CALL TO ORDER A Regular Meeting of the Planning Commission was called to order by Chair Pradetto on Tuesday, December 5, 2023, at 6:00 p.m. 2. ROLL CALL Present: Commissioners Nancy DeLuna, John Greenwood, Vice-Chair Ron Gregory, and Chair Pradetto. Absent: Commissioner Lindsay Holt. Staff Present: Oscar Verdugo, City Attorney; Richard D. Cannone, AICP, Director of Development Services; Nick Melloni, AICP, Principal Planner; Carlos Flores, AICP, Senior Planner; and Monica O’Reilly, Executive Administrative Assistant/Recording Secretary. 3. PLEDGE OF ALLEGIANCE Commissioner Gregory led the Pledge of Allegiance. 4. NON-AGENDA PUBLIC COMMENT: None. APPROVAL OF MINUTES RECOMMENDATION: Approve the Planning Commission Regular Meeting minutes of October 17, 2023. MOTION BY COMMISSIONER GREENWOOD, SECOND BY COMMISSIONER DE LUNA, CARRIED 4-0 (HOLT ABSENT), to approve the Planning Commission Regular Meeting Minutes of October 17, 2023. CONSENT ITEMS HELD OVER: None. 6. ACTION CALENDAR None. 7. PUBLIC HEARINGS The staff report(s) and Zoom video of the meeting are available on the City’s website. CONSIDERATION OF A REQUEST TO ADOPT A NOTICE OF EXEMPTION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) AND APPROVE A TENTATIVE PARCEL MAP (TPM) TO SUBDIVIDE AN EXISTING PARCEL INTO TWO PARCELS AND A LETTERED LOT AT 49425 JFK TRAIL (ASSESSORS PARCEL NUMBERS 655-300-030 AND 655-300-031) Senior Planner Flores narrated a PowerPoint presentation, noting the applicant is available via Zoom to answer any questions, and responded to Planning Commission inquiries. Chair Pradetto opened the Public Hearing. Lindsay Ross, the applicant, addressed the Planning Commission on the proposed project and issues raised in the letters from the neighbors. He also responded to Planning Commission inquiries. The following members of the public spoke in opposition to the project: Julia Burt, Palm Desert resident, noted they did not receive a public hearing notice and voiced concern with the increasing density, retention basin, and pad elevations. Lynn Haws, Ironwood Country Club homeowners’ association (HOA Ironwood 9) president, mentioned that the proposed property needed to be annexed into Ironwood 9. The property owner agreed and signed that the annexation was based on three lots, not four. She also mentioned that new property owners in the area oppose the proposed increased density. Planning Commission Minutes December 5, 2023 City of Palm Desert Page 3 Joe Baldwin, representative for Timmy Holloman (Palm Desert resident), stated that they were not properly notified of the public hearing. To avoid any issues or litigation, he urged the Planning Commission to not approve the proposed project until questions from the people are answered. Lindsay Ross addressed public comments. Senior Planner Flores confirmed that City staff did the proper public hearing notification. At this point, both staff and the applicant responded to additional Planning Commission inquiries. There being no others desiring to speak, the Public Hearing was closed. MOTION BY COMMISSIONER GREGORY, SECOND BY COMMISSIONER GREENWOOD, CARRIED 4-0 (HOLT ABSENT), continuing Case No. TPM/EA23-0001 (TPM 38491) to the regularly scheduled meeting on February 6, 2024. 8. INFORMATIONAL REPORTS & COMMENTS A. SUMMARY OF CITY COUNCIL ACTIONS None. B. COMMITTEE MEETING UPDATES 1. Cultural Arts Committee None. 2. Parks and Recreation Commission Principal Planner Melloni reported that the Commission formed a subcommittee to review the design for a planned regional park. Also, a subcommittee met to decide on naming schemes for existing and newly created parks in the University Park subdivision. C. PLANNING COMMISSIONERS None. D. CITY STAFF Principal Planner Melloni provided an update on the Objective Design Standards, which will go before the regularly scheduled Planning Commission meeting on January 16, 2024. The Planning Commission acknowledged that it is Monica O’Reilly’s last Planning Commission meeting and thanked her for her service. The Commission took no action on this matter. 9.
