detecting lighting should not be required if it conflicts with applicable requirements.

A Regular Meeting of the Architectural Review Commission (ARC) was called to order by
Chair Vuksic on Tuesday, October 24, 2023, at 12:30 p.m. in the Development Services
Conference Room, City Hall, located at 73510 Fred Waring Drive, Palm Desert, California.

recusal due to a conflict of interest as his architectural firm was retained for this project.
Commissioner Sanchez announced his recusal due to a conflict of interest as his firm
was retained to provide landscaping design services for this project.
Principal Planner Melloni advised the Commission with the recusal of Commissioners
McAuliffe and Sanchez there are not enough commissioners present to form a quorum
for this item, therefore, it will need to be reviewed at the next regularly scheduled
Architectural Review Commission (ARC) meeting held.
Due to lack of a quorum Case No. SARC23-0008 has been deferred to the next
regularly scheduled ARC meeting held which can provide a sufficient number of
commissioners in attendance to form a quorum for the item.

1. Applicant shall revise renderings to reflect actual roof materials and description.

4. Site plan shall reflect signage and stripping for armored vehicle location.
5. Incorporate security lighting into the structure which is motion activated and

B. CITY STAFF
Principal Planner Melloni informed the Planning Division has prioritized streamlining
certain development review applications. One of the applications identified as a potential
option is for certain accessory structures. Principal Planner Melloni explained these
particular applications would no longer require a review by the ARC but would undergo a
more comprehensive review by staff based on feedback from the commission on design
items that should be examined and considered during staff’s review of the item. Principal
Planner Melloni encouraged commissioners to comment on what criteria should be
considered should a policy be formed for a staff level review of these applications.
Discussion ensued with commissioners providing their comments and concerns and
requested further discussion on the matter.
Principal Planner Melloni advised the two commissioners assigned to the ARC
subcommittee for the Urban Crossings project were unavailable to review the project,
therefore, Commissioners McAuliffe and Latkovic have volunteered for the Urban
Crossings ARC subcommittee which will be held today, after the ARC meeting.
C. ATTENDANCE REPORT
The attendance report was provided with the agenda materials. The Commission took no
action on this matter.

Subject: Consideration to approve a Sign Design Review for four (4) new exterior
business identification wall signs and one (1) new freestanding monument sign
including a height exception for a new commercial building located at 73611
Highway 111.
BACKGROUND
The Applicant, Chandler Signs, is requesting approval of four (4) new exterior business
identification wall signs and one (1) new freestanding monument sign for a new commercial
building located at 73611 Highway 111. The wall signs will service the incoming tenant,
Mechanics Bank. The wall signs will consist of face-lit channel letters and logos mounted
directly to the building fascia. Each elevation has a different sign area and height.
On September 12, 2023, planning staff presented the project to the ARC for design review.
Following discussion, the ARC continued the item with a 5-0 vote, (Commissioner McAuliffe
and Commissioner Sanchez absent) with the following comments:
1) Sign E should be revised to one line.
2) Consider a different location for Sign B, additionally, reconsider scale of sign in
relation to the identified alternate location for placement.
3) Applicant shall revisit the scale and proportion of the business logo located on the
entry doors.
On October 24, 2023, the item was on the ARC agenda for design review but was continued
due to lack of a quorum.
Subsequent to the meeting, the Applicant updated their plans and made the following revisions
to address the comments:
1. Every proposed sign is now two lines instead of one line. The sign area of each
sign has changed as a result.
2. Sign B has been lowered by four (4) inches on the same location and is now at a
height of 25’ from grade, as compared to a height of 25’-4” from the previous

proposal. Applicant communicated the landlord would not permit sign installation
on other parts of the north elevation due to the materials.
3. Business logo on the entry door has changed from a width of 7” to 3”.
4. Sign C has been relocated one (1) foot higher on the building.
5. Signs D and E have been relocated to a lower location.
6. Addition of a new 50 square foot freestanding monument sign.
Table 1 below provides a summary of the changes from the September 12, 2023, submittal
and the updated submittal.

