(planned residential five units per acre with a natural overlay and scenic preservation) to O.P. (office professional) and a parcel map waiver reconfiguring two lots fronting on Village Court at the northerly end of the Embassy Suites property located at 74-700 Highway 111 . GPA 03-06, C/Z 03-09 AND PMW 03-05 Page 2 November 13, 2003 Discussion: BACKGROUND In 1997 the City approved PM 28596 creating the office professional lots on Village Court on the north side of Highway 111 at the east city limit. The property had been zoned O.P. in 1989. The present request is to extend the O.P. designation and zoning to the west by 1 .1 acres and reconfigure two lots which front on Village Court. The area is currently unused PR-5 zoned open space at the north end of the Embassy Suites site. On the original hotel site plan (Granada Royale - Fountains) this area had been shown with casita units which were never constructed. ADJACENT ZONING AND LAND USE North: O.P. / vacant South: PR--5 and O.P. / tennis courts and office building East: O.P. / office West: PR-5 / vacant / parking PLANNING COMMISSION ACTION The Planning Commission at its October 7, 2003 meeting considered the request, and on a 5-0 vote recommended approval of the application. PROJECT DESCRIPTION General Plan Amendment, Change of Zone and Parcel Map Waiver The applicants propose to change the land use designation from medium density residential (5-7 du/ac) to office professional and change the zone from PR-5 (planned residential five units/acre) to O.P. GPA 03-06, C/Z 03-09 AND PMW 03-05 Page 3 November 13, 2003 The existing Parcel No. 13 fronts onto Village Court and is presently .43 acres (18,731 square feet). Due to the cul-de-sac in Village court portions of this lot are only 120 feet deep. The applicant proposes to amend the general plan land use designation and zoning of the property to the west of Parcel No. 13 to Office Professional and then reconfigure present parcels 13 and 16 as shown on PMW 03-05, (parcels 1 and 2). The reconfigured parcels will be larger, deeper and wider thereby making them more usable. Specifically parcel 1 , presently Parcel 16 is 131 feet from north to south with a length east to west of 500 feet. In its reconfigured state it will be 150 feet from north to south and 400 feet from east to west. The remnant piece at the west 131 by 100 feet will be conveyed to the owners of the Embassy Suites site as part of the property exchange. Embassy Suites indicates that the property will continue to be used for storage and possibly overflow parking. Parcel No. 2 will increase in size from .43 acres (18,731 square feet) to 1 .435 acres (62,509 square feet) and its depth will increase from 120 feet to 352 feet along the north lot line. At this time we do not have a precise plan request for either of the two parcels. When these are submitted they will go through the required precise plan process. ANALYSIS The property which is subject to the requested general plan amendment and change of zone is relatively unusable space at the north end of the Embassy Suites site. It is between the existing tennis courts to the south and the existing O.P. zoned lots to the north and east. (Wpdocs\tm\sr\gpa03-06.cc) • Staff Report Case Nos. GPA 03-06, C/Z 03-09 AND PMW 03-05 Page 4 November 13, 2003 The addition of this property to the adjacent lots to the north and east makes those lots more usable as professional office sites. Increasing the lot depth on the northerly lot from 131 feet to 150 feet will allow for a less crowded layout and expanding the depth of the adjacent lot to the east from 120 feet to 352 feet improves its development potential. As PR-5 zoned property this is limited to uses accessory to the hotel. The hotel operators prefer to sell the land to the adjacent professional office property owners rather than expand the hotel facilities. Expansion of the O.P. zoned properties should result in improved O.P. project site efficiency on the two adjacent O.P. lots. ENVIRONMENTAL REVIEW The property subject to the application, while it is designated and zoned residential, is part of the commercial development on the Embassy Suites site which was approved through a conditional use permit. The request is to change the use to a lesser commercial land use (office professional). As such, the request is a Class 5 (minor alteration to land use limitations) categorical exemption. CASE NOS. GPA 03-06 AND PMW 03-05 WHEREAS, the City Council of the City of Palm Desert, California, did on the 13th day of November, 2003, hold a duly noticed public hearing to consider the request of SCHMID INVESTMENTS L.P. for approval of the above described project; and WHEREAS, the Planning Commission by its Resolution No. 2224 has recommended approval of the applications; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 02-60", in that the Director of Community Development has determined that the project is a Class 5 Categorical Exemption and no further environmental review is necessary ; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to justify its actions, as described below: General Plan Amendment: 1 . The office professional designation at the proposed location represents a logical extension of the existing O.P. designation to the north and east. 2. The O.P. land use designation/zoning allows for adequate design buffers to assure compatibility with adjacent land uses. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1 . That the above recitations are true and correct and constitute the findings of the City Council in this case. 2. That the City Council does hereby approve Case Nos. Once the updated general plan and EIR have been certified, then no additional environmental review will be necessary for this request. V. RECOMMENDATION: That the Planning Commission recommend approval to the City Council of Case Nos. GPA 03-06, C/Z 03-09 and PMW 03-05, subject to conditions. 3 STAFF REPORT CASE NOS.
