HomeMy WebLinkAboutAdoption of MOU with PDEO 0 4110 INTEROFFICE MEMO CITY OF PALM DESERT TO: City Manager, Members of the City Council FROM: Dave Millheim, Director of Human Resources DATE: July 5 , 1994 SUBJECT: PDEO MEMORANDUM OF UNDERSTANDING 94/96 RECOMMENDATION: By minute motion adopt the attached Memorandum of Understanding (MOU) with the Palm Desert Employees Organization (PDEO) which is in effect from July 1 , 1994 to June 30, 1996 . BACKGROUND: The attached MOU was prepared by William Floyd who is the City' s labor negotiator. This MOU contains the items which the City and representatives of the PDEO have agreed upon as part of the meet and confer process as required by state law. These agreements have also been ratified by the general membership of the PDEO. Finally, these items were discussed in detail in executive session with the City Council on June 23, 1994 . From a labor relations point of view, I was very pleased by the process to date. Much of the enclosed agreement has gone through significant review, discussion, analysis and revision. Most importantly, staff believes a very balanced and fair package is being presented to the City Council at this time. Staff wishes to acknowledge and thank the entire PDEO Board and others who have helped in this process . The cooperative attitude which has been exhibited throughout this process is a compliment to all involved. This Memorandum of Understanding shall not be binding upon the parties, in whole or in part, unless and until said Council formally approves said Memorandum of Understanding. ARTICLE 2 - IMPLEMENTATION AND TERM 2.1 Any agreement, alteration, understanding, variation, waiver, or modification of any of the terms or provisions contained herein shall not be binding upon the parties hereto unless made and executed in writing by the parties hereto, and if required, approved and implemented by Council. 2.2 The term of this Agreement shall be for a two (2) year period beginning July 1, 1994 and ending at midnight on June 30, 1996. 2.3 In the event that either party desires to meet and confer over the provisions of a successor memorandum of understanding, such party shall deliver to the other, no later than ninety (90) days before the expiration date in Article 2.2, its written notice to commence meeting and conferring. 2.4 If a new memorandum of understanding/agreement is not reached prior to the expiration date, the parties may mutually extend the term of the Agreement for a specific period of time to allow for the continuation of meeting and conferring. ARTICLE 3 - FULL UNDERSTANDING, MODIFICATIONS, WAIVER 3.1 It is agreed and understood that the parties hereto voluntarily and unqual- ifiedly waive their rights and agree that neither shall be required to meet and confer with respect to any subject or matter covered herein or with respect to any other subject or matters, whatsoever, within the scope of representation as defined in Section 3504 of the Government Code, during the term of this Memorandum of Understanding. 3.2 The waiver of any breach, term, or condition of this Memorandum of Under- standing by either party shall not constitute a precedent in the future enforcement of all its terms and provisions. ARTICLE 4 - SAVING CLAUSE 4.1 If any provision of this Agreement is or shall at any time be contrary to law, that provision shall not be applicable or performed or enforced, except to the extent WWF222247 0 permitted by law, and any substitute action shall be subject to appropriate meeting and conferring between the parties. In the event that any provision of this Agreement is or shall at any time be contrary to law, all other provisions of this Agreement shall continue in full force and effect. ARTICLE 5 - WAGES 5.1 The wage rates for employees covered by this Agreement are set forth in Exhibit "A." ARTICLE 6 - MILEAGE REIMBURSEMENT 6.1 The mileage reimbursement rate to employees required to use their personal car on City business shall be $0.31 per mile. ARTICLE 7 - VACATION BUY-BACK 7.1 All regular full-time personnel, both exempt and nonexempt, instead of taking leave time off, may, at their option, be compensated for vacation time earned by receiving pay at the hourly rate of their salary,up to a maximum of forty (40) hours per calendar year, with the added requirement, for both exempt and nonexempt personnel, that after the buy- back, eighty (80) hours credits must be left available on the books for vacation leave. ARTICLE 8 - RETIREE HEALTH CARE PROGRAM 8.1 The specifics of this plan are included by reference and attached hereto as Exhibit "B" under the title of Resolution 92-96 adopted on September 24, 1992. ARTICLE 9 - SICK LEAVE INCENTIVE PROGRAM 9.1 STATEMENT OF PURPOSE: The City has paid sick leave for full-time employees. If employees need to use this benefit for legitimate purposes, they are encouraged to do so. The purpose of this program is to reward employees who do not overuse the sick leave benefit. 9.1.1 Effective July 1, 1992, upon termination, employees can be compen- sated at their current hourly rate for a percentage of their unused sick leave provided they meet certain minimum qualifying criteria as follows: • The employee must have at least 192 hours of accrued sick leave on the books on the date of termination. • All service time must be full-time paid City service in order to qualify. I, 9.1.2 The percentage cashout assuming the above criteria are met is based on the following payout schedule: • Less than four (4) years of service = 0 • Over four (4) but less than seven = 25% (7) years of service • Over seven (7) but less than ten = 35% (10) years of service • Over ten (10) but less than thirteen = 45% (13) years of service • Over thirteen (13) but less than = 55% sixteen (16) years of service • Over sixteen (16) years of service = 65% 9.1.3 Since the City has a PERS Sick Leave Credit Conversion option, the employee may choose, upon retirement only, not to cash out any percentage of sick leave and instead have his or her entire unused sick leave balance converted to service credit for retirement calculations. ARTICLE 10 - OFFICE HOUR CHANGE AND PILOT PROGRAM 10.1 Effective August 1, 1992, city hall will be open from 8:00 a.m. to 5:00 p.m. Affected employees will work with their respective department heads in making sure coverage is maintained under the existing 37.5 hour workweek schedule. This will neces- sitate using flexible scheduling of employees. The intent of this change is to provide better customer service to the public. ARTICLE 11 - BOOT REPLACEMENT 11.1 Employees eligible under the City's current boot replacement policy shall be eligible for boot replacement, under the terms and conditions of said policy, at nine (9) month intervals. ARTICLE 12 - HOLIDAYS (CHRISTMAS AND NEW YEAR'S EVES) 12.1 Employees will be eligible for one-half('h) day off,with pay, on Christmas Eve and New Year's Eve when these days fall on a regular City workday. During those years that Christmas Eve and New Year's Eve fall on a non-City workday, employees are eligible for an additional full day floating holiday in accordance with the policies and practices currently applicable to floating holidays. WWF222247 -3- • ARTICLE 13 - CLASSIFICATION STUDY 13.1 The City will conduct a classification study in accordance with the REQUEST FOR PROPOSAL FOR PERSONNEL STUDY FOR CITY OF PALM DESERT, issued by the City on May 25, 1994, and make all reasonable efforts to see that said study is completed prior to December 31, 1994. Upon completion of the classification study, it will be submitted to the City Council for review and consideration. The City Council is under no obligation,whatsoever, to adopt recommendations of the study or otherwise act upon its contents. Action on the classification study, if any, shall be within the sole discretion of the City Council.
