HomeMy WebLinkAboutRes 02-11 Establish Palm Desert Youth Commission Resolution No. 02-11 CITY OF PALM DESERT COMMUNITY SERVICES DEPARTMENT STAFF REPORT REQUEST: REQUEST FOR ADOPTION OF RESOLUTION ESTABLISHING A PALM DESERT YOUTH COMMISSION DATE: February 28, 2002 CONTENTS: RESOLUTION NO. 02 - 11 CITY OF CONCORD, CALIFORNIA YOUTH COMMISSION BY- LAWS, STAFF LIAISON RESPONSIBILITIES, AND EVENT CALENDAR Recommendation: Waive further reading and adopt Resolution No. 02 - 11 relative to the formation of a Palm Desert Youth Committee. Executive Summary: The City Council requested that the feasibility of forming a Palm Desert Desert Youth Committee be investigated. This effort would provide an opportunity for the City's youth to become formally involved, in an advisory capacity, in a variety of issues that affect their daily lives to the City Council; the proposed resolution would establish the process with goals and objectives. Pertinent research has now been completed, and staff is recommending that the City Council move forward with forming such a committee to involve the community's youth in a variety of programs and activities. Background: For the past several months City staff has been researching the structure and effectiveness of a variety of youth committees/commissions throughout the State of California. The results of this research indicate that such bodies have been used in an advisory capacity Resolution No. 02-11 to local legislative bodies for periods of time between 30 years and six months. The scope of responsibility that these committees/commissions have been charged with ranges from planning a single annual event to providing the local legislative bodies that they advise with input on issues that include recreational facilities and programs, transportation, public safety programs, regional concerns, local legislation, advertising and promotion, cultural outreach, a wide variety of special events, historical preservation, educational facility and program needs, environmental issues, anti drug and smoking programs, etc. Some entities involve their youth committee/commission to the extent that active member participation in other advisory bodies throughout their jurisdiction when needed and appropriate. Each of the programs investigated have experienced varying degrees of success, but those with the most longevity and the most success tend to encompass the widest range of activities and/or subjects for which input and advice is sought by the legislative bodies the committees/commissions serve. Yna I} Original on File with City Clerk's Office RESOLUTION NO. 02 - i i A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING A PALM DESERT YOUTH COMMITTEE WHEREAS, a Palm Desert Youth Committee is hereby created and established for the City of Palm Desert. The Youth Committee shall be known as and referred to as the "Palm Desert Youth Committee" or the "Youth Committee"; and WHEREAS, the Youth Committee shall be comprised of seven (7) members between the ages of 13-18 who all reside within the City of Palm Desert or attend school in Palm Desert; and WHEREAS, members of the Youth Committee will be appointed by the City Council. Such appointments will be made at a regular City Council meeting; and WHEREAS, members of the Youth Committee will serve one year terms commencing upon appointment by the City Council; and WHEREAS, vacancies on the Youth Committee will be filled by appointment by the City Council; and WHEREAS, regular meetings of the Youth Committee will be held bi-monthly at a time and place to be determined by it's appointees; and WHEREAS, two unexcused absences from regularly scheduled meetings in a calendar year will constitute an automatic resignation; and WHEREAS, it shall be the responsibility of the Youth Committee to make recommendations to the City Council with respect to matters concerning the City's programs and projects targeted to serve young people of the community. The Youth Committee shall have the authority and responsibility to plan, organize, and implement, with the assistance and support of appropriate members of the City staff and within budget limits, events, programs, and activities for the young people of the community. WHEREAS, accurate and permanent records of the actions of the Commission will be kept, and such records will have the same status as records of other committees and/or commissions of the City; and RESOLUTION NO. 02 - 1 1 WHEREAS, each December the Youth Committee will elect one (1) of its members to serve as chair and one (1) of its members to serve as vice-chair for service during the subsequent calendar year. The Chair and Vice-chair will serve at the pleasure of the Committee. The Committee may adopt such rules and regulations as it deems necessary to provide for its other officers and their method of selection, and for other matters relative to its work and administration. Minutes, resolutions, and all other official records of the Commission will be filed with the City Clerk. WHEREAS, members of the Youth Committee will serve without compensation. Expenses incurred by the members of the Committee in the performance of their duties will be authorized in advance by the City Manager or his/her designee and will be consistent with the adopted budget of the City. Claims for expenses will be filed with the Director of Finance/City Treasurer and will be subject to audit and the approval by the City Council. