIED 4-0, (COMMISSIONER LATKOVIC
ABSENT, VICE CHAIR MCINTOSH RECUSED); to approve Case No. MISC23-0035
as presented.
6. NON-ACTION ITEMS
Community Services Manager, Shawn Muir, addressed the Commission and explained staff
is currently working on two new parks in North Palm Desert, the first of which is located off
Dinah Shore Drive. To date, two community engagement meetings have been conducted at
the Palm Desert iHub to engage the community and gather feedback on needed amenities for
the new parks. Manager Muir, shared staff has been working with a consultant to develop a

conceptual design for the first park and introduced, Gianno Feoli, from Interwest. Mr. Feoli
provided a comprehensive PowerPoint presentation of their conceptual design for the North
Palm Desert Community Park. The presentation included an overview of community
feedback, park amenities, park programming, breakdown of park segments, and overall
design for the community park.

B. CITY STAFF
Recording Secretary, Melinda Gonzalez, acknowledged the memo provided by the City
Clerk for appointed Body Members regarding commissioner absences from commission
meetings. Secretary Gonzalez provided a brief oral summary of the memo.
Principal Planner Melloni reported the City’s Object Design Standards consultant, JKA,
will be hosting a Community Outreach Open House Meeting at the Palm Desert iHub, on
June 19, 2023. Principal Planner Melloni encouraged commissioners to attend and asked
interested commissioners to RSVP with their anticipated time of arrival to ensure no Brown
Act violations. A study session will be held on June 20, 2023, with the Planning
Commission and subsequent study sessions will be held with ARC on July 11, 2023, and
August 8, 2023.
Principal Planner Melloni formally introduced the Planning division’s newest member,
Senior Planner, Carlos Flores.
C. ATTENDANCE REPORT
The attendance report was provided with the agenda materials. The Commission took no
action on this matter.
8. ADJOURNMENT
The Architectural Review Commission adjourned at 1:41 p.m.

Subject: Consideration to approve a Design Review for a front yard fence height and
material exception for a single-family residence located at 45639 Abronia Trail
(Assessor’s Parcel Number 625-193-004).
PROJECT SUMMARY
The Project Applicant, Jason Teague, is requesting an exception to the fence material and
setback requirements of the Palm Desert Fence and Wall Ordinance, Palm Desert Municipal
Code (PDMC) Section 25.40.080. The Applicant is proposing to construct a six-foot (6’) tall,
corrugated metal fence with a twelve-foot (12’-0”) setback from the face of curb at 45639 Abronia
Trail. This proposal is requesting an exception to the minimum setback of twenty-feet (20’-0”)
from face of curb for walls taller than five feet (5’-0”). The Architectural Review Commission
(ARC) may grant exceptions for wall setbacks and material based on procedures set by the
PDMC.
BACKGROUND
In May 2023, the Applicant submitted an application requesting an exception to the fence material
and front yard setback requirements for their home. A decision by the ARC is required to approve
the requested exceptions.
Staff mailed a public notice of the ARC meeting to property owners within 300 feet of the project
site on June 30, 2023. Following distribution of the notices, staff requested additional information
and plan revisions from the applicant to support findings for the exceptions. The Applicant was
unable to adequately address all revisions and requested information prior to posting the ARC
agenda.
STAFF RECOMMENDATION
Staff recommends the ARC continue the design review of the subject fence height and material
exception to a date uncertain, to allow City staff additional time to work with the Applicant on
providing additional information and design details.

NOTICE OF APPLICATION

NOTICE IS HEREBY GIVEN that the Development Services Department has received a request for a
setback and materials exception to the City of Palm Desert’s Fence and Wall Standards to allow a six-
foot (6’) tall, corrugated metal fence at a setback of twelve feet (12’) from the face of curb in the front yard
of a single-family residence located at 45639 Abronia Trail. The City’s Fence and Wall Standards are
provided under Palm Desert Municipal Code Section 25.40.080. At a setback of 12’-0”, the Code limits all
fences to a maximum height of three feet, six inches (3’-6”). The Code also requires all walls and fences
visible from the public right-of-way to be constructed of decorative block, stucco, or wrought iron.
However, exceptions to these standards may be approved by the City’s Architectural Review
Commission.
This notice is being sent to you based on your property’s proximity to the proposed exception location.
The proposed fence exception is scheduled for consideration before the Palm Desert Architectural
Review Commission on Tuesday, July 11th, 2023, at 12:30 p.m. via Zoom meeting or in-person in the
Development Services Conference Room at Palm Desert City Hall, 73510 Fred Waring, Palm
