The Committee recessed at 10:05 a.m. to participate in the Discover Palm Desert site

Management Analyst Powell provided a staff report and responded to Committee Member
inquiries.
The Committee provided feedback regarding potential for art placement and discussed
preference for an interactive sculpture that does not exceed the height of the roof. No
formal action was taken.

A. PLANNING COMMISSION LIAISON:
Planning Commission Liaison Holt provided a verbal update on the three-story medical
building proposed for Technology Way and Dinah Shore Drive.
B. ARCHITECTURAL REVIEW COMMISSION:
Architectural Review Commission Liaison Colvard provided an update on the recent
activities of the Architectural Review Commission and encouraged the Committee to
communicate with designers regarding the potential wind and sand impacts on art
sculptures.

Committee Member Adney suggested the City consider giving preference to local artists
as they may be more aware of the unique weather conditions that can impact artwork.
Chair Boren requested an update on the landscaping around the Anza-Borrego sculpture
on San Pablo Avenue and Magnesia Falls.
D. CITY COUNCIL LIAISON
Mayor Pro Tem Quintanilla expressed appreciation to the Committee and advised there
was no reportable action from the City Council.
E. CITY STAFF
Management Analyst Powell provided a verbal update on City projects and responded to
Committee Member inquiries.
Recording Secretary Lomeli provided an update on new appointments and the upcoming
election of presiding officers.

the exclusion of participants in the 2023/24 El Paseo Sculpture Exhibition as applicants,
and with a recommendation to equip each concrete pad with electricity.
B.DEACCESSION OF RECREATION LIBERATES BY JOS GOMOLKA
Management Analyst Powell presented the staff report and responded to Committee
Member inquiries.
Following discussion, MOTION BY COMMITTEE MEMBER BOREN, SECOND BY
COMMITTEE MEMBER MITZE, CARRIED 7-0, to continue this item to the November
Cultural Arts Committee meeting and requested that staff gauge philanthropic interest
through advertisements in October 2023.
7.INFORMATIONAL REPORTS & COMMENTS
A.PLANNING COMMISSION LIAISON:
Planning Commission Liaison Holt provided an update on the creation of design
guidelines for new developments and requested that the Committee provide an update
on the landscaping of roundabouts on San Pablos and Magnesia Falls.
B.ARCHITECTURAL REVIEW COMMISSION:
Architectural Review Commission Liaison Colvard provided an update on community
meetings regarding the passive park on Dinah Shore, reporting that there has been
consistent input from the community requesting public art.
C.CULTURAL ARTS COMMITTEE MEMBERS
Committee Member Flint commented in support of placing art in passive parks, and
provided an update regarding the Palm Desert Library, encouraging the Committee to
consider ways to incorporate art into a new facility.
Committee Member Simley reported that she found the required AB1234 Ethics Training
requirement to be informative and encouraged Committee Members to complete the
training.

Chair Hauer provided an update on the upcoming appointment of Lori Davis as the Palm
Desert Poet Laureate.
D.CITY COUNCIL LIAISON
Mayor Pro Tem Quintanilla welcomed new Committee Members Rose and Olson Stone.
E.CITY STAFF
Management Analyst provided the following updates:
•Community Gallery opening went well and the current exhibition will close on
October 6, 2023. The next exhibition will highlight the City’s 50th anniversary.
•August 5, 2023, Summer Spray Day was a success and there will be two more
events for adults and seniors with potential for a tribute to the City’s outdoor
workers.
•The art at Freedom Park has been successfully installed.
•The Suncrawlers traffic signal cabinet wrap is scheduled to be installed the second
week in September.
•The Sunburst installation is tentatively scheduled for November 7, 2023, with a
community event to follow in January 2024.
•An inspection after Hurricane Hilary revealed that the City’s artwork was not
impacted by storm related damage.