As noted in Table 1, the applicants new proposal decreases the sign area and the height
for two signs (B and E), increases both the sign area and height for Sign C, and increases
the sign area but decreases the height for Sign D. Applicant has also proposed a new
freestanding monument sign that would be solely for Mechanics Bank and installed
adjacent to Highway 111. Staff expressed concerns to the Applicant on the new proposal
not meeting the recommendations from ARC. The Applicant communicated they would
like to proceed with the new proposal.
PROJECT SUMMARY
A. Property Description:
The project site is a 0.41-acre parcel containing one (1) 3,830 square-foot commercial
building on the southwest corner of Highway 111 and Larkspur Lane located at 73611
Highway 111. The site is zoned Downtown-Core Overlay (D.O.). The building, which is still
under construction, was entitled in 2019 by the Planning Commission pursuant to
Resolution No. 2763 for Case No. PP19-0003 and CUP18-0007. The building architecture
and landscaping was approved by the Architectural Review Commission (ARC) under
Case No. MISC22-0013 on August 23, 2022, with a subsequent amendment on November
15, 2022.

C. Project Description
The project is a request to install four (4) new exterior wall signs and one (1) freestanding
monument sign on a currently under construction commercial building to service the
incoming tenant, Mechanics Bank. The signs will be placed on all four building elevations,
each sign being at a different height and size.
North Elevation
On the north elevation, Sign B will face Highway 111 and will have a total sign area of
54.04 square-feet. The sign will have two lines of text and a logo. It will be installed flush
against the building fascia/architectural projection at a height of 25 feet above the ground.
East Elevation
Sign C will be installed facing Larkspur Lane with a total sign area of 54.09 square feet.
The sign will have two lines of text and a logo. It will be installed flush and centered against
the building fascia, 19 feet and 6 inches above the ground.
South Elevation
Sign E will be installed facing the internal parking lot and will have a size of 15.08 square
feet. The sign will have two lines of text and a logo. It will be installed flush against the
building fascia, 18 feet, 9 inches above the ground.
West Elevation
Sign D will be facing the internal parking lot and Highway 111 and will have a total sign
area of 54.09 square feet. The sign will have two lines of text and a logo. It will be installed
flush against the building fascia, 19 feet and 6 inches above the ground.
Monument Sign
The Applicant has also proposed a 61.25 square foot monument sign (Sign A). Sign A is
proposed to be located at a 5’ setback from the existing sidewalk off Highway 111 and

approximately 25’ setback from Highway 111. Sign A would be installed within a
landscaped area for the Mechanics Bank and is within a sewage easement. Final location
will require coordination with the City’s Land Development Division to ensure compliance
with location within the easement. Sign A is proposed as a fabricated aluminum monument
sign with flat aluminum faces and ½” acrylic push-thru graphics. The sign is internally
illuminated and built on a 9 ½” concrete foundation. The aluminum sign face will be painted
with a burgundy satin finish, and the base cladding would be painted natural tan and studio
taupe, to match the Mechanics Bank building. The sign graphics would incorporate a yellow
and white logo with white lettering. The sign is two lines, with 1’-1” letter heights, a logo
height of 1’-8”, and a length of 9’-2” for the text. The sign structure measures 6’ in height
and 10’-2.5” in length for an area of 61.25 square feet. The maximum square feet for
freestanding signs within PDMC is 50 square feet.
All wall signs are constructed of individual front-lit channel letters with 3-inch-deep white
aluminum returns and white acrylic faces. The letter faces are overlaid with a burgundy
vinyl film. The logos are also front-lit fabricated acrylic signs with aluminum returns. The
logo faces are overlaid with a translucent sunflower vinyl film.
ZONING ORDINANCE SUMMARY
Pursuant to Palm Desert Municipal Code (PDMC) Section 25.68.050 (C)(5), the zoning
administrator (ZA) may elevate any sign to the ARC depending on the design, context, color,
size, shape, location, or circumstance of the sign. The standards for exterior wall signs are
listed under Section 25.56.070 (D) and Section 25.56.080 (A) of the Sign Ordinance.
The proposed signage meets the standards for signage area, installation, and illumination as
outlined in the PDMC. However, it fails to comply with the maximum sign height, which is
limited to 20 feet from grade to the uppermost part of the sign. The plans demonstrate that the
tallest sign is on the north elevation at 25' above grade.
Furthermore, even though the signs meet the maximum sign area allowance of 75 square feet,
the proximity of the building to the street, its height, and overall massing create a distinctive
situation in which the signage should be reviewed by the ARC. The signs could be more
consistent in area across each elevation, even if the building frontage is large enough to
accommodate that sign's size. For instance, the north building frontage measures 92'-3", but
the 55.04 square foot sign is on a 22'-3" wide fascia. ‘

