Folkers, Assistant City Manager/Public Works Director SUBJECT: CUP 90-6 -- PALM LAKES GOLF COURSE AT COOK STREET & SHERYL AVENUE-- MELVIN CURCI DATE: July 26, 1990 RECOMMENDATION: Affirm the staff's position with respect to development fees for Conditional Use Permit 90-6. BACKGROUND: On May 24, 1990, the City Council reviewed a request by the developer of the above-referenced project for waiver or adjustment of fees. The specific fees were drainage, lizard mitigation, and TUMF. The Council directed staff to work with the developer in an attempt to reach an equitable solution. After reviewing the applicable fees, staff met with Mr. Curci and Mr. Dave Evans and presented the following: Lizard Mitigation Fee: As stated in the May 24, 1990, staff report, the fringe toed lizard fee is a result of the Federal Endangered Species Act and the need to acquire habit area for the lizard. The imposition of the $600 per acre fee is required on all disturbed land north of the Whitewater River without regard to ownership, lease arrangements, etc. The subject property includes approximately 15.42 acres north of the river. This would result in a lizard mitigation fee of $9,252. Transportation Uniform Mitigation Fee: This fee is applied on a regional basis as a result of local legislation actions last year. Fees paid as a result of this action are applicable to all developments regardless of ownership, lease arrangements, etc. Developers objecting to the imposition of this fee have a right of appeal through the Coachella Valley Association of Governments (CVAG) who administer the TUMF program. The fee for this type of development (golf course) is $549.78 per acre or approximately $28,808.47, for the 52.4-acre site. Drainage Fees: A substantial portion of this project (approximately 37 acres) lies within the Whitewater River Channel . The balance of the site (15.4 acres) is adjacent to Master Plan drain lines as identified in the Northside Area Drainage Master Plan. In order to facilitate the construction of these lines, the developer will be required to pay fees of $4,000 per acre on the 15.4 acres north of the Whitewater River. This would result in a drainage fee of $61 ,600. City Council and City Manager Page 2 July 26, 1990 The developer has expressed his reluctant agreement with the fees, as identified above, and is anxious to proceed with the development; therefore, it is requested that the Council affirm staff's position with respect to the development fees for this project.
