A. STAFF RECOMMENDATION:
That the City Council delete Condition No. 10 of Planning Commission Resolution
2053 allowing the installation of a 2' diameter with the following conditions:
• The data dish shall be oriented towards the north or freeway;
• The data dish shall be painted to match the artificial palm tree pole; and
• The data dish be placed near the top of the pole, adjacent to the antennas
with a maximum diameter of 24".
B. BACKGROUND:
On March 20, 2001 , the Planning Commission voted 4-1 , with Commissioner
Finerty voting no, to approve the conditional use permit to allow the installation of a
65' high tele-communication tower, camouflaged as an artificial palm tree. The
tower was approved at the rear of the existing Desert Country Plaza shopping
center, along the south side of the retention basin. The site is bordered to the north

by the Southern Pacific Railroad and Interstate 10 and the center's commercial
buildings to the south.
The Planning Commission approval required Condition 10, which reads as follows:
No data dishes or other equipment shall be installed on the artificial palm tree.
This condition prohibited the installation of any equipment such as data dishes on
the artificial palm tree tower. The data dish is a wireless, substitution to a ground
phone line. At the time of Planning Commission's review, the plan illustrated a 4
foot diameter data dish installed on the artificial palm tree's pole. The height of the
dish was proposed at 55 feet from the ground. The diameter of the pole is 24" and
thus the dish would project 12" on either side. The applicant has filed an appeal
specifically to Condition 10, to allow the use of the dish in a less visible location
(see Appeal attached).
C. DISCUSSION:
The applicant has provided revised plans illustrating the relocation of the data dish
towards the top of the pole, below the antennas. In addition, the size of the data
dish has been reduced from 4 foot diameter to 2 foot diameter. The diameter of
the palm tree is 24" and thus the dish would not project on either side of the pole.
The dish orientation is expected to be towards the railroad and freeway and would
be only be partially visible from the east and west sides. With the following
conditions of approval staff believes the dish can be substantially screened and
thus recommends approval.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO
ALLOW THE INSTALLATION OF A 65-FOOT HIGH WIRELESS
COMMERCIAL COMMUNICATION TOWER LOCATED IN THE PLANNED
COMMERCIAL DISTRICT AT 77-850 COUNTRY CLUB DRIVE.
CASE NO. CUP 01-03
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the 20th day of March, 2001 , hold a duly noticed public hearing to consider the request by
VERIZON; 02 SOLUTIONS for the above noted conditional use permit; and
WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act",
Resolution No. 00-24, in that the Director of Community Development has determined that
the project is a Class 3 categorical exemption for purposes of CEQA and no further
documentation is necessary; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts and reasons to exist to justify the granting of
said conditional use permit:
1 . That the existing towers and buildings do not technologically afford the
applicant the ability to provide service to the service area of the applicant or
service provider; and
2. That the geographical boundaries of the proposed service area cannot
technologically be bifurcated to avoid the necessity for a freestanding
tower/antenna at the height proposed; and
3. That the applicant shows compelling technological or economic reason(s)
for requiring a new freestanding facility.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1 . That the above recitations are true and correct and constitute the findings of
the Commission in this case.
2. That approval of Conditional Use Permit 01-03 is hereby granted for reasons
subject to the attached conditions.

CONDITIONS OF APPROVAL
CASE NO. CUP 01-03
Department of Community Development:
1 . The development of the property shall conform substantially with exhibits on file
with the department of community development/planning, as modified by the
following conditions.
2. Construction of a portion of said project shall commence within one year from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Palm Desert Architectural Review Commission
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
5. That where co-location may effectively be accomplished without violation of the
provisions of proposed Municipal Code Chapter 25.104 and without reasonable
interference with applicant's existing use, applicant shall allow third party co-
location onto the tower erected under this permit. Applicant may charge a
reasonable rental fee for such co-located use to the extent allowed by law.
6. That the communication tower comply with all provision of the City's Zoning
Ordinance including but not limited to Section 25.104.040, Commercial
Communication Tower Ordinance.
7. Applicant agrees to maintain the artificial palm tree. Applicant will enter into an
agreement to maintain said mono palm for the life of the project, which agreement
shall be notarized and which agreement shall be recorded. It is the specific intent of
the parties that this condition and agreement run with the land and bind successors
and assigns. The site shall comply with the Property Maintenance Ordinance
(Ordinance No. 801 ).