All freestanding signs, such as monument signs, require design review, to be approved by
ARC.
Per PDMC 25.56.030 (E), when approving or rejecting a sign permit application, the ARC shall
consider the design review criteria provided below and shall make the following findings:
1. That the sign is necessary for the applicant’s enjoyment of substantial trade and
property rights.
The number and location of signs are necessary to provide adequate identification to
customers and employees of the business in the building as it is located on a high-
volume enhanced arterial (Highway 111). The monument sign is needed for
identification of the bank for vehicles driving along Highway 111. However, the signs, at
their proposed location and size, are disproportionately scaled based on the building
architecture and the width of the fascia where the signs are placed. Additionally, the
design of the monument sign could be enhanced and reduced in size to provide better
scale and compatibility with the building and to meet the ordinance requirements for
freestanding signs sign area. Staff recommends that the ARC provide direction on
reducing the height of sign B, preference for one line of text, and design of the
freestanding sign.
2. That the sign is consistent with the intent and purpose of this chapter and title.
The signs are relatively consistent with the guidelines of the Sign Ordinance as they are
designed within the acceptable sign envelope. However, the sign on the north elevation
exceeds the maximum height allowance of 20-feet. Staff recommends that the ARC
provide direction on reducing the height of sign B, preference for one line of text, and
design of the freestanding sign.

3. That the sign does not constitute a detriment to public health, safety, and welfare.
The design of the signs do not constitute a detriment to public health, safety, and welfare
as the design of the signs do not incorporate elements that are distracting or intrusive
to motorists or pedestrians. The placement of the signs are not anticipated to create
sight obstruction to motorists or pedestrians as they are setback away from line of site
areas and mounted onto the building, ranging 18’-9” to 25’ above grade.
The location of the monument sign is proposed within a sewer easement. Final
construction drawings would require coordination with Development Services staff and
the Coachella Valley Water District to confirm the structure is allowable within the area.
4. That the size, shape, color, height, and placement of the sign is compatible with and
will have a harmonious relationship to the building it identifies, the surrounding
neighborhoods, and other signs in the area.
The allowable sign area and mounting height shall be determined by the ARC given the
context of the building. As proposed the signs are disproportionate to the scale and
length of the building and could be revised to allow for greater consistency, including
the monument sign which currently exceeds the 50 square foot maximum as allowed
within the Palm Desert Municipal Code.
5. That both the location of the proposed sign and the design of its visual elements
(lettering, words, figures, colors, decorative motifs, spacing, and proportions) are legible
under normal viewing conditions prevailing where the sign is to be located.
The signs are oriented in a manner to be visible to pedestrians and motorists traveling
along Highway 111. The sign area and orientation on the north and south elevations
could be revised to better fit the width of the building fascia. As presented, the signs are
appropriately centered, but the ARC shall determine whether the height is acceptable.
The ARC must also determine if the location, size, and design of the monument sign is
acceptable.
6. That the location, height, and design of the proposed sign does not obscure from view
or unduly detract from existing or adjacent signs and does not in any way compromise
the health or safety of any person(s).
The location, height, and design of the proposed signs shall be reviewed by the ARC to
determine whether they obscure views or unduly detract from existing signs in the
vicinity. The signs are not anticipated to adversely affect the public health, safety, or
welfare; however, the size and height of signs A, B, C and D may be reduced for
aesthetic purposes.
7. That the location and design of the proposed sign, and its size, shape, illumination, and
color are compatible with the visual characteristics of the surrounding area so as not to
detract from or cause depreciation of the value of adjacent developed properties.
The proposed sign area and installation height of signs C, D, and B are not compatible
with the visual characteristics of the building or surrounding properties. The architectural
projections and massing necessitate smaller signs on these elevations, while still
providing adequate visibility and benefits to the tenant. Given the context of the building,

