AND DIRECTOR OF COMMUNITY AFFAIRS/CITY CLERK SALARY
AND CLASSIFICATION DESCRIPTION
RECOMMENDATION:
Waive further reading and adopt Resolution No. 96-55 amending Resolution No. 96-47
setting salary range and the classification description of the Director of Building and Safety and
Director of Community Affairs/City Clerk.
BACKGROUND:
Director of Building and Safety
During the 1996-97 budget process, staff developed a plan to eliminate the Code Compliance
Department by separating code enforcement issues from business license issues. The need for
this separation arose as the Code Compliance Director desired to participate in the service credit
retirement offer. PERS requires that the City of Palm Desert leave the (a) position vacant for
five years and demonstrate a salary savings due to the reorganization. Therefore, staff
recommends that the code enforcement functions be placed under the Building and Safety
Director and the business license functions be placed in either a Business Service Center or
under Economic Development.
The Director of Building and Safety will be the department head over both Building and Safety
and Code Compliance. The Senior Code Compliance Officer will be the manager of the Code
Compliance functions. The additional duties and responsibilities of administering code
compliance necessitate a classification modification for the Director of Building and Safety.
Attached please find the new classification description prepared for the Director of Building and
Safety.
The white paper prepared for the City Council during the 1996-97 budget process identifies this
reorganization but indicates the change will occur November 1, 1996. Mr. Ramsey retired at
the front end of the retirement window and not at the end of October as first indicated.

MODIFICATION OF SALARY SCHEDULE
AUGUST 22, 1996
Director of Community Affairs/City Clerk
Due to the pending retirement of Larry McAllister, it is proposed that special events be handled
on a contract consultant as needed basis. However, that contract will require administration,
oversight and assurances of cooperation with City boards, staff and Council.
Previously, a great deal of time involving special events was spent by the City's Promotion
Committee, as well as Civic Arts Committee, and the Public Information Officer portion of the
Community Affairs Director. It is proposed that the Community Affairs Department administer
the special events contract and Sister Cities programs. As a result of these new duties and
responsibilities the Community Affairs Director should be placed at a salary range of 855.
CONCLUSION:
The new salary ranges will be 5,198 to 6,318, or a 5.5% increase over 840, the current ranges.
The attached resolution amends Resolution 96-46 setting the salary range for the Director of
Building and Safety and the Director of Community Affairs/City Clerk and places the Director
of Building and Safety into Exempt A, Management.
Staff recommends that the City Council adopt the attached resolution amending Resolution No.
96-47 setting the salary and classification of the Director of Building and Safety and Director
of Community Affairs/City Clerk.

PALM DESERT AMENDING RESOLUTION 96-47, SECTION
I, SALARY SCHEDULE, RANGES AND ALLOCATED
CLASSIFICATIONS, AND SECTION II, EXEMPT
PERSONNEL, RELATING TO THE POSITION OF DIRECTOR
OF BUILDING AND SAFETY AND DIRECTOR OF
COMMUNITY AFFAIRS/CITY CLERK.
WHEREAS, the City of Palm Desert is deleting the classification of Code Compliance
Director due to retirement; and
WHEREAS, the Code Compliance Department will be reorganized into a division of the
Building and Safety Department; and
WHEREAS, the importance of the code enforcement functions will not be diminished by
this reorganization, rather will assist by enhancing inter-departmental cooperation; and
WHEREAS, the Director of Community Affairs/City Clerk will be given additional
duties and responsibilities relating to special events and activities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert that Section I and Section II of Resolution No. 96-47 be amended as follows:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT RESCINDS RESOLUTION NO. 96-18, 96-12, 95-41, 94-90, 92-55,
AND THE MEMORANDUM OF AGREEMENT WITH THE PALM DESERT
EMPLOYEES ORGANIZATION FOR THE PERIOD OF JULY 1, 1994
THROUGH JUNE 30, 1996.
WHEREAS, the City of Palm Desert has met and conferred in good faith with the Palm
Desert Employees Organization (PDEO) in accordance with the Meyers-Milias-Brown Act and the
City employer- employee relations Resolution No. 81-89; and
WHEREAS, the City of Palm Desert has reached agreement with the employees represented
by the Palm Desert Employees Organization, for the period of July 1, 1996 through June 30, 2001.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PALM DESERT AS FOLLOWS:
SECTION I- SALARY SCHEDULE. RANGES & ALLOCATED CLASSIFICATIONS
All employees shall be classified and shall receive compensation for services performed. This
compensation shall be in accordance with the established salary schedule and salary ranges for their
respective classification as shown below and on the attached Memorandum of Understanding.
This schedule of allocated positions supersedes the schedule of allocated positions in the 1995/96
approved budget.
Specific terms for appointment and tenure of all City employees are prescribed in the"City of Palm
Desert Personnel System" as found in Section 2.52 of the Palm Desert Municipal Code.

