Dear City of Palm Desert Building Board of Appeals (appointed members),
This letter is in opposition of this boards consideration to deny Palm Desert property owner (239
Serena Drive) of their long established and demonstrated word terminology associated with room space
designations of their private property located within the boundaries of the City of Palm Desert,
Riverside County California.
Please consider that the subjected label space is NOT associated with a basement or other below
building grade (soil) living area. California residential code 2022, R310.1 emergency escape and rescue
opening requires every sleeping room shall have not less than one operable emergency escape and
rescue opening. The term Emergency escape may be described as an exit route (exit access) where a
portion of an exit that leads to an exit. (Passage through an adjacent non-lockable space which has an
approved means of escape) could be defined.
Sleeping spaces could be defined in many ways -hotels/motels and other sleeping elements (as in
campers/tents) are a small example of how people will use spaces to accommodate their needs. Safety
is a chief concern and would not be compromised by the word terminology of living space designations.
Please consider that any potential future City Council involvement in this matter maybe seen as a
conflict of interest because of the City Councils prior discussion and previous ruling in regard to this
private property.
