DIARY REVIEW
Event: The claimant alleges that he has a loss of income due to the paving
project that took place.
Statute of Limitations: 06/13/2024
Action plan items from last review and status:
1. The claimant is claiming damages from the design of the parking lot. Due
to previous claims, there was a paving project that took place in the past
at the Presential plaza. Is this the same project? Is this a more recent
project or design changes made to the parking lot? It is the same project.
2. Were there any design changes to the parking lot? The design changes
were part of the Presidents Plaza East and West Improvements.
3. Can you send over the contract for the work done. Yes. It will be in the
project folder – link below.
4. Is the parking lot design in compliance with the green book standard with
any pectinate standards that encompass parking lots. The parking lot
would have been designed in accordance with the City’s parking lot
requirements.
5. Can you confirm if the claimant is a licensed business owner in the city of
Palm Desert? Business account number and status for Babaloo Lounge
attached.
6. Did the claimant complain during the project when the project
started? The claimant complained at various points throughout the
project. The correspondence subfolder of the Project folder contains
many documents related to communications with Mr. Ungo – link below.
7. Is there appropriate exits and entrances to the claimant’s business? Were
there any obstructions in the area that would hurt his business? There were
times during the construction project that obstructions were near the
business. It is unknown if the obstructions hurt the business.
8. Is the parking stall large enough or where they made smaller? Use the link
to access the aerial photos for determining if the parking area is

9. Can you send design plans? Yes. They will be in the project folder – link

and As built from the city. The claimant alleges that he could not get into his
building during the construction.

Event: The claimant alleges that he has a loss of income due to the paving
project that took place.
Statute of Limitations: 06/13/2024
Action plan items from last review and status:
1. The claimant is claiming damages from the design of the parking lot. Due
to previous claims, there was a paving project that took place in the past
at the Presential plaza. Is this the same project? Is this a more recent
project or design changes made to the parking lot? It is the same project.
2. Were there any design changes to the parking lot? The design changes
were part of the Presidents Plaza East and West Improvements.
3. Can you send over the contract for the work done. Yes. It will be in the
project folder – link below.
4. Is the parking lot design in compliance with the green book standard with
any pectinate standards that encompass parking lots. The parking lot
would have been designed in accordance with the City’s parking lot
requirements.
5. Can you confirm if the claimant is a licensed business owner in the city of
Palm Desert? Business account number and status for Babaloo Lounge
attached.
6. Did the claimant complain during the project when the project
started? The claimant complained at various points throughout the
project. The correspondence subfolder of the Project folder contains
many documents related to communications with Mr. Ungo – link below.
7. Is there appropriate exits and entrances to the claimant’s business? Were
there any obstructions in the area that would hurt his business? There were
times during the construction project that obstructions were near the
business. It is unknown if the obstructions hurt the business.
8. Is the parking stall large enough or where they made smaller? Use the link
to access the aerial photos for determining if the parking area is