SECTION IV- MILEAGE REIMBURSEMENT
The mileage reimbursement rate to employees required to use their personal car on City business shall
be $0.31 per mile.
SECTION V- OTHER COMPENSATION
While this resolution establishes the ranges and gross salary for certain positions in the classified
service for the City of Palm Desert, there are other benefits both tangible and intangible that are not
addressed in this document. Unless referenced otherwise, all benefits in place on July 1, 1996 will
continue as constituted.
SECTION VI
This resolution is effective upon adoption. The provisions relating to salary and other compensation
shall be effective and where applicable, accrue on, and from July 1, 1996.

the event that any provision of this Agreement is or shall at any time be contrary to law, all other
provisions of this Agreement shall continue in full force and effect.
ARTICLE 5 - BOOT REPLACEMENT
5.1 Employees eligible under the City's current boot replacement policy shall be eligible
for boot replacement, under the terms and conditions of said policy, at nine (9) month intervals.
ARTICLE 6 - COMPENSATION SETTING FORMULA FOR FISCAL YEAR 2001-2002
6.1 The City will consider PDEO salary setting formula in fiscal year 2000 - 2001 to assist
in determining salary adjustments in fiscal year 2001 - 2002. The City agrees to work with PDEO
to determine bench mark positions, separation percentage between grades, and implementation
formula.
ARTICLE 7 - DENTAL BENEFITS
7.1 Effective August 1, 1992, dental benefits increased to a maximum dollar limit of
$2,000 along with adding orthodontia coverage ($1,000 lifetime benefit at a 50% co-pay). This
benefit is extended to all covered employees and their covered dependents.
ARTICLE S - HOLIDAYS
8.1 The following is a replacement of Section 2.52.230 which all permanent full-time
employees of the City shall receive eight hours of pay for each listed holiday. Any holiday that falls
on Saturday, employees will get the preceding Friday off. If a holiday falls on Sunday, employees will
get the following Monday off.

ARTICLE 1 - MEMORANDUM OF UNDERSTANDING
1.1 This MEMORANDUM OF UNDERSTANDING, also referred to as Agreement,
made and entered into this day of , 1996, by and between representatives
of the City of Palm Desert (hereinafter referred to as "City"), and the Palm Desert Employees'
Organization (hereinafter referred to as "PDEO"), constitutes a mutual recommendation to be
submitted to the City Council of the City of Palm Desert (hereinafter referred to as"Council"). This
Memorandum of Understanding shall not be binding upon the parties, in whole or in part, unless and
until said Council formally approves said Memorandum of Understanding.
ARTICLE 2 - IMPLEMENTATION AND TERM
2.1 Any agreement, alteration, understanding, variation, waiver, or modification of any
of the terms or provisions contained herein shall not be binding upon the parties hereto unless made
and executed in writing by the parties hereto, and if required, approved and implemented by Council.
2.2 The term of this Agreement shall be for a five (5) year period beginning July 1, 1996
and ending at midnight on June 30, 2001.
2.3 In the event that either party desires to meet and confer over the provisions of a
successor memorandum of understanding, such party shall deliver to the other, no later than ninety
(90) days before the expiration date in Article 1.1, its written notice to commence meeting and
conferring.
2.4 If a new memorandum of understanding/agreement is not reached prior to the
expiration date, the parties may mutually extend the term of the Agreement for a specific period of
time to allow for the continuation of meeting and conferring.
ARTICLE 3 - FULL UNDERSTANDING. MODIFICATIONS. WAIVER
3.1 It is agreed and understood that the parties hereto voluntarily and unqualifiedly waive
their rights and agree that neither shall be required to meet and confer with respect to any subject or
matter covered herein or with respect to any other subject or matters, whatsoever, within the scope
of representation as defined in Section 3504 of the Government Code, during the term of this
Memorandum of Understanding.
3.2 The waiver of any breach, term, or condition of this Memorandum of Understanding
by either party shall not constitute a precedent in the future enforcement of all its terms and
provisions.
ARTICLE 4 - SAVING CLAUSE
4.1 If any provision of this Agreement is or shall at any time be contrary to law, that
provision shall not be applicable or performed or enforced, except to the extent permitted by law, and
any substitute action shall be subject to appropriate meeting and conferring between the parties. In