8. The applicant shall comply with abandonment requirements set forth in Section
25.104.040 (o) of the City's Commercial Communication Tower/Antenna
Ordinance.
9. The applicant shall construct an 8' block wall around the perimeter of the lease
area to screen the equipment shelter. The block wall shall be finished in smooth
stucco and shall painted to match the shopping center's building color.
10. No data dishes or other equipment shall be installed on the artificial palm tree.

BACKGROUND:
The subject property is located at 77-850 Country Club Drive. The property is
know as the Desert Country Plaza, a 20-acre commercial/industrial master plan
approved by Planning Commission in December of 1998. The property is zoned
P.C.(3), Planned Commercial (Regional) and has a Freeway Commercial Overlay.
The shopping center is bordered by Interstate 10 on the north and has street
frontage on Country Club Drive on the south and Desert Country Circle on the east.
The vacant property to the east is zoned Regional Commercial. To the west the
adjacent property is zoned Service Industrial and to the south the property is
adjacent to a vacant commercial parcel and a multi-family apartment project known
as Oasis Apartments.

II. PROJECT DESCRIPTION:
Verizon requests approval to install a 65 foot high wireless communication tower,
camouflaged as an artificial Date Palm. The artificial palm tree will be placed within

the retention basin located at the north end of the shopping center. The retention
basin is located adjacent to the railroad and freeway (see site plan). In May of
2000, the Planning Commission approved a similar request by Nextel
Communications to install a 65 foot mono palm, 60 feet to the east along the same
retention basin.
The applicant's lease area is 20' x 30' and is located at the west end of the
retention basin. The retention basin is lined with 9 live date palms. Two of these
existing palm trees will be relocated to the west to allow the installation of the
mono palm and equipment shelter. The equipment shelter consists of 11 '6" x 20'
concrete equipment shelter, having a maximum height of 10'6". The equipment
shelter will be screened with an 8' block wall, similar to Nextel's site. The Zoning
Ordinance requires the construction of an 8' high block wall around the perimeter of
the site. The block wall will be required to be finished in smooth stucco with the
color to match shopping center.
The tower has 6 antennas mounted at a height of 65 feet. The antennas are
camouflaged using artificial Date Palm tree fronds. The pole surface simulates a live
palm tree trunk and is round. Nextel Communications has installed an identical 65
foot high, artificial Date Palm, 60 feet to the east. As part of Nextel's approval, the
applicant was required to install a grove of natural date palms along the perimeter of
the retention basin. A total of 9 date palms with heights between 40 and 45 feet
are installed on the site.
Architectural Review Commission:
On February 27, 2001 the A.R.C. reviewed and unanimously approved the project
with the following condition:
• The applicant shall lower the height of the equipment shelter by 2 feet to be
provide screening of the shelter by the 8' high block wall or shall lower pad
height to provide screening of the equipment shelter.
Issues:
Equipment Shelter:
The applicant has filed an appeal to this condition and will referred to the City
Council for their decision. After further research the applicant indicates that an 8
foot high equipment shelter cannot be secured nor can the pad height for the shelter
be lowered due to the topography of the retention basin. Staff believes that due to
the location of the site (i.e. behind the shopping center and adjacent to the railroad)