its size, and proximity to Highway 111, the ARC shall determinate a suitable sign height
and area across all four elevations. The monument sign, Sign A, shall also be revised
to provide a better design for the single use tenant. The size of the sign for one tenant
could be reduced and enhanced for better scale and compatibility with building. The
monument sign is suggested to be reduced in size to meet the PDMC and provide better
scale with surrounding building and freestanding signs. Additionally, a relocation may
be considered to meet easement requirements and be more appropriate.
8. That the location and design of a proposed sign in close proximity to a residential district
does not adversely affect the value or character of the adjacent residential uses.
The project site is located on Highway 111, an enhanced commercial arterial that is not
in proximity to any residential uses. Therefore, installing the signs would not have any
adverse effect on nearby residents. However, the installation of the signs would
immediately impact the tenants of the Jensen's Shopping Center. To ensure a
consistent and harmonious appearance, the signs should be appropriately designed for
both daytime and nighttime use.
9. That any neon tubing used in conjunction with any sign is incorporated as an integral
part of the sign design with careful attention to color, intensity of light, and the use of
colors that are not overly bright.
Neon tubing is not proposed as part of the signs, including the freestanding monument
sign. The wall signs will be internally illuminated, front-lit channel letters with white
6500k LEDs in a manner that complies with the Sign Ordinance requirements for
commercial business identification signs. All illuminated signs shall be designed with a
dimmer system to avoid undue glare or reflection of light on private property in the
surrounding vicinity.
10. That the quantity of information displayed in the sign does not cause visual clutter.
The signage text is limited to the name of the business and their logo.
STAFF RECOMMENDATION
Staff recommends the ARC continue the sign design review and provide further direction to
the Applicant on the following:
1) An acceptable height for Sign B.
2) The design of all signs being two lines and the location of the logo as it relates to
the text.
3) Provide further scaling and details on the proposed signs as it relates to the fascia
they are located on.
4) Direction on the proposed design, size, and location of the freestanding monument
sign.
Alternatively, the ARC may approve the sign design review as proposed or with conditions.

Executive Summary
The proposal is a request by Kimley-Horn (Applicant) on behalf of FLITE Banking Centers,
LLC to install a walk-up automatic teller machine (ATM) in the existing Walmart parking lot.
The project will consist of constructing a new 100 square-foot shade structure, signage,
installation of an aluminum cabinet and ATM, site improvements for accessibility, and
installation of new landscaping. The Architectural Review Commission (ARC) will consider
the architecture and landscape design of the proposed project for final consideration. Signage
for the project is included in the submittal package but will be approved by Planning staff and
is not part of the ARC design review.
Background
The item has been continued from the regular ARC meeting of October 24, 2023. Following
discussion, the ARC voted (Commissioner Latkovic motioned, seconded by Commissioner
Blakeley) 5-0 (Commissioners Colvard and Vuksic Absent) to continue Case No. MISC23-
0043 with the following comments:
1. Applicant shall revise renderings to reflect actual roof materials and description.
2. Rafter ends shall extend over the support columns.
3. Applicant shall provide details and depiction of all proposed hardware including exposed

In response to these comments, the applicant updated their exhibits and made the following
revisions:
1. The applicant has updated the project renderings to reflect the roof materials provided
on the color/material board.
2. Renderings have been updated to show rafters extending over the support columns by
approximately 2”.
3. Hardware details are shown on the exhibit. To screen, the applicant has added a note
that all exposed hardware will be screened with caps and painted to match the structure.
4. The site plan has been updated to include signage indicating the location of armored
vehicle parking. The applicant has not proposed striping.
5. Security lighting has been added to the underside of the ATM canopy structure and
shown on the renderings as motion activated.
6. The site plan has been revised to show accessible parking locations with signage and
striping.
7. The color of the concrete caps has been identified on the elevation drawings.
8. Due to security purposes, the applicant will not consider alternative placement for the
boulders. The applicant states that their sizing is sufficient for the size of the planter.
Project Summary
A. Property Description:
The project site is an irregularly shaped 8.56-acre parcel of developed land near the northeast
corner of Monterey Avenue and Dick Kelly Drive. The parcel is within the existing Desert
Gateway retail center (Center) and is improved with a Walmart Superstore retail building and
parking lot, which was approved by the City Council under Resolution No. 03-27 for Planning
Cases PP 01-30 and TPM 30502 and subsequently developed in 2005. The portion of the
site where the project is located is adjacent to an existing accessible path of travel connecting
to the center’s internal private sidewalk system.