ARTICLE 11 - REMOVAL OF AUTO ALLOWANCE
11.1 Since auto allowance was paid to both management and represented employees, it was
necessary to enter into a supplemental MOU with those affected. The specifics of this program was
adopted within Resolution No. 92-55.
ARTICLE 12 - RETIREE HEALTH CARE PROGRAM
12.1 All employees who are currently receiving health insurance coverage through the City
are eligible to participate in this program provided the following minimum criteria are met. Further
guidelines are set forth within Resolution No. 92-96.
• Employee must be enrolled in the medical group which offers the "Retiree
Health Care Program."
• Employee must have at least ten (10) years of continuous service with the
City.
• During said employment, employee must continuously be covered by health
care insurance provided by the City.
• Employee must retire from the City and the Public Employees Retirement
System (PERS).
• Employee must be at least age 55 at the time of retirement.
• If, for any reason, the employee is precluded or partially restricted from
participating in the City's health care insurance plan as an active employee,
those same preclusions and restrictions will be in effect as they relate to retiree
health care eligibility.
12.2 Once an employee meets the eligibility criteria and upon retirement, an employee
would receive the following premium payment contribution percentage:
• Age 55, fifty (50) percent of premium as a base contribution, provided the
employee has completed the ten year base service requirement.
• After age 55 and assuming the employee has satisfied the ten year base service
requirement, the retired employee would receive the base contribution amount
(50%) plus five (5) percent for each full year of paid city service completed
above the ten year base service requirement, up to a maximum of seventy-five
(75) percent of the premium contribution.
• All service must be continuous. Retired employees qualifying for this
program would have to complete fifteen (15) years of continuous city service
in order to receive the maximum of seventy-five (75) percent of the premium
payment at retirement.

* Should these two days fall on a City work day, City Hall will close at 12:00 noon.
All employees must complete a total of four (4) hours providing department coverage until 12:00
noon. Any employee NOT working a complete four(4) hours will need to show the difference from
accrued leave balances (i.e. if the employee is on vacation the timecard would show 4 hrs Vac and
4 hrs Hol). Any employee working longer than four(4) hours will need prior approval to show the
amount as overtime. Should these two days fall on a non-City work day, employees are eligible for
an additional full day floater in accordance with the policies and practices currently applicable to
floating holiday.
ARTICLE 9 - OFFICE HOUR CHANGE
9.1 City Hall will continue to conduct business between 8:00 a.m. to 5:00 p.m., however,
effective July 1, 1996 all employees will work eight hours with a one hour lunch break (non-
compensated) and two fifteen minute breaks (compensated). Breaks should be taken in the middle
of each work period. With City manager approval, Department Heads may modify work schedules
to conduct business effectively.
ARTICLE 10 - PUBLIC EMPLOYEES RETIREMENT SYSTEM (PERS) CONTRACT
10.1 The City agrees to report the value of employer paid member contributions (EPMC).
For all local miscellaneous members, seven (7) percent of EPMC paid by the City will be reported
to PERS in the compensation reports submitted to PERS.
10.2 The City agrees to offer to eligible members, who meet the conditions, three (3)years
of additional service credit for retirement. This additional service credit is a one time offer beginning
on June 28, 1996 and ending on October 26, 1996.

10.3 Two (2) percent at fifty-five (55) contract amendment for local miscellaneous
members.
10.4 Other PERS optional benefits:
• Post-Retirement Survivor Allowance (Provides upon the death of a member, after
retirement, an allowance continued to the surviving spouse.)
• Increased Level of 1959 Survivor Benefits (Payable to eligible family members if the
member's death occurs during employment.)
• Credit of Unused Sick Leave (Unused sick leave at retirement will receive additional
service credit.)
• Industrial Disability Retirement (Provides a miscellaneous member who is industrially
disabled qualifies for a retirement allowance based on the same qualifications and limitations
as for safety,members.)
• Improved Non-Industrial Disability Allowance (If a member retires on a non-
industrial disability, the allowance would equal to 20%of final compensation for five (5)
years of service and 1%for each additional year of service to a maximum of 50%)
• One-year Final Compensation(Final compensation calculated using the last(or highest)
twelve(12)consecutive monthly pay rates.)

