SUBJECT: CONSTRUCTION OF HOVLEY LANE STREET IMPROVEMENTS BETWEEN PORTOLA AVENUE
AND COOK STREET
DATE: October 27, 1988
RECOMMENDATION:
( 1 ) That the developer of Precise Plan 87-37 construct street improvements along
the park site with the costs for such improvements repaid to the developer
via a negotiated zero interest reimbursement agreement.
(2) That the Kelly Ordinance process be used to improve the south side of Hovley
Lane between Portola Avenue and the Butler project.
(3) That the median construction on Hovley Lane between Portola Avenue and Cook
Street be deferred at this time.
BACKGROUND:
On February 26, 1987, the Palm Desert City Council adopted Resolution No.
87-16 approving Precise Plan 87-1 , Marriott Desert Springs Golf Course No. 2.
Included within the resolution of approval was City Council Condition No 1 , which
stated, "Public improvements for Hovley Lane may be bonded for, with installation
of the applicant's portion of the Hovley Lane improvements occurring at the time
of approval of the final tract map for the residential area, or when development
occurs on the south side of Hovley Lane, whichever occurs first." In order to
proceed with their golf course construction, the Marriott posted a faithful
performance bond with the city for the Hovley Lane improvements.
As a result of the recent City Council approval of the Jack Butler apartment
project (Precise Plan 87-37) , it would appear that development is now ready to
occur on the south side of Hovley Lane. The only uncertainty here is the
definition of when "development occurs". Does it occur with project approval or
with issuance of permits? It is the position of the Public Works staff that with
the approval of the project, development has occurred. Therefore, it would now
be appropriate for us to notify the Marriott Corporation that, in accordance with
the conditions of approval for Precise Plan 87- 1 , they are to initiate
construction of street improvements on the north one-half of Hovley Lane between
Portola Avenue and Cook Street. These improvements include curb and gutter, 24
foot wide pavement section, and one-half landscape island.

A portion of street improvements on the south side of Hovley Lane were
installed approximately 3-1/2 years ago as a part of Parcel Map 17452. These
improvements consisted of curb and gutter and a 32-foot-wide A.C. pavement
section from the intersection of Hovley Lane and Cook Street westerly
approximately 2,000 lineal feet.
The Butler project will provide for the construction of approximately 1 ,200
feet of improvements along the apartment project frontage. This construction
will result in a gap in the street improvements across the frontage of the
to be dedicated to the cityas a park site, approximately 680 feet in

length. In addition, the south half of Hovley Lane from Portola Avenue to the
westerly boundary of the Butler project (approximately 1 ,320 feet) will also
remain unimproved.
Since no development activity is proposed or planned for this property, the
Council may wish to direct staff to initiate proceeding under Ordinance No. 416
(Kelly Ordinance) to provide for additional travelway construction. The
estimated cost for this improvement would be $65,000 based on 24 feet of paving.
This will then leave only the 680 feet of improvements along the park frontage
unconstructed. The cost of this portion of the improvement is estimated to be
$36,000, not including the median island. With the median island, the cost is
estimated at $52,000. Since the apartment project will need roadway access, a
possible option for the construction of these improvements would be to have Mr.
Butler provide for their construction under a negotiated zero interest
reimbursement agreement.
Both the Marriott project and the Butler project were conditioned to
construct one-half landscape median island or provide the city with a cash
payment for the cost of the island construction. By receiving the funds in lieu
of the actual installation of a piecemeal landscaped median island, the roadway
could then be constructed to allow for two lanes of travel for both eastbound and
westbound traffic. Then, at such time as the balance of the vacant property is
developed, the median island would be constructed.
In summary, the construction options available to the city for the
completion of Hovley Lane street improvements can be reduced to the use of the
Kelly Ordinance provisions for that southerly portion owned by F.X. McDonald
between Portola Avenue and the Butler project and a possible reimbursement
agreement between Mr. Butler and the city for the portion fronting the dedicated
park site.
