Folkers, Assistant City Manager/Public Works Director SUBJECT: FISCAL YEAR 1990-91 ASSESSMENTS FOR ASSESSMENT DISTRICT NO. 4 DATE: July 26, 1990 RECOMMENDATION: Waive further reading and adopt Resolution No.90-97 levying the fiscal year 1990-91 assessments for the subject district. BACKGROUND: This assessment district was formed under the Landscaping and Lighting Act of 1972, as outlined in the California Streets and Highways Code, and a public hearing is required at a regular Council meeting before August 10, 1990, to levy annual assessments. At the regular Council meeting of June 28, 1990, a resolution of intention to levy and collect assessments for the subject district was passed and a public hearing legally noticed for July 26, 1990 at 7:00 p.m. An Engineers Report, as required by the Streets and Highways Code, has been on file with the City Clerk and available for review prior to the public hearing. Exhibit "A" to the resolution lists the amount of the Fiscal Year 1990-91 assessment for each parcel within the district described in the Engineers Report. Public Works staff recommends adoption of Resolution No. 9 0-9 7 establishing the assessments, as listed on Exhibit A, for parcels within the subject. RICHAR J. FOLK P.E. BACKGROUND This report is prepared for the City Council of the City of Palm Desert to be approved prior to the levy of annual assessments under the Landscaping an Lighting Act of 1972. The report is in compliance with the requirements of Article 4, Chapter 1 , Division 15 of the Streets and Highways Code, State of California. Before the recommended assessments can be confirmed by the City Council a public hearing must be held to allow public comments on the proposed assessments. The date for the hearing will be set by resolution of the City Council at which time the contents of this report will be discussed and approved. SECTION 2. PLANS AND SPECIFICATIONS The improvements to this district consist of twenty-three (23) street lights. The public ways to be lighted within the district are: Primrose Drive, Desert Star Boulevard, Wanda Circle, Palmilla Circle, Myrsine Avenue. Gazania Place, Rutledge Avenue, Buttonwood Drive. Silktree Lane. Santolina Drive. Balsam Lane and Erin Street. The maintenance and operation of the lighting system includes repairs, replacements and any other items necessary for proper operation of the system. SECTION 3. ESTIMATED COSTS. All street lighting and landscaping improvements currently exist within the boundaries of the district. The costs for FY 1990-91 will be for the maintenance of the existing improvements. Paae 2 Landscape 8 Lighting SECTION 4. ASSESSMENTS Each parcel within this district receives the same benefit from the improvements described. The distribution of costs among the 174 parcels will be an assessment of $17.33 per parcel . This is an increase of about $3.00 per parcel . The increase is due to increased costs and the provision for an adequate fund cash balance. SECTION 5. ASSESSMENT DIAGRAM A diagram for the Assessment District has been submitted to the City Clerk in the format required and is available for inspection at normal office hours. The lines and dimensions of each lot or parcel within the district are those lines and dimensions shown on the maps at the Assessor of Riverside County, California for the year in which this report was prepared and are incorporated by reference herein and made part of this report. SECTION 6. PROPERTY OWNERS LIST The property owners list with the names and addresses of each property owner of each lot or parcel as shown on the assessment diagram in Section 5 herein is the list of property owners shown on the last equalized tax roll of the Assessor of Riverside County, California and is by reference made part of this report. SECTION 7. ASSESSMENT ROLL The total assessment for FY 1990-91 will be $3,015.00. Said charges are in compliance with Section 22620 et. seq. of the California Streets and Highways Code and said charges are levied without regard to property valuation. Said amounts and fund and parcel numbers have been verified and certified correct by the City Clerk. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, that the Board of Supervisors, County of Riverside, is hereby respectfully requested to authorize the county assessor to enter said assessments against each parcel as set forth in Exhibit "A" of this resolution pursuant to Section 22640 et. seq. of the Landscaping and Lighting Act of 1972.