C. Project Description
Site Plan
The Site Plan (Figure 1 below) shows the location of the shade structure, landscaping, and
proximity to parking, and private sidewalk/path of travel. The shade structure will be an open
sided, solid-roofed, 100 square-foot freestanding pergola which will shade a proposed ATM
kiosk. The structure will require the removal of one parking space to accommodate the raised
sidewalk area, access, and landscaping.

Architecture
The proposed structure is characterized by Spanish style architectural elements including a
sloped clay tile roof supported by four (4) six-inch wooden posts, with a stone veneer-clad
concrete masonry unit (CMU) base, and exposed wooden beams as depicted in the
elevations shown below. The ATM will be housed within an aluminum cabinet enclosure
which is painted blue and surrounded by a 6’-0” wall clad with stone. The total height of the
structure will be 10’-0” above the proposed finished grade, which will be raised approximately
0’-6” from the existing parking lot to match grade of the adjacent private sidewalk. Other
buildings in the center are designed with Spanish style architectural elements such as sloped
clay tile roofs and decorative wood rafter ends, which are similar to the proposed structure.

Landscaping
The proposed landscape plan will modify existing landscaping planters to add four (4) new
Sierra Negra plants on the east and west sides of the ATM facility. Additional hardscaping
consisting of three (3) new boulders will be added to the north side of the ATM facility.
Approximately 142 square-feet of decomposed granite will be added to the adjacent planters
existing ground cover nearby. Two existing parking lot shade trees will be removed to
construct the proposed structure.

Lighting
ATM lighting requirements are regulated by state law under Finance Code Section 13000-
13070, with requirements specified under Finance Code Section 13040 – 13041. These
requirements generally require a mandatory minimum foot candle rating directly over outdoor
ATMs and in the vicinity with the intent of providing for user safety and generally include the
following standards under Section 13041:

(a) There shall be a minimum of 10 candlefoot power at the face of the automated
teller machine and extending in an unobstructed direction outward five feet.
(b) There shall be a minimum of two candlefoot power within 50 feet from all
unobstructed directions from the face of the automated teller machine. In the event
the automated teller machine is located within 10 feet of the corner of the building and
the automated teller machine is generally accessible from the adjacent side, there
shall be minimum of two candlefoot power along the first 40 unobstructed feet of the
adjacent side of the building.
(c) There shall be a minimum of two candlefoot power in that portion of the defined
parking area within 60 feet of the automated teller machine.
The City’s outdoor lighting Ordinance, Chapter 24.16 establishes general requirements for
outdoor lighting including shielding requirements. To avoid any potential conflicts between
the requirements of state law, staff recommends that the ARC require the applicant submit a
final lighting plan for review by City staff and not include a condition that the lighting be motion-
activated. It may be necessary for the applicant to modify the existing site lighting to comply
with requirements.
Findings in support of the project are listed below:
To approve a design review application, the ARC shall find the following:
A. That the proposed development conforms to any legally adopted development
standards.
The proposed development conforms with the standards for the PC-3, FCOZ zoning
district, including setbacks, floor area ratio, parking, and density. As outlined in table
2 above, all development standards are met.
B. That the design and location of the proposed development and its relationship to
neighboring existing or proposed developments and traffic is such that it will not impair
the desirability of investment or occupation in the neighborhood; and that it will not
unreasonably interfere with the use and enjoyment of neighboring existing or proposed
developments and that it will not create traffic hazards or congestion.
The proposed project is within the PC-3 zoning, surrounded by existing retail, service
commercial, and financial institution land uses including walkup and drive-through
ATMs. The design of the project includes quality finishes and Spanish style
architectural elements which are compatible with existing architecture in the vicinity.
The architecture and landscape design of the project does not impair the desirability
of investment or occupation in the neighborhood and improves the overall aesthetic
and desirability of the surrounding properties. The project falls within the acceptable
density range and is not anticipated to generate a traffic issue.