REQUEST: RECOMMEND THE CITY COUNCIL APPROVE THE
DEACCESSION OF RECREATION LIBERATES BY JOS
GOMOLKA

Recommendation
Recommend the City Council Approve the Deaccession of Recreation Liberates by
Jos Gomolka.
Background
In May 1993, Palm Desert’s Civic Arts Committee recommended approval of Recreation
Liberates by Jos Gomolka, for installation at the Palm Desert Community Center, which
was subsequently approved by the City Council. The glass sculpture, which was
dedicated along with the building on September 19, 1993, was created specifically for
the lobby at a total cost of $12,000.
The Palm Desert Community Center has planned renovations scheduled to begin in
January 2024 and the new design does not incorporate the sculpture due to its large
size and outdated design.
In accordance with the Public Art Deaccession Policy adopted by the City Council on
July 13, 2023, given the age of the installation and size and sight specific nature of the
artwork, staff recommends that Recreation Liberates by Jos Gomolka be permanently
deaccessioned from the City’s permanent collection based on the following criteria:
1.The sculpture has been in place for more than fifteen (15) years.
2.The costs of relocating the artwork exceed the value of the artwork.
3.Loss of Site - No alternative site for the artwork is available.
Given that the framed housing of the sculpture would need to be reconstructed once
removed, the costs exceed the value of the artwork and thereby it would not be cost
effective to relocate or sell. As such, the only feasible deaccession method would be to
properly dispose of the artwork.
At its regular meeting on September 13, 2023, the Cultural Arts Committee requested
that a press release be sent out to the community offering the sculpture as a donation.

On October 5, 2023, a press release was sent out and the City did not receive any
responses.
After several attempts to reach the artist’s family, staff received a call from Jos
Gomolka’s daughter, Silva deJong, on October 12, 2023. Ms. deJong is requesting to
take possession of two (2) of the smaller pieces of the sculpture - one end piece and
one in the wall.
Given that the artwork meets all criteria for deaccession, and there was no response to
the City’s press release offering the sculpture as a donation, staff is recommending
removal of the sculpture from the City’s collection via the formal deaccession process
with partial donation of the artwork to the daughter of Jos Gomolka and disposal of the
remainder.
Fiscal Analysis
The cost of the artwork was $12,000 in May 1993. Staff has no record of current fair
market value of this site-specific work.

City of Palm Desert’s Public Art Deaccessioning Policy
DEFINITION
Deaccession means the formal process to permanently remove a City-owned public
artwork by selling, donating, or destroying it.
POLICY
A. The purpose of the Public Art Deaccessioning Policy (“Policy”) is to maintain a
deaccession program that results in high-quality, City-owned public artwork;
eliminate artworks that are unsafe, not repairable, or no longer meet the needs of
the City, and respect the creative rights of artists.
B. Although the City of Palm Desert would like each public artwork to remain in situ
for a minimum of 15 years (although 15 years is not a limit on the life of an
artwork), it recognizes that public artwork is not necessarily going to remain in
place in perpetuity.
C. Any proposal for removal, destruction, or relocation of an artwork shall be
submitted to the Cultural Arts Committee by City staff and reviewed according to
the policies and procedures contained herein and shall be deliberate and
independent of political pressures, fluctuations in artistic taste, popularity, and
public opinion.
D. At regular intervals, the City’s public artwork collection shall be evaluated by the
Cultural Arts Committee to determine the condition of each artwork and
determine whether any artwork should be deaccessioned.
APPLICABLE ARTWORK
This Policy applies to all City-owned artwork acquired through the Public Art program or
through donation. In the case of donated artwork, all legal documents surrounding the
donation must be reviewed and a legal opinion rendered by the City Attorney before
proceeding with the deaccessioning process.
CRITERIA FOR DEACCESSIONING
One or more of the following criteria must apply prior to an artwork being deaccessed:
1. Damage Beyond Repair - The artwork has been damaged and repair is
unfeasible or repair costs would exceed the value of the artwork.
2. Safety - The artwork is deemed hazardous and a threat to public safety.
3. Deterioration - The artwork has deteriorated to the point that the restoration cost
is greater than its monetary value or the artwork has deteriorated beyond the
original design and restoration would prove impractical or would render the work
essentially false.
4. Security - The condition or security of the artwork cannot be reasonably
guaranteed or the City of Palm Desert cannot properly care for or store the
artwork.
5. Site Alteration - In the case of site-specific artwork, the artwork has become
inappropriate, is no longer accessible to the public, it is unsafe, or it is due to be
destroyed and would severely alter its relationship to the site.

