HomeMy WebLinkAboutRes 92-22 thru 92-25 Ord 674 CFD 91-1 Indian Ridge INTEROFFICE MEMORANDUM CITY OF PALM DESERT DATE : March 12 , 1992 TO : CITY MANAGER , HONORABLE MAYOR AND MEMBERS OF CITY COUNCIL FROM : EXECUTIVE DIRECTOR , REDEVELOPMENT AGENCY SUBJECT : PUBLIC HEARING AND FORMATION OF INDIAN RIDGE CFD 91- 1 Recommendation: That the City Council open public hearing and take testimony regarding Indian Ridge CFD 91 - 1 . That following such public hearing : A . The City Council , by Minute Motion , approve and authorize the following : 1 . Resolution No. 92-22 _ - A resolution of formation of City of Palm Desert Community Facilities District No . 91 - 1 ( Indian Ridge Public Improvements ) , authorizing the levy of a special tax within the District , preliminarily establishing an appropriations limit for the District and submitting levy of the special tax and the establishment of the appropriations limit to the qualified electors of the District . 2 . Resolution No . 92-23 - A resolution determining the necessity to incur bonded indebtedness within the City of Palm Desert Community Facilities District No . 91 - 1 ( Indian Ridge Public Improvements ) and submitting the proposition to the qualified electors of the District . 3 . Resolution No . 9_ __2-24 _ - A resolution calling for a special election . B. That following the results of the election , Council make a finding of the special election by approving the following resolution : Resolution No. 92-25 - A resolution declaring results of special election and directing the recording of notice of special tax lien . C. That Council hold its first reading of the Ordinance establishing the Indian Ridge CFD 91 - 1 : Ordinance No. 674 - An ordinance of the City Council of the City of Palm Desert levying special taxes within the City of Palm Desert Community Facilities District No. 91 - 1 ( Indian Ridge Public Improvements ) . Background: Staff has been working with representatives of the Sunrise Company in the development of the Indian Ridge Community Facilities District 91 - 1 . The purpose of the District will be to provide for the payment of infrastructure and fees in the development of the Indian Ridge Project , as described in the attached Engineer ' s Report under Exhibit A . The proposed District will encompass approximately 640 acres of the Indian Ridge Project proposed and owned by the Sunrise Company. A map of the area is included in the Engineer ' s Report as Exhibit B. The purpose of the public hearing will be to take testimony in the establishment of the Community Facilities District and, given a favorable response, to begin the establishment of the District . The attached resolutions provide for a series of findings and determinations which the Council must consider in the approval of such resolutions . Resolution No. 92-22 calls for the establishment of the Community Facilities District , incorporating the tax levy and the Engineer ' s Report outlining the maximum amount of taxes to be imposed on the property in question . Resolution No. 92-23 allows the District the ability to incur bonded indebtedness utilizing taxes levied by the CFD as debt service for such bonds . Resolution No. 92-24 calls for a special election to be held in the establishment of the CFD . Because there is only one property owner , the election will be held at the time of the public hearing with the results being posted by the City Clerk at that time. Following the successful resolution of this process , the remaining resolution declaring the results of the special election and the ordinance establishing the District should be adopted. 2 • As this process is completed, the next action will be to continue with the Bond Issue process . The property in question will be responsible for the debt generated by this CFD. No City funds will be obligated as a result of this process . REVIEWED AND CONCUR : Carlos L . The Mayor makes the following opening remarks: "This is the time and place for the public hearing in connection with this Council 's proceedings relating to Community Facilities District No. 91-1 (Indian Ridge Public Improvements) . The hearing is to consider the formation of the District, the levy of special taxes against the parcels within the District and the issuance of bonds secured by the special taxes. Before I formally open the hearing, are they are property owners or registered voters in the District who wish to file written protests? If so, they must be filed with the City Clerk now. " [Pause to see if there are any protests. ] "The hearing is now officially open. To have an orderly hearing, we will first have a presentation by staff about the District. After that, we will receive comments and questions and any oral protests from any interested persons. When all comments have been received the hearing will be closed. " 2 . Staff (and consultants) as necessary make presentations . 3 . Time for comments, questions and protests from audience. 4 . Close hearing. 5 . The City Council may then ask questions and discuss the District. 6 . When discussion is through, the City Council considers and adopts : ( 1) A Resolution of Formation of City of Palm Desert Community Facilities District No. 91-1 (Indian Ridge Public Improvements) , Authorizing the Levy of a Special Tax within the District, Preliminary Establishing an Appropriations Limit for the District and Submitting Levy of the Special Tax and the Establishment of the Appropriations Limit to the Qualified Electors of the District; (2 ) A Resolution Determining the Necessity to Incur Bonded Indebtedness within the City of Palm Desert Community Facilities District No. 91-1 ( Indian Ridge Public Improvements ) and Submitting the Proposition to the Certified Electors of the District; and ( 3) A Resolution Calling Special Election. 7 . The Mayor then announces : "At this time, I ask the City Clerk to open the ballot and announce the results of the election. " [Pause for opening of ballot. ] 8 . The City Clerk opens the ballot and announces the results of the election. The City Clerk then completes one copy of the Canvass and Statement of Result of Election. 9 . The Mayor then announces : "The results of the election being in favor of the proposition, we may now proceed with the final actions for the District. " 10 . The City Council considers and takes the following actions : ( 1) Adoption of A Resolution of the City Council of the City of Palm Desert Declaring Results of Special Election and Directing Recording of Notice of Special Tax Lien. (2 ) First reading of An Ordinance of the City Council of the City of Palm Desert Levying Special Taxes Within Community Facilities District No. 91-1 ( Indian Ridge Public Improvements ) .