rate of their salary, up to a maximum of forty (40) hours per calendar year, with the added
requirement, for both exempt and nonexempt personnel, that after the buy-back, eighty (80) hours
must remain available on the books for vacation leave.
ARTICLE 15- WAGES
15.1 The wage rates for employees covered by this Agreement are set forth in Exhibit "A."
Exhibit "A" shall be amended annually as follows:
YEAR 1: July 1, 1996 through June 30, 1997 five (5) percent
"across the board" increase.
YEAR 2: July 1, 1997 through June 30, 2001. On July 1, of each
year the City shall adjust salaries by the Consumer Price Index,
published by the U.S. Department of Labor, Bureau of Labor
Statistics, for the Los Angeles-Anaheim-Riverside area. Said CPI
shall be computed as the difference between the March of the current
year to the March of the previous year Index, irregardless of the
computed CPI. These annual adjustments shall not be less than two
(2) percent nor greater than four(4) percent.
IN WITNESS WHEREOF, the parties have caused their authorized representatives to
execute this Memorandum of Understanding this 27th day of June, 1996.

• An employee who does not complete the ten year base service requirement
prior to age 55 OR who is hired after age 55 MUST first complete this ten
year base service requirement before being able to receive this benefit. They
may receive the additional five(5) percent premium contribution for each full
year of paid city service completed after the ten year service requirement is
completed.
12.3 Should the City elect to change the premium contribution percentage for active
employees health care premium,the city contribution for retirees will change on a proportional basis.
ARTICLE 13 - SICK LEAVE INCENTIVE PROGRAM
13.1 STATEMENT OF PURPOSE: The City has paid sick leave for full-time employees.
If employees need to use this benefit for legitimate purposes, they are encouraged to do so. The
purpose of this program is to reward employees who do not overuse the sick leave benefit.
13.1.1 Effective July 1, 1992, upon termination, employees can be compensated at
their current hourly rate for a percentage of their unused sick leave provided they meet certain
minimum qualifying criteria as follows:
•
• The employee must have at least 192 hours of accrued sick leave on
the books on the date of termination.
• All service time must be full-time paid City service in order to qualify.
13.1.2 Assuming the above criteria are met, the percentage cashout is based on the
following payout schedule:
• Less than four(4)years of service = 0
• Over four (4)but less than seven (7)
years of service = 25%
• Over seven (7) but less than ten (10)
years of service = 35%
• Over ten (10) but less than thirteen (13)
years of service = 45%
• Over thirteen (13) but less than sixteen
(16) years of service = 55%
• Over sixteen (16) years of service = 65%
13.1.3 Since the City has a PERS Sick Leave Credit Conversion option, the employee
may choose, upon retirement only, not to cash out any percentage of sick leave and instead have his
or her entire unused sick leave balance converted to service credit for retirement calculations.
ARTICLE 14 - VACATION BUY-BACK
14.1 All regular full-time personnel, both exempt and nonexempt, instead of taking leave
time off, may, at their option, be compensated for vacation time earned by receiving pay at the hourly

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT AMENDS ARTICLE 5 . 1 (WAGES) ON THE MEMORANDUM OF
AGREEMENT WITH THE PALM DESERT EMPLOYEES ORGANIZATION FOR
THE PERIOD OF JULY 1, 1994 THROUGH JUNE 30, 1996 . THIS
RESOLUTION RESCINDS RESOLUTION NO. 93-67 AND AMENDS
SECTIONS I THROUGH V OF RESOLUTION NO. 92-55 .
WHEREAS, the City of Palm Desert has met and conferred in good
faith with the Palm Desert Employees Organization (PDEO) in
accordance with the Meyers-Milias-Brown Act and the City employer-
employee relations Resolution No. 81-89 ; and
WHEREAS, the City of Palm Desert has reached agreement with
the employees represented by the Palm Desert Employees
Organization, for the period of July 1, 1994 through June 30 , 1996 .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PALM DESERT AS FOLLOWS :
SECTION I - SALARY SCHEDULE, RANGES & ALLOCATED CLASSIFICATIONS
All employees shall be classified and shall receive compensation
for services performed. This compensation shall be in accordance
with the established salary schedule as attached and salary ranges
for their respective classification as shown below and on the
attached Memorandum of Understanding related to salary setting.
This schedule of allocated positions supercedes the schedule of
allocated positions in the 1994/95 approved budget.
Specific terms for appointment and tenure of all City employees are
prescribed in the "City of Palm Desert Personnel System: as found
in Section 2 . 52 of the Palm Desert Municipal Code

While this resolution establishes the ranges and gross salary for
certain positions in the classified service for the City of Palm
Desert, there are other benefits both tangible and intangible that
are not addressed in this document. Unless referenced otherwise,
all benefits in place on July 1, 1995, will continue as
constituted.