C. That the design and location of the proposed development is in keeping with the
character of the surrounding neighborhood and is not detrimental to the harmonious,
orderly, and attractive development contemplated by this title and the General Plan of
the City.
The design of the project includes quality finishes and Spanish style architectural
elements which are compatible and harmonious with existing architecture in the
vicinity, which utilizes similar Spanish style elements.
D. That the design and location of the proposed development would provide a desirable
environment for its occupants, as well as for its neighbors, and that it is aesthetically
of good composition, materials, textures, and colors.
The proposed design utilizes durable finishes and features, provides a shaded
structure and screen walls for the ATM, and is compatible with the adjacent
development in terms of materials, textures, and colors.
E. That the proposed use conforms to all the requirements of the zone in which it is
located and all other applicable requirements.
The proposed development conforms with all development standards of the underlying
PC-3 zoning district and all other applicable requirements.
F. That the overall development of the land shall be designed to ensure the protection of
the public health, safety, and general welfare.
The site plan and grading plan have been reviewed to confirm the design provides for
protection of the public’s health, safety, and general welfare. The site is adequately
serviced by utilities and the grading plan reviewed in accordance with City
requirements. The project provides setbacks from adjacent properties that meet the
standards of the PC-3 zoning district.
STAFF RECOMMENDATION
Staff recommends the ARC determines that the requirements of the findings have been met
based on the analysis and approves the Design Review with the following condition as a part
of the motion:
1. The applicant shall submit a final lighting plan demonstrating compliance with
applicable State regulations and local ordinance, for review by staff. Motion-detecting
lighting should not be required if it conflicts with applicable requirements.
Any modifications required by the ARC should be added to the motion as a condition of
approval.

The proposed improvements include construction of a new metal patio trellis structure over
an existing outdoor seating area, a block wall to enclose an outdoor seating area, and outdoor
lighting. The applicant is seeking approval for these exterior modifications in conjunction with
a tenant improvement for an interior remodel. The Architectural Review Commission (ARC)
will consider the architectural design of the proposed project for final consideration. Signage
for the project is included in the submittal package but will be approved by Planning staff and
is not part of the ARC design review.
Project Summary
A. Property Description:
The project site is an irregularly shaped 1.68-acre developed parcel near the northwest corner
of Cook Street and Gerald Ford Drive. The parcel is developed with an 11,395 square-foot
multi-tenant retail and office building containing a drive-through Starbucks restaurant. This
building was approved by the Planning Commission in September 2005 by Planning
Commission Resolution No. 2354, Case No. PP/CUP 05-09. The existing Starbucks is
located within Suite 100, and totals approximately 1,750 square-feet with an outdoor seating
area near the southern edge of the building, and a drive-through.

C. Project Description
Site Plan
The Site Plan (Figure 1 below) shows the location of the proposed outdoor dining patio cover
on the eastern side of the existing building. The structure will be placed over the existing
outdoor dining area located at the southern portion of the building, adjacent to the front
entrance and drive-through lane. This existing outdoor seating area consists of a paved area,
with movable outdoor chairs and seating which is separated from the drive-through lane by a
metal picket fence.

The project will remove the existing furniture and fence and construct a 1’-9” block wall to
create a perimeter around a majority of the outdoor seating area and construct a metal patio
cover structure.
Architecture
The proposed structure will be a small patio cover constructed from metal with a maximum
height of 10’-9”. The roof of the structure will be open and spanned by string lights and canvas
canopies finished in the Starbucks green branding. The new low wall enclosing the patio will
be 1’-9” tall and constructed from concrete masonry units (CMU) clad with stone veneer and
a precast concrete wall cap. An additional wall will be constructed to fill in another portion of
the patio at a height of 3’-0” tall.
