HomeMy WebLinkAboutRes 96-47 MOU Between City and PDEO T INTEROFFICE MEMORANDUM j\e))- CITY OF PALM DESERT TO: HONORABLE MAYOR AND CITY COUNCIL FROM: JOHN WOHLMUTH, ACM/DIRECTOR OF ADMINISTRATIVE SERVICES DATE: JUNE 27, 1996 SUBJECT: RESOLUTION APPROVING SALARY SCHEDULE, SALARY RANGES, ALLOCATED CLASSIFICATIONS AND MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND PDEO RECOMMENDATION Waive further reading and adopt Resolution No.96-47 setting the salary schedule, salary ranges, allocated classifications, and approving a five year Memorandum of Understanding between the City and Palm Desert Employees' Organization (PDEO). BACKGROUND During the last several months, management and the PDEO Board have been negotiating in good faith to develop a comprehensive Memorandum of Understanding. In May 1996, the PDEO Board and the City reached a tentative agreement on the MOU. The provisions included the following items: 1. A five year MOU; 2. 5% salary increase for 1996-97; 3. Years 2-5, a CPI increase capped at 4% and a 2% minimum; 4. 2% at 55 PERS contract amendment; 5. Eight hour workday; 6. Employer paid member contribution as compensation; 7. Agree to consider PDEO salary setting formula for Year 6; 8. One-time, three year additional service credit retirement incentive. SALARY & MOU RESOLUTION JUKE 27, 1996 The PDEO general membership approved the negotiated agreement by a vote of 47 ayes and 5 noes. The attached MOU includes the aforementioned items as well as previously agreed upon provisions passed by prior resolutions. Human Resources staff prepared the comprehensive MOU to document and list provisions still affecting employees. In addition to the MOU, the attached resolution sets the 1996-97 salary schedule, salary ranges, and allocated classifications. The salary schedule and ranges as well as allocated classifications do not reflect the proposed changes to the Code Compliance and the Business Service Center. A later resolution will be drafted to reflect these changes after Council discusses this reorganization in August. The 1996-97 Budget reflects several changes in allocated classifications and salary ranges. The following list is a summary of these changes. I. With the pending reorganization of the Code Compliance Department to Building and Safety and the creation of the Business Service Center, staff anticipates the addition of one clerical position. With all of these changes the City of Palm Desert will remain at 109 full-time employees. Staff recommends that the City Council waive further reading and adopt the attached resolution approving the City/PDEO MOU and setting the salary schedule, salary ranges, and allocated positions. ARTICLE 13 - SICK LEAVE INCENTIVE PROGRAM 13.1 STATEMENT OF PURPOSE: The City has paid sick leave for full-time employees. If employees need to use this benefit for legitimate purposes, they are encouraged to do so. The purpose of this program is to reward employees who do not overuse the sick leave benefit. 13.1.1 Effective July 1, 1992, upon termination, employees can be compensated at their current hourly rate for a percentage of their unused sick leave provided they meet certain minimum qualifying criteria as follows: • The employee must have at least 192 hours of accrued sick leave on the books on the date of termination. • All service time must be full-time paid City service in order to qualify. 13.1.2 Assuming the above criteria are met, the percentage cashout is based on the following payout schedule: • Less than four (4)years of service = 0 • Over four (4) but less than seven (7) years of service = 25% • Over seven (7) but less than ten (10) years of service = 35% • Over ten (10) but less than thirteen (13) years of service = 45% • Over thirteen (13)but less than sixteen (16) years of service = 55% • Over sixteen (16) years of service = 65% 13.1.3 Since the City has a PERS Sick Leave Credit Conversion option, the employee may choose, upon retirement only, not to cash out any percentage of sick leave and instead have his or her entire unused sick leave balance converted to service credit for retirement calculations. ARTICLE 14 - VACATION BUY-BACK 14.1 All regular full-time personnel, both exempt and nonexempt, instead of taking leave time off, may, at their option, be compensated for vacation time earned by receiving pay at the hourly 5 rate of their salary, up to a maximum of forty (40) hours per calendar year, with the added requirement, for both exempt and nonexempt personnel, that after the buy-back, eighty (80) hours must remain available on the books for vacation leave. Exhibit "A" shall be amended annually as follows: YEAR 1: July 1, 1996 through June 30, 1997 five (5) percent "across the board" increase. YEAR 2: July 1, 1997 through June 30, 2001. On July 1, of each year the City shall adjust salaries by the Consumer Price Index, published by the U.S. Department of Labor, Bureau of Labor Statistics, for the Los Angeles-Anaheim-Riverside area. Said CPI shall be computed as the difference between the March of the current year to the March of the previous year Index, irregardless of the computed CPI. These annual adjustments shall not be less than two (2) percent nor greater than four(4) percent.