an 8 foot high block wall will be sufficient to screen the 10'6" equipment shelter.
Staff recommends that the equipment shelter be painted to match the block wall.
The equipment shelter used by Nextel Communications for their installation is 10
feet high and it is substantially screened by an 8 foot block wall (see photos
attached).
Digital Data Dish:
The applicant's plan illustrates a 4 foot digital data dish installed on the artificial
palm tree's pole. The height of the dish from ground level is 55 feet. The digital
dish provides ground phone line communication to the site. Although the A.R.C.'s
comments regarding the dish do not show up in the minutes, they did express a
concern with the dish and suggested it be removed. Staff recommends that the
data dish be removed as it not camouflaged and lessens the realistic character of
the artificial palm tree. A condition requiring the removal of the dish is included in
the draft resolution.
A. ORDINANCE REQUIREMENTS (Sec. 25.104):
Commercial communication towers are permitted in the P.C. zone, provided
they meet the City's Zoning Ordinance performance standards found in
Section 25.104.040 and they receive approval of a conditional use permit by
the Planning Commission.
Zoning Ordinance development and performance standards include the
following:
1 . Separation Requirements:
The proposed wireless communication tower is proposed 60 feet to the west
of an existing communication tower located within the same retention basin.
The City's recent amendment to the Commercial Communication Tower
Ordinance allows the Planning Commission to waive the separation
requirement of 1 ,000 feet from other towers, if it is determined that the
tower and antennas utilizes stealth design. In this case, the tower is
designed as an artificial palm tree and will be surrounded by other natural
palm trees. Staff believes the separation requirement can be waived.
2. Fencing: Minimum 8' fence or wall surrounding the tower.
Project: The ordinance requires the applicant to construct an 8' block
wall around both the tower and the equipment shelter.

3. Landscaping:
Minimum perimeter landscaping screening to minimize visual impacts to
nearby viewers to the satisfaction of the Architectural Review Commission.
Project: N/A (Solid Wall required)
4. Height: Maximum of 65' from ground level to the top of antennas.
Project: 65' to top of antennas
III. ANALYSIS:
With the required conditions of approval, the communication tower site will
meet all Zoning Ordinance requirements. The artificial palm tree's design
successfully camouflages the antennas. The existing grouping of natural
palms at heights of 40' and 45' along the retention basin create a planned
cluster effect. This effect will blend the tower in with the shopping center
landscaping plan.
The A.R.C. granted approval of the proposal at their February 27, 2001
meeting. Staff can conclude that the following findings for approval can be
made.
(a) That existing towers and buildings do not technologically afford the
applicant the ability to provide service to the service area of the
applicant or service provider; and
Response:
Due to the applicant's height requirements there are no buildings of
adequate height to provide service to the service area.
(b) That the geographical boundaries of the proposed service area cannot
technologically be bifurcated to avoid the necessity for a freestanding
tower/antenna at the height proposed; and
Response:
Site selection and antenna height is the result of a computer analysis
of service coverage requirements for the Southern California and the
United States. Topography (both natural and man made) and

vegetation characteristics of the valley make it difficult to cover even
with multiple sites.
(c) That the applicant shows compelling technological or economic
reason(s) for requiring a new freestanding facility.
Response:
Existing coverage in this area by Verizon is inadequate for existing
customers. The proposed communication tower will allow for better
service and create a larger network leading to increased clientele.
Environmental Review:
The proposed project is considered a Class 3, Categorical Exemption for
purposes of CEQA and no further documentation is necessary.
IV. RECOMMENDATION:
That the Planning Commission adopt Resolution approving CUP 01-03,
subject to the attached conditions.

Chairman Gregory moved, seconded by Commissioner Hanson, to
continue the case to allow the applicant the opportunity to meet
with his neighbor with some form of resolution that the neighbor can
sign off on. If staff is comfortable that the neighbor is happy, they
can approve that plan. Motion carried 6-0-1 with Commissioner
VanVliet abstaining.

Mr. Alvarez reported that there is already a 65-foot artificial palm
tree in this area behind Country Club Plaza as well as a bunch of
live palms. Commissioner O'Donnell asked why the building had to
be so tall and why couldn't it be set into the lower grade as it is
located on the slope of the retention basin. The wall has been
raised to 8 feet in an attempt to screen the 10-foot building.
Mr. Hank Owens, applicant's representative, while he could not
answer that without verification, he stated that they had found some
new equipment which has a 6' height rather than a 8' height, which
would allow them to lower the building's height.
Action:
Commissioner VanVliet moved, seconded by Commissioner
Hanson, to grant approval with the condition that the small building
at the base of the antenna be lowered in height by two feet. Motion
carried 7-0.

