5.06, Section 5.06.010 of the Business License Tax Code
I. DISCUSSION:
Currently, the vendors operating a business at an art fair, street
fair, swap meet or similar event, pay a business license tax fee
based upon gross receipts. The vendors currently licensed at the
C.O.D. street fair pay a fee of sixty dollars ( $60.00) .
It is impossible to audit vendors for correct fees for various
reasons, to insure the city is receiving the proper revenue from
this source.
A new business license tax fee rate should be implemented for the
outdoor sale vendors which will insure the city receives the
revenue due. Ordinance No. 656 now requires a conditional use
permit for these outdoor events, and by making it part of the
agreement terms, a better method of payment can be implemented.

Council will also need to approve a resolution containing a new
business license tax fee for the outdoor events listed in the
ordinance.
Because Ordinance No. 656 requiring a C.U.P. will be effective
December 14, 1991, it is necessary to declare this ordinance as an
emergency ordinance in order to collect the fees under the C.U.P.
II. RECOMMENDATION:
Staff recommends city council approve this ordinance adding
Category "J" to the Palm Desert Municipal Code.

ORDINANCE NO. 664
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, ADDING CATEGORY "J"TO CHAPTER 5.06 OF THE PALM DESERT
MUNICIPAL CODE PERTAINING TO THE ESTABLISHMENT AND DEFINING
OF BUSINESS LICENSE TAX CATEGORIES AS AN URGENCY ORDINANCE
The City Council of the City of Palm Desert, California, DOES HEREBY ORDAIN
as follows:
SECTION 1: That Category "J"be added to Section 5.06.010 to read as follows:
5.06.010- Category J. Businesses Included in This Category.
1. Every person engaged in the business activity of selling at retail or wholesale,
arts, crafts, clothing, goods, wares, and other merchandise; every person
providing a service of any kind in conjunction with a street fair, swap meet,
and similar outdoor events.
SECTION 2: The City Council hereby declares that this ordinance shall be effective
immediately and the same is necessary for the preservation of the public health, safety, and
welfare because there are numerous such vendors presently active in the City and because
potential use of the revenues generated from this fee will be utilized to offset some of the
potential adverse affects created by these activities.
SECTION 3: The City Clerk shall certify to the passage and adoption of this
ordinance and shall cause the same to be published once in The Palm Desert Post with 15
days of the passage and adoption, and this ordinance shall be and is hereby declared to be
effective December 12, 1991.

Desert, California, at its regular meeting held on the day of , 1991, by the
