Folkers, Assistant City Manager/Public Works Director SUBJECT: ANNUAL ASSESSMENT FOR LANDSCAPING AND LIGHTING DISTRICT NO. 4 (TRACT 8237) DATE: May 25, 1989 RECOMMENDATION: By minute motion, adopt Resolution No. 89-57 for the purpose of levying and collecting assessments for fiscal year 1989-90 for the subject assessment district. BACKGROUND: This existing landscaping and lighting district encompasses Tract 8237, located westerly of Deep Canyon Road and southerly of Magnesia Falls Drive. The following streets are included in this district: Rutledge Way; Santolina Drive; Buttonwood Drive; Myrsine Avenue; Primrose Drive; Balsam Lane; Silktree Lane; Gazania Place; Palmilla Circle; and Wanda Circle. This district has been in existence for approximately seven years, and was originally formed as a 1927 Act assessment district. In May of 1983, a new district was formed under the 1972 Act. The assessments for this district pay for the cost of street lighting only; there are no landscaping costs associated with this district. In order to cover the energy and maintenance costs for street lighting within the district, the City Council must levy assessments for fiscal year 1989-90. The California Streets and Highways Code specifically requires that public hearings for levying annual assessments be held at the first regular City Council meeting in June. Public Works staff recommends adoption of the resolution setting the annual public hearing for this assessment district. RI HA D J. FO S, P.E. CZ P .7:P T: EI':_iF'IED BY: c�r Original on Fi e i ;; h ity Clerk' s Of is= j RESOLUTION NO. 89-57 111 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, DECLARING ITS INTENT TO LEVY AND COLLECT ASSESSMENTS WITHIN LANDSCAPING & LIGHTING ASSESSMENT DISTRICT NO. 4 IN FISCAL YEAR 1989-90. WHEREAS, pursuant to Section 22620 of the Streets and Highways Code, it is the intent of the City Council of the City of Palm Desert, California, to establish the annual assessments for landscaping and lighting assessment districts. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: ( 1 ) That said City Council hereby declares its intent to levy and collect assessments within the assessment district for fiscal year 1989-90. (2) That existing improvements are a part of said assessment district and are described as follows: Street lighting encompassing all streets within Tract 8237.. (3) That the existing,assessment district is designated as:Landscaping. and Lighting Assessment District No. 4 and generally encompasses the following areas: • Within an area covered by Tract No. 8237 shown by Map Book 92, Pages 3-5 of Maps, Records of Riverside County, California. (4) That said City Council does hereby give notice that on Thursday, June 8, 1989, at 7:00 p.m., at the regular session of the City Council of the City of Palm Desert, a hearing will be held on the levy of assessments for fiscal 1989-90. Said Clerk of the City of Palm Desert is hereby ordered to give notice of said hearing in accordance with Section 22626 of the Streets and Highways Code.
