SUBJECT: Environmental Liability Insurance
Recommendation:
By Minute Motion, approve the subject purchase of insurance from Cal-Surance for the term of
one year and appropriate funds in the amount of$27,256 from the Unobligated General Fund
account# 110-4192-419-3090.
Background:
Currently the City does not provide environmental protection insurance for our properties due to
the high cost for this type of insurance. The California Joint Powers Insurance Authority has
negotiated a rate with Cal-Surance to provide this liability insurance for its eighty-city members
at an attractive rate. This is a mandatory program for all participants in the property
insurance program. Our cost is based on payroll and we can add unlimited vacant
properties to this program without any additional costs. The deadline for this submittal to
the CJPIA is June 23, 2000.
Attached (see Exhibit 1) is the CJPIA environmental protection insurance program summary.
This summary sheet describes the basic coverages of the policy, coverage limits and exclusions.
Staff is requesting that the City Council approve the purchase of the environmental
liability insurance with the direction to staff to amend our property schedule to reflect the
open space, parks and vacant land which we do not currently insure.
Also attached, as an informational item, is the application to ECS Underwriting, Inc.

and gradual pollution coverage of scheduled property, streets, and storm
drains owned by all California JPIA Members. Coverage is on a claims-
made basis.
PROTECTION July 1, 2000 to July 1, 2003 at 12:01 a.m. Pacific Time

PROTECTS: CALIFORNIA JPIA members (including wholly owned and controlled
UAuthorities, Agencies, etc.)
COVERS: Legal liability for pollution, legal liability for remediation of pollution,
and legal defense expense arising out of the following property, and pollution
conditions arising from a Member's product or waste during transportation by a third
