A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT RECOMMENDING THAT THE CITY COUNCIL AMEND AND
ADOPT LOCAL GUIDELINES FOR IMPLEMENTING THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (PUB. RESOURCES CODE §§ 21000 ET
SEQ.)
WHEREAS, the California Legislature has amended the California Environmental
Quality Act (“CEQA”) (Pub. Resources Code §§ 21000 et seq.), the Natural Resources
Agency has amended the State CEQA Guidelines (Cal. Code Regs, tit. 14, §§ 15000 et seq.),
and the California courts have interpreted specific provisions of CEQA; and
WHEREAS, Public Resources Code section 21082 requires all public agencies to
adopt objectives, criteria and procedures for (1) the evaluation of public and private projects
undertaken or approved by such public agencies, and (2) the preparation, if required, of
environmental impact reports and negative declarations in connection with that evaluation;
and
WHEREAS, the City of Palm Desert must revise its local guidelines for implementing
CEQA to make them consistent with the current provisions and interpretations of CEQA and
the State CEQA Guidelines.
WHEREAS, on May 7th, 2024, the Planning Commission conducted a duly noticed
public meeting on this Resolution, at which time all persons wishing to testify were heard and
the Action was fully considered; and
WHEREAS, at the said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, the Planning Commission
did find the following facts and reasons, which are outlined in the staff report, exist to justify
approval of said action:
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
SECTION 1. Recitals. The Planning Commission hereby finds that the foregoing
recitals are true and correct and are incorporated herein as substantive findings of this
Resolution.
SECTION 2. Recommendation. The Planning Commission hereby recommends the
City Council adopt a Resolution approving the following:
1. The City adopts the “2024 Local Guidelines for Implementing the California
Environmental Quality Act for the City of Palm Desert,” attached hereto as Exhibit A. A copy
of said document is on file at the offices of the City and is available for inspection by the
public.
2. All prior actions of the City enacting earlier guidelines are hereby repealed.
SECTION 3. Custodian of Records. The documents and materials that constitute the
record of proceedings on which these findings are based are located at the City’s office at
73510 Fred Waring Drive, Palm Desert, CA 92260. Richard D. Cannone, AICP, the Secretary
to the Palm Desert Planning Commission, is the custodian of the record of proceedings.
SECTION 4. Execution of Resolution. The Chairperson of the Planning Commission
signs this Resolution, and the Secretary to the Commission shall attest and certify to the
passage and adoption thereof.
