STAFF RECOMMENDATION: Waive further reading and pass Ordinance No. 631 to second reading. B. DISCUSSION: The proposed amendment, if adopted, will establish a maximum content limit for signs. This amendment is a result of several cases being appealed to the city council after they were denied by the architectural review commission. Several meetings of the sign subcommittee were held with the city attorney in attendance. This proposed amendment was the result of those meetings. The proposed amendment will allow the business name plus the listing of up to two goods or services sold on the premises. Architectural commission will still review the sign for color compatibility, proportion, as well as graphics and other items. CLAUDIA HAMBURGER, Applicants, were present to discuss the project. Mr. Chapman explained that they would be offering between 700 to 1,000 international and domestic magazine and newspaper titles. He explained that the newsstand would be placed against the wall as a freestanding structure under the awning. He also noted that this would take approximately two and a half feet from the existing nine to nine and a half feet of sidewalk. Mr. Gaugush of the public works department indicated that was sufficient clearance. Upon questioning by Commissioner Erwood, Mr. Chapman explained that the newsstand would be secured and locked to look like a solid piece similar to restaurants. Following further discussion, commission expressed concern regarding the proposed location, ingress and egress from San Pablo, and lack of two-way traffic. Commission felt an area on El Paseo would be more suitable. Vice Chairman Richards expressed concern regarding a percentage of right-of-way being used and not being part of a building. Aft er more discussion with the applicant, commission determined a continuance would be appropriate. Mr. Chapman concurred with a two-week continuance and requested assistance in selecting a location. Commission directed staff to help Mr. Chapman in this endeavor. Action: Moved by Commissioner Downs, seconded by Commissioner Jonathan, continuing CUP 90-22 to December 4, 1990. Carried 4-0. D. Case No. ZOA 90-3 - CITY OF PALM DESERT, Applicant Request for approval of a zoning ordinance amendment relating to signs, Section 25. 68. Mr. Diaz outlined the salient points of the staff report and recommended approval . After further clarification as to the type of signs that would be allowed by the amendment, Vice Chairman Richards opened the public testimony and asked if anyone present wished to speak 3 a MINUTES PALM DESERT PLANNING vviMISSION NOVEMBER 20, 1990 in FAVOR or OPPOSITION to the proposal. There was no one and the public testimony was closed. Action: Moved by Commissioner Downs, seconded by Commissioner Erwood, approving the findings as presented by staff. Carried 4-0. Moved by Commissioner Downs, seconded by Commissioner Erwood, adopting Planning Commission Resolution No. 1482, recommending approval of ZOA 90-3 to city council . Carried 4-0. VIII. DIAZ, Secretary ATTEST: JIM RICHARDS, Vice Chairman /tm 4 PLANNI COMMISSION RESOLUTION NO 482 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A ZONING ORDINANCE AMENDMENT RELATING TO SIGNS. CASE NO. ZOA 90-3 WHEREAS, the planning Commission of the City of Palm Desert, California, did on the 20th day of November, 1990, hold a duly noticed public hearing to consider amendment of zoning ordinance amendment to Section 25. 68 relating to signs; and WHEREAS, said amendment has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89, " in that the director of community development has determined the amendment to be a class 5 categorical exemption; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said planning commission did find the following facts and reasons to exist to recommend approval of a zoning ordinance text amendment: 1 . The proposed amendment relating to signs is consistent with the intent of the zoning ordinance and protects the community health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1 . That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That it does hereby recommend approval of ZOA 90-3 as provided in the attached exhibit labeled Exhibit "A" . PASSED, APPROVED AND ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 20th day of November, 1990, by the following vote, to wit: AYES: DOWNS, ERWOOD, JONATHAN, AND RICHARDS NOES: NONE ABSENT: WHITLOCK ABSTAIN: NONE JIM RICHARDS, Vice Chairman ATTEST: RAMON A. Business and identifications signs that mention more than two ( 2 ) goods or services sold on the premises. J. Business and identification signs that employ slogans, sayings, or mottos. " Section 2: That Section 25. 68.440 of the Palm Desert Municipal Code be amended to add subsection K, which will read as follows: "K. That the quantity of information displayed in a proposed sign does not cause visual clutter. APPLICANT: City of Palm Desert I. BACKGROUND: For quite some time the architectural review commission has been attempting to limit the content of signs. The denial of several signs with menus of services or products offered by a business resulted in appeals to the city council. The sign subcommittee was then convened with the result being the amendment attached hereto. II. DISCUSSION: The proposed amendment will allow a business sign to include the name of the business plus up to two additional goods or services sold on the premises. III. ENVIRONMENTAL REVIEW: An amendment to the ordinance of this nature is a class 5 categorical exemption for the purposes of CEQA. IV. RECOMMENDATION: Approve the findings and adopt Resolution No. recommending approval of ZOA 90-3 to city council. V. ATTACHMENTS: A. Draft resolution. B. Legal notice.