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, that upon adoption of Resolution No. 02 -11, it shall become effective February 28, 2002. Purpose: The purpose of the Concord Youth Council shall be to serve as an advisory Commission to the City Council and the Community Services Commission on matters affecting or concerning the youth of Concord. These matters may include recommendations or implementation of teen programs, juvenile delinquency problems, youth employment, involvement of youth in municipal matters, or any other civic matter falling within jurisdiction of the City in which youth have an interest. Its general responsibilities are: (A) To hold meetings and conferences, open to both you and adults, whereby matters of concern to youth may be discussed and ideas exchanged. (B) To review, those municipal matters referred by the City Council and the Community Services Commission and to initiate proposals on its own motion to be forwarded to the City Council and/or the Community Services Commission. (C) To promote public awareness of the contribution youth desires to make, and is capable of making, towards the solution of problems affecting young people. (D) To increase public awareness of problems affecting young people. Section 2. Composition of the Council: The Council shall be composed of between nine (9) and fifteen (15) youth members between the ages of 13 and 21 years inclusive, and shall represent a cross section of young people of the community. Also, three alternates shall be appointed. Section 3. Appointment of Member: A task force composed of the following persons shall review the list of applicants for Youth Council positions and select the Youth Council members and up to three alternates. (1) One member of the Community Services Commission (2) The Police Department Liaison Officer to the Youth Council. (3) One Youth Council member not seeking reappointment who is selected by the Youth Council. (4) Two representatives of the Department of Leisure Services, one being the Leisure Services Staff Liaison The Chairperson of the Selection Task Force shall be either the Chairperson of the Community Services Commission or his/her appointee. Section 4. Term of Office: Appointments to the Youth Council shall be for one (1) year. Any member of the Youth Council who has not reached the age of twenty-one (21) before the • City of Concord Youth Council Bylaws Page 2 expiration of his/her term will be eligible for reappointment . Any member who reaches the age of twenty-one (21) before the expiration of his/her term will be permitted to serve out the remainder of that term. Appointments shall be effective on July 1 and expire on June 30 of the following year. In the event a member discontinues his/her service on the Youth Council, an alternate shall be appointed in the predetermined order designated by the Selection Task Force to fill the remainder of the term. Any member who fails to appear,unexcused, at 3 consecutive meetings will be contacted by one of the officers (Sec. 5) and notified that if attendance is not improved he/she will be subject to impeachment. If the member is absent, unexcused, from the next meeting the council will be able to vote on removal (2/3 majority required to pass). Any member with an excess (4-5 straight) of excused (excused absence being one due to illness or school related activities, with one or more council members being notified in advance, [exceptions will be determined by council approval.]) absences will be turned over to a committee of 3 council members for consideration of the problem, a report from said committee will be given to the council, and if needed, a vote will be made. Section 5. Officers of the Youth Council: The Youth Council shall elect from its membership a Chairperson, Vice-Chairperson, Secretary-Treasurer, and Historian. The Chairperson shall preside at all meetings of the Youth Council and shall appoint such standing or special committees and subcommittees as may be necessary to carry out the Youth Council's business. The Vice-Chairperson shall serve as the Youth Council's Parliamentarian. In absence of the Chairperson, the Vice-Chairperson shall assume the responsibilities of the Chairperson. The Vice-Chairperson shall also be responsible for assuring