Statute of Limitations: 05/07/2024 Action plan items from last review and status: 1. Can you verify the jurisdiction of the loss? City of Palm Desert. 2. Can you verify the correct city personnel for signing a declaration? M. Gloria Sanchez, Records Coordinator or Anthony J. Mejia, City Clerk 3. Can you verify ownership of the road and jurisdiction of the location? if the city does not own and maintain the loss location, who does? Are there any recorded easements? Do multiple entities share the location? Alessandro Drive is a public street within the public right-of- way. Adding to Ryan’s answer, the public right of way including the concrete sidewalk are city owned and maintained. 4. Does the location have a documented history of complaints by residents? If so , what where they and what was done in response? Can you please send me copies of the records regarding the same? I have never heard a complaint about this location. Ask Bassam. Concur with Ryan’s answer, I have not heard of any complaints at this location since the time I joined the City two years ago. Hint, no records. 5. Can you send me the MART Report? What is MART (curious to know)? 6. Can you send me the traffic collision report? Not aware of any traffic collision reports at this location. 7. Can you verify whether criminal charges were filed against the motorist? 8. Can you send me a copy of the coroner’s report? 9. Can you obtain any photos taken at the scene of the loss by the police? 10. Can you confirm if the city contracts out the maintenance of the roadway for this area? if so to whom? Please send me a copy of the contract if that is the case? The City performs routine maintenance with City crews as well as contract maintenance. Contract maintenance includes street sweeping, slurry seal, and pavement resurfacing. Slurry seal and pavement resurfacing are performed less frequently than annually. 11. Does the city have a copy of the original design plans? Attached. 12. Does the city have the AS Built for this location? No. 13. Can you verify if there is any light timing in the area? I am not sure how to interpret the question. There are no traffic signals near the location. The closest traffic signal is the corner of Portola Avenue and Highway 111. There are no street lights on Alessandro Drive near the collision, but the collision occurred on May 4 around noon, so street lighting would not be an issue. Adding to Ryn’s comment, what is light timing (street light, signal light, private property security lights mounted on property wall)? Please clarify. 14. Were there any traffic/Warrant studies undertaken by the city regarding the location? if so what were the results? Were any modifications to the location made? I do not know. Ask Bassam. SCENE DESCRIPTION: Alessandro Drive is a roadway that runs in an east-west direction within the City of Palm Desert. The posted speed limit on Alessandro Drive is 30 miles per hour. The roadway is composed of asphalt concrete and is fully improved with a Portland cement concrete curb and gutter. There is one lane in each direction for vehicular traffic. East of Portola Avenue, Alessandro Drive has a total of three lanes for approximately 282 feet. There is one eastbound lane, one westbound lane, and a center two-way left turn lane. After approximately 282 feet east of Portola Avenue, the two-way left turn lane converges into itself and completely goes away after approximately 363 feet. At this point, Alessandro Drive is a two lane street, with one eastbound lane and one westbound lane. Description: At the time of the collision, Michael Satcher was wearing a dark colored shirt, gray sweatpants, and white shoes. Katy Lee is a 41-year-old female with a date of birth of September 27, 1981, with a listed address of 44700 Las Palmas Avenue Apt 1 in the City of Palm Desert, California. Pre-Collision Profile: Deputy Thomas 1D#5764 conducted the pre-collision interview with Katy Lee. The following is a summary of the footage: Michael Satcher is seen along the north sidewalk of Alessandro Drive, west of Ace Hardware, around 17:43 hours. Michael is walking southbound, towards Ace Hardware. Approximately 50 feet to the east of Michael, is a large "HYDES" van parked along the north curb line of Alessandro Drive. From the footage, it appears that Michael does not look at westbound traffic before stepping onto Alessandro Drive, which is around 17:43:42. At 17:43:43 hours, V-1 enters the frame and is traveling westbound on Alessandro Drive. V-1 continues driving westbound and collides with Michael around 17:43:45 hours. V-1 immediately comes to a stop, and Katy Lee Brewster exits V-1, and walks toward Michael after he was struck. Katy does not move her vehicle after the collision. Summary: D-1 was driving V-1 westbound on Alessandro Drive toward Portola Avenue. At the time of this incident, the sun was close to the horizon, making it difficult to see without obstruction. While D-1 was driving V-1 westbound on Alessandro Drive, P-1 attempted to walk southbound across Alessandro Drive, directly into the path of travel of V-1. D-1 did not have enough time to perceive and react to P-1, and struck P-1, causing major injury to P-1. P-1 died as a result of this collision. Estimated Speed: Per the video surveillance footage, V-1 enters the frame around 17:43:43 hours, and collides with Michael around 17:43:45 hours, which is approximately two seconds after it enters the frame. From the area where V-1 enters the frame, to the point of impact, is approximately 76 feet. This means that V-1 covered approximately 76 feet over two seconds. To convert miles per hour to feet per second, you multiply miles per hour by 1.467. This conversion rate is taught in multiple traffic investigation courses which are POST approved. If V-1 was driving 30 miles per hour, V-1 was covering approximately 44.01 feet per second. Over the course of two seconds, V-1 would have traveled approximately 88.02 feet. Perception and Reaction; In the scientific community, it is well documented that for an average person, who is not under the influence of alcohol or drugs, the perception and reaction time while driving is approximately 1.5 seconds. Further dividing it down, that it takes approximately .75 seconds to perceive, and approximately .75 seconds to react. V-1 would have traveled approximately 66 feet before a reaction by an average driver to seeing Michael in the road. That would leave only approximately 10 feet (vehicle is still covering 44.01 feet per second) of distance (or .227 [~l/4th] of a second) to make a driving action to avoid striking Michael. Based on the above information, 1 do not believe Katy Lee Brewster was at fault for this collision. Area of Impact; The AOI was estimated to be approximately 133. IT east of the west curb prolongation of Palm Desert Drive North, and 14.0' south of the north curb line of Alessandro Drive. The AOI was determined based on reviewing video surveillance footage, and evidence located at the scene. The area of impact was determined using video of the incident and D-2’s statement, evidence in the roadway, and the damage to V-1. Cause: P-1 (Michael Satcher) caused this collision by violating Vehicle Code Section 21954(a), which states in part that every pedestrian upon a roadway at any point other than within a marked crosswalk or within an unmarked crosswalk at an intersection shall yield the right-of-way to all vehicles upon the roadway so near as to constitute an immediate hazard. The cause of the collision was determined by D-2’s statement, the damage to V-1, evidence in the roadway, and video of the incident. I am not sure how to interpret the question. There are no traffic signals near the location. The closest traffic signal is the corner of Portola Avenue and Highway 111. There are no street lights on Alessandro Drive near the collision, but the collision occurred on May 4 around noon, so street lighting would not be an issue.