be deemed to have been abandoned.Upon such abandon-
ment,the owner/operator of the tower shall have an addi-
tional one hundred eighty days within which to: (1)reacti-
vate the use of the tower or transfer the tower to another
owner/operator who makes actual use of the tower;or(2)

at the Post Office, he thought they should look at it. But he didn't have a
problem with the way the project was proposed. The problem wasn't the
applicant, it was the Post Office.
Chairperson Lopez said that he had a couple of concerns. One was safety on
Hovley. He spent a lot of time riding and walking that particular street and
traffic moved along at a fairly rapid speed and traffic seemed to be increasing.
The facility not warranting a lot of trips was one thing that was swaying him.
It was a limited number and he didn't think he'd ever pulled in front of a
storage area and had to wait any amount of time to get in. They really just
got in and were usually the only one there and rarely saw anyone else. He
would rather see it flipped and rather see a slow down right lane on the facility
itself, but he was also concerned about the landscaping in the front. He said
that bicycles couldn't be ridden on the street. They had to ride on the
sidewalk. They needed the sidewalk and the landscaping. Based on that he
would be in favor and asked for commission action.
Action:
It was moved by Commissioner Campbell, seconded by Commissioner Finerty,
approving the findings as presented by staff. Motion carried 5-0.

C. Case No. CUP 01-03 - VERIZON; 02 WIRELESS SOLUTIONS, Applicant
Request for approval of a Conditional Use Permit to allow the
installation of a 65' high wireless communication tower on
property located at 77-850 Country Club Drive.
Mr. Alvarez said that the request was for a 65-foot mono palm. Pictures were
distributed to the commission in their packets that described the location. This
was the retention basin behind Desert Country Plaza, the 20-acre commercial
master plan that backed up to 1-10 and had frontage on Country Club and the
newly created street Desert Country Circle. In the staff report he described
the applicant's proposal. The location was about 60 feet west of the existing
65-foot mono palm also along the retention basin. The applicant's lease area

was a 20 by 30 space. There were two existing date palms as part of a
grouping of nine. These two would be relocated to other areas and this was
the new lease area for Verizon. He showed the location of the existing
equipment shelter and eight-foot block wall which enclosed Nextel's existing
approval. He showed a photo of the existing installation and the grove of
natural palms. When heading east, the last two natural palms would be
relocated and that's where the proposed mono palm would be installed. There
was a couple of issues that needed to be addressed. First is the equipment
shelter. ARC on February 27 reviewed the project and unanimously approved
the project with a condition that the equipment shelter be lowered two feet or
that the pad on which the equipment would sit would be lowered two feet.
They were trying to achieve a full screening of the equipment shelter. The
proposed equipment shelter was 10 feet 6 inches. The existing equipment
shelter used by Nextel was an eight-foot block wall as required by the
ordinance. It substantially screened the equipment which was ten feet. He
stated that the applicant filed an appeal of that condition and that would be
deferred to the City Council. He said they were looking for a recommendation
from the Planning Commission to move along before the City Council. Staff's
position was basically that they have seen how much an eight-foot wall would
screen a ten-foot structure and it substantially screens it. It was also behind
the existing shopping center and backs up to the railroad and that would be
taken up with the City Council. The second issue to be addressed was the
digital data dish. The applicant wanted a four-foot dish installed on the mono
palm itself. Staff's position was that this dish should be removed and wasn't
camouflaged and it detracted from the somewhat realistic appearance of the
mono palm. As a condition of approval, they required the removal of the dish
and required the installation of an eight-foot block wall around the shelter with
a smooth stucco finish to match the shopping center and Nextel's installation.
In terms of ordinance requirements, the only issue which had arisen was the
separation requirements between towers. He noted that a recent amendment
allowed the commission to waive the separation requirement when stealth
design was used. In this instance the applicant was using an artificial mono
palm which staff felt successfully camouflaged the antennas and warranted
waiving the separation requirement. Mr. Alvarez indicated that there were
conditions of approval which staff felt addressed the issues described. Staff
recommended approval of the project subject to conditions. The project was
a Class 3 categorical exemption for CEQA purposes.