6. Excessive Maintenance - The artwork requires excessive or unreasonable
maintenance.
7. Loss of Site – The current site is no longer available and no suitable alternate
site for the artwork is available.
8. Aesthetic Value - The artwork is of poor quality or is judged to have little
aesthetic and/or historical or cultural value.
9. Failure to Comply - If the approved terms of the contract pursuant to which the
artwork was installed have not been fulfilled.
10. Inauthentic - The artwork is a forgery or in violation of existing copyright laws.
11. Theft – The artwork has been stolen. Any stolen artwork will be documented
through an official police report and a report prepared by the entity that owns or
is responsible for the site of loss.
SEQUENCE OF ACTION / PROCEDURES
1. Deaccession requests may be submitted by a neighborhood organization, City
department, independent City board or commission, or a City Council member.
The Cultural Arts Committee will review each preliminary request. City staff will
work with the applicant to bring a full proposal to the Cultural Arts Committee.
2. Staff will provide the applicant with a Deaccessioning Form that will serve as the
applicant’s formal request for consideration by the Cultural Arts Committee.
3. Staff (with assistance from the property owner, if applicable) will make
reasonable effort to notify and consult with any living artist(s) whose work is
being considered for deaccession as to the best procedure for artwork removal.
The City will allow the artist(s) 30 days to respond.
4. If the artist(s) is/are deceased, the City will make reasonable efforts to contact
artist(s) estate.
5. After an attempt to contact the artist(s) is made, staff will consult with the City
Attorney on how to proceed with the deaccessioning.
6. Once the request is reviewed by the City Attorney, the applicant will complete
and return the Deaccessioning Form.
7. City staff will use the information from the Deaccessioning Form to complete a
staff report addressing the proposed removal of the artwork. The staff report will
provide all available relevant information and materials to the Cultural Arts
Committee, including, but not limited to:
a. Artist, Title, and Location of artwork.
b. Name of property owner and contact information.
c. Property owner at the time of commission or installation.
d. Year commissioned/purchased, original cost of artwork, and applicable Art
in Public Places (AIPP) fee.
e. Dimensions and removal/re-installation instructions.
f. Appraisal of the artwork provided by a qualified art appraiser and current
condition of artwork. If appropriate, current fair market value of the
artwork.
g. Detailed reason for deaccessioning/relocating artwork.
h. Proposed deaccession method or new location for artwork (relocation,
sale, donation, demolition, etc.).