that all committees meet regularly. The office of secretary/treasurer is hereby changed to the secretary,' with all necessary adjustments being made. The Historian researches, chronicles, and logs all pertinent data concerning the Youth Council. The Youth Council may remove any officer that it deems to be satisfactorily performing his/her duties. Any officer who resigns or is removed will be replaced by an election by the full Council. If any officer proves unable to serve, the Council can appoint 3 members to discuss the problems and to work on resolving them. They would then report their finds to the council and appropriate action would be taken. During the resolution process the officer will be temporarily relieved of duties and an appropriate person will fill the job (i.e. vice chair to chair, sec to v.c., etc.). If an officer is removed, the council shall elect a replacement. All candidates for office must be appointed by another council member, no self appointments. Meetings of the Youth Council: The Youth council shall conduct bi-monthly meetings, and upon call of the City Council whenever the Council desires the viewpoint of the Youth Council on municipal matters affecting or concerning the interest of youth. The Chairperson of the Youth Council shall schedule special meetings whenever a matter requires subsequent meetings of the whole Youth Council or committees thereof. Section 7. Conduct of Meetings: A simple majority of members of the Youth Council shall constitute a quorum for the conducting of business. A majority vote of the members present shall be sufficient to act upon any matter coming before the Youth Council, except where otherwise stated in these bylaws. It will be the policy of the Youth Council to allow guest speakers ten (10) minutes to make a presentation to the Council. Additional time will be allowed for questions and answers. Section 8. Committee Structure: (A) The Youth Council as a whole, or the Chairperson, may appoint ad hoc committees whenever necessary. (B) All committees will set their own meeting schedule and will also meet on call of the Chairperson of the Committee or the Youth Council Chairperson. (C) Attendance of all committee meetings shall be kept by the Committee Chairperson and reported to the Secretary-Treasurer. Section 9. Miscellaneous: (A) All members shall attend at least one council outside Youth Council, and report to the Youth Council. (B) A representative from the Youth Council shall be named to each of the high and middle schools in Concord. LD Aj - 0 c_ Section 2440. Youth Council. There is created a Youth Council, which shall consist of no more than eleven (11) voting members to be appointed by a selection Task Force, as established by City Council Resolution No. 87-126. Members of the Youth Council shall be between the ages of thirteen (13) and twenty-one (21)at the time of their appointment, and be residents of Concord or attending school in the City of Concord. The basis and amount of any compensation which may be paid to the members of the Youth Council shall be set by resolution of the City Council. (Ords. 91-2, 92-19) Section 2441. Purpose and Intent. The general purpose of the Youth Council is to act as an advisory body to the City Council on issues pertaining to the youth population. (Ord. 91-2) Section 2442. Terms of Members. Members shall serve at the pleasure of the City Council for one (1) year. Any member who has not reached the age of twenty-one before the expiration of his/her term will be eligible for reappointment. Any member(21) who reaches the age of twenty-one (21) before the expiration of his or her term shall be permitted to serve out the remainder of that term. Appointments shall be effective on July 1 and expire on June 30 of the following year. Any member who absents him/herself from three (3) consecutive meetings of the Youth Council without being excused will be deemed to have resigned his/her appointment. (Ord. 91-2) Section 2443. Rules of Procedure. The Youth Council shall adopt Rules of Procedure on the conduct of its business and may designate, by resolution, committees and task forces. Such resolution shall not be effective until approved by the City Council. (Ord. 91-2) Section 2444. Vacancies on the Youth Council. All vacancies occurring on the Youth Council for expired or unexpired terms shall be filled according to the method of their original selection by the Selection Task Force. (Ord. 91-2) Section 2445. Powers and Responsibilities of the Youth Council. The Youth Council shall have the responsibility of carrying the following functions: (Ord. 91-2) A. Act in an advisory capacity to the City Council on issues pertaining to the youth population; (Ord. 91-2) B. Conduct fundraising activities to provide financial support for operation of the Youth Employment Office; (Ord. 91-2) Sections 2445-2450