Chairperson Lopez opened the public hearing and asked the applicant to
address the commission.
MR. HANK HOWENSTEIN, 9090 Calle Escorial in Desert Hot Springs,
addressed the commission. He thanked the commission for the
opportunity to address them and also thanked staff for their efforts. He
felt the issues were not great and appreciated the recommendation of
approval by staff and the furtherance of that approval by ARC. The
issue before them was the separation from the existing mono palm by
Nextel which was only 60 feet to the east, however, with the change
in zone text in Palm Desert, with the Planning Commission's approval
it is permitted to be in that distance. The other issue which was
dramatically shown was the nature of the equipment building and the
surrounding block wall. He said they have no difficulty in increasing the
height of that wall to eight feet. They had no difficulty in changing the
finish from slump stone to stucco coating finish that would match the
building and selecting a color to match the color of the shopping center.
He said they looked to find equipment buildings that were lower in
height and were unable to find any at this time. Therefore, they would
also agree to paint the color of the equipment building the same color
as the wall, which meant the two would sort of blend into one another.
One of the difficulties with Nextel, his equipment building and the
existing wall, was that the building was a darker, gravely texture which
made it a stark standout against the block wall, but if the two were the
same color they would have a great deal of similarity. He hoped that
the commission would recommend to the City Council that they allow
them to go forward with a 10'6" building. The only issue they had that
he thought was significant was the requirement that they remove the
dish. Here they were getting into an issue of technology and there were
only two companies that currently use the digital dish system. The
other carriers continued to use land lines, but the technology was
moving toward the digital dish. The reason was that the digital dish
was much more efficient, faster, it carried a greater volume of calls, it
was less susceptible to break down in the event of an emergency like
an earthquake and produced a much higher quality of service and the
cost per transmission of call was about one-tenth with a digital dish.
The alternative to a digital dish was land lines and throughout the valley
those were probably all fiber optics. While they were fast, they weren't
as fast as transmission by digital dish. The digital dish would face north

so that from the heavily traveled Country Club it wouldn't be seen in its
robust fullness of four feet, but rather as an interrupted hemisphere.
Looking at it from the other direction, to the north, it would be tough to
spot as they were coming down. He urged that the commission
approve the project with the modifications of conditions 10 and 11 .
Commissioner Finerty noted that the ARC minutes of February 27 stated that
Mr. Hank Howenstein, the applicant's representative, while he could not
answer without verification, he stated that he had found some new equipment
which had a six-foot height, rather than an eight-foot height, which would
allow them to lower the building height.
Mr. Howenstein stated that was for externally mounted equipment, not
the equipment that going into the building. He said he didn't know the
technology. In locating one of these in the city park in the city of
Riverside, they were able to find lower equipment. But there they had
a different situation because it was out and exposed and had a greater
cooling capacity whereas here these units generated a great deal of heat
and the larger they are, the better they were able to dissipate that heat.
Commissioner Finerty asked for clarification that Mr. Howenstein was saying
that they needed the 10'6" height.
Mr. Howenstein concurred.
Commissioner Campbell asked if the dish could be moved up any higher to
camouflage it a bit by the palms.
Mr. Howenstein said that was a good question, but he didn't know the
answer. He indicated he didn't know what the level of separation had
to be between the antenna and the dish. He said he would ask that
question for future reference.
Commissioner Tschopp asked how big the data dish would be on the palm.
Mr. Howenstein said it would be four feet in diameter. When looking
at it from the south, they would really only see one foot of that on
either side of the pole. The pole was a little greater than 28 inches.
They vary in size between 20 and 28 inches depending upon what they