8. The staff report will then be placed on the Cultural Arts Committee agenda at a
regularly scheduled public meeting, where it will be reviewed and voted on.
9. If the Cultural Arts Committee approves the deaccession, City staff will bring the
staff report before the City Council for review and final action.
10. If deaccession is approved by the City Council, all documents will be updated to
reflect the deaccessioning of the artwork. Staff will review property records from
the County Recorder’s Office and if an artwork covenant is recorded against the
property, the City will cause a release covenant to be filed.
11. The deaccessioning process should be documented in both written and visual
form.
12. If an artwork is sold, proceeds should be deposited into the Art in Public Places
fund.
13. The City’s Risk Manager must be notified so that the work can be removed from
the City’s insurance policy.
DEACCESSIONING METHOD OPTIONS
1. If appropriate, reasonable efforts will be made to move the work to a new location
within the City. If the artwork was designed for a specific site, City will consider
the artist’s intent when deciding where to relocate the artwork.
2. The artist(s) will be given the first option to purchase or exchange the artwork. If
the artist(s) decides to purchase the work, they will be responsible for the cost of
the removal of the artwork from the current site. If the artist(s) is/are deceased,
the legal heir(s) will have first rights of purchase. The artist(s) can purchase the
artwork at fair market value according to the appraisals obtained by a qualified
appraiser.
3. Put the work in storage until a new, appropriate location can be found.
4. Donate work to a school, an educational or non-profit organization.
5. Dispose of work in an appropriate manner.
PROVISIONS FOR EMERGENCY REMOVAL
In the event that the structural integrity or condition of an artwork is such that, in the
opinion of the Public Art staff, the artwork presents an imminent threat to public safety,
the City Manager may authorize its immediate removal without Cultural Arts Committee
action or the artist’s consent and have the work placed in temporary storage. The artist
and the Cultural Arts Committee will be notified of this action within 30 days. The
Committee will then consider options for disposition: repair, reinstallation, maintenance
or deaccessioning. If the artwork cannot be removed without being altered, modified, or
destroyed, and if the Artist’s Agreement with the City and County has not waived his/her
rights under the California Art Preservation Act and the Visual Artists Rights Act, City
staff will attempt to gain such written permission before proceeding. In the event that
this cannot be accomplished before action is required in order to protect the public
health and safety, the City Manager shall proceed with the advice of the City Attorney.

CITY OF PALM DESERT TO DONATE "RECREATION LIBERATES"
SCULPTURE BY JOS GOMOLKA
PALM DESERT, CA — The City of Palm Desert today announced its intention to donate the
iconic sculpture “Recreation Liberates” by renowned artist Jos Gomolka. This magnificent glass
sculpture, which has graced the Palm Desert Community Center’s lobby since its dedication on
September 19, 1993, has become a beloved symbol of the community's artistic spirit.
The decision to donate “Recreation Liberates” stems from the center's upcoming renovations
scheduled to commence in January 2024. The new design plan, while exciting and promising,
does not accommodate the sculpture due to its considerable size and specific aesthetic.
Given the need for substantial reconstruction of the sculpture's housing upon removal, it has
been determined that relocating or selling the artwork is not a cost -effective option.
Consequently, the most practical path forward is to donate the piece to an organization that
could give the beloved artwork a new home. While the artwork itself would be given as a
donation, the recipient would be responsible for all costs associated with the removal, transport,
and re-installation of the artwork.
The City invites interested parties who appreciate the historical significance and artistic value of

The community and art enthusiasts have cherished “Recreation Liberates” for nearly three

Recommendation
Approve proposed outdoor LED colored lighting schedule for Sunburst by Donald
Gialanella.
Background
Upon selection of artist Donald Gialanella’s sculpture, Sunburst, as a finalist for
installation in the roundabout at San Pablo Avenue and San Gorgonio Way, the Art in
Public Places Commission (now the Cultural Arts Committee) suggested that the
lighting installed with the sculpture should have the ability to alternate colors, possibly to
reflect commemorative holidays and events within the city.
The project is currently in the installation phase and is due to be completed by
November 10, 2023. The lighting system that will illuminate the sculpture at night allows
for a versatile color lighting schedule. Eight (8) color LED lights will be installed
according to the engineered plans.
The proposed color lighting schedule is designed to enhance the sculpture, celebrate
local events and holidays, and provide an engaging and ever-changing visual
experience for both residents and visitors. The proposed monthly lighting schedule is as
follows:

submit proposals for a project to honor Palm Desert’s hard-working Public Works staff
for their tireless efforts serving the community during and after Tropical Storm Hilary by
creating a mural on the side of the City’s Corporate Yard building located at 74705 42nd
Avenue. Artists were asked to submit creative proposals that not only embraced
teamwork and determination, but also something that involved the community and
represented their collective spirit. As part of this project, artists were asked to describe
community participation within their proposals and consider community workshops,
collaborative design, and hands-on painting.
The Call for Artists was posted on the City of Palm Desert’s Public Art Artist
Opportunities webpage remained open for one month and was promoted via City of
Palm Desert’s Facebook page, shared on Instagram and CODAworx. A total of seven
(7) submissions were received.
Staff is hereby requesting that the Committee review and discuss the attached
submissions during the meeting and select an artist to administer the project.
Fiscal Analysis
The budgeted cost for the proposed community mural project is $8,000. Funding is
available in the FY 2023/2024 Public Art budget.

ABOUT THE PROJECT
The City of Palm Desert is dedicated to serving residents and visitors by providing exemplary
services to the community. A large percentage of staff has been recognized for going above and
beyond during the emergencies and disaster situations brought on by Hurricane Hilary. The City
of Palm Desert would like to honor and distinguish its Public Works staff and other outdoor
workers for their unfailing determination to serve this community during and after the storm.
ABOUT THE MURAL
The City of Palm Desert is seeking mural artists to create proposals that embrace the teamwork,
determination, and hard work that staff has provided the community. The mural should serve as
a visual representation of our community’s collective spirit.
COMMUNITY PARTICIPATION
This mural project’s essence relies in the active involvement of our staff and community
members. Artists should consider the following elements in their proposals:
1. Community Workshops: Develop and host interactive workshops to engage
community members of all ages in the creation of the mural. These workshops can serve
as platforms for sharing stories, memories, and creative ideas.
2. Collaborative Design: Collaborate with community members to design and sketch the
mural, ensuring their ideas and visions are incorporated into the final artwork.
3. Hands-on Painting: Encourage residents to contribute to the mural by inviting them to
participate in the painting process. Creatively identify Public Works staff and other
outdoor workers with initials or other ideas.
LOCATION AND DIMENSIONS
The mural wall measures 160’ (W) X 6’ (H) and is located at 74705 42nd Ave and Joni Drive.

ELIGIBILITY
Open to artists aged eighteen (18) and older in the Coachella Valley and surrounding area with
demonstrated experience as a mural artist. The City of Palm Desert is committed to inclusion
and diversity and welcomes applicants of all faiths, creeds, ancestries, and ethnicities without
regard to disability, gender identity, sexual orientation, or immigration status.
Artist shall procure or otherwise provide proof of commercial general liability ($1,000,000 per
occurrence/$2,000,000 general aggregate/$1,000,000 personal injury), naming the City of Palm
Desert and their representative officer agents, employees, and volunteers, as additional insured.
ARTIST COMPENSATION
The artist selected will receive $8,000, inclusive of artist fees, supplies, and community
participation elements.

I currently work as a muralist for the Coachella Valley area. I hope to expand and mobilize my work, as the freedom of travel is important to me, and I hope to one
day become an international artist. I am also working on a series of oil paintings which I plan to showcase in New York. As a side experiment, I’m creating a
sculpture series - turning mannequins into aliens! I was born and raised in Olney, Maryland and graduated with a BFA in Painting and Printmaking from VCU in
Richmond, VA. I immediately migrated over to California in 2014 and lived in Los Angeles for a majority of those years until moving to Palm Desert, where I
currently reside.

Hello! I am very excited to apply for this public project. I have been painting over 15 years, and have began mural painting in the summer of 2022, after moving to
Palm Desert. This is my dream, and I would love for my artwork to reach the public eye. I have enjoyed all the connections I have made with the people in this
area since moving here. If selected, I would develop the design with a team of locals. I have volunteered for The Galen Center, as well as Old Town Artisan
Studios, and will reach out to them to create a team of people willing to help with the project. I have also found the app NextDoor to be a major help in
connecting with the community, as this is my way of finding work. I will also use the directory of the Public Works Staff to conduct phone interviews to draw
upon the stories and inspiration involving the hurricane. I will do anything and everything I can think of, and have fun doing it! Thank you.