need to meet building requirements, so if they subtracted that from the
48, it would leave about one foot on either side of the pole when
looking at it from the south.
Chairperson Lopez indicated that the applicant wanted the commission to
adjust conditions 10 and 11 regarding the wall height and the dish.
Mr. Howenstein said they had no difficulty with the wall height at eight
feet so the only condition they were concerned with was condition 10,
which would allow the building to go as originally designed at 10'6" and
to eliminate number 1 1 .
Chairperson Lopez noted that the staff recommendation was to move ahead
with the application with the current conditions of approval. He noted that the
applicant would have the right to appeal any decision to the City Council.
Mr. Howenstein concurred. He said the commission's option tonight
was to adopt staff's recommendation and move forward as it is or if
they wanted to make specific comments on either of the two requests
which he made.
Commissioner Finerty asked if the ordinance addressed whether or not there
could be dishes. Mr. Alvarez said no, it was currently silent. Commissioner
Campbell noted that there were other towers in the city now with dishes all
over them. Mr. Alvarez said not that he was aware of. Nextel's site to the
east was allowed a temporary dish for 90 days to allow them to secure a land
line. Commissioner Campbell said she wasn't talking about the palm trees, but
existing towers that had dishes attached all over them. Mr. Drell said that
communication towers in general had dishes on them. Mr. Alvarez said those
weren't the mono palms. Commissioner Campbell said that they had dishes
attached to those other towers which were more of an eyesore. Mr. Drell said
that the next application that would be coming to the commission was going
to be a mono palm in the city's soccer field. The explanation he heard from
the Sprint representative was that it had to do with the distance between their
land line connection to a phone and the palm. Based on the distance they had,
they also wanted a dish. There would be a project next door, 1 5 to 20 feet
away from them, and at that point in time when they did have close proximity
to a land line, they said it wouldn't be a problem connecting to it. It was a
function of distance. The more that were transferring through the line, the

more interference. Commissioner Campbell said that staff recommended that
it be camouflaged, but she felt the way it faced to the north, people from the
freeway would not be able to see the dish or that the palm tree was artificial.
Mr. Drell said that he also assumed that the dish could be painted in the same
brown tone as the tree trunk.
Chairperson Lopez asked if anyone wished to speak in FAVOR or OPPOSITION
to the proposal. There was no one and the public hearing was closed.
Chairperson Lopez asked for commission comments or action.
Commissioner Finerty concurred with ARC's condition that the equipment
shelter be lowered by two feet. She noted in the minutes that it was a 7-0
vote and they felt fairly strong about it. With regard to the dish, they worked
really hard on the ordinance and they wanted to make these towers as
aesthetically pleasing as possible. That was why they came up with the mono
palm and it had to be clustered and she believed that the dish negated that.
So she also concurred with staff's condition that the dish be removed.
Commissioner Jonathan said he didn't have a problem with the 10'6" because
of the location. He wasn't sure ARC was aware of the technical difficulties
and apparent impossibilities of getting the equipment into an 8'6" area. He
was willing to live with that. He also felt the separation was acceptable for
that area and he thought it would be a huge step backward for them to reduce
their standards. They worked hard to get them to the point where if they
were going to be looking at these, then at least they had gotten them to the
point that they were somewhat camouflaged by looking like trees. Now to put
up some metal within eyesight would be a huge step backwards and he would
be vehemently opposed that. He was in complete concurrence with the staff
report, which would mean deleting condition number 10 but retaining number
11 and he was prepared to move for approval on that basis.
Commissioner Campbell concurred with Commissioner Jonathan and said she
would second the motion.
Commissioner Tschopp concurred but noted there were exceptions to the
rules. A data dish that small facing Interstate 10 he didn't feel would be a
disruption to anyone in Palm Desert and most people going 90 mph down
Interstate 10 wouldn't notice it. So he felt there were exceptions.
Commissioner Campbell felt that approval would be setting a precedent.

Commissioner Tschopp said he didn't disagree, but felt they would be seeing
those anyway in the future just like they have seen the proliferation of dishes
on people's homes or in their backyards. Commissioner Jonathan said they
wouldn't see them if the city didn't allow them. Commissioner Tschopp said
they would see those types of appeals anyway and this one he felt as far as
exceptions go facing Interstate 10 with no impact on residential or even
commercial areas and didn't see it as a big problem. Commissioner Jonathan
pointed out that the dish was four feet wide and would be clearly visible from
all directions. Even from the rear it protruded on both sides.
Chairperson Lopez said he agreed. He didn't have a problem with the height
of the building considering where it was located. He did have a problem with
the dish and while that might be the wave of the future, somehow they would
have to come up with an ordinance change or revision to address this element
in the future and how they could be hidden. Under the current situation he
would be in favor of the recommendation to eliminate condition number 10.
He called for the vote.
Action:
It was moved by Commissioner Jonathan, seconded by Commissioner
Campbell, approving the findings as presented by staff. Motion carried 4-1
(Commissioner Finerty voted no).