Project Proposal
I have experience working with the community to create and install large-scale public murals ( pictures included in application).For this project I envision
volunteers being provided the opportunity to choose how they share their ideas and experiences. Providing a variety of ways to engage diverse groups and
people of all backgrounds will allow for a breadth of ideas. Community members will be encouraged to share their ideas in writing as well as sketches if they feel
comfortable drawing. A brief, one-page questionnaire in English and Spanish will have a multitude of open- ended questions to guide their creative thinking. I
will ask for email addresses and/ or phone numbers to facilitate communication well in advance of any on-site painting. I will be trying to identify a common
theme from the community as well as diverse perspectives and viewpoints which will allow me to weave imagery together in a way that can be understood
collectively but interpreted individually.

Artist Biography
Born and raised in Indio, CA., Adam Enrique Rodriguez, 33, is quickly becoming one of
California’s most prominent emerging artists. His work incorporates classical techniques combined with an
expressive, abstract quality, in an ongoing conversation of the human condition, perseverance and personal
identity. In high school, his work was featured in Palm Springs Art Museum, gaining a scholarship to
attend Laguna College of Art and Design in 2008. He later received recognition from The Broad
Foundation for his painting, “Interpreting Light”. In 2013, Rodriguez’s work was published as
album artwork for Grammy-award winning musician Anderson .Paak. He has created over 30 murals in commercial and private residences. His large scale
murals have been displayed at music festivals throughout California, including Desert Oasis, Desert Trip, Joshua Tree Music Festival, and Lightning in a Bottle.
In 2020, Adam was a featured artist in Kobe Bryant’s novel, “Geese Are Never Swans”.

Project Proposal
For the concept design I will incorporate integral aspects of our community, drawing inspiration from the diverse cultural tapestry that makes up the greater
Coachella Valley. The mural will be vibrant in color, eye catching, and most of all, convey a meaningful and inspiring message. The mural will be centered around
human perseverance and hometown pride. As with past projects, collaborating with the community is paramount for me whether in concept or creation.
Community participation is highly encouraged during the entire process of the creation of the mural. Families of the community will be able contribute their

Project Proposal
The piece is called "Palm Desert United" It gives thanks to the workers and community for helping to save this beautiful city. It shows on both ends of the mural the disasterous weather seeping in and the
workers holding it back to save the city. In the center of the mural it shows all the beauty and culture of the city. These images include El Paseo, The living Desert, golf, the baseball field and the wildlife such as
roadrunners and lizards. There is a plaque in the center of the mural with words of thanks to the workers and the community.
I currently work with students around the valley and collaborate on many pieces of art. I would like to include students from Palm desert to collaborate with me on the painting of the mural.

Artist Biography
Mike Tauber is a professional artist, working in paint, ceramic tile, and cement relief.
Much of his is work is by commission, architectural in scale, designed to be site-specific, and is often permanent. Themes and content are drawn from client needs, location, audience and view, and
desired message. Works, ranging from traditional to contemporary, are installed internationally. Tauber is noted for his award-winning Community Mosaics program, engaging citizens in the creation
of public tile murals. More than 1,400 people have worked with him on projects including “Parrots in Flight” in Tustin, and “Swimming in Sea Life” in Laguna Beach. His awards and nominations by
the Laguna Beach Arts Alliance include Best in Collaboration (2009, 2019), Artist of the Year (2011), Best in Leadership (2019), and he was named Artist of the Year in 2018.
Tauber's exhibited at Palm Springs Art Museum, and he completed his Bachelors Degree at the College of Fine Art at San Diego State University.

MIKE TAUBER specializes in exterior wall relief and murals in ceramic tile, paint, and cement. Tauber earned his
Bachelor’s Degree in Art and Environmental Design at San Diego State University in 1985. Starting as an architectural
illustrator, he has been commissioned for landmarks, parks, schools, churches, resorts, residential and commercial centers.
His works are purposeful, site-specific, and responsive to the needs of its users. Based in Laguna Beach since 1987, he
